    FARMERS & ARTISTS MARKETPLACE BY THE LAKE RULES
                      2010 SEASON
   The mission of the Springfield Township Farmers Marketplace by the Lake is to provide a dynamic Market to
    benefit the Greater Springfield Township community and Marketplace customers and vendors.
   We operate to improve the production and marketing of local agricultural and artisan products and to
    stimulate public interest and education through local food and art.

RULES & REGULATIONS
The Rules and Regulations of the Springfield Township Farmers Marketplace by the Lake are established to maintain a standard that
will make the Marketplace enjoyable and profitable to all. Vendors must read and abide by the Annual Rules and Regulations of the
Marketplace. Any vendor who does not follow the Rules and Regulations of the Market may be asked to leave and may lose any
further privileges at the Marketplace.
         *The Marketplace by the Lake is an outlet for farmers, food processors and food concessionaires to sell their wares directly to
         the public. All products must be grown, raised, produced and gathered by the vendor in the State of Ohio.
         *The Marketplace by the Lake is an outlet for artists to display and sell their new, handmade, and unique artwork upon
         application approval by the Marketplace Committee.
         *The Marketplace is an outlet for homebased businesses to display and sell their new products upon application approval by
         the Marketplace Committee.
         *The Marketplace by the Lake is an outlet for area musicians and artists to perform for the enjoyment of the public. An area
         will be set-aside at the Market for this purpose after the end of the Summer Concert Series. All performers and musicians
         must register each week to be a part of the Market activities. Call 330-414-7438.

LOCATION, DAYS, AND HOURS
The Farmers Market will be open every Friday beginning on June 11, 2010. The Market will be open through October 2010 depending
on the growing season.
     1. The market is open from 5:30 pm until 9:00 pm (hours may be adjusted as Fall approaches). There are no sales prior to 5:30
     2. Vendors may arrive at 5:00 pm on sale days.
     3. All vendors must be prepared to stay until the market closes. No in and outs permitted. No early booth break down or early
         departures. (Again, hours will be adjusted as Fall approaches).
     4. All vendors must be registered.
     5. All set up must be done by 5:15 pm. All venders arriving late or not set up in time may be refused participation that day.

APPLICATION AND FEES:
   1. Farmer and homemade product vendors’ application fee is $25 for the entire season.
   2. Artists application fee is $10 with an additional $10 for every week of participation. Application fee will be due after juried
      approval of your application. *(See #5 below.) The weekly checks will be collected each Friday or $100 may be paid for
      the entire season.
   3. Homebased business fee is $25 with an additional $25 for every week of participation. Application fee will be due after
      juried approval of your application. *(See #5 below.) The weekly checks will be collected each Friday or $250 may be
      paid for the entire season.
   4. The above referenced fees are payable by check only. Make all checks payable to Springfield Township and return to:

APPLICATION JURIED APPROVAL:
   * 5. All artists and homebased business art and products will be subject to approval by the Marketplace Committee. Only pre-
        approved art objects, items or products will be permitted to be sold at the Marketplace.

ARTISTS GUIDELINES AND APPLICATION
Guidelines For Entry: Artists must be juried to participate in the Springfield Township Farmers & Artists Marketplace and should
have a working email address. Contact Teri Fretz (see below) to make arrangements for jurying. You need only submit your work for
jurying in your first year with us, unless you start a significantly different style or medium.

Once accepted by the Marketplace, artists may participate for the remainder of the season and need not re-apply until the next season.

pictures and you will be notified within 3 days if your application is approved. The Committee may ask for additional pictures if
necessary. All decisions are final.

Criteria for Selection:
     Preference will be given to unique, handcrafted artwork or uncommon media in the context of an open-air market.
     Please do not submit pre-fabricated, commercially purchased work.

HOMEBASED BUSINESSS GUIDELINES AND APPLICATION

     Only businesses selling new products will be considered.

ATTENDENCE AND SPACE ASSIGNMENTS:
   1. If a vendor is unable to attend a sale, please notify Teri Fretz (330-414-7438) no later than the Monday prior to the sale day.
      This allows the space to be filled by an alternate.
   2. Space does not include tables, chairs, tent, canopy, or electricity; this is the vendor’s responsibility.
   3. All tents or canopies must be weighted and/or tethered for safety purposes.
   4. The Market Manager reserves the right to place vendors in different locations to provide the best possible market diversity.

LICENSES, SIGNS, LAWS:
   1. Vendors must have signs on their tables identifying their farm or business. These signs must not intrude into the walkway.
        Vendors are to set their own prices.
   2. It is the vendor’s responsibility to obtain all the licenses and permits, and to pay the fees required by local and state
        governments. This includes the vendor’s license for goods sold for which a sales tax must be collected.

    3. Scales should be capable of approval by the Summit County Weights and Measures at 311.
    4. Vendors must comply with all laws, ordinances, and regulations of the United States, State of Ohio, and Springfield Township
         (which uses the Summit County Health Department regulations and inspectors).
    5. Vendors are to clean their areas – remove all produce, containers, signs, and trash at the end of the day or when they leave.
    6. Vendors are encouraged to assist the Market Managers in promoting the market.

VENDOR PARKING:
Vendors must unload their product for sale at their assigned spaces. The vendor entrance, as well as the community entrance, will be
through the main entrance from Canfield Road. All vendors must be unloaded by 5:15 pm. There is parking in the Town Hall lot
directly across from the Marketplace or down the road, as there is no parking on the lawn at the Park.

SUMMIT COUNTY REQUIREMENTS:
   1. All vendors selling edible items are registered with the Summit County Department of Health. Approval by the Health
       Department is required prior to selling any edible items. The Market Manager will notify the vendor if there are any
       problems.
   2. Vendors selling items on which sales tax is collected must have a proper vendor’s license from Summit County Auditor’s
       Office (330) 725-9755. Your vendor license must be displayed if you are collecting sales tax.

AVAILABLE PRODUCTS:
Springfield Township has the right to monitor the products that are for sale by vendors and restrict the sale of items that do not meet
the mission of the market.
    1. All products labeled certified organic must be certified by an accredited organization in accordance with the rules of the
         National Organic Program.
    2. Flowers, plants, bulbs, and/or seed must be from locally grown production.
    3. All edible products sold at the market must be grown in Ohio or made from Ohio grown ingredients. Local producers and
         those outside of the northeast Ohio area are welcome.
    4. Any dispute concerning products must be appealed in person or in writing to the Market Manager.

CODE OF CONDUCT
The Market Manager or Representative of the Springfield Township Farmers and Artists Marketplace has the right to remove any
vendor whose conduct is disruptive or harmful to the integrity of the Marketplace customers, staff and other vendors. Disruptive or
harmful behavior can be described as an act of assault, abusive language, fighting and acting in an unprofessional manner. If a
vendor’s behavior is negatively affecting the market atmosphere or reputation, they also may be removed. Also, misrepresentation of
products sold at the market shall be considered cause for dismissal from the Market.

PROOF OF INSURANCE:
Springfield Township requires vendors to have specific proof of insurance, certificates of liability, or insurance coverage of a
minimum amount. Springfield Township is not responsible for any damage, loss, injury, harm, theft, or altercation that may occur
before, during, or after the hours of the market. Vendors take full responsibility for any and all liability for any such occurrence.
Liability of Springfield Township is strictly limited to Township employees, staff members, and proper maintenance of Township
park grounds.

AGREEMENT:
                   SPRINGFIELD TOWNSHIP FARMERS & ARTISTS MARKETPLACE BY THE LAKE
                            INDEMNIFICATION AND HOLD HARMLESS AGREEMENT


THE MARKETPLACE VENDOR PARTICIPANT NAMED BELOW SHALL indemnify and hold Springfield Township and its
Trustees, agents, employees, and/or officers, harmless from and shall process and defend at its own expense any and all claims,
demands, suits, at law or equity, actions, penalties, loss, damages, or costs, of whatsoever kind or nature, brought against Springfield
Township arising out of, or in connection with, or incident to, their participation (or the MARKET VENDOR PARTICIPANT'S
agents, employees, officers, or volunteers) at the SPRINGFIELD TOWNSHIP FARMERS & ARTISTS MARKETPLACE, and/or the
MARKETPLACE VENDOR PARTICIPANT'S performance or failure to perform in a manner consistent with Springfield Township
facility rules and regulations, following Springfield Township staff instructions, or any actions while at the SPRINGFIELD
TOWNSHIP FARMERS & ARTISTS MARKETPLACE; provided, however, that if such claims are caused by or result from the
concurrent negligence of the Springfield Township, its agents, employees, and/or officers, this indemnity provisions shall be valid and
enforceable only to the extent of the negligence of the MARKETPLACE VENDOR PARTICIPANT; and provided further, that
nothing herein shall require the MARKETPLACE VENDOR PARTICIPANT to hold harmless or defend Springfield Township, its
agents, employees, and/or officers for damages or loss caused by the Township's sole negligence. The MARKETPLACE VENDOR
PARTICIPANT expressly agrees that the indemnification provided herein constitutes the contractor's waiver of immunity, for the
purposes of this Indemnification and SPRINGFIELD TOWNSHIP FARMERS & ARTISTS MARKETPLACE participation if the
MARKETPLACE VENDOR PARTICIPANT is any type of business entity, whether for profit or not for profit. No MARKET
VENDOR PARTICIPANT is an employee, agent or volunteer of Springfield Township for this SPRINGFIELD TOWNSHIP
FARMERS & ARTISTS MARKETPLACE ACTIVITY, all are independent vendors.

PHOTO/VIDEO RELEASE: I the undersigned MARKETPLACE VENDOR PARTICIPANT and/or any representative of my
SPRINGFIELD TOWNSHIP FARMERS & ARTISTE MARKETPLACE participation, give permission to have photos/video tapes
taken without compensation, during Springfield Township activities and used for publicity purposes in any manner by the Township.
The Artist grants the Market permission to use information and photos that the Artist has submitted, and any photos taken while
exhibiting at the Market, in ads, print and webbased guides distributed to the public for the purpose of promoting both the Market and
Artist.

PARTICIPANTS BRINGING ANIMALS ON SITE AS PART OF BOOTH/PRODUCT: MARKETPLACE VENDOR
PARTICPANT expressly agrees to hold Springfield Township harmless as described above for all incidents involving any behavior
from the animals they bring onto Township property regardless of whether the animal was provoked, injured, died, or from any
actions whatsoever that bring a claim or lawsuit against the Township. The MARKETPLACE VENDOR PARTICIPANT is solely
responsible for the actions of the animals they or their agents have brought onto Township property and will reimburse the CITY for
any damages to Township property ensuing from those animal's actions. The MARKETPLACE VENDOR PARTICPANT agrees that
Township staff has the sole determination in whether any animal may stay or must vacate Township property immediately upon such
Township staff verbal notification to MARKETPLACE VENDOR PARTICIPANT. Safety of the general public is the first concern of
the Township and any decision of Township staff to have an animal removed from Township property is the final and sole
determination. If MARKETPLACE VENDOR PARTICIPANT does not immediately remove an animal upon Township staff
notification, the Township police will be notified to do so. I/we fully understand and agree to abide by the listed Rules & Regulations
of the Springfield Township Farmers & Artists Marketplace and the above Hold Harmless Agreement, a copy of which I/we
acknowledge having received.
