FACILITY USE AGREEMENT
This Facility Use Agreement (the “Agreement”) is made by and between the Episcopal Church of St.
Luke (the “Church") and ____________________________________ (the “Licensees”) for the times
and dates indicated herein.
Subject to the terms and conditions of this Agreement, and in consideration of payment of the fees and
performance of other obligations set forth herein, the Church hereby grants to Licensee a license to use
facilities on the Church’s property located at 221 West Third Street, Dixon, Illinois 61021 (the
“Facility”). Licensee agrees to conduct its activities and to supervise and control its participants in all
ways consistent with the primary use of said facilities as a church and to prevent use or conduct which
would interfere in any respect with the religious status and use of the Church and its property.
Licensee agrees not to violate any applicable laws, regulations, or ordinances, and will pay any and all
fines, penalties, taxes, and increased insurance premiums, if any, in any way arising out of such use.
Licensee acknowledges that it is aware of the maximum lawful room capacities and will abide thereby.
Licensee will not interfere with any other uses or activities of the Church. Licensee represents that it is
licensed and legally authorized to conduct the event(s) contemplated hereunder.
It is agreed that Licensee may use the following rooms, facilities, and equipment of the Church
on the following terms and conditions, all fees payable one month in advance:

Parish Membership:
Under the terms of the Parish By-Laws and the Canons of the Episcopal Church and of the
Diocese of Chicago, membership in a Parish is fulfilled by the following:
(a) Regular attendance (a pattern of attendance established with the parochial clergy)
(b) Baptism into the Church, reception into the Anglican Communion, transfer of
membership from another Episcopal or Anglican Church.
(c) Receiving Holy Communion not less than three times per year.
(d) Financial or other equivalent contributions to the parish.
(a pledge of financial giving is preferred, but contributions can be made to the
Rector’s Discretionary Fund for help to the poor and needy, by gifts of property,
and by donation of volunteer service time to the parish)
(e) Parish membership must be established for a period of at least one year, prior to,
or following the date of this agreement. If membership is cancelled by the
licensee or annulled by the clergy within this time, Non-parishioner rates for the
use of the facility will apply.
License:
This Agreement provides a personal license only, and does not create a tenancy. It may not be
assigned to or used by any other organization or person.
Security Deposit and Cancellation:
With the receipt of a security deposit of $200, the Church will agree not to cancel this event
without consent of the Licensee, except in exceptional circumstances. If the event must be
cancelled by the Church, any deposits or payments made by Licensee will be returned in full. If
the event is cancelled by the Licensee, no return of deposits or payments will be made.
Without the receipt of a security deposit, this Agreement may be revoked or cancelled by the
Church without liability at any time for any reason. If cancelled by Licensee, a cancellation fee
of $250 will be paid to the Church.
Time of the Essence:
Time shall be of the essence for this Agreement.
Use of Church Property:
Licensee shall not use the Church’s equipment, tools, or furnishings, located in or about the
facilities, without the prior approval of the Church’s agent.
Maximum Capacity:
Licensee shall not admit a larger number of persons than can safely and freely move about in the
Facility. The Church shall notify Licensee of the recommended capacity of the Facility. The
decision of the Church’s agent concerning questions arising under this paragraph shall be final.
Parking:
The Church shall make the existing parking area at the facilities available for the vehicular traffic
and parking necessitated by Licensee’s use of the Facility.

Concessions and Catering:
All concession and catering rights for the Facility are reserved to the Church. All catering and
concession sales must be arranged with the Church.
Smoking and Alcohol Restrictions:
There will be no smoking in any church building and no use of any alcoholic beverages on the
Church property or parking lot at any time.
Compliance with Laws:
Licensee shall comply with all laws, ordinances and rules of the Church, the State of Illinois, and
the United States, that are applicable to the use of the Facility. Licensee shall pay all taxes, if
any, imposed by law in connection with its use and occupancy of the Facility.
Defacement and Damage:
Licensee shall not injure or in any way deface the Facility and shall not cause or permit anything
to be done whereby the Facility shall be in any manner injured or defaced. Licensee will not
allow to be made any alterations of any kind therein. Licensee is responsible for any costs
related to repair of damages caused during usage.
Violations:
If at any time the use of the Facility by Licensee violates an applicable ordinance or law of the
City of Dixon, County of Lee, State of Illinois, or the United States of America, Licensee shall
either cease and desist from continuing such use or shall surrender the Facility immediately upon
demand of the Church’s agent.
Right to Enter:
In permitting the use of the Facility described herein, the Church does not relinquish control or
custody thereof and hereby specifically retains the right to enforce any and all laws, rules, and
regulations applicable thereto. All portions of the Facility will at all times be under the charge
and control of the Church. The Church’s agent or other authorized representatives of the Church
may enter the Facility at all times to make inspections to ensure compliance with this agreement.
Indemnification:
Licensee shall indemnify and hold the Church, its officers, and employees harmless from any
claim, suit, or proceeding arising out of the subject matter of this agreement, and Licensee shall
indemnify the Church, its officers, and employees for all expenses (including reasonable
attorney’s fees) incurred in defending such claims.
Notice:
Any notice to be delivered under this Agreement shall be sent by United States mail, postage
prepaid, certified mail, return receipt requested, addressed to the Church at the address indicated
below:
