RESPONDENT' S MOTION FOR STAY OF PROCEEDINGS PENDING ACTION BY KENTUCKY TRANSPORTATION CABINET
Respondent Kentucky Household Goods Carriers Association , Inc. ("Kentucky
Association ) hereby moves the Commission for an Order pursuant to Section 3. 54(c) of
the Commission
s Rules of Practice ,
staying this proceeding pending the Commission
review of action by the Kentucky Transportation Cabinet with respect to Supplement No.
86 to Tariff KYDVR No. 5 on the following grounds: (I) since the time of entry of the
Initial Decision in this proceeding, the Kentucky Transportation
Cabinet .
("KTC" )
has
instituted procedures consistent with the statement of the law respecting State Action and
intrastate motor carier collective
adopted by Complaint Counsel ,
ratemaking contained in the Initial Decision and
notwithstanding the legal position of KTC and the
Kentucky Association that the conduct under review in this case satisfies the legal
standard articulated by the Supreme Court in Tiear and Mideal;
(2) KTC has suspended
No. 86 and scheduled a
proposed intrastate collective rates contained in Supplement
hearing with regard to said rates for February 28 , 2005; (3) Article VII of the Proposed
Order contained in the Initial Decision provides that the Order would be effective
pending a demonstration of " active
supervision "
by KTC , and such a demonstration is
made by the within Motion; and (3) the interests of fairness and justice require that
insofar as both KTC and the Kentucky Association have acted promptly to effect changes
in order to comply with the wishes of Complaint Counsel and the erroneous standards
described in the
Initial Decision (without prejudice
to the Kentucky Association
position on the merits in this procecding) these Respondents be spared the hardship and
exposure to future litigation expense which might result from the entry of an Order
against their interests in this proceeding.

On September 16, 2004, Ms. Sonia Sanders, Director of the KTC Motor
Carrier Division, convened a public meeting at the offices of KTC in Frankfort, KY, to
which ail Members of the Kentucky Association were invited (the September 16" Meeting"). Present at the Meeting were Director Sanders, KTC Administrative Specialist
William C. Debord (the KTC employee directly inwlved with the regulation of
. .
household goods carriers), KTC General Counsel Frank Miller, and KTC Deputy General Counsel Todd J. Shipp, Kentucky Association Counsel James C. McMahon, and approximately fifty (50) representatives of Kentucky Association Members including the undersigned.

The purpose of the September 1 6 ' ~ Meeting (which was anticipated and
referred to in the Kentucky Association's Reply Appeal Brief filed with the Commission in this proceeding, and joined in by Respondent KTC) was to address changes being

made in the KTC regulatory program to address the concerns voiced by Complaint Counsel and expressed by the Administrative Law Judge in the Initial Decision - - in the
hopes of, among other things, bringing about the dismissal of this proceeding.

During the course of the September 1 6 ' ~Meeting, KTC officials
announced a series of changes in current KTC Motor Carrier Division procedures relevant to the operations of household goods carriers (sometimes referred to herein as "Movers") and intrastate collective ratemaking procedures affecting Movers' Tariff rates.
These changes, which are described in a document entitled "Kentucky Household Goods Carriers Requirements," are a part of the Agenda for the September 1 6 ' ~ Meeting which is attached as Exhibit "B." Debord are as follows: (a) Commencing in 2005, Movers will be required to submit annual financial reperhin a form to be determined by the Division; Notice of a proposed tariff rate increase must be published in a newspaper of general circulation; In the event of a protest to a proposed Tariff rate, a hearing will be held; If there is no protest to a proposed Tariff rate, then a newly formed entity within KTC known as the "State Tariff Committee," whose proceedings and decisions will be fully documented based upon financial data and any other documentation submitted or requested by the "State Tariff Committee", will determine the reasonableness of the proposed Tariff rate; The requirements described by Director Sanders and Mr.

If it is determined by the State Tariff Committee that a Proposed Tariff change is appropriate then a written finding will be prepared; and If the proposed Tariff change is unjustified, the matter will be rejected with appropriate notice of the right to a hearing.

KTC distributed copies of various statutory and regulatory provisions
Meeting and pertaining to rates and tariffs which were discussed at the September 1 6 ' ~ are a part of Exhibit "B." 10. On August 30, 2004, KTC advised the Kentucky Association of the need
for household goods carriers to comply with the requirements of Kentucky law and KTC
Regulations respecting, among other things, (a) notification to competing household goods carriers and publication in a newspaper of general circulation of proposed household goods tariff rate increases filed with KTC; and (b) the re-institution of a KTC requirement that compels household goods carriers to submit an annual financial report to
KTC. Copies of the relevant KTC Regulations were included as part of the Notice; a
copy of the Notice is attached as Exhibit "C."

