11   TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA,
12   1976, BY ADDING SECTION 8-11-81 SO AS TO AUTHORIZE
13   THE COMPTROLLER GENERAL TO PAY A PREMIUM FOR
14   THE PREPAID LEGAL INSURANCE OF A STATE
15   EMPLOYEE BY MEANS OF PAYROLL DEDUCTION AND
16   TO PROVIDE THE CONDITIONS APPLICABLE WITH
17   RESPECT TO THE PAYROLL DEDUCTION.

19   Be it enacted by the General Assembly of the State of South
20   Carolina:

22   SECTION 1. Article 1, Chapter 11, Title 8 of the 1976 Code is
23   amended by adding:

25      “Section 8-11-81. The Comptroller General, upon request of an
26   employee of the State, may make a deduction from the
27   compensation of the employee for the payment of a fee for prepaid
28   legal services as defined in Section 37-16-10(3), offered by a
29   prepaid legal company as defined in Section 37-16-10(2), and
30   regulated by the South Carolina Department of Consumer Affairs.
31   The Comptroller General may not make deductions for fewer than
32   two hundred and fifty state employees in any particular plan. The
33   Comptroller General shall pay over to the prepaid legal company
34   amounts collected or withheld pursuant to this section. The cost of
35   the prepaid legal services or expenses incidental to the payroll
36   deduction must not be borne, in whole or in part, by the State in
37   connection with the deduction, nor may the State aid a prepaid
38   legal company in the solicitation of a policy by expressly or
39   implicitly endorsing a particular prepaid legal service or prepaid
40   legal company.”

42   SECTION 2. This act takes effect upon approval by the Governor.
