Public Hearing Notice Proposed rule language for Ohio Administrative Code (OAC) rule 3745-25-03 to Correct the Air Pollution “Warning” Language for Nitrogen Dioxide
Notice is hereby given that the Ohio Environmental Protection Agency, Division of Air Pollution Control (DAPC) is proposing the following new, amended and rescinded rules to the Joint Committee on Agency Rule Review (JCARR). The rule contains the criteria justifying the proclamation of an air pollution "Alert", air pollution "Warning", or air pollution "Emergency" in the state of Ohio. Specifically, Ohio EPA is proposing the following: On April 8, 2009, DAPC final filed Ohio Administrative Code (OAC) rule 3745-25-03 as part of the 5 year review process for OAC chapter 3745-25. A few days later, it was noted that a typographical error in OAC rule 3745-25-03 had slipped through the review process. Apparently, while copying and pasting the rule language to create the new rule document, the language in paragraph (D)(4) was double copied into paragraph (E)(1)(a), replacing the existing, and intended, language. The proposed changes will return the language to the original intended wording and restore the proper “warning” level for nitrogen dioxide to match the level in Ohio’s State Implementation Plan (SIP) for attaining and maintaining the national ambient air quality standards under the Clean Air Act. Pursuant to Section 121.39 of the Ohio Revised Code, DAPC was required to consult with interested parties affected by the rules before the division formally adopts them. On November 21, 2008 these rules went out for a 30 day review by interested parties. No comments were received. Pursuant to Section 119.03 of the Ohio Revised Code, a public hearing on these rule changes will be conducted on Tuesday, June 30, 2009 at 2:00 PM in Conference Room C at Ohio EPA, Lazarus Government Center, 50 W. The Long-Term Control Plan, which was received by Ohio EPA on May 8, 2009, contains an implementation schedule that will be included in the City’s NPDES permit upon renewal. Ohio EPA will provide an opportunity for public comment concerning this project. Comments received shall be considered by the Director before the plan is issued as final.
