Pursuant to Rule of Practice
22(d), Complaint Counsel and Respondent &ealcomp n Ltd. ("Realcomp ) respectfully submit this Joint Motion for Extension to Answer Complaint Counsel' s Motions In Limine.
on May 18 , 2007. Pursuant to in limine
the Scheduling Order in this matter , Complaint Counsel served the motions by email. Due to email server problems , however , Complaint Counsel's email was not sent (according to Complaint Counsel' s server) until 5:36 p. m. Complaint Counsel also served hard copies of the pleadings via Federal Express.
Complaint Counsel filed three motions
Respondent' s email system showed the em ail sent at 5:46 p. , and due to the size of the email , Respondent had problems opening the files. Respondent received hard copies of the pleadings and was able to open the emailed files on May 21 2007.
Given the delay caused by these technical problems, Complaint Counsel and Respondent jointly move for an extension of time for Respondent to answer the motions in limine to May 31 , 2007.
