Loyal Message

The State President advised that the following Message of Loyalty to Her Majesty Queen
Elizabeth II, read by the Chief Executive Officer, would be conveyed to Her Majesty.

THE STATE PRESIDENT AND THE DELEGATES ASSEMBLED AT THE 93rd ANNUAL SUB-
BRANCH CONFERENCE IN ADELAIDE AND REPRESENTING THE LIFE, SERVICE AND
AFFILIATE MEMBERS OF THE RETURNED & SERVICES LEAGUE OF SOUTH AUSTRALIA,
BROKEN HILL AND THE NORTHERN TERRITORY, WISH TO AFFIRM TO HER MOST
GRACIOUS MAJESTY, QUEEN ELIZABETH II, SOVEREIGN OF AUSTRALIA AND PATRON

Ceremony of Remembrance

At the instigation of the Chairman, delegates and guests observed the Minute’s Silence during
the Ceremony of Remembrance.

Opening Address

His Excellency Rear Admiral Kevin Scarce AC CSC RAN (Retd) acknowledged the attendance
of Distinguished Guests and Sub-Branch Delegates. He then gave a speech in which he noted
the need for the RSL to look to the future, to attract and address the needs of post-Vietnam and
younger veterans and also to strive to modernise facilities, the way the RSL conducts its
business and become familiar with current communication technologies.

A vote of thanks to His Excellency Rear Admiral Kevin Scarce AC CSC RAN (Retd) was moved
by Mr John Spencer OAM RFD and CARRIED WITH ACCLAMATION.

Awards

The Chief Executive Officer invited the RSL National President, Rear Admiral Ken Doolan AO
RAN (Retd) to present the following award:-

ANZAC of the Year     Mr Glen Stockham – Enfield Sub-Branch

The Chief Executive Officer acknowledged the following awards. The presentations of these
awards had been made to recipients prior to the Conference as they were unable to be present
on the day.

The Hon Alan Griffin MP, Minister for Veterans’ Affairs addressed the delegates.

The Hon Mrs Louise Markus MP, Shadow Minister for Veterans’ Affairs addressed the
delegates.

The State President adjourned the Conference.

Working Session

The State President reconvened the Annual General Meeting and welcomed those present and
advised that when dealing with Repatriation items on the agenda, he would invite the
representatives from the Department of Veterans’ Affairs and the Repatriation Commission to
provide clarification when necessary.

Minutes

The minutes of the 92nd Annual Sub-Branch Conference held on Saturday 4th July 2009 had
been circulated.

THAT THE MINUTES BE CONFIRMED. CARRIED.

Mr Cook, Freeling Sub-Branch, noted that his surname had been spelt incorrectly on item 24 of
the previous minutes. He also queried the action of the result of this item as Freeling Sub-
Branch had not been informed. He requested that all Sub-Branches raising motions at the Sub-
Branch Conference be advised of the result and action taken following the Conference.

Action:       State President to circulate the result and action taken regarding motions from
              the 2009 Annual Sub-Branch Conference with the 2010 Annual Sub-Branch
              Conference minutes.

The State President called on the Chief Executive Officer to list the defaulting Sub-Branches.

Defaulting Sub-Branches

Alice Springs, Booleroo Centre, Coober Pedy, Darwin North, Gove Peninsula, Gumeracha,
Katherine, Keith, Keswick and Richmond, Maitland, Moorook-Kingston, Morgan, Mount
Pleasant, Nairne, Roxby Downs, Woomera.

The State President CONFIRMED that any representative present from the above Sub-
Branches was ineligible to vote on any of the items on the agenda.

The State President noted that Alice Springs were a defaulting Sub-Branch as the financial
reports received by State Branch was not audited. He asked that the delegate from Alice
Springs be allowed to participate in discussions but not vote. This was agreed.

Annual Report and Balance Sheet

The Annual Report, containing the Balance Sheet, had been distributed to the Sub-Branches
prior to the Conference.

