MINUTES SPECIAL MEETING OF THE CAYUGA COUNTY LEGISLATURE THURSDAY, SEPTEMBER 8TH, 2005, 6:30 PM LEGISLATIVE CHAMBERS CAYUGA COUNTY OFFICE BUILDING Meeting called to order by Hon. Herbert Marshall 6:30PM all Legislator’s present except Mitchell and Tortorici, absent. Reports of Death: Edward L. Lauckern, Jr. former Deputy Director of County Veteran’s Office, two term Auburn Mayor, Media Consultant and area civil leader. Bernie Smith asked Herbert Marshall to remove the tax on gasoline, Herb County can not do that it must be done by the State. Herbert Marshall: Second Circuit Court will not hear case of the Cayuga Nation again, they can appeal to the Supreme Court. Fearon, We will discuss gas tax at the Ways & Means Meeting. RESOLUTIONS RESOLUTION NO. 427-05 AUTHORIZE THE AMENDMENT OF THE 2005 ORDER OF PROTECTION UNIT OPERATING BUDGET TO ACCOMMODATE FUNDS PROVIDED BY THE FEDERAL GRANT PROGRAM BY: MR. STEVEN NETTI, Chairman, Judicial & Public Safety Committee Mr. David Pappert, Chairman, Ways & Means Committee WHEREAS, the Cayuga County Sheriff was awarded a Grant from the United States Department of Justice to Encourage Arrest Policies and Enforcement of Orders of Protection through 2005; and WHEREAS, The Sheriff continues to administer that program through the Order of Protection Unit under Cayuga County Budge number 3112; and WHEREAS, that program has had an extension approved through September 30, 2005; and WHEREAS, in order to continue the maintenance of the program it has become necessary to make modifications to the County operating budget to accept federal money remaining available to the program; NOW THEREFORE BE IT RESOLVED, that the Cayuga County Treasurer is hereby authorized and directed to amend the Order of Protection Unit’s operating budget as follows: Increase 4322.000.000-A Federal Aid OOP Unit …………………………………….$55,000.00 Increase 3112.200.000-A Equipment …………………………………………………$25,000.00 Increase 3112.400.059-A Professional Services ………………………………………$30,000.00 and Be It Further RESOLVED, that the Cayuga County Treasurer make the necessary journal and accounting entries to accomplish the forgoing pursuant to the policies and procedures of the County of Cayuga. RESOLUTION NO. 428-05 AWARDING AND ACCEPTING BIDS FOR RENOVATIONS FOR THE PUBLIC SAFETY BUILDING FOR CAYUGA COUNTY AND ESTABLISHING A CONSTRUCTION CONTINGENCY COMMITTEE BY: MR. STEVEN NETTI, Chairman, Judicial & Public Safety Committee BY: MR. DAVID PAPPERT, Chairman, Ways & Means Committee WHEREAS, the Clerk of the Cayuga County Legislature was previously authorized by resolution No. 366-05 to advertise and receive bids for the renovations for the Cayuga County Public Safety Building; and WHEREAS, several proposals were received for each of the four phases of the project; and WHEREAS, the lowest bids of said renovations are as follows: General Construction Work…………Bellows Construction Specialties $ 34,364.00 HVAC Work………………………… Siracusa Mechanical, Inc. 27,857.00 Electrical Work……………………….Blackmon-Farrell Electric, Inc 11,800.00 Roofing Work…………………………J&B Installations, Inc. 292,000.00 Total $366,021.00 And; WHEREAS, due to the short construction season and the need to respond quickly, it is recommended that the Legislature approve a 5% construction contingency in advance of construction and establish a construction contingency committee to review change orders; and WHEREAS, a 5% contingency amounts to $18,300.00 and the cost of the Architect fees for Beardsley Design of $49,500.00, per resolution 366-05, would bring the project total to $433,821.00; and WHEREAS, the County Legislature authorized Capital H Project No. 05-01 to pay for the costs of said renovations in an amount not to exceed; $450,500.00; now therefore be it RESOLVED, that the Cayuga County Legislature hereby award the bids as follows; General Construction Work………Bellows Construction Specialties $ 34,364.00 HVAC Work………………………… Siracusa Mechanical, Inc. 27,857.00 Electrical Work……………………….Blackmon-Farrell Electric, Inc 11,800.00 Roofing Work…………………………J&B Installations, Inc. 292,000.00 Total $366,021.00 And be it further, RESOLVED, that a construction contingency be created in the amount of $18,300.00 and that a construction contingency committee comprised of Chairman of the Cayuga Legislature, Chairman of the Judicial and Public Safety and the Chairman of the Ways and Means Committee, together with Richard Evans be established to review and approve change order requests; and be it further RESOLVED, that the Chairman of the County Legislature is hereby authorized to sign any agreements necessary to carry out the intent of this resolution; and be it further RESOLVED, that the Legislature be advised at its next meeting of any changes; and be it further RESOLVED, that the County Treasurer make the journal and accounting entries necessary to accomplish the foregoing. Mr. Catto: His Resolution Fixing Day and Notice of Public Hearing on a Local Law Establishing the Office of County Manager for Cayuga County. He would like a real County Manager, to be put before a Public Referendum. Motion by Lockwood to table resolution, approved by roll call vote, Ayes to table Petrus, Palermo, Dudley, Lockwood, Sedor, Fearon, Cuddeback, Pappert, DeRosa, Netti. Noes, Catto, Lepak, Marshall, Absent Mitchell, Tortorici. (10/3/2) Mr. Catto would like a special meeting. Mr. Fearon is in total support. Ms. Petrus to Mr. Catto you did not present idea to Government Operations. Mr. Mitchell, we have had four referendums all defeated. Mr. Pappert, choice, current form of Government or dress up administrator. Mr. Marshall, it has already been tabled. Motion by Ann Petrus to close 7:10 PM, approved by voice vote, all voting aye.
