                                        APPLICATION INSTRUCTIONS

The State Housing Fund State FY 2008 Program Summary and Application Guide
Because understanding the State’s Housing Program policies is key to completing a successful application,
applicants must read the State FY 2008 Program Summary and Application Guide. The Summary and Application
Guide is intended to serve as a tool for applicants applying for funding available between July 1, 2007 and June
30, 2008, and contains the information necessary to evaluate whether a proposed project can meet all aspects of
the State Housing programs.

Submission Deadlines
Until funding is exhausted, the following timetable will be utilized by the State in making funding available
from July 1, 2007 through June 30, 2008.

Applications are due (must be in the possession of the Department) no later than 4:00 p.m. on the deadline
dates noted above. Applications must be mailed or hand delivered to:

Funding Decisions
The Department will make every effort to make its funding decisions by the dates listed above.

Submit One (1) original and two (2) Copies of the Completed Application (total of three applications)
Applicants must complete their application packages as described under Application Format, completing all
required sections and required supporting documentation, submitting one original and two copies (3 copies
total). Incomplete applications, applications missing documentation or applications not filed in triplicate will
not be accepted for review. This application and any subsequent revisions or clarifications, if approved for
funding, will become part of the agreement with the State.

Application Format
Applications must be typewritten or computer generated. Do not to revise these forms in any way. A copy of
this application is available by U.S. Mail, on diskette, by e-mail, or at the Housing website www.housingaz.com.

Application material must be:
    Bound in a 3 ring binder
    8 ½ x 11 format
    single-sided
    indexed and tabbed to correspond with the application checklist

In instances where the documentation is not applicable to a project, the tab must still be included and a single
sheet indicating “N/A” and a statement describing the reason(s) the item is not applicable should be included in
this space. The tabulation format should not be altered in any way.

                                                  2.       BUDGET STATEMENTS
The Sources and Uses statements for the Development period should be kept separate from the Sources and Uses statements
for Permanent Financing. Therefore, there are two separate sections that must be completed. Section 2.1. covers the
development period, i.e., the initial acquisition, construction and/or rehabilitation of the property. Section 2.2. covers for the
permanent financing sources, i.e., sales proceeds, etc., that will permanently pay for the project.

          4.     STATE HOUSING FUND APPLICANT AFFIDAVIT, RELEASE AND CERTIFICATION FORM


The undersigned Applicant hereby applies to the Arizona Department of Housing, its successors and assigns (the
“Department”), for a commitment of State Housing Funds. The undersigned is responsible for ensuring that the program will
assist only qualified low income housing as described in the application, and will satisfy all applicable State and Federal
requirements in the rehabilitation or construction to receive a commitment of State Housing Funds. The Applicant represents
and certifies that the application has not requested more State Housing Funds than is necessary to provide the assistance
described in this application. In planning this project or program, the Applicant certifies that it has provided for and will
continue to encourage the participation of citizens, particularly persons of low income who are residents of areas in which the
State Housing Funds are proposed to be used.

The Applicant understands that the Department will determine the eligibility of the project or program based, at least in part,
on the information in and submitted with the application by the Applicant and the readiness of the program to proceed, as
presented in the application. The Applicant is responsible for the accuracy of all information submitted. Misrepresentations,
mistakes or omissions may be the basis for the cancellation of an award.

The Applicant understands and agrees that should the Department commit more funds than the State of Arizona is entitled to
award in any given fiscal year (whether State or Federal), and funding is not available as awarded, the Department shall be
held harmless by the Applicant, the Applicant’s investors and anyone else relying upon the commitment.

The Applicant acknowledges and agrees that it will at all times cooperate with regard to request(s) for submittal of additional
requests for information from the Department as necessary.

The Applicant acknowledges and agrees to fully comply and cooperate with all monitoring activity of the Department after
the date of commitment. The Applicant will give the State, the U.S. Department of Housing and Urban Development, and any
State authorized representative access to and the right to examine all records, books, papers, or documents related to the
application and any resulting funding awards.

