Lady Gaga's "Poker Face" (Interscope/Universal) racks up a 12th week atop European Hot 100 Singles. The Depeche Mode album spends a third week at the top of the German, Swiss and Hungarian charts and adds a No. 1 debut in Greece, but is down 1-5 in Sweden, 1-2 in Italy and 12-22 in the United Kingdom. It's up 4-2 in France and holds at No. 2 in Austria and the Belgian region of Wallony. That collective performance keeps "Universe" ahead of the Dylan set, which tops the U.K. bestsellers for a second week (with 28,000 sales for a two-week total of 70,000) and moves 2-1 in Sweden. It's down 1-3 in Denmark, 15 in Austria, 2-3 in Norway, 2-4 in Switzerland, 2-6 in Germany, 3-5 in Flanders and 6-9 in Italy, but holds at No. 2 in Ireland. Lady Gaga is at No. 3 on the aggregate chart again with "The Fame," after moving 3-2 in the United Kingdom and Switzerland, 4-3 in Germany, 5-4 in Austria and holding at No. 3 in Ireland. Pink's "Funhouse" (LaFace/Sony Music Entertainment) continues its robust European run, climbing 6-4 in its 28th week on Top 100 Albums. It makes that same move in the United Kingdom, adding another 20,000 sales, and holds at No. 4 in Ireland. U2 and Beyoncé are each down another rung, with "No Line on the Horizon" (Mercury/Universal)" at No. 5 and "I Am... Sasha Fierce" (Columbia/Sony Music Entertainment) at No. 6. The highest new entry on the pan-European album chart is Michael Hirte's "Der Mann Mit Der Mundharmonika 2" (Columbia/Sony Music Entertainment) at No. 7. The harmonica-playing graduate of German TV's "Das Supertalent" last year is new at No. 1 in Austria and No. 2 in Germany with the swift follow-up to his first album from the turn of the year. Lily Allen's "It's Not You It's Me" (Regal/Parlophone/EMI) is back in the Europe-wide top ten, climbing 13-8 as it improves 5-3 in the United Kingdom. The sophomore set debuted at No. 2 overall in February and spent its first three weeks in the collective top ten. Rounding out the BILLBOARD.BIZ BULLETIN PAGE 3 OF 7 [IN BRIEF] P2P STUDY QUESTIONS LONG TAIL U.K. authors' and composers' collecting society PRS for Music has published a report showing new research into file-sharing over a 12-month period that casts doubt on the long tail theory. Will Page, chief economist at PRS for Music, teamed up with industry analyst Eric Garland of BigChampagne to publish the paper "The Long Tail of P2P." The original theory was proposed by Chris Anderson in Wired magazine in 2004 and expanded in the book "The Long Tail: Why the Future of Business Is Selling Less of More." The Page and Garland' research involved analysis of billions of swaps on a 12-month global filesharing data set and - in contrast to the long-tail theory - they found "a very hit-heavy, skinny tail profile" where 95% of the inventory accounted for only 20% of swaps on P2P. They also contend that P2P activity mirrors the legal download market to some extent. "What continues to fascinate me about our prior Radiohead 'In Rainbows, On Torrents' study was the simple fact that after proving popular on torrents, 'In Rainbows' also proved popular in legal markets and even reached No. 1 on iTunes," said Page. "This study helps explain that phenomenon, and allows PRS for Music to understand an illegal digital market for music that's been with us for longer and is far larger than the legal one. By doing so, it helps move the PRS for Music forward with the challenge of monetizing it on behalf of our songwriters." Eric Garland, chief executive at BigChampagne, added: "There are many broad and pronounced differences between file-sharing networks and the local record shop, or iTunes store. But the most popular artists, albums and songs tend to dominate the charts everywhere. BigChampagne has yet to see a big hit or wildly popular release in the pirate market that was not also a top seller in the licensed market." "The Long Tail of P2P" was launched at the Great Escape music convention in Brighton yesterday (May 14) and is available at prsformusic.com/economics to download. The report states that on average the most popular files were swapped over 14 million times over that one-year period. And the most swapped files were also the most downloaded on legal music sites. More than 13 million unique files found at least one swap via P2P, according to the research. Success in the courts against piracy has not dampened illegal P2P activity either, the report says. Despite the conviction against the Pirate Bay operators in Sweden last month, Lady GaGa's "The Fame" was downloaded 388,000 times in the last week of April 2009 alone. —Andre Paine, London don's Royal Albert Hall - also played host to two of the legendary Three Tenors, Plácido Domingo and José Carreras. Domingo performed in the first half with Welsh soprano Katherine Jenkins, (who was nominated for best album). Carreras closed the show with a rendition of Eldo Di Lázaro's "Chitarra Romana." Pro-forma revenue is used because BMG had not yet been acquired from Bertelsmann in Q4 2007. The division's pro-forma revenue for Q4 was $654 million, down 3% on a U.S. dollar basis. According to Nielsen SoundScan, SME had a 26.7% share of the U.S. album market through the end of March 2009, a solid increase over its 21.5% share in the same period the previous year. Through March, SME's share of U.S. track shares was 23.3%. That is a slight drop from the 24.4% logged by Sony BMG in the period during 2008. Parent company Sony Corp lost $1 billion in fiscal 2008. —Glenn Peoples, Nashville ANALYSIS: TICKETMASTER SURVIVING WITHOUT LIVE NATION BUT OTHER ISSUES REMAIN Ticketmaster’s Q1 2009 earnings release on Tuesday saw the company being impacted by the loss of Live Nation ticketing volume, the Bruce Springsteen ticketing fiasco in New Jersey and the proposed merger with Live Nation. Like many other companies in the entertainment world, Ticketmaster praises its long-term strategy of acquisitions, synergies and cost-cutting. And like many other entertainment companies attempting to lure cashconscious consumers, Ticketmaster can point to middling results rather than clear-cut successes. This was Ticketmaster’s first quarter since Live Nation contracts began to expire and the concert promotion giant began selling its own tickets in January. With the loss of Live Nation, Ticketmaster’s ticket volume was down 6% and the value of those tickets was down 7%. Those losses from Live Nation took away $8 million from Ticketmaster’s profits, which fell 78% to $7.2 million on $373.8 million in revenues (a 7% increase). The company