					                   Vermont Business Solar Energy Tax Credit Certification Application
                                                           Form 1A
As required by Act 159, 2010 the Vermont Clean Energy Development Board (CEDB ) shall certify to the Vermont
Department of Taxes the amount of Business Solar Energy Tax Credits for 2010. To accomplish this task,
taxpayers that seek to take tax credits must submit an application form to determine their eligibility. Please
provide the following information and submit the appropriate form to:

NOTICE: A taxpayer who has received any grants or similar funding from the Clean Energy Development Fund is
not eligible to claim the business solar energy tax credit for that project under this program (32 VSA §5930z). The
final amount of any solar energy tax credit certified under this section shall not exceed the amount awarded to the
taxpayer under 26 USC §48. Certificates for Credits are issued on a first come, first served basis. Based on the
number of applications, the taxpayer may be denied the full amount or any credits for 2010.



Application Instructions

Select the Correct Form:
►Form 1A           If you are applying prior to July 16, 2010 for Business Solar Energy Tax Credits for a Solar
(prior to July 16, Energy Plant that has, or will be, installed and commissioned after January 1, 2010, and for
2010)              which a CPG has been (or will be) applied for on or before July 15th, 2010 (if a CPG is required)
                   complete Form 1A. You will also need to list the names and social security numbers for
                   those taxpayers wishing to claim the tax credit on the confidential taxpayer information
                   form.
►Form 1B           If you are applying after July 15th, 2010 for Business Solar Energy Tax Credits for a Solar
(After July 15, Energy Plant that has a rated capacity of 150kW of less (for photovoltaic systems), and has
2010)              been, or will be, installed between January 1, 2010 and December 31, 2010, then complete
                   Form 1B. You will also need to list the names and social security numbers for those
                   taxpayers wishing to claim the tax credit on the confidential taxpayer information form.

Instructions for Form 1A:
Contact Information
Line 1:          Provide the name of the business entity and the Employer Identification Number.
Line 2:            Check the box for the type of the business (partnership, S Corp, C Corp, LLC, Sole
                   Proprietorship).
Lines 3&4:         Enter the business address.
Line 5:            Identify the contact person for the business, a daytime phone number and email address.
Eligibility
                   The term “investment” refers here to the basis amount for calculating the federal investment tax
                   credit for solar energy property as defined under 26 USC § 48.
                   The date of investment is the date on which the solar property is commissioned. Please note that
                   Vermont law requires a reduction in the calculated investment when an energy property is
                   commissioned after October 1, 2009. In those cases, the basis must be reduced by any grants or
                   similar funding from any public or private sources.

                   Criterion
           Line 6: If the "investment" for which the solar energy tax credit was, or will be, made after January 1,
                   2010, check "yes". If the "investment" was made prior to January 1, 2010, check "no". To
                   receive the tax credit the solar energy plant must be commissioned before September 1, 2011
                   for non-net metered photovoltaic systems and prior to December 31, 2010 for all other systems.
           Line 7: 26 USC §48(a)(3)(A)(i) defines "energy property" as "any property which is equipment which
                   uses solar energy to generate electricity, to heat or cool (or provide hot water for use in) a
                   structure, or to provide solar process heat, excepting property used to generate energy for the
                   purposes of heating a swimming pool ." If the investment pertains to a system that constitutes
                   "energy property" as defined under this section, check "yes". If the system does not meet this
                   definition, check "no".

           Line 8: If the solar energy plant has a plant capacity of 2.2 MW or less, check "yes". For any solar
                   energy plant with a capacity larger than 2.2 MW, check "no".
           Line 9: If the business submitted (or will submit) a complete petition with the Vermont Public Service
                   Board for a Certificate of Public Good (CPG) under 30 VSA 248 on or before July 15, 2010,
                   check "yes". If a complete petition was not filed by July 15, 2010, check "no".
          Line 10: If the solar energy plant does not require a CPG then mark "yes". If the plant does require a
                   CPG then mark "no". Examples of systems that would not require a CPG are solar thermal
                   systems and off-grid systems.


Additional Information
       Line 11: For Solar Photovoltaics : Enter the size of the Solar Energy Plant (kW, AC rating).
       Line 12: For Solar Thermal : Enter the expected annual production of the Solar Thermal Energy System
                (MMBtus).
       Line 13: Enter the date that the a petition for a Certificate of Public Good was filed with the Vermont
                Public Service Board (or the date it will be filed), and the CPG Docket Number, if one has been
                issued.
       Line 14: Enter the date that the Vermont Public Service Board (PSB) issued the Certificate of Public
                Good, and the CPG Docket Number.
       Line 14: Enter the date the Certificate of Public Good was issued by the PSB, if one has been issued.

          Line 15: Enter the date the system was/will be commissioned.

Tax Credit Estimation
       Line 16: Check the box for all sources of funding that apply. NOTICE: Any taxpayer who has received any
                grant or similar funding from the Vermont Clean Energy Development Fund (e.g., incentive
                payment from the Small-Scale Renewable Energy Incentive Program) is not eligible to claim the
                business solar energy tax credit for that project.
        Line 17: Enter the amount of grants and other similar funding not from CEDF. NOTICE: Any tax credit will
                 only apply to project costs not covered by any grants or similar funding from any public or private
                 program that assists in providing capital investment for a renewable energy project.

        Line 18: Enter the total actual project costs. This value must be based on the Federal credit calculated via
                 IRS Form 3468.

        Line 19: Subtract Line 17 from Line 18 and enter the total amount eligible for the Vt. Business Solar
                 Energy Tax Credit here.
        Line 20: Enter the anticipated or known Federal Tax Credit. The Vermont Business Solar Energy Tax
                 Credit shall not exceed the amount of the Federal Tax Credit. Note: The taxpayer who has
                 received grants or other similar funding from public or private programs that assist in providing
                 capital investment for renewable energy projects will need to recompute their credit and submit,
                 or be ready to submit if asked, a pro forma federal IRS-3468. Those taxpayers submitting an
                 estimated and expected Federal tax credit will still need to submit standard Federal forms.

       Line 22: Enter the title for the person signing the form and the date.


Note:

The CEDF is not required to provide the full amount of the Vermont Business Solar Tax credit that is applied for.
Rather, the amount, if any, will be based on the known and estimated costs . If a project has been commissioned,
the total costs will be known, and this is the basis for federal tax credit. Those projects still under development that
submit estimated costs will have their tax credits, if any, based upon their estimates, and upon a first come, first
served basis. In no case shall the Vermont tax credit exceed the Federal credit.

This form is for Vermont taxpayers seeking to claim the Vermont Solar Business Tax Credit for 2010 or 2011. Information on this form is considered public
domain and will be used to determine the applicant's eligibility for the Vermont Business Solar Tax Credit. See the Instructions for this form, then complete
the following information and submit this form to the Clean Energy Development Fund by 4:00 p.m. July 15, 2010 to be considered for 2010 VT Business
Solar Tax Credits.

The final amount of any solar energy tax credit certified under this section shall not exceed the amount awarded to the taxpayer under 26 USC §48, and may
be less, or none at all, based on a first come, first serve basis.

                                                      Taxpayer Information



           The Vermont Business Solar Energy Tax Credit, as revised in Act 159 (32 VSA §5930z), state that the Vermont Clean Energy
          Development Fund (CEDF) Board must certify eligible solar energy tax credits to the Vermont Department of Taxes. To do so,
          the CEDF must provide the names and taxpayer identification numbers of individual taxpayers involved with a Solar Energy
          Plant (e.g., investors, owners) to the Vermont Department of Taxes. The information provided to the CEDF on this form shall
