JA-085-FF (4-04) ARIZONA DEPARTMENT OF ECONOMIC SECURITY Employment Administration Jobs Program JOBSTRT EMPLOYMENT AGREEMENT I. THE AGREEMENT This agreement is entered into between the Arizona Department of Economic Security (DES), hereafter called the Sponsor, and Name of Business Type of Business Federal ID No. or Owner’s Soc. No. hereafter referred to as the Employer, to provide subsidized employment, work experience training, and opportunities for unsubsidized employment under the JOBSTRT Program to as Jobs Participant’s Name Job Title II. EMPLOYMENT SPECIFICATIONS A. BRIEF DESCRIPTION OF DUTIES B. START DATE HOURS PER WEEK HOURLY WAGE C. PAY CYCLE DAY OF WEEK FIRST PAY DATE III. EMPLOYER’S AGREEMENT The Employer agrees to: A. Offer job openings that have a reasonable possibility of becoming full-time, unsubsidized positions. B. Neither fill previously announced positions with JOBSTRT participants or displace any current employed part-time, full-time or laid-off regular employee or position (including partial displacement such as a reduction in the hours of non-overtime work, wages, or employment benefits); or replace persons who have been laid off or terminated by the Employer or when the Employer has otherwise reduced its work force; or infringe upon promotional opportunities of current employees C. Do nothing to impair existing contracts or collective bargaining agreements. D. Employ JOBSTRT participants for no more than 40 hours of subsidized employment per week with the understanding that the state will not subsidize overtime. E. Pay wages that are substantially like those paid for similar jobs, with appropriate adjustments for experience and training, but at least the federal minimum hourly wage. F. Maintain health, safety, and working conditions at or above levels set by the labor laws of Arizona, the federal government, those generally accepted by the industry, and no less than that of comparable jobs offered by the Employer. G. Notify and assist JOBSTRT participants regarding the federal Earned Income Tax Credit (EITC). H. Provide workers’ compensation coverage for JOBSTRT participants. I. Apply Employer’s new employee rules regarding health care coverage, benefits, sick leave, and holiday and vacation absences to JOBSTRT participants. J. Allow JOBSTRT participants time off (without compensation) if requested to appear for Division of Child Support Enforcement proceedings. K. Repay DES JOBSTRT reimbursements in the event of any violation of this agreement or JOBSTRT project rules. L. Not employ any JOBSTRT participants with whom the Employer may have a conflict of interest. M. Maintain records and prepare reports on the JOBSRT employees as prescribed by the Sponsor. N. Allow the Sponsor to visit the premises, observe conditions and activities, and interview the JOBSTRT employee at a mutually agreed upon date and time. JA-085-FF (4-04) IV. SPONSOR’S AGREEMENT The Sponsor agrees to: A. Provide a subsidy to the Employer equal to $400 per month or the actual gross wages paid whichever is less. JOBSTRT subsidies will be paid for up to six months. One three-month extension may be granted when a written request detailing the reason for the extension has been approved by the Sponsor. B. Supply the Employer with the required forms and procedures for maintaining JOBSTRT employees’ records, and instructions on required reporting information. C. Provide supportive services and Transportation-Related Expense (TRE) payments as required by the JOBSTRT employee(s). V. ADDITIONAL DECLARATIONS This Agreement is subject to Title VI of the Civil Rights Act of 1964 and the regulations issued thereunder, and any service, financial aid, or other benefits provided under this Agreement shall be provided without discrimination because of age, race, color, creed, sex, handicap, or national origin. This Agreement may be terminated by either party by giving written notice to the other party not less than five working days before the intended termination date and is subject to A.R.S. § 38-511 regarding conflict of interest. VI.
