                            OFFICIAL PROCEEDINGS
                                  MAY 1, 2007

The Faribault County Board of Commissioners met in regular session at the Courthouse
in the City of Blue Earth at 9:00 a.m. on May 1, 2007. The following members were
present: Butch Erichsrud, Bill Groskreutz, Barb Steier, Tom Loveall, and Tom Warmka,
Commissioners. Auditor John Thompson and County Attorney Brian Roverud were also
present.

The meeting was called to order Chairman Warmka. The pledge of allegiance was
recited.

Groskreutz/Erichsrud motion carried unanimously to approve the synopsis and official
proceedings of the April 17, 2007 regular meeting.

Steier/Erichsrud motion carried unanimously to approve the agenda of May 1, 2007.

The calendar was updated. Committee reports were presented.

No member of the public appeared during public comment.

The FEMA Mitigation Plan and Region 9’s participation was discussed. The County
Attorney was directed to contact Region 9 to verify the status.

Veteran Services Officer Bryan Schultz met regarding office business.

Groskreutz/Erichsrud motion carried unanimously to approve the Veteran Services
Officer to attend the reintegration meeting at Camp McCoy.

Daryl Murray of the Faribault County Fair Board met to discuss repairs to the hog barn at
the fairgrounds. The condition of the hog barn has deteriorated over time. Two bids
have been received for the repair of the hog barn. Two quotes were received one for
$22,247.49 and the other for $20,000. The difference in the quotes was discussed. The
budget and financial statements were reviewed.

Steier/Loveall motion carried unanimously to pay $10,000 to the Fair Board for the repair
of the hog barn and to loan $10,000 to the Fair Board at 0% interest with payment set at
$2,000 per year for five years.

Planning and Zoning Technician Bruce Blakesley met regarding a conditional use permit
for Dean Johnson and Nicholas Johnson in Section 21 of Rome Township for a vehicle
dealers license and sales business.

Steier/Loveall motion carried unanimously to adopt Resolution 07-PZ2-17 granting a
conditional use permit to Dean Johnson / Nicholas Johnson for a Minnesota Vehicle
Dealer’s license and sales on an existing farmstead in Section 21 of Rome Township.
Commissioners Erichsrud, Groskreutz, Loveall, Steier, and Warmka voted yes.

                                 RESOLUTION

WHEREAS, Dean Johnson / Nicholas Johnson applied for a conditional use permit
         under the Faribault County Zoning Ordinance requesting a permit for a
         Minnesota vehicle dealer’s license and sales on an existing farmstead in
         the A-2 general agriculture district, located at the following descried
         property:

              The East Half (E ½) of the Southwest Quarter (SW ¼) of Section Twenty-
              one (21), Township One Hundred One (101) North, Range Twenty-six
              (26) West, Rome Township in Faribault County, Minnesota.

WHEREAS, the Planning Commission finds:

              a. That the conditional use will not be injurious to the use and enjoyment
                 of other property in the immediate vicinity for the purposes already
                 permitted, nor substantially diminish and impair property values
                 within the immediate vicinity, and is compatible with the existing
                 neighborhood;

              b. That the establishment of the conditional use will not impede the
                 normal and orderly development and improvement of surrounding
                 vacant property for uses predominant in the area and conforms to the
                 comprehensive land use plan of the county;

              c. That adequate utilities, access roads, drainage and other necessary
                 facilities have been or are being provided;

              d. The soils conditions are adequate to accommodate the proposed use;
                 and

              e. The use is of the same general character as other conditional uses in
                 the agriculture district and will not be detrimental to the general health
                 and welfare of the county;

              f. That proper facilities are provided which would eliminate any traffic
                 congestion or traffic hazard which may result from the proposed use.

NOW, THEREFORE BE IT RESOLVED the Faribault County Board of
         Commissioners approve the conditional use permit for Dean Johnson /
         Nicholas Johnson for a Minnesota vehicle dealer’s license and sales on an
         existing farmstead located in the A-2 general agriculture district with the
         following conditions:

              1. A maintenance fee of $50.00 shall be paid to the Zoning Office every
                 two years starting April 23, 2009.

              2. The conditional use permit is non-transferable.

Public Works Director John McDonald met regarding office business.

Loveall/Erichsrud motion carried unanimously to approve Resolution 07-RB3-18
sponsoring the application for funding to the State of Minnesota Department of Natural
Resources for maintenance and grooming of the snowmobile trails managed by Blue
Earth Snow Rovers, Stateliner’s Snowmobile Club, and Blue Earth River Trails.
Commissioners Erichsrud, Groskreutz, Loveall, Steier, and Warmka voted yes.