Mr Dennis, Royal Australian Regiment Sub-Branch, queried the expenditure at the end of 2009
in regard to the legal fees of $94K and asked how this was incurred.

The State President responded that the majority of the legal fees were incurred due to a conflict
with Murray Bridge Sub-Branch but this had been settled within the last month.

Mr Dennis suggested that if a Sub-Branch could not operate within the rules of the RSL then
they should be suspended and an administrator appointed so that this does not financially
disadvantage those who do operate within the rules.

The State President asked Mr Dennis to submit this as a notice of motion for the 2011 Sub-
Branch Conference if the Royal Australian Regiment Sub-Branch wishes to put this forward.

Mr Bowles, Morphett Vale Sub-Branch, queried the bad debts of $4390 in the financial report.

The State President responded that this was due to legal fees incurred by Murray Bridge Sub-
Branch regarding the sale of their premises. These fees were paid by State Branch.

Mr Burton, Blackwood Sub-Branch, queried the increase in administration costs for the Poppy
Day Trust Fund.

Mr Watt responded that this is an accounting book figure resulting from the sale of properties at
Mount Gambier. The properties were in such repair at the time of sale that they were sold at
land value only.

Adoption of the State Constitution

The reaffirming of the State Constitution passed in 2003. ADOPTED.

A copy of the State President’s Interim Report was distributed at the Conference.

2.     CONTRAVENTIONS BY SUB-BRANCHES

       State Branch Constitution Sub-Clause 26.11 be amended to read:

       Subject to any State, Territory or Commonwealth legislation to the contrary, a Sub-Branch is
       not authorised to and shall not transfer or offer to transfer, lease or offer to lease, or create
       or authorise to be created any security or interest in any property held or owned by it either
       legally or beneficially without the prior written approval of the State Board.

3.   BY-LAWS FOR SUB-BRANCHES

     By-Law No 3 Clause 10 (a) (i) to be amended to read:

     May vote and be elected to the positions of Secretary, Treasurer or Committee person
     and may be elected as President or Vice President after serving 2 years as a Committee
     person in the Sub-Branch.

4.   ANZAC, COMMEMORATION, CEREMONIAL AND MEMORIALS

5.   ANZAC, COMMEMORATION, CEREMONIAL AND MEMORIALS

     Submitted by: State Board

     National BY-LAW NO 14 be amended to read:

     BY-LAW NO 14

     RSL COMMEMORATION CEREMONIES - RECOMMENDED PROCEDURE
     (Rule 4.1 (e) refers)

     1.   Wherever possible, RSL commemoration ceremonies should follow a standard
          order of service as detailed in this By-Law.

     2.   At the appropriate time of the commemoration the sequence of events for RSL
          ceremonies shall be as follows:

           a.    The Ode shall be spoken by the designated person.
                 'They shall grow not old, (short pause)
                 As we that are left grow old, (longer pause)
                 Age shall not weary them, (short pause)
                 Nor the years condemn, (longer pause)
                 At the going down of the sun, (short pause)
                 And in the morning, (longer pause)
                 We will remember them’. (short pause)
                 The gathering repeats 'We will remember them.'

          b.    The designated person shall say 'Lest We Forget' and the gathering will
                repeat 'Lest We Forget'.

           c.    The Last Post shall be played.

           d.    A period of not more than two minutes' silence shall then be observed.

           e.    Rouse or Reveille shall then be played.
                 (Rouse is the bugle call more commonly used in conjunction with the 'Last
                 Post' and to the layman is often incorrectly called 'Reveille'. Although
                 associated with the 'Last Post', 'Reveille' is rarely used because of its length).

           f.    The ceremony is ended. The words 'thank you' shall NOT be spoken to end
                 the ceremony.

6.   WEARING MEDALS & DECORATIONS AT FUNERALS

     civilian dress from wearing decorations or medals unless requested to do so (by
     family/organisation, etc),

                        VETERANS’ AFFAIRS MATTERS

7.   MILITARY SUPERANNUATION

     Submitted by: McLaren Vale Sub-Branch

     The RSL seek the same community standard of indexation, as adopted for the Age and
     Service pensions to be applied to all components of DFRB/DFRDB/MSBS military
     superannuation pensions.

