to support and provide a Joint LDF Team
for Central Lancashire
Central Lancashire covers the administrative areas of Preston City Council, South Ribble Borough Council and

AGREEMENT BETWEEN LOCAL PLANNING AUTHORITIES TO
SUPPORT AND PROVIDE A JOINT LDF TEAM

Chorley Council; of Town Hall, Market Street, Chorley.
Preston City Council; of Town Hall, Lancaster Road, Preston.
South Ribble Borough Council; of Civic Centre, West Paddock, Leyland.
Lancashire County Council ; of County Hall, Fishergate, Preston.
The three aforementioned district authorities of Chorley Council, Preston City
Council and South Ribble Borough Council will be known jointly as the Joint
Local Planning Authorities (JLPAs) and Lancashire County Council will be
referred to as LCC.

The JLPAs and LCC have agreed to establish a Joint LDF Team to provide planning
policy advice to the Central Lancashire Joint Advisory Committee and, as
appropriate, the Executive Cabinets of the JLPAs, on the preparation of a joint Core
Strategy and associated Local Development Documents, as agreed between the
JLPAs and LCC.
It is intended that LCC will host the Joint LDF Team and provide services in kind
(including office accommodation, equipment, IT and administrative services and one
0.8 fte Officer to work on the Joint LDF Team). The three JLPAs will second staff, or
an equivalent financial contribution, to the Joint LDF Team in equal proportions. This
will include jointly funding the post of Team Co-ordinator (employed by Chorley
Council). The seconded staff will retain the terms and conditions of their employing
In addition, it is intended that three additional temporary posts funded by Growth
Point revenue grant will be employed by Chorley Council and be available to the
Joint LDF Team or the three district Planning Policy Teams, as work load levels
require. These posts will adhere to the terms and conditions of Chorley Council.
The JLPAs and LCC agree that:-
1. The three JLPAs jointly fund the position of Team Co-ordinator (with Chorley
Council as employing authority).
2. The three JLPAs will second one 0.8 fte Planning Officer or above, or financial
equivalent, to the Joint LDF Team. Equalisation of any variance in salaries of
those staff actually engaged will be undertaken at the end of the financial
3. Chorley Council will be the employing authority for any temporary
appointments to the Joint LDF Team or any of the three Planning Policy
Teams, financed by Growth Point revenue grant.
4. LCC will provide office accommodation, equipment and administrative
services, in addition to the services of the equivalent of 0.8 fte Planning
Officer to work on the Joint LDF Team, as long as the capacity to provide
these services in kind continues to exist.
5. The matters set out below form the basis of the relationship between the
JLPAs and LCC.

1. Joint LDF Team
i) The Team Co-ordinator will manage the activities of seconded staff and
temporary appointees to the Joint LDF Team;
ii) Each of the JLPAs agree that they will retain responsibilities for the
staff seconded from their authority;
iii) Chorley Council will retain responsibilities for any temporary
appointees funded by Growth Point revenue grant;
iv) The Team Co-ordinator will produce a Project Plan to steer the
activities of the Joint LDF Team and will make recommendations to the
JLPAs and LCC upon the nature and number of staff required to work
in the Joint LDF Team at any time;
v) The JLPAs and LCC agree that, as required by the Project Plan, and
following agreement between the Team Co-ordinator and a JLPA
acting through its Head of Planning, other staff may be seconded to the
Joint LDF Team for periods of time. The JLPAs agree that each will
second at least the equivalent (staff or payment in kind) of one full-time
officer of Planning Officer level, or above, to the Joint LDF Team. In
kind contribution to be calculated as the average full-time cost,
including NI and Pension, of those Planners seconded. A continuation
of this arrangement will be agreed subject to a performance review,
carried out by the Team Co-ordinator in consultation with the JLPA
Heads of Planning;
vi) The JLPAs agree not to transfer the secondment to other members of
staff, unless negotiated and agreed with the Team Co-ordinator;
vii) The JLPAs agree, in order to maximise innovation and creativity and to
fully absorb the implications of the LDF to inform district based work, to
enable participation in the Joint LDF Team by other staff from their
planning services. The JLPAs will liaise with the Team Co-ordinator to
determine the average maximum involvement of the additional

will be required to execute the functions specified in the Project Plan
prepared by the Team Co-ordinator. The JLPAs agree that technical
and specialist input specifically required in the production of LDF
documents, other than that provided as part of an authority’s normal
function, may be accounted as part of a JLPA’s input into the Joint LDF
ix) Unless otherwise agreed between each JLPA, acting through its Head
of Planning and the Team Co-ordinator, all secondments of staff to the
Joint LDF Team shall be:
a) agreed at least one month in advance of commencement;