                                 RESOLUTION

BE IT RESOLVED that the County of Faribault act as the legal sponsor for an
           application for funding to the State of Minnesota Department of Natural
           Resources for maintenance and grooming of the snowmobile trails
           managed by Blue Earth Snow Rovers, Stateliner’s Snowmobile Club, and
           Blue Earth River Trails.

BE IT FURTHER RESOLVED that upon approval of its application by the State, the
           County of Faribault may enter into an agreement with the State of
           Minnesota for the above referenced project and that it will comply with all
           applicable laws and regulations as stated in the agreement.

BE IT FURTHER RESOLVED that John McDonald Director/Engineer of the Public
           Works Department and John Thompson County Auditor are authorized to
           sign such an agreement with the Department of Natural Resources.

BE IT FURTHER RESOLVED that John McDonald Director/Engineer of the Public
           Works Department is hereby authorized to serve as the fiscal agent for the
           above referenced project.

Groskreutz/Loveall motion carried unanimously to accept bid from Brunz Construction,
Co. for Project #22-621-21 replacing Bridge 9985 on CSAH 21 in Minnesota Lake
Township in the amount of $1,518,083.13. Other bids received were $1,542,351.98 from
Mathiowetz Construction; $1,660,459.16 from Freeborn Construction; and $2,001,214.20
from Rognes Brothers.

Steier/Erichsrud motion carried unanimously to reappoint Public                   Works
Director/Engineer John McDonald to a four year term ending April 30, 2011.

Groskreutz/Loveall motion carried unanimously to approve request of S. Robbins to
attend a three day MN Assoc. of Assessing Officers conference in St. Cloud; S. Wiltse to
attend a four day Minnesota Counties Computer Cooperative annual conference in
Alexandria; A. Seifert to attend a two day Drug Interdiction class in Fairmont.

Groskreutz/Erichsrud motion carried unanimously to approve Resolution 07-CB-19 a
signature resolution relating to Huntley Sewer Service District. Commissioners
Erichsrud, Groskreutz, Loveall, Steier, and Warmka voted yes.

                                 RESOLUTION

BE IT RESOLVED, that Tom Warmka, Chairman of the Faribault County Board of
           Commissioners, and John Thompson, County Auditor or their successors
           in office, are hereby authorized to execute documents relating to Huntley
           Sewer Service District, as are necessary to implement the wastewater
           project on behalf of the applicant. In the event of disability or resignation
           or other absence of either such officers, documents may be signed by the
           manual signature of that officer who may act on behalf of such absent or
           disabled officer. In case either such officer whose signature shall appear
           on the documents shall cease to be such officer before delivery of the
           documents, such signature shall nevertheless be valid and sufficient for all
           purposes, the same as if he or she had remained in office until delivery.

Groskreutz/Steier motion carried unanimously to approve applications for reduction in
valuation of real estate and/or refund of taxes paid of $366.00 for Paul Amundson on
Parcel No. 21-200-9710 in the City of Blue Earth and $1,503.88 for Kurt Sylvara on
Parcel No. 17-019-0500 in Seely Township.

Discussion was held regarding the Law Enforcement Center plat.

Steier/Erichsrud motion carried to accept changes in the Faribault County Law
Enforcement plat submitted to City of Blue Earth to include a 66 foot wide road easement
on the east parcel boundary, but not to grade the proposed road on the north as part of the
plat, and to retain naming rights on the unnamed street dedication. County Auditor was
also directed to send notification to City of Blue Earth that while the County accepted
these changes it also urged the City Council to reconsider the need to include these
changes. Groskreutz and Warmka voted no.

Steier/Groskreutz motion carried unanimously to close the meeting to discuss Law
Enforcement Labor Services (LELS) labor negotiations. Present were: Commissioners
Erichsrud, Groskreutz, Loveall, Steier, and Warmka; County Auditor John Thompson;
County Attorney Brian Roverud; and Personnel Director Brenda Ripley.

Meeting was re-opened.

Loveall/Steier motion carried unanimously to approve a labor agreement with Law
Enforcement Labor Services (LELS) for 2007-2009.

Steier/Groskreutz motion carried unanimously to approve a paid time off plan for the
non-union personnel effective May 1, 2007.

Groskreutz/Steier motion carried unanimously to pay bills totaling $94,367.24 as follows:
