169-1.         DEFINITIONS:

         As used in this Chapter, the following terms shall have the meanings indicated:

DEALER              A.      Any person, partnership or corporation who, whether
permanent or itinerant, on one (1) or more occasions, through any means, buys or sells
secondhand:

               1.     Gold, silver, precious metals or jewelry.

             2.     Television sets, videocassette recorders, stereophonic and phono-
graphic equipment, radios and citizens band trans-receivers.

               3.     Musical instruments and cameras.

               4.     Typewriters, business machines and office equipment.

               5.     Power tools and automotive or construction mechanic's tools.

                   B.     Includes anyone advertising the purchase or sale of any of
the aforementioned items.

MINOR          Any person under the age of eighteen (18) years.

169-2.         LICENSE REQUIRED:

       Each dealer conducting business within the jurisdiction of the Borough of Lincoln
Park shall first register with the Chief of Police, who shall fingerprint and investigate the
applicant, and shall obtain a license from the Borough Clerk.

169-3.         RECORDS OF PURCHASES AND SALES:

       Each dealer shall maintain a complete record of each purchase and sale,
including the amount paid, indicating the name, residence, age and description of the

person from whom the items were purchased, received or sold. These records shall be
subject to the inspection of any authorized Police Officer of the Borough of Lincoln Park.

169-4.             DESCRIPTION OF ITEMS PURCHASED:

        Each dealer doing business in the Borough of Lincoln Park, shall deliver upon
request, to the Chief of Police the description of all items purchased, received or sold,
within forty-eight (48) hours of the completion of the transaction, on forms prescribed by
the Chief of Police.

169-5.             TIME LIMIT FOR HOLDING ITEMS:

       No dealer shall sell, melt, change the form of or dispose of any articles
purchased or received within five (5) days of the date of said purchase, and all such
items shall be made available to the Chief of Police, upon request, for at least five (5)
days.

169-6.             IDENTIFICATION OF SELLER; TRANSACTIONS WITH MINORS:

      Each dealer must require identification of the person with whom he is transacting
business, and no transaction may be made with any minor as hereinabove defined.

169-7.             EXCEPTIONS:

        The provisions of this Chapter shall not apply to the purchase or acquisition of
any article described in 169-1 where such transaction takes place off the licensed
premises (such as garage sales, auctions, etc.) and not over the counter, provided that
a written record thereof is kept, disclosing the off-premises transaction date, location,
piece, price and, if applicable, vendor.

 169-8.            VIOLATIONS AND PENALTIES:

       Any Person who violates any provision of this Chapter shall, upon conviction
thereof, be subject to the fines and penalties set forth in Article III, Section 1-15 of this
Code (General Penalty), in the discretion of the Judge imposing the same. A separate
offense shall be deemed committed on each day during or on which a violation occurs
or continues.
