       construction projects. The City of Fort Wayne is a participating member in the President's Recycling
       Program and has a written recycle policy, which can be requested from the Purchasing Department.

   7. Bids will be publicly opened and read in the Purchasing Conference Room in the basement of the City-
       County Building, 1 East Main Street, Room B91, Fort Wayne, Indiana 46802.
   8. To ensure proper identification of your response, the ITB number should be written on the lower left
       corner of your bid packet envelope. See attached specifications/bid form.
   9. Quote F.O.B. Destination
   10. Cash discounts: Bidders are encouraged to offer discounts for expedited payment of invoices rendered
       under this contract. Cash discounts will be taken as earned by the City. Cash discounts will not be
       considered in the bid evaluation.
   11. The City of Fort Wayne has the right and option to terminate the agreement upon thirty days written
       notice.

      12. Quantities indicated are estimates only. City reserves the right to buy additional units of commodity
           specified at the quoted price.
      13. Any waiver of the specifications is void unless a formal addendum is sent from the Purchasing
      Department.
      14. Approved Equivalents: Unless an item is indicated “No Substitute”, special brands, when named, are
      intended to describe the standard of quality, performance or use desired. Equivalent items will be considered
      by the City, provided that the Bidder/Proposer specifies the brand and model, and provides all descriptive
      literature, independent test results, product samples, etc. to enable the City to evaluate the proposed
      “equivalent”. The decision of the City as to what items are equivalent shall be final and conclusive. If the City
      elects to purchase a brand represented by the Bidder/Proposer to be an “equivalent”, the City’s acceptance of
      the item will be conditioned on the City’s inspection and testing after receipt. If, in the sole judgment of the
      City, the item is determined not to be an equivalent, the item shall be returned at the Bidder/Proposer’s
      expense and the contract canceled without any liability whatsoever to the City. When a brand name or level of
      quality is not stated by the Bidder/Proposer, it is understood the offer is exactly as specified. If more than one
      brand name is specified, Bidder/Proposer must clearly indicate the brand and model/part number being
      bid/proposed.
      15. Contractor shall understand and comply with the City of Fort Wayne Drug Policy as listed on the
          City of Fort Wayne website at: Cityoffortwayne.org, Finance and Administration, Purchasing,
          Drug Policy.
      16. If Bidder/Proposer has any proprietary information that cannot be disclosed, the proprietary information
          should be submitted as a separate package. Bidder/Proposer must understand that all information
          submitted is subject to public records request after award is made. If proprietary information is requested,
          bidder/proposer will be contacted and given an opportunity to defend its position that the information is
          proprietary.

17.       MERCURY FREE SPECIFICATION

BIDDERS MUST OFFER MERCURY-FREE ALTERNATIVES TO ALL PRODUCTS WHICH
CONTAIN INTENTIONALLY ADDED MERCURY (MERCURY ADDED PRODUCTS) WHERE
SUCH ALTERNATIVES EXIST.

SHOULD SUCH ALTERNATIVES NOT BE AVAILABLE, BIDDERS MUST SUBMIT WITH
THEIR RESPONSE A LIST OF PRODUCTS WITHOUT MERCURY-FREE ALTERNATIVES AND
AN EXPLANATION OF WHY ALTERNATIVES ARE NOT AVAILABLE.

CITY RESERVES THE RIGHT TO REJECT ANY AND ALL BIDS THAT DO NOT PROVIDE
MERCURY-FREE ALTERNATIVES OR AN ADEQUATE EXPLANATION WHICH CITY DEEMS
ACCEPTABLE.

18.  ALL EQUIPMENT WHICH RUNS ON ELECTRICITY WILL CARRY THE ENERGYSTAR
RATING WHENERVER POSSIBLE. COMPUTER EQUIPMENT, ETC., MAY BE SELECTED
BECAUSE IT MEETS THIS SPECIFICATION OVER COMPETITORS THAT DO NOT.

       required to meet minimum Insurance Requirements according to the following schedule:

       minimum per occurrence; Aggregates $1,000,000 minimum per occurrence; Products
       Liability $1,000,000 minimum per occurrence; Completed Operations Liability

                                    SECTION I
                              CITY OF FORT WAYNE
                BOILER, HEATING, AIR CONDITIONING, & VENTILATION
                           INSPECTION, MAINTENANCE,
                           & MISCELLANEOUS REPAIRS

                                          SPECIFICATIONS

Unless all items are checked as to “Read and Accepted,” the entire bid will be considered incomplete
and nonresponsive. The “Comments” blank is for notations regarding a possible better, or equal method
or service that does not increase the overall bid.

I.   Overview

       1.1      The City of Fort Wayne is requesting bids on boiler, heating, air conditioning, and
                ventilation inspection, maintenance, and miscellaneous repairs as outlined in the
                following specifications. These services will be provided for Animal Care and Control,
                Fire Department, Filtration Plant, Parks Department, Police Department, Police
                Academy, Radio Shop, Street Light Operations, Traffic Engineering Sign & Signal
                Divisions, Water Maintenance & Service, and WPC Plant properties. Some of these
                areas will have multiple buildings and/or locations.

