Who is a Refugee?
According to the 1951 Convention Relating to the Status of Refugees, a refugee is a person who "owing to a well-founded fear of being
persecuted for reasons of race, religion, nationality, membership in a particular social group, or political opinion, is outside the country of his
nationality, and is unable to or, owing to such fear, is unwilling to avail himself of the protection of that country."

What is Asylum?
Asylum is "protection granted by a State on its territory against the exercise of jurisdiction by the State of origin, based on the principle of non-
refoulement and characterised by the enjoyment of internationally recognised refugee rights, and generally accorded without limit of time."

What is Non-refoulement?
Non-refoulement is the "principle of international law which requires that no State shall return a refugee in any manner to a country where his
or her life or freedom may be endangered. The principle also encompasses non-rejection at the frontier."

5    Pupil Exclusion Start Date (StartDate) and Pupil Leaving Date (LeavingDate)

In the case of a permanent exclusion “the absence of a permanently excluded pupil is treated as authorised while any review or appeal is in
progress. If a permanent exclusion is confirmed, the pupil`s name should be removed from the school roll on the school day either: after the
appeal committee`s confirmation of permanent exclusion; or on expiry of the time allowed for appeals to be made; or, if before that, the pupil
takes up a place elsewhere. Meanwhile absence should be recorded as authorised.”

For a permanent exclusion the “Exclusion Start Date” and the “Leaving Date” will be the day the pupil‟s name has been removed from the
school roll.

A Carer is defined as “a person named by a local authority to care for a child for whom the social services department has parental
responsibility, ie a child who is the subject of a care order and who has been placed in a residential or foster placement. The carer may
qualify as a parent for the purposes of the Education Acts because he or she has care of the child (see the definition of Parent below). If so,
he or she will have a role to play in the consideration of a child's special educational needs.”

The above guidance defines “parent” and “parental responsibility” as follows:-

DEFINITION OF “PARENT”

4. Section 576 of the Education Act 1996 defines “parent” to include:
- all natural parents, whether they are married or not; and
- any person who, although not a natural parent, has parental responsibility for a child or young person; and
- any person who, although not a natural parent, has care of a child or young person.

PARENTAL RESPONSIBILITY

5. Having parental responsibility means assuming all the rights, duties, powers, responsibilities and authority that a parent of a child has by
law(i). People other than a child‟s natural parents can acquire parental responsibility through:

- being granted a residence order;
- being appointed a guardian;
- being named in an emergency protection order (although parental responsibility in such a case is limited to taking reasonable steps to
safeguard or promote the child's welfare); or

(i) Parental responsibility is defined in the Children Act 1989. If the parents of a child were not married to each other when the child was
born, the mother automatically has parental responsibility but the father does not, even if he is named on the birth certificate. He can,
however, subsequently acquire parental responsibility by various legal means.

7    First Language (FirstLanguage) and Language Code (Language)

The language recorded as "First Language" should be the language to which the child was initially exposed during early development.

If the child was exposed to more than one language then one of the languages should be recorded as "First Language" and the other
language (or, in exceptional circumstances, other languages) should be recorded in the Language section with a Language Type of "M"
(Multiple First Language). If, in these circumstances, one of the languages is English then this should be recorded as the "First Language"
and the other language (or languages) recorded in the Language section.

It is proposed that in the future the collection of language data will use the language section only, with the “First Language” data item no
longer used.

Currently, children for whom English is an additional language may be identified by the “First Language” not being English.
