GENERAL DURABLE POWER OF ATTORNEY THE UNDERSIGNED, _____________, as principal, domiciled and residing in the State of Washington, designates, under chapter 11.94 RCW, _____________, as ATTORNEY IN FACT for the principal. 1. Durable Power. This shall be a general Power of Attorney and shall be a durable Power of Attorney which shall not be affected by the disability or incompetence of the principal. 2. Powers. My attorney in fact shall have all powers, as a fiduciary, of an absolute owner over my assets and liabilities, whether located within or without the State of Washington. (a) Without limiting the general powers set forth above, my attorney in fact may form corporations or partnerships and transfer property to them, lease, purchase, sell, encumber, convey, exchange, and acquire; and may agree, bargain, and contract for the lease, purchase, exchange, sale, conveyance, and acquisition of; and may accept, take, receive, and possess any real or personal property whatsoever, tangible or intangible, or any interest therein, on such terms and conditions, and under such covenants as my attorney in fact considers proper. (b) My attorney in fact may make gifts to those members of my family, in such amounts as I have done on an annual basis in years past. My attorney in fact may disclaim any right, title, or interest that I may acquire through gift, bequest, inheritance, operation of law, or any other method whatsoever. My attorney in fact may transfer resources not prohibited under chapter 74.09 RCW for the purpose of qualifying me for medical assistance or the limited casualty program for the medically needy. (c) My attorney in fact shall not have the power to revoke or change any estate planning or testamentary document previously or subsequently executed by me unless the document authorizes changes with court approval. 3. Alternate Attorney in fact. If my attorney in fact predeceases me, resigns, or is unable or unwilling to serve, I appoint _____________, as alternate attorney in fact with all the powers, rights, duties, and obligations of my attorney in fact. 4. Revocation. This Power of Attorney may be revoked by me by written notice to my attorney in fact and by recording the written instrument of revocation in the county where I reside and in counties in which I hold real property. 5. Termination. (a) By appointment of guardian. The appointment of a guardian of my estate vests in the guardian, with court approval, the power to revoke, suspend, or terminate this power of attorney. Power of Attorney 1 The appointment of a guardian of the person only does not empower the guardian to revoke, suspend, or terminate this Power of Attorney. Nomination of guardian. If a petition for guardianship is presented to any court pursuant to RCW 11.94.010, I hereby nominate _____________, as guardian of both my person and my estate. If _____________, is unable or unwilling to serve, I nominate _____________, as guardian of both my person and my estate. (b) By death of the principal. My death revokes this Power of Attorney upon actual knowledge or actual notice being received by the attorney in fact. 6. Accounting. My attorney in fact shall keep proper accounts and shall provide an accounting if requested by an appointed guardian of my estate or by my personal representative. 7. Indemnity. My estate shall hold harmless and indemnify my attorney in fact from all liability, including liability for attorney's fees, for acts done in good faith and not fraudulently against me. 8. Reliance. My attorney in fact and all persons dealing with my attorney in fact may rely upon this Power of Attorney whether it is recorded or not. Unless otherwise invalid or unenforceable, any action shall be binding on me, my guardian, my heirs, my devisees, my legatees, and my personal representative. 9. Effective date and duration. This Power of Attorney shall take effect on the date of its execution and shall remain in effect to the extent permitted by chapter 11.94 RCW or until revoked or terminated under other provisions of this instrument. 10. Applicable law.
