11 TO AMEND SECTION 20-1-220, AS AMENDED, CODE OF
12 LAWS OF SOUTH CAROLINA, 1976, RELATING TO
13 MARRIAGE LICENSE APPLICATION REQUIREMENTS, SO
14 AS TO DELETE THE REQUIREMENT THAT THE
15 APPLICATION CONTAIN SOCIAL SECURITY NUMBERS
16 OR THE ALIEN IDENTIFICATION NUMBERS ASSIGNED TO
17 RESIDENT ALIENS WHO DO NOT HAVE SOCIAL
18 SECURITY NUMBERS.

20 Be it enacted by the General Assembly of the State of South
21 Carolina:

23 SECTION 1. Section 20-1-220 of the 1976 Code, as last amended
24 by Section 105, Part II, Act 100 of 1999, is further amended to
25 read:

27 “Section 20-1-220. No marriage license may be issued unless a
28 written application has been filed with the probate judge, or in
29 Darlington and Georgetown counties the clerk of court who issues
30 the license, at least twenty-four hours before the issuance of the
31 license. The application must be signed by both of the contracting
32 parties and shall contain the same information as required for the
33 issuing of the license including the social security numbers, or the
34 alien identification numbers assigned to resident aliens who do not
35 have social security numbers, of the contracting parties. The
36 license issued, in addition to other things required, must show the
37 hour and date of the filing of the application and the hour and date
38 of the issuance of the license. The application must be kept by the
39 probate judge or clerk of court as a permanent record in his office.
40 A probate judge or clerk of court issuing a license contrary to the
41 provisions, upon conviction, must be fined not more than one

1 hundred dollars or not less than twenty-five dollars, or imprisoned
2 for not more than thirty days or not less than ten days.”

4 SECTION 2. This act takes effect upon approval by the Governor.
