REGULAR MEETING OF THE BOARD OF ALDERMEN August 17, 2004
The Regular Meeting of the Board of Aldermen of the City of Warson Woods was held on Tuesday, August 17, 2004 at the City Hall, 10015 Manchester Road. The following members of the Board were present: Mayor E. William Bergfeld, Jr. Gordon Gosh Larry Howe Mark Wittich David Aitken Matt Witte Judith Pohl George Bruenning Absent: John Devoto
Also present were City Attorney, Marvin Young, Assistant City Attorney, Paul Rost, City Clerk/Collector, Kathy Mahany, Chief Robert Stanczak, Building Commissioner, Elijah Cunningham, City Engineer, Ken Lichtenheld and Park Commissioner, Gerry Murphy. The Mayor called the Meeting to order at 7:00 P.M. PLEDGE OF ALLEGIANCE PUBLIC HEARING –TO SET THE 2004 REAL ESTATE AND COMMERCIAL PROPERTY TAX RATE Mayor Bergfeld opened the Public Hearing at 7:01 p.m. With no public comments to be heard, Mayor Bergfeld closed the Public Hearing at 7:02 p.m. MINUTES REGULAR BOARD MEETING—July 20, 2004 Alderman Gosh moved, seconded by Alderman Pohl, that the Minutes be accepted as submitted. On Voice Vote, the motion was unanimously approved. SPECIAL BOARD MEETING—August 16, 2004 Alderman Wittich moved, seconded by Alderman Gosh, that the Minutes be accepted as submitted. On voice Vote, the motion was unanimously approved.

SPECIAL BOARD MEETING EXECUTIVE SESSION—August 16, 2004 Alderman Gosh moved, seconded by Alderman Witte, that the Minutes be accepted as submitted. On Voice Vote, the motion was unanimously approved. REGULAR BOARD MEETING—August 17, 2004 TREASURER’S REPORT—July 2004 Alderman Gosh moved, seconded by Alderman Pohl that the Treasurer’s report be received as submitted. On Voice Vote, the motion was unanimously received. BILLS AND RECURRING DISBURSEMENTS TO BE APPROVED Alderman Pohl moved, seconded by Alderman Gosh, that the Bills with the addendum be approved as submitted. On Voice Vote, the motion was unanimously approved. GLENDALE FIRE REPORT—Alderman Gosh asked what “other hazardous conditions” referred to? Chief Stanczak answered possible trees down. Alderman Pohl asked what “routine medical” referred to? The Chief answered not transported to the hospital. WARSON WOODS POLICE REPORT—No action required. PETITIONS, REQUESTS AND COMPLAINTS-Nothing to report. MISC. REPORTS COLLECTOR—Kathy Mahany-nothing to report. BUILDING COMMISSIONER—Elijah Cunningham reported 3 new permits have been issued, one fence, one wall and a room addition. One permit application was denied for a large oversized detached garage. He then gave an update on 1591 Forest View, during the last meeting the developer met the basic requirements. At this time the City Engineer, Ken Lichtenheld, commented that there was a new survey done regarding the water situation and the pipe size has been changed from a 12” pipe to a 15” pipe. This should solve the “ponding” problem. Before a permit is issued an evening meeting will be scheduled and all interested parties will have a chance to look at the final plans. A short discussion was held between the Board the City Engineer and Building Commissioner. PARK COMMISSIONER--Gerry Murphy reported this Friday the tennis programs, men’s & women’s, will be ending and the lessons are already over. In September he would like to rebuild the practice board and do some painting. Also in September he will check to see if there are any bad trees which need to be removed. CITY ENGINEER—Ken Lichtenheld reported he finished visiting with the residents with complaints regarding water problems. He said he met with all but two and one of the two is out of town. To date, four residents have hired contractors to correct their problems. He also stated that he has a possible solution for the Swim Club but he would like to speak to MSD before he -2-
REGULAR BOARD MEETING—August 17, 2004 takes any action. Aldermen Howe and Pohl both asked if the Greenwald’s were on the list and Mr. Lichtenheld answered yes. Alderman Aitken asked if anyone else could still get on the list, Mr. Lichtenheld answered yes. A short discussion was held. CITY ATTORNEY—Marvin Young-Nothing to report ASST. CITY ATTORNEY—Paul Rost –Nothing to report. TREASURER—Bill O’Neil—Absent. MAYOR— E. William Bergfeld, Jr.—Nothing to Report OLD BUSINESS At this time Mr. Anthony Haesek, 1625 Dearborn Drive, gave a synopsis of neighboring Cities and their Architectural Review Committees. After a lengthy discussion, Alderman Aitken suggested Mr. Haesek and Alderman Pohl come up with a plan for Warson Woods and present it to the Board. MISC. OLD BUSINESS Mr. Jim Lewis, 1604 Daulphine, asked the City Engineer if his plan would not only help the flooding problem at the pool, but also some residents. The City Engineer said he thought it would. NEW BUSINESS Ordinance Establishing the 2004 Real Estate and Commercial Tax Rate. Alderman Witte moved, seconded by Alderman Gosh that Bill 1372 was read two times become Ordinance No. 1323. By Roll Call, the Vote was as follows:

The ordinance was announced passed 6-0 Request to have Sullivan Publications update the Code Book Alderman Gosh moved, seconded by Alderman Howe to Approve the codification of the City Code Book. On Voice Vote the motion was unanimously approved. MISC. NEW BUSINESS Alderman Witte asked if the trash situation was better with Danny O’Toole’s. He was answered yes since they closed the restaurant. Alderman Aitken discussed the property at 509 Beaucaire. Next he discussed the erosion problem at the Robben residence. Since it is so difficult to get in touch with the Maines’, it was suggested that a registered letter be sent to the Maines’ asking for permission to enter the creek from their property. Alderman Howe respectfully asked the City Engineer and Building Commissioner to make sure the building of two homes at 1591 Forest View will not adversely hurt the City at a later date.
