ORDER ON MOTION TO QUASH
On May 3 2004 , non-par John Nokes filed a motion to quash a subpoena issued to Nokes on April 26 , 2004 requiring his appearance at the trial of the above-captioned matt scheduled to begin on May 4 2004. Complaint Counsel subsequently withdrew Nokes from their trial ,witness list and represented that they did not intend to call Nokes at tral. As Nokes testimony will no longer be required , Nokes
' motion is GRANTED.
