Amy Rote received the Proclamation for Tie A Yellow Ribbon Month and gave Council a Battalion coin from the 203rd. Citizen Requests and Petitions Public Hearings Public Hearings Procedures – read by City Clerk, Barbara Hogelin RESOLUTION NO. 2004-008 - A RESOLUTION granting a Special Use Permit (First Request) to Whitney Wimer for the operation of a family day care home located at 2808 Grand Avenue in the City of Joplin, Jasper County, Missouri. Motion by Mr. Shaw, Second by Mr. Landrith to Table Resolution No. 2004-008. Motion carried, 9-0. COUNCIL BILL NO. 2004-245 - AN ORDINANCE providing for the vacation of a portion of Hampton Avenue located between Forest Avenue and Patterson Avenue in the City of Joplin, Jasper County, Missouri. Motion by Mr. Russell, Second by Mr. Palmieri, to Place Council Bill No. 2004-245 on First Reading. Motion carried, 9-0. COUNCIL BILL NO. 2004-246 - AN ORDINANCE providing for the vacation of a portion of Patterson Avenue located between Newman Road and Islington Street in the City of Joplin, Jasper County, Missouri. Motion by Mr. Shaw, Second by Mr. Thurman, to Place Council Bill No. 2004-246 on First Reading. Motion carried, 9-0. Anyone wishing to address the Council should step to the Podium and state their name and address. If the matter is not a Public Hearing, a request to speak to the Council should be prepared prior to the meeting. Speaking time will be limited to five minutes. Sound enhancement units are available for hearing impaired customers. You will be asked to provide a form of identification as security, which will be returned when you return the unit. Council Agenda 2 July 6, 2004 COUNCIL BILL NO. 2004-247 - AN ORDINANCE amending Ordinance No. 97-161, passed by the Council of the City of Joplin, Missouri, September 15, 1997, by removing from District R-1 and including in District C-0 property as described below and located at 3225 Old Main Street Road in the City of Joplin, Newton County, Missouri. Motion by Mr. Landrith, Second by Mr. Harrington, to Place Council Bill No. 2004-247 on First Reading. Motion carried, 9-0. COUNCIL BILL NO. 2004-248 - AN ORDINANCE amending Ordinance No. 97-161, passed by the Council of the City of Joplin, Missouri, September 15, 1997, by removing from District R-1 and including in District C-3 property as described below and located at the northeast corner of 20th Street and Schifferdecker Avenue in the City of Joplin, Jasper County, Missouri. Motion by Mr. Russell, Second by Mr. Tupper, to Place Council Bill No. 2004248 on First Reading. Motion carried, 9-0. COUNCIL BILL NO. 2004-250 - AN ORDINANCE providing for the vacation of a drainage easement at the end of the cul-de-sac on Hilltop Lane in the City of Joplin, Newton County, Missouri. Motion by Mr. Harrington, Second by Mr. Palmieri, to Place Council Bill No. 2004-250 on First Reading. Motion carried, 9-0. COUNCIL BILL NO. 2004-252 - AN ORDINANCE amending Ordinance No. 97-161, passed by the Council of the City of Joplin, Missouri, September 15, 1997, by removing from District R-1 and including in District C-3 property as described below and located at 11341 East Highway FF (32nd Street) in the City of Joplin, Newton County, Missouri. Motion by Mr. Landrith, Second by Mr. Harrington, to Place Council Bill No. 2004-252 on First Reading. Motion carried, 9-0. 7. Minutes of June 21, 2004 meeting COUNCIL BILL NO. 2004-249 - AN ORDINANCE establishing grades and accepting the Plat of ABIGAIL SUBDIVISION located on the north side of 10 th Street at the intersection of 10th Street and Willard Avenue in the City of Joplin, Jasper County, Missouri. Stays on Consent Agenda COUNCIL BILL NO. 2004-251 - AN ORDINANCE establishing grades and accepting the Plat of LOGAN’S PARK located between Kent Drive and Lucas Drive approximately 500 feet west of Prairie Flower Road (St. Louis Avenue) in the City of Joplin, Jasper County, Missouri. Motion by Mr. Palmieri, Second by Mr. Thurman, to Approve Resolution No. 2004-031. Motion carried, 9-0. Motion by Mr. Landrith, Second by Mr. Tupper, to Place Resolution No. 2004-032 on the Agenda. Motion carried, 9-0. RESOLUTION NO. 2004-032 - A RESOLUTION granting a waiver of certain alcohol related Code provisions to the Joplin Historical & Mineral Museum, Inc., for a period of five (5) years. Motion by Mr. Landrith, Second by Mr. Thurman, to Approve Resolution No. 2004-032. Motion carried, 9-0. 