ACTION CALENDAR

                        SOUTH BAY CITIES COUNCIL OF GOVERMENTS -
                          SUPPLEMENTAL AGREEMENT AMENDMENT

SUMMARY:

The South Bay Cities Council of Governments (SBCCOG) through the South Bay Energy Savings
Center (Center) is currently marketing several of West Basin’s conservation programs. The Center is
promoting the District’s Complete Restroom Retrofit Program throughout all cities located in the South
Bay as well as coordinating several residential landscape classes. The Center also provides overall
District promotion through the various outreach activities they conduct throughout the year.

This supplemental amendment request is to add several new programs to the existing Agreement
#W1778 Scope of Work and to increase the dollar value to cover the additional staff time and resources
needed to accomplish these tasks. The new tasks to the SBCCOG’s Agreement will include the
coordination and promotion of the following programs; six Ocean-Friendly Garden landscape
workshops, two Commercial/Industrial workshops and one “Smart” Gardening Expo in spring 2008.

If approved by the Board, this Amendment No. 2 to Agreement #W1778 will add $51,920 to the current,
which will expire on June 30, 2008.

FISCAL IMPACTS:

Funding for the additional promotion and coordination is currently budgeted through the following
budgets; $45,420 budgeted in 74G – Ocean Friendly; and $6,500 in 74D – CII Industrial Program. As
a way to leverage funding and increase partnership participation, staff will be developing funding
partnership agreements with its private retailers, cities and other interested agencies.  Staff has
already received several verbal funding commitments for the programs, which will lower overall
program costs.

ENVIRONMENTAL COMPLIANCE:

Not applicable.

COMMITTEE STATUS:

The item will be discussed at the Water Resources Committee on November 16, 2007.

RECOMMENDED MOTION:

That the Board authorizes the General Manager to amend the current Professional Services Agreement
No. W1778, with the SBCCOG to increase by $51,920 for a new total not-to-exceed Agreement
amount of $151,920 and incorporate new deliverables into the existing Scope of Work.