b) to carry out Joint LDF Team tasks unless a specified JLPA
priority workload is agreed with the Team Co-ordinator;
c) subject to the same terms and conditions of the respective JLPA
d) implemented following discussion between the Team Co-
ordinator and Head of Planning in cases of urgent need.
x) Staff employed in the Joint LDF Team under temporary contract will be
placed on the establishment of the employing JLPA under the terms
and conditions of that JLPA and will be the subject of secondment to
the Joint LDF Team to be line managed by the Team Co-ordinator.
xi) Temporary staff employed in the Joint LDF Team utilising Growth Point
revenue grant will adhere to the terms and conditions of Chorley
Council and will be the subject of secondment to the Joint LDF Team to
be line managed by the Team Co-ordinator.
xii) LCC will provide services in kind to the Joint LDF Team by way of
accommodation, equipment, administrative support and professional
and technical officer support equivalent to 0.8 fte Planning Officer, as
long as the capacity to provide these services continues to exist.
b) Accommodation and Travelling
i) All members of the Joint LDF Team will normally be based at LCC
offices in central Preston. Individual pieces of work may be carried out
on any site in Central Lancashire, subject to agreement with the Team
ii) The JLPAs agree that travelling expenses of seconded staff to and
from offices that are not their normal place of work and which are over
and above the normal costs of travelling to and from the Planning
Office of each JLPA, will be reimbursed by the respective JLPA
through normal salary arrangements and that those costs will be
counted as part of the financial contribution of that JLPA.
iii) It is further agreed that travelling expenses incurred by seconded staff
in carrying out work for the Joint LDF Team will be reimbursed by the
respective JLPA through its normal salary arrangements.
iv) Travelling expenses incurred by temporary staff funded by Growth
Point revenue grant, employed by Chorley Council and based in the
Joint LDF Team, will be reimbursed by Chorley Council through its
normal salary arrangements.

c) Financial Matters
i) The salary and related costs of all seconded staff members to the Joint
LDF Team shall be separately accounted for in order that the
proportionality of the funding contributions to the Joint LDF Team can
be equalised between the JLPAs as part of the financial management
of the JAC (the financial equalisation agreement.)
ii) Chorley Council will be the employing authority for the Team Co-
ordinator post, which will be jointly funded by the three JLPAs.
iii) Chorley Council will be the employing authority for any temporary staff
funded by Growth Point revenue grant. Chorley Council will be
reimbursed for these salary costs from the Growth Point fund and will
draw down the relevant Growth Point funding from LCC, who act as
accountable body for the Growth Point fund.
iv) All financial contributions of the JLPAs will be considered in the
financial equalisation agreement. JLPAs will be required to provide
evidence of separate coding of costs and the justification of the
allocation of staff time. In order to keep the financial equalisation
simple, only costs of a material nature will be accounted for in this way.
Such materiality to be determined by the Responsible Finance Officers
of the JLPAs.
v) Each JLPA will produce quarterly budget statements to be audited by
the JLPLA’s Finance Officers in the management of the financial

2. Procurement Arrangements for Specialist Advice
i) The Project Plan will be used to identify major works to be carried out
by the Joint LDF Team in support of the preparation of the Core
Strategy and related Local Development Documents (LDDs), as agreed
by the JLPAs and LCC. Individual JLPAs will also need to commission
specialist works in support of the related but individual LDDs.
ii) If agreed by the JLPAs that similarly qualified consultants may be
required to complete both the joint and individual projects, these may
be commissioned through joint procurement arrangements to ensure
consistency of advice and minimise costs.
iii) If agreed by all the JLPAs, the costs of joint studies will be charged to
the procurement authority and may be accounted for in the financial
iv) Pieces of work carried out for individual JLPAs will be charged directly
to the individual authority and may not be accounted for in the financial
equalisation agreement, unless it is jointly agreed that excess costs are
incurred by the requirements of the Project Plan.
v) The Joint LDF Team will provide a Project Plan, including a forward
planning element for each JLPA, to determine the total costs of
external procurement required. It is intended that the individual JLPAs
will make budget provision for this work in their preliminary estimates,
utilising Planning and Housing Delivery Grant where appropriate, to
ensure collective delivery of the planning function.
vi) Contracts may be procured by one of the JLPAs, on behalf of all others
participating, in compliance with its financial strategy and procurement
rules, or otherwise as agreed.
3. Termination of the Agreement
i) This Agreement shall commence on 1st June 2009 and shall continue
until such time as the Core Strategy is adopted, unless extended by the
agreement of the JLPAs and LCC.
ii) Any JLPA may request LCC to act as mediator in any dispute, with the
potential for termination of this Agreement if there has been a
substantial breach of its terms by another JLPA. Substantial breach
shall include non participation or non funding of the Joint LDF Team,
failure to agree LDDs required, or inappropriate influence of the Joint
LDF Team activities by individual JLPA councils.
iii) Amendments or modifications to this agreement will require the
consent of all JLPAs and LCC.

4. Service Standards
i) The Joint LDF Team will operate independently of the JLPAs.
ii) The Joint LDF Team will be accountable to the JAC and will ensure
that advice given to the Joint Advisory Committee is competent and
compliant with current Law and good practice.
iii) The Joint LDF Team will be advised by an Officer Steering Group
comprising the Head of Planning in each JLPA and LCC, which will
ensure there is a suitable level of technical and professional expertise
present at the Joint Advisory Committee to provide competent advice.
iv) The Joint LDF Team will engage in full and timely exchange of
information with District Officers and provide advice as appropriate to
the general public.
v) The Joint LDF Team will manage and monitor the performance of sub-
contracted work, set project briefs and work programmes, agree
variations from the brief and manage the research budget.

1. Preparation of those aspects of the Joint LDF agreed by the Joint
Advisory Committee, including a joint Core Strategy.
2. Exploring the possibility of producing other joint LDDs. Such
consideration to be agreed by the Officer Steering Group.
3. Carrying out community involvement as part of the Joint LDF
Submission of Core Strategy – September 2009
Adoption – December 2010
1. Advise or participate in the co-ordination of sub regional planning and
transport proposals and cross-boundary strategic planning issues.
2. Co-ordinate and assimilate the information base to inform the Joint

4. Appear as expert witness at the Independent Examination into the
Central Lancashire Core Strategy and other public inquiries as
