R-7074 (File No. CR-6882) DISMISSALWITHDRAWN DURING INVESTIGATION January 24, 2006 The services of the National Mediation Board (NMB or Board) were invoked by the United Transportation Union (UTU) on May 31, 2005, to investigate and determine who may represent for the purposes of the Railway Labor Act (RLA), as provided by Section 2, Ninth, thereof, personnel described as “Train & Engine Service Employees,” employees of Union Pacific Railroad. At the time this application was received, these employees were represented in part by the UTU and in part by the Brotherhood of Locomotive Engineers and Trainmen (BLET). The Board assigned Investigator Susanna C. Fisher to investigate. Subsequently, the UTU filed a letter with the NMB which stated, “The United Transportation Union (UTU) hereby withdraws subject application for investigation of representation dispute submitted herein on May 27, 2005.” -45- 33 NMB No. 12 On the basis of this letter of withdrawal referred to above, the Board hereby converts this matter to NMB Case No. R-7074 and dismisses the application.