9. Ordinances – Emergency COUNCIL BILL NO. 2004-048 - AN ORDINANCE authorizing the City of Joplin to enter into an Agreement with Barbara L. Hogelin for the purpose of employing her as City Clerk for the City of Joplin; authorizing the Mayor to execute said Agreement by and on behalf of the City of Joplin, Missouri; and containing an Emergency clause. Motion by Mr. Palmieri, Second by Mr. Thurman, to Adopt Council Bill No. 2004-048. Motion carried, 9-0. Ordinance No. 2004-152 COUNCIL BILL NO. 2004-121 - AN ORDINANCE approving the purchase of right-of-way for street purposes from John B. Brown and Phyllis Kathleen Wilson, consisting of the East 22 feet of Lots Numbered 43 in WANOKA HIGHLANDS ADDITION to the City of Joplin, and a 20-foot triangle on the Northeast corner of said Lot 43, located in the Southeast Quarter in Section 17, Township 27, Range 33, Jasper County, Missouri; and authorizing the payment of Seventeen Thousand and 00/100 Dollars ($17,000.00) and containing an emergency clause. Motion by Mr. Shaw, Second by Mr. Russell, to Adopt Council Bill No. 2004-121. Motion carried, 9-0. Ordinance No. 2004-153 10. Ordinances – First Reading COUNCIL BILL NO. 2004-046 - AN ORDINANCE amending Division I., Article IV., Boards and Commissions, of Chapter 2, Administration, dealing specifically with general requirements for Boards and Commissions; establishing the term of Board and Commission members; setting certain meeting requirements for Boards and Commissions; and addressing appointment removal of members of such Boards and Commissions. Motion by Mr. Harrington, Second by Mr. Thurman, to Place Council Bill No. 2004-046 on First Reading and Advance to Second and Third Reading. Motion carried, 9-0. COUNCIL BILL NO. 2004-047 - AN ORDINANCE authorizing the City of Joplin, Missouri, to enter into an Agreement Addendum with North Park Crossing, LLC., relating to a certain technical paragraph and authorizing the City Manager to execute the same by and on behalf of the City of Joplin. Motion by Mr. Harrington, Second by Mr. Tupper, to Place Council Bill No. 2004-047 on First Reading and Advance to Second and Third Reading. Motion carried, 9-0. Council Agenda 4 July 6, 2004 11. 12. Ordinances – Second and Third Reading Unfinished Business The following Council Bill was placed on First Reading at the May 3, 2004 City Council Meeting: COUNCIL BILL NO. 2004-028. According to State Statute, this Council Bill will remain on the Agenda for a 90-day waiting period. No further action by the Council is required. New Business Development Plan review – Request to review the development plan for Southtown Plaza. Motion by Mr. Harrington, Second by Mr. Thurman to Approve. Motion carried, 9-0. APPOINTMENTS TO BOARDS AND COMMISSIONS Motion by Mr. Tupper, Second by Mr. Thurman to Reappoint the following individuals: Stephen Looney – ADA Accessibility Board Don Miller – Joplin Sports Authority Melanie Ousley – Policemen’s & firemen’s Pension Board Motion by Mr. Landrith, Second by Mr. Harrington, to appoint Pam Hankins to the ADA Accessibility Board. Motion carried, 9-0. Motion by Mr. Tupper, Second by Mr. Landrith, to appoint Ervin Wilson to the ADA Accessibility Board. Motion carried, 8-1 with Mr. Thurman voting no. Motion by Mr. Russell, Second by Mr. Shaw, to appoint Wesley Bell to the Historic Preservation Commission. Motion carried, 9-0. Motion by Mr. Landrith, Second by Mr. Palmieri, to appoint Evan Mense to the Historic Preservation Commission. Motion carried, 9-0. Motion by Mr. Tupper, Second by Mr. Russell, to appoint Cary Marion to the Joplin Sports Authority. Motion carried, 9-0. Motion by Mr. Tupper, Second by Mr. Landrith, to appoint William Griffith to the Parks and Recreation Board. Motion carried, 9-0. Motion by Mr. Woolston, Second by Mr. Thurman, to appoint Dick Eastman to the Personnel Board to fill an unexpired term. Motion carried, 9-0. Motion by Mr. Harrington, Second by Mr. Landrith, to appoint Chris Morris to the Traffic Commission. Motion carried, 9-0.
