Where the job fits

The Compliance Sub-plan
The intent of the Compliance Sub-plan is to maximise the number of Australians who choose to
voluntarily comply with their tax obligations, and to implement strategies to deter
non-compliance.
Our overall approach to compliance is twofold. The first approach includes making it as easy as
possible for people to understand and meet their obligations. This involves helping people to
meet their obligations through, for example, rulings, marketing, education products and
responding to written and personal enquiries. The second approach to compliance involves risk
identification and resulting reviews, audits, investigations and prosecutions. This also includes
debt collection and lodgment enforcement.
Our current focus, as outlined in the updated compliance program, is on the following
compliance issues:
      tax agents and other intermediaries
      international tax issues
      aggressive tax planning
      evasion and serious fraud.

Additional compliance activities and challenges include:
    employer obligations
    small to medium enterprises
    capital gains tax
    leveraging through tax agents
    superannuation
    revenue laws.



Large Business and International
The Large Business and International business line administers the income tax system for large
business taxpayers and manages international issues and transactions on behalf of the ATO.
The business line aims to help large businesses by encouraging voluntary compliance by
providing assistance in relation to their tax obligations, and having processes in place to make
it easy to comply and keep compliance costs as low as possible.
We work closely with large business, their advisers and representative bodies to provide
certainty about their tax obligations and understanding of the tax system with a view to
encouraging voluntary compliance.

We have an active compliance program that includes risk assessments and audits to address
instances of potential non-compliance. We differentiate our risk stance based on our view of
the likelihood and consequences of potential non compliance. Taxpayers considered to present
a higher risk will face greater scrutiny.


Offshore Compliance Program

Offshore Compliance Program is a Tier 2 Project which has recently been extended. It was
established specially:
      to treat tax haven risks in the Individual and Micro markets;
      to establish and manage the Offshore Voluntary Disclosure Initiative launched by the
       Commissioner in July 2007; and
      to help build future Tax Office international tax technical active compliance capability.


The Government has also provided additional funding under the IT expansion and the
Compliance Executive has a high expectation of the results that this Project can to deliver.
Project deliverables and business outcomes include:
      The project focus is on consistency and quality in delivering a balanced program of
       active compliance case work carried out by dispersed teams (Brisbane, Newcastle and
       Moonee Ponds) on a National basis; and also co-ordinated national leadership via the
       cross business line Tax Haven Community of Practice which is helping to build
       future/sustainable international tax office technical capability.

The job

Job description
This position is available for permanent transfer at level. Applicants will also be considered for
higher duties where not enough suitable at level candidates are identified.
Managing the risk associated with tax havens is a high reputation risk for the ATO. Abusive
use of tax havens is included in ATO corporate plans and mentioned regularly in the public
domain by senior ATO leaders. Australia is playing a very active role internationally in
contributing to strategies which will attack the use of havens. Our active compliance work is
critical to identifying the risks that we face.
APS5 auditors are like to be required to:
      Undertake risk profiling, review and audit activity on high risk taxpayers who are
       suspected of concealing income and assets offshore.
      Conduct face to face meetings with taxpayers as required.
      Respond to voluntary disclosures made by taxpayers who have failed to declare
       offshore income, processing amendments and recording activities on Siebel
      Answer calls from taxpayers with questions about the assessability of offshore income
      Have sound time management and computer skills
      Take an active role in technical, operational and other activities
      Assist in developing and implementing strategies to ensure the achievement of planned
       objectives and required
      Participate in a range of staff development and training activities, including mentoring,
       coaching, the delivery of formal training and on-the-job training


Duty statement
Under general to limited direction, the occupants of these positions will undertake the following
duties:
      Risk profiling, review and audit activity on high risk taxpayers who are suspected of
       concealing income and assets offshore.
      Research, interpret and apply legislation and policy to resolve complex queries.
      Negotiate with taxpayers or their representatives on contentious issues (likely to include
       face to face contact).
      Be responsible as case owner in non complex matters or provide support to the primary
       case owner in other audits or reviews.
      Ability to identify/recognise matters requiring escalation and the ability to communicate
       and escalate those matters to the appropriate forum in a timely manner.
      Prepare unique correspondence and reports
      Managing working relationships with other BSL’s within the Tax Office especially Debt
       SNC and TPALS.
      Promote the use of Siebel and ensure compliance within the current quality framework.

      Duties are to be performed in accordance with the APS Code of Conduct, and
       upholding the APS and ATO values, to achieve results in line with the corporate mission
       and goals of the Australian Taxation Office.


Selection criteria
1. Technical knowledge and experience
      Ability to undertake reviews or audits and to assist in the resolution of complex issues
      Ability to understand, interpret and apply legislation, rulings, policy and guidelines and
       the ability to effectively communicate this knowledge verbally and in writing
      Qualifications gained in taxation, law, accounting, business, commerce or economics
       will be highly regarded

2. Financial principles and practices
      Understanding, or demonstrated ability to quickly acquire knowledge of financial work
       practices involving various business and commercial arrangements including the
       utilisation of multiple entities such as trusts, companies and partnerships

3. Relationship management and communication
      The ability to develop and maintain strong client relationships and to operate
       productively in a team environment.
      Well developed communication, negotiation and conflict resolution skills
      Sound interviewing skills, including active listening and assertiveness.

4. Research and analysis, judgement and decision making
      Research and analytical skills including the ability to identify issues and risks and assist
       in the resolution of complex issues
      Ability to apply sound judgment and effective decision making skills
      Sound investigative and evidence gathering techniques and the ability to identify where
       information is missing