8.   TAXATION ASPECTS OF MILITARY SUPERANNUATION UNDER “BETTER
     SUPER”

     Submitted by: McLaren Vale Sub-Branch

     The RSL seek the removal of income tax on DFRB/DFRDB/MSBS military
     superannuation pensions, including death and invalidity, in line with the most of the
     remainder of the Australian community but, at the very least if that is not agreed, we ask
     for a separation of taxed military pensions from other taxed income on the taxpayers’ tax
     return.

9.    MSBS MAXIMUM BENEFIT LIMITS (MBL)

      The RSL seek the immediate removal of MBLs in the MSBS superannuation scheme.

10.   DFRB/DFRDB COMMUTATION ISSUES

      The RSL seek:

      a.    Immediate adoption of up to date life tables in calculating commutation and
            fortnightly payments for all new DFRDB superannuants; and

      b.    Rectification of injustices associated with the application of inappropriate life tables
            for existing DFRDB superannuants.

11.   EXTENSION OF MILITARY SUPERANNUATION TO ADF RESERVE MEMBERS

      The RSL seek more flexible MSBS membership for all ADF reserve members; and;
      Commonwealth employer contribution of 9% under the Superannuation Guarantee
      (Administration) Act 1992 to all reserve service not presently covered.

12.   FBT REPORTABLE ISSUES RELATING TO FAMILIES OF SERVICE ADF
      PERSONNEL

      The Government conduct a thorough investigation into the application of the fringe benefit

13.   INTEGRATED PEOPLE SUPPORT SYSTEM

      The Government conduct a thorough review to ensure that this transition process is
      comprehensively managed to ensure that deficiencies in the following processes have
      been eliminated:

         -   Appropriate invalidity and other financial entitlements are in place to ensure
             discharging personnel can access these without delay.
         -   Members records of service be more comprehensive and include full details of
             postings and particularly deployments to operational zones, overseas and to
             remote localities.
         -   Any adverse service related medical conditions identified during the member’s
             service have been fully identified and adequately recorded in ADF service
             documents.
         -   Appropriate treatment and rehabilitation programs have been instituted and will
             continue without interruption.
         -   Servicemen and women are offered comprehensive relevant financial advice,
             vocational support, and family assistance to ensure a smooth transition from the
             Service.
         -   Servicemen and women are provided with comprehensive advice on how they
             may access medical and other support services post separation when the need
             arise;
         -   Provision of timely follow-up by the Services to ensure that any residual issues are
             quickly resolved.

24.   SPECIAL RATE PAYMENT: CATCH-UP 1998-2007

      That all rates of Veterans’ disability entitlements are adjusted by an amount which would
      fully restore them to the level they would have been had their indexation arrangements
      been adjusted when the Age/Service pensions were originally changed in 1997.

      Entitlements to recognize the increase in community standards since 1997.

In concluding, the State President noted the following:-

          South Australia, Rear Admiral Ken Doolan AO RAN (Retd) RSL National President, Major
          General David McLachlan, State President RSL Victoria, Hon Alan Griffin MP and Mrs
          Louise Markus MP for their attendance.

         Thanked the delegates for their healthy debate on agenda items.

         Noted the need for Sub-Branches to be compliant on tax issues, with the Constitution and
          relevant Acts.

         Congratulated the State Board and State Council on their deliberation in looking at a path
          ahead for the future of the RSL SA Branch.

         Acknowledged the work of Mrs Sam Jackman, CEO for 12 months, in addressing the future
          of the RSL SA Branch and the staff of State Branch whose dedicated work is often
          unnoticed.

         Thanked the Ladies of the Central Council of Women’s Auxiliaries and its Auxiliaries for their
          continued support of RSL projects and their Sub-Branches.

         The Combined Mess would be open at the conclusion of the Conference and thanked the
          volunteer staff of the Mess for providing this facility.