On September 1, 2004, the Kentucky Association caused to be filed with
KTC proposed Supplement No. 85 to KHGCA Tariff KYDVR No. 5 with an effective date of October 1, 2004. The proposed Supplement contained, among other things,
proposed adjustments in the charges of several Movers for local hourly rates and, in some cases, for intrastate rates. The requests for adjusted rates were supported by justification included on a Form 4268 which included notations regarding increases in insurance costs,
labor, equipment maintenance, and packing materials. A copy the Covering Letter &
Justification which accompanied Supplement No. 85 is attached as Exhibit "D"; Supplement No. 85 is attached as Exhibit "E"; a copy of the Newspaper Advertisement of the proposed tariff filing in the Louisville Courier-Journal on September 24, 2004 is attached as Exhibit "F."

In due course, on September 7, 2004, KTC advised the Kentucky
Association, and the Mover-participant in the Kentucky Association Tariff which was seeking a rate increase as part of the Supplement No. 85 filing, that it would be necessary for written justification to be submitted in support of the rate request. A copy of the KTC Letter demanding such rate justification is attached as Exhibit "G." When rate
justification documentation was not filed with KTC as demanded, that portion of
Supplement No. 85 seeking the rate increase was suspended by Order of KTC on
September 21 ,
2004 , with notice that a hearing will be scheduled upon submission of the

Administrate Regulation 601 KAR 1:050
Section 2 requires:
Section 2. Change in Existing Rates or Fares of Common Carriers and Irregular Route Common Carriers of Specific Commodities.
(I) All changes in any rate or fare shall be shown by the fi ling of a new tariff or supplement thereto , which tariff shall be in accordance with the requirements of 601 KAR 1:060. Notice of any change in any rate or fare shall be given in
accordance with 60 I KAR 1:070.
(2) An authorized carrier desiring to make a change in its existing intrastate fares rates or charges need not conform with the requirements of 601 KAR I :045 but shall file its application and exhibits in triplicate with the cabinet , such application to be in the form of a petition fied in accordance with the requirements of 60 I KAR I :030. The application shall contain the following information: (a) The applicant' s name and address;
jb) The type of service rendered;
- (c) A detailed statement including the reasons
why the change is necessary; and (d) A detailed statement of the change which is sought. (3) This part has been deleted for purpose of this document as it pertains to
passenger fares
(4) Any common carrier authorized to exclusively transport property desiring to effect a change in rates upon less than thirty (30) days ' notice to the cabinet shall not be required to comply with 60 I KAR I :050 unless requested , but shall
furnish in addition to the other requirements a statement or statements
containing such information that clearly sets forth the reasons for the proposed change upon less than thirty (30) days ' notice to the cabinet. (5) Any applicant may furnish other information in addition to that required by this administrative regulation as may appear useful to the cabinet in determining justification for the proposed change at the time the application is filed. (5) The cabinet may request any additional information as may be reasonable and usefuJ for its study of any case.
(3) Annual Financial Reports
KRS 281. 705 states that " the department (Dept of V ehicleRegulation) may prescribe uniform systems of accounts and the filing of reports by motor carrier. As discussed with your Association , this Division will be requiring the filing of an annual financial report by all motor carriers whose rates are regulated by this office. This will include household good certificate holders and certain passenger carriers. The present proposal is to require the same format as the old TC 95- 44- Annual financial report. That report was pattered after the Class 1I & IV report required by the Federal government (Old Interstate Commerce Commission). The annual report for the calendar year 2004 will be mailed by this offce and will be required to be filed by the certificate holders on or before April I , 2005.

Supplement # 85 to KHGCA Tariff, KYVR # 5 has been prepared in final format with an effective date of October 1 , 2004.
This supplement contains name changes of carriers, and deletion of carriers due to sale of certificates.
Several carriers have requested adjustments in their charges for local hourly rates, and in some cases, adjustments in intrastate rates. These requests for adjusted rates were supported by notations and comments on Form 4268 as to the need for adjusted rates, such as increases in insurance costs, labor, equipment maintenence and packing materials.
. would like to point out that there are requests for an exception to Item 185, fuel surcharge, that may need some attention. The exception on page 84-A, filed by Shadowens Moving/Storage, Inc., DVR 261, Brooks, KY., and on page 86for Lyn Moving & Storage, DVR 226, Brooks, KY. Tariif KYDVR#5 did not have suffcient justification. Your offce submitted partial justification prior to the proposed effected date , but this office. did not receive the data in time to conduct an in- depth review.

The Kentucky Household Goods Carriers Association, Inc. hereby submit for your consideration the attached Special Supplement No. 86. To sumarize, this supplement contain the following re-
quest:
Delete Item 185, Fuel Surcharge Delete Item 188, Insurance Related. Revenue surcharge Roll- in above surcharges (6% fuel plus 4% I. into the rates contained in Section II and VI for a net 10% increase. These surcharges will no longer apply to local moves. We will allow our members to adjust their local rate schedules to offset this charge, if they so choose. Request an additional 1% increase in Sections II and VI to offset the increase in the fuel costs since the June 15, 2004 approval of 6%. I have included a copy of the December 14 2004 S. Department of Energy Gasoline and Diesel Fuel Update which reflects the national U. S. average price of diesel fuel reported by this federal agency.

The Department is preparing an order suspending the increase unti can be obtained, A hearing has been scheduled for February 28, 2005 in Frankfort.