By executing this authorization and release, the Applicant does hereby authorize the Arizona Department of Housing, its
successors and assigns, to obtain and furnish and release, to all proper institutions and/or agencies, full and complete records,
reports and/or information pertaining to the Applicant and its application under the State Housing Fund program.

The Applicant agrees In compliance with State and Federal laws regarding conflict of interest. No elected or appointed officer
or employee of the Applicant may seek or accept any gifts, service, favor, employment, engagement, emolument or economic
opportunity which would tend improperly to influence a reasonable person in that position to depart from the faithful and
impartial discharge of the duties of that position. No officer or employee may use his or her position to secure or grant any
unwarranted privilege, preference, exemption or advantage for himself or herself, any member of his or her household, any
business entity in which he or she has a direct or indirect financial interest, or any other person. No officer or employee may
participate as an agent of Applicant in the negotiation or execution of any contract between Applicant and any private
business in which he or she has a direct or indirect financial interest. No officer or employee of Applicant may suppress any
report or other document because it might tend to affect unfavorably his/her financial interests.

The Applicant agrees that the Arizona Department of Housing, its successors and assigns, its agents, employees, attorneys,
contractors and representatives will at all times be indemnified and held harmless against all losses, costs, damages, expenses
and liabilities of whatsoever nature or kind (including, but not confined to, attorneys’ fees, litigation and court costs, amounts
paid in settlement, and amounts paid to discharge judgments, and any loss from such judgments or assessments) directly or
indirectly resulting from, arising out of, or related to acceptance, consideration and approval or disapproval of the Applicant’s
application for funding.

The Applicant hereby represents and certifies under penalty of A.R.S. 13-2311 and 39-161 that the information set forth herein,
and all material submitted by the Applicant to the Department, are to the best of the Applicant’s knowledge, true and
complete and accurately describe the proposed project. The undersigned is duly authorized to execute this instrument on
behalf of the Applicant and possesses the legal authority to apply for an allocation of State Housing Funds and to execute the
proposed program.

Further, the Applicant represents that its governing body has duly adopted or passed an official act of resolution, motion, or
similar action authorizing the filing of the application, including all understandings and assurances required, and directing

The Applicant understands that all representations made herein, and all documentation submitted, is subject to verification by
the Department, and that any misrepresentations or inaccuracies, whether intentional or not, may subject the project to a loss
of competitive scoring points or to disqualification. For the purposes of verification, the Applicant and Developer hereby
authorize the Department to request information on entities and individuals closely related to this transaction from any
lender, investor, or other institution or entity named in this application. Such information includes but is not limited to audits,
financial statements, credit history, copies of income tax returns, and other information deemed necessary by the Department.

Required attachments as specified in the Application Checklist and the Application Forms must be included and
appropriately tabbed. Following are detailed instructions for attachments that are not self-explanatory or otherwise included
in the application packet.

     A          Applicant Eligibility
                       An Applicant must be an existing legal entity authorized to conduct business in Arizona. Only an
                        authorized representative may sign any documentation that requires the signature of the
                        Applicant. The ADOH will reject forms signed in the name of an entity that does not legally exist
                        or by a representative without authority.
                       For Non-Profit or governmental applicants – Provide a Resolution to Apply for Funding. See
                        Sample Attachment A included at page 25.

                       Attach articles of incorporation, by-laws, partnership agreement or other relevant entity
                        organizational information, determination letter and Certification of Good Standing from the
                        Arizona Corporation Commission. If a non-profit, provide evidence of a 501 (c)(3) or (4) status in
                        the form of a copy of the Internal Revenue Service designation letter.

     B          Project Description
                       Provide descriptive information including the location, type of project, scope of work, and steps
                        required to implement the project successfully. (The applicant’s ability to fully describe the project
                        is a key indicator of the applicant’s understanding of what is required to complete the project
                        successfully.)

                       Attach pictures of the site. If rehab/resale provide interior photos.