       1.2      Compliance to the specifications will be addressed by “Read and Accepted” and
                deviations and/or exceptions will be clearly indicated under “Comments” and referenced
                by component to aid in proper evaluation.

       1.3      Contractors will itemize all deviations to the specifications. If sufficient space has not
                been provided under “Comments,” attach additional sheets as required.

       1.4      Term of agreement will be from time of award through and including December 31,
                2012.

       1.5      This section may be awarded in whole or by individual Department. The award may be
                based on bid with Filter changes or bid without Filter changes as determined to be in the
                best interest of the City.

       1.6      Awarded contractor(s) will receive the Safety Policies & Procedures of each Department
                where established.

       1.7      There will be a mandatory pre-bid conference on Wednesday, October 20th at 1 p.m. in
                the Human Resources conference room 380, City County Building. Any and all questions
                will be answered at that time.

       1.8      All heating inspections will be done in September and cooling inspections done in May
                unless otherwise specified.

II.   Vendor Responsibility

      2.1    Each contractor will be responsible for visiting each site before submitting a bid on this
             project.

      2.2    The contractor and its employees must be qualified and experienced in all types of
             boiler/HVAC systems and their controls to ensure that proper inspections, maintenance,
             and repairs are done.

      2.3    Awarded contractor(s) must carry a sufficient parts inventory to guarantee continuous
             operation of their systems.

      2.4    All Departmental filters are to be changed as referemced within Departmental
             specifications and/or per the attached change out schedule.

      2.5    The awarded contractor shall provide the labor, materials, equipment, appliances,
             services, and transportation, and perform the operations in connection with the
             performance and installation of the work.

      2.6    Must be able to respond and perform twenty-four (24) hour, seven (7) day a week
             emergency service and repairs.

      2.7    The awarded contractor(s) shall provide any and all necessary inspection report sheets to
             the individual departments and its designated contact person. Reports should be detailed
             and list any potential problems or repairs.

      2.8    Upon award and before commencement of work, contractor(s) will be required to supply
             the following documentation.

                a. Copy of insurance certificate showing general liability in the amount of
                   $1,000,000.00 per occurrence and a $1,000,000.00 per aggregate and
                   Worker’s Compensation per Indiana Statute. The City of Fort Wayne
                   must be named as an additional insured. In the event of cancellation of
                   the policy, the City of Fort Wayne shall be given thirty (30) days prior
                   written notice.

                b. Copy of Non-Sanitary Piping Contractor’s license.

                c. Copy of H V A C Category A license.

                d. Provide proof of customer base that you provide service to with boiler larger than
                   400,000 BTU’s. Include phone number and contact name.

      2.9    All parts and labor must carry a one (1) year warranty.

      2.10   Provide five (5) commercial preventative maintenance and service contract references
             performed within the last five (5) years.

      2.11   Contractor warrants that it is an independent contractor and represents that it owns or

              leases, and shall have available at all time during the agreement, equipment necessary
              to perform the services specified. All equipment shall be in good operating condition

III.   Miscellaneous Repairs

       3.1    If upon inspection, repairs are needed and the amount of repair is under $500.00, the
              Contractor must write up a report and submit to the department and its contact person
              for approval. If the repair is $500.00 or more, then the Contractor must submit the
              report to the Property Manager and the Department’s contact person for approval.
              Failure to receive approval before work is done may result in the cancellation of

                  Check pump coupling alignment.
                  Grease the pump motor and pump bearings.
                  Check systems for any leaks.

            Exhaust Fan Maintenance – Semi Annual (Spring & Fall)

                  Check belts if applicable.
                  Motor inspection:
                    Check the motor for oil ports (add 5 drops each of oil to each port SAE 30 or
                      equivalent oil).
                    Wipe the motor down of any dust accumulation.
                    Check shaft for bearing play.
                    Check for vibration, clean if necessary.
                    Inspect the damper opening and closing, and adjust if necessary.

            Domestic Hot Water Heater Burner Maintenance – Annually (Spring)

                  Check for cracks and/or leakage.
                  Check the refractory around the burner for cracks.
                  Clean the burner ad test all safety and operating controls. Check for proper flame
                   and combustion characteristics.

            Domestic Hot Water Heater Pump – Semi Annual (Spring & Fall)

                  Lube the pump and motor bearings.
                  Check coupler.

            Temperature & Pressure Relief Valve Maintenance – Annually (Spring)

                  Manually open and allow water flow, then shut.
                  After shutting down the system, remove and visually inspect for accumulation of
                   corrosion deposits.
                  Start a log and maintain near the water heater to provide a record of the inspection
                   dates and the results of the inspection.

            Chiller - Start Up (Spring)

                  Check all relief valves for presence of refrigerant oil to detect any leaking relief
                   valves.
                  Refrigerant leak test the entire machine, repair minor leaks and report major leaks
                   immediately.
                  Inspect condenser and clean.
                  Measure the compressor motor winding resistance to ground.
                  Check oil level and refrigerant charge.
                  Check all electrical components and connections for any deficiencies.
                  Check fan assemblies for proper clearance.
                  Test compressor oil for acid.
                  Check all cooling pumps for proper operation.
                  Check for proper chilled water flow.
                  Check for proper operation of all interlocks and flow switches.
                  Start the chiller and record the following:

                  Check system for proper operation and listen to system for potential problems.