said ticket value was down only 1% excluding Live Nation. TicketsNow, Ticketmaster’s secondary ticketing service, has proved to be a problem child. A settlement with the Attorney General of New Jersey cost the company $350,000. Even worse are the effects of changes at TicketsNow that pulled $15 million in profits from the bottom line in Q1. As a part of the settlement, tickets cannot be posted to TicketsNow until primary tickets go on sale. In addition, customers will be informed about and provided a link to primary tickets at Ticketmaster.com if the event is not yet sold out. Those changes are good for consumers but will lower short term profits. The best long-term strategy, however, may be to acquiesce to government demands and forego further punishment and financial pain. In the context of a longer time frame, changes at TicketsNow are prudent. Merger costs were also a big part of Q1 results, amounting to $6.5 million during the period. Ticketmaster said yesterday over half its bank lenders have approved the proposed merger with Live Nation. Both Live Nation and Ticketmaster believe their merger will be approved later this year. Recent statements by antitrust officials at the Department of Justice, however, give hints the merger will face far greater scrutiny than had it been pushed through during the previous administration. With a traditionally slow Q1, the Artist Services division (via the merger with Front Line) contributed only $34.8 million of revenue and $4.4 million of EBITDA. This division will continue to be in flux will take some time to reach its potential as Front Line is re-shaped and fit into the larger, merged company. It continues to acquire smaller competitors -Mick Management (John Mayer) in November 2008, for example, and Dale Morris (Kenny Chesney, Big & Rich) just recently. The company has decided to move Echo, the online e-commerce and artist services company Ticketmaster acquired in March 2007, to Los Angeles. Judging from conversations with involved parties, the transition could easily be a drag on artist relationships and the division’s Q3 performance. There is a good chance the transition will cause lower levels of e-commerce, and the loss of employees means an absence of knowledge and relationships that Front Line will need to service the handful of Echo clients Ticketmaster will keep. One bright spot was a resilient average revenue per ticket, which increased 1% in the domestic market as ticketing volume dropped 9%. Global ticketing volume was down 8%. If you post details to iLike, it now automatically will go to that page on Ticketmaster. Some of the other sites require only a one-time configuration by the artist, which might entail embedding a widget. For example if you want to manage you content on your own Web site using the iLike Dashboard, you need to embed a javascript widget into your own site once, and from then on you can add tour dates or songs from iLike. Same thing with your MySpace Page. If you have a Twitter or YouTube channel, it's just a one-time linking of your account and password. Those are the basics we're making available for any artists. We're providing look and feel customization. And there's an area we created called Puzzles and Games that needs to be customized by each artist, and something that will be implemented for a smaller number of bigger artists. The current version doesn't have a way to do that. We've talked to a few artists that have asked us about it, to do something special just for them, but over time our plan is to embrace an open strategy so you can just add things on. The majority of artists won't have the time or money to build their own iPhone app. Certainly the Trent Reznors of the world will, but we wanted to build something that's extensible for 300,000 artists that use iLike. We give you a breakdown of total number of views and clicks for anything you post, and do that through every syndication channel to the extent it's possible. The premium package provides an even richer breakdown. It gives you a geographic breakdown. It also lets you see the correlation between the content you posted and response for fans, so we provide graphs where you can visually see on a timeline what things you've done and what the results were. We've always had a syndicated approach. Even when we first launched iLike.com, it came out with a companion application for iTunes. The success we saw there led us to expand to other social network platforms. This is just taking that same strategy to a new level, notably the iPhone and Twitter being the most high-profile. Tickets for the May 17 date, when the trio was scheduled to play an afternoon and an evening concert, will be honored on the new day at the same times (3 pm and 7:30 pm). "We know the situation is stabilizing and that many fans travel long distances to live the experience of seeing a Jonas Brothers concert," read the statement. "That is why we hope that your experience and your enjoyment of the concert will be as pleasant as possible." HOSTESS STRIKES DIGITAL DEAL WITH AVEX Japan's Hostess Entertainment has signed an agreement on a digital support-based strategic partnership with Avex Marketing Inc. The deal means that the division of the Avex Group will provide back end support services and, together with the in-house digital marketing staff at Hostess, co-market the indie's catalog and new releases exclusively across all Mobile and download services in Japan. The exclusive support and distribution partnership will see Avex enhance their international repertoire presence in the digital space, while Hostess stands to gain from tapping into Avex's domestic-led digital marketing strategies, which are considered to lead the field among industry-leading players in Japan. The deal means that Hostess now has agreements in place with both Sony Music (Billboard.biz, April 2, 2009) and Avex - two of the top three market share holders in Japan - despite the country's highly competitive, allegiance-driven industry. Coinciding with the start of Black Music Month (June), the one-hour biography program will return Sunday, June 7 (8 p.m. ET) with Riperton as the first episode. Premiering Sunday (June 14) will be the Moore episode, followed by Shalamar (June 21) and Ballard (June 28). Among those interviewed for the various segments are the Supremes’ Mary Wilson, Shalamar’s Jody Watley and Ballard’s sister Maxine Ballard. Each episode is narrated by actor Gary Anthony Williams. Four additional new episodes of “Unsung” are due to air in November 2009.