     C          Architectural Floor Plans and Elevations
                       Floor plans for all unit types ¼” = 1’-0” scale.
                       Elevations for project

     D          Third Party Cost Estimate
                       One third-party cost estimate from a professional estimator, contractor or architect must be
                        included for all construction and rehabilitation projects using Attachment D-1. Cost estimates
                        must be based on actual drawings and specifications for the proposed development. Drawings
                        and specifications may be preliminary provided they are of sufficient detail to represent the cost of
                        the final design.
                       Rehabilitation projects must include a Capital Needs Assessment (CNA) and a Housing Quality
                        Standards Inspection checklist for each unit. If a CNA is not possible complete Attachment D –
                        HUD Form 9822 “Physical Inspection Report”. Include the cost breakdown in the application.
                        Items identified in the CNA report must be addressed in the cost estimate.
                       If final designs and construction bids are available, the applicant will provide evidence that (1) it
                        has received at least three bids and the selected bid was the most advantageous for cost and other
                        specified reasons; and/or (2) a cost analysis was conducted by a qualified party if multiple bids
                        were not received (and the results of that analysis included).


     E          Commitments for Financing
                       Applicants with firm commitments for financing must include commitment letter(s) from the
                        source of financing. Commitment letters must be on the letterhead of the organization providing
                        the commitment. The letterhead must include the mailing address and phone number of the
                        organization. The letter must include the name of the contact person, contact person phone
                        number, eligible uses of committed funds, terms and conditions of the commitment, including but

              not limited to repayment provisions, loan period, interest rate, and loan-to-value and debt
              coverage ratios, expiration date of the commitment, if any, signature and typed title and name of
              authorized official.
             If requesting State Housing Funds for projects with no conventional financing sources, include a
              copy of at least two loan denial letters from lending institutions.


F   Site Control Documentation
             The applicant must establish that it has legal control of the property by submitting a recorded deed
              (if already owned), a fully executed 99-year leasehold on the property (50 years for Tribal Land),
              contract for purchase or lease, option for purchase or lease, or an approved and executed
              governmental resolution and other documentation indicating the intent to sell to the applicant.
              Applicants must acquire land and buildings for the Project from unrelated third parties in arms-
              length transactions.
             Provide a preliminary title report for the property dated within 30 calendar days of the date of the
              application for each property.


G   Project Zoning Confirmation Letter
             Include a letter from the unit of local government indicating whether the property is appropriately
              zoned for the intended use.
             Include the Use Permit(s) if needed.

H   Utility Availability
             For new construction projects indicate that utilities are currently available to the project, provide
              documentation from local utility companies (i.e., “will serve letters”).
             Identify and explain if there are any potential problems obtaining connection to the site.
    .

I   Site Plan Approval
    For new construction projects provide written documentation of site plan approval or an explanation of
    when it will be complete.

J   Building Permits
             Include copies of any building permits (if available). Submit permits as soon as available.
             If State Historic Preservation Office directed particular historic preservation specifications provide
              a copy of the document.

K   Appraisal
    If this project involves acquisition of real property provide an appraisal indicating the value of the real
    property to be acquired. This includes both vacant land and land with existing buildings and
    improvements. If no acquisition is to take place an appraisal is not.

L   Homebuyer Selection Plan and Assistance Standards
    Include Homebuyer Assistance Plan and Assistance Standards, as described in Chapter 3, of the Program
    Summary and Application Guide.

M   Market Demand Analysis
    Projects in excess of 11 units require a third party Market Demand Study in accordance with the
    Department’s market demand study guidelines. See Appendix I of the FY2008 Program Summary and
    Application Guide
    Projects with 11 or fewer units require a Market Demand Analysis that includes the following information:
         Description of the proposed site(s) and site neighborhood. The site location is to be described using the
          nearest roadways. Color photographs of the subject site(s) from various vantage points are to be
          included. Color photographs of adjacent properties and streetscapes are to be included as well. All
          photographs are to be described (e.g., view of the site, looking northeast from Main Street / view from