                                         SPECIFICATIONS

Unless all items are checked as to “Read and Accepted,” the entire bid will be considered incomplete
and nonresponsive. The “Comments” blank is for notations regarding a possible better, or equal method
or service that does not increase the overall bid.

                                           I.      Overview

       1.1    The City of Fort Wayne is requesting bids on heating, air conditioning, and ventilation
              inspection, maintenance, and miscellaneous repairs as outlined in the following
              specifications. These services, that do not include any Boiler services, will be provided
              for the City Garage, Fire Department, Parks Department, Street Department, WPC
              Maintenance, and WPC Plant Sludge Lagoons and Biosolids properties. Some of these
              areas will have multiple buildings and/or locations.

       1.2    Compliance to the specifications will be addressed by “Read and Accepted” and
              deviations and/or exceptions will be clearly indicated under “Comments” and referenced
              by component to aid in proper evaluation.

       1.3    Contractors will itemize all deviations to the specifications. If sufficient space has not
              been provided under “Comments,” attach additional sheets as required.

       1.4    Term of agreement will be from time of award through and including December 31,
              2012.

       1.5    This section may be awarded in whole or by individual Department. The award may be
              based on bid with Filter changes or bid without Filter changes as determined to be in the
              best interest of the City.

       1.6    Awarded contractor(s) will receive the Safety Policies & Procedures of each Department
              where established.

       1.7    There will be a mandatory pre-bid conference on Wednesday, October 20th at 1 p.m. in
              the Human Resources conference room 380, City County Building. Any and all questions
              will be answered at that time.

       1.8    All heating inspections will be done in September and cooling inspections done in May
              unless otherwise specified.

II.   Vendor Responsibility

      2.1   Each contractor will be responsible for visiting each site before submitting a bid on this
            project.

      2.2   The contractor and its employees must be qualified and experienced in all types of
            boiler/HVAC systems and their controls to ensure that proper inspections, maintenance,
            and repairs are done.

      2.3   Awarded contractor(s) must carry a sufficient parts inventory to guarantee continuous
            operation of their systems.

      2.4   All Departmental filters are to be changed as referenced within the Departmental
            specifications and/or per the attached change out schedule.

      2.5   The awarded contractor shall provide the labor, materials, equipment, appliances,
            services, and transportation, and perform the operations in connection with the
            performance and installation of the work.

      2.6   Must be able to respond and perform twenty-four (24) hour, seven (7) day a week
            emergency service and repairs.

      2.7   The awarded contractor(s) shall provide any and all necessary inspection report sheets to
            the individual departments and its designated contact person. Reports should include the
            model and serial numbers of each unit being serviced at that time and list any potential
            problems or repairs.

      2.8   Upon award and before commencement of work, contractor(s) will be required to supply
            the following documentation.

               a. Copy of insurance certificate showing general liability in the amount of
                  $1,000,000.00 per occurrence and a $1,000,000.00 per aggregate and
                  Worker’s Compensation per Indiana Statute. The City of Fort Wayne
                  must be named as an additional insured. In the event of cancellation of
                  the policy, the City of Fort Wayne shall be given thirty (30) days prior
                  written notice.

               b. Copy of Non-Sanitary Piping Contractor’s license.

               c. Copy of HVAC Category A license.

               d. Provide proof of customer base that you provide service to with boiler larger than
                  400,000 BTU’s. Include phone number and contact name.

       2.9    All parts and labor must carry a one (1) year warranty.

       2.10   Provide five (5) commercial preventative maintenance and service contract references
              performed within the last five (5) years.

       2.11   Contractor warrants that it is an independent contractor and represents that it owns or
              leases, and shall have available at all time during the agreement, equipment necessary
              to perform the services specified. All equipment shall be in good operating condition
              and shall be operated by a sufficient number of trained, experienced personnel.
              Contractor acknowledges that it, alone, directs and supervises the work of its
              employees, disciplines its employees, and makes direct payment to its employees for
              services rendered by such employees for Contractor.

III.   Miscellaneous Repairs

       3.1    If upon inspection, repairs are needed and the amount of repair is under $500.00, the
              Contractor must write up a report and submit to the department and its contact person
              for approval. If the repair is $500.00 or more, then the Contractor must submit the
              report to the Property Manager and the Department’s contact person for approval.
              Failure to receive approval before work is done may result in the cancellation of
              agreement.

V.    Execution/Inspection Requirements:

      Requirements apply to all departments and should be considered when pricing each
      department’s bid. It is the Contractor’s responsibility to follow all good industry standards. And
      to inform City of situations or unusual operating conditions that may lead to unsafe or
      hazardous operations. All units are required to be cleaned, vacuumed, and wiped down after
      each service.

            Unit Ventilators/Fan Coil Units/Air Handling Units/(With or Without Electric Heat)

                Inspect main disconnect, control power terminal block, grounding lug, and
                 control transformer.
                Check main supply voltage on load side of main disconnect.