          the site, looking west toward the adjacent single family home). The positive and negative attributes of
          the site and site neighborhood, and their impact on project marketability are to be discussed.
         The proposed project’s market area must be described and justified. The market area is the smallest
          geographic area from where the subject development will draw most of its residents. (The market area
          is not necessarily the same as a service area.) Provide a narrative describing the methodology and
          rationale used to determine the market area.
         The applicant is to provide a profile of the most likely (prospective) residents, including income range
          (minimum income required to afford the proposed units to the maximum permitted income), and other
          demographic characteristics. Indicate other homeownership opportunities available to the targeted
          population in the market area.
         Note at least three comparable projects near the proposed development, and provide their current
          prices, occupancy level and initial absorption rate, and amenities in comparison with the proposed
          development.
         Note the anticipated number of months it will take proposed development to reach stabilized
          occupancy (to 90 percent). Provide supporting evidence from recently developed projects if available.
         Number of comparable units targeting the same population that are under construction (or
          rehabilitation) or planned concurrently with the proposed project. Include the number of recently
          issued building permits or building permit applications for comparable units. Note the name, title, and
          phone number of the local government official who assisted in this determination.
         Note if applications are currently being accepted, and whether a waiting list or list of individuals who
          have expressed interest or inquired about the project is maintained. If a list is maintained, note when it
          was started and for what purpose (i.e., this project or other projects), as well as the number of names or
          applications that have been collected. Note if there has been any pre-screening of the applicants. If so,
          note what portion (number and percentage) of the applicants is estimated to be eligible. Of those who
          are estimated to be eligible, note what portion is estimated to be likely purchasers.

N   Financial Statements of the Owner/ Developer
    Provide audited financial statements for the most recent two years, unaudited statements for a completed
    fiscal year for which an audit is not yet available, and year-to-date unaudited statements for the current
    fiscal year. New nonprofit organizations that do not have completed or audited financial statements, must
    provide a current unaudited statement plus a statement from the organization’s CPA or auditor and
    certification from the Board that the organization’s financial management system meets the standards of 24
    CFR 84.21. Sole proprietors must provide personal financial statement

O   Environmental and Inspection Reports
        New construction/change in use projects: Submit a Phase I and/or II Report. In addition a
           Soil/Geotechnical report and ALTA Site Survey will be needed for the building permit process.
        Projects (except emergency shelters) must complete Attachment O “Determination Form”.
        Include an asbestos and Lead-based Paint Analysis if applicable. Note: Lead Based Paint
           requirements must be in accordance with 24 CFR Part 35 if federally funded or in accordance with
           the Department’s Lead Hazard Control Procedures in Appendix G of the State Housing Fund
           Summary. Provide a termite inspection (if applicable).
        Provide Flood Plain Map where project is located detailing the flood zone.
             Provide the Environmental Review pursuant to 24 CFR Part 58 if completed.

P   Property Standards
         Must meet applicable local codes, ordinances and zoning ordinances at time of          completion.
             New construction projects must complete Attachment P “Site & Neighborhood Standards” and
              meet the model Energy Code.

Q   Occupied Building (s) and Relocation Information-
             If the project is an acquisition and rehabilitation project, must include a current rent roll and
              income levels of existing tenants. Provide a tenant survey and current vs. proposed rents for the
              project.
             Complete Attachment Q “Occupied Building(s) & Relocation”. Provide a relocation plan and cost

              An activity from Section A.2 that is in or will impact on a floodplain or airport clear zone.
              Acquisition, repair, improvement, reconstruction or rehabilitation of public facilities and
              improvements (does not include buildings) when the facilities/improvements are in place and will
              be retained in the same use without change in size or capacity of more than 20%.
              Architectural barrier removal
              New construction, acquisition and rehabilitation of single family up to 4 units.
              New construction or rehabilitation of scattered site single family of 5 or more units as long as
              not more than 4 units per site and sites 2000 feet apart.
              Acquisition/rehabilitation of multi-family if no change in land use, the density is not increased
              beyond 20% and the estimated cost of rehab does not exceed 75% replacement value.
              Non residential rehabilitation (commercial, industrial, public buildings) only IF:
              No change in land use (from commercial to industrial, etc.); and
              Facility/improvement in place and change in size or capacity will not exceed 20%.
              Acquisition, leasing, equity loan or disposition of an existing structure or vacant land provided
              that the structure or land acquired or disposed of will be retained for the same use.
