Santa Clara Valley Explorer Post #2928 invites you to submit your application for arts, crafts or food booths at the 2011
Sespe Creek Car Show & Festival. This outdoor event will take place on Monday, July 4th, from 9 a.m. to 5 p.m. in the
Downtown Central Park, Fillmore, California.

During the course of the Festival, the event will present a series of special activities throughout the Festival area including:
car show, food booths, arts & crafts, one-hour vintage train rides, plus live entertainment.

                                                FEES for one-day event
FOOD VENDOR SPACE (12'x12') options

Self contained food vendors (must have own VCEHD approved sink) - $175

If you are cooking on an open flame fire pit you will need to pay for an additional space at $175, as your pit is required to be
10' from your preparation facility.

ART AND CRAFT VENDOR SPACE (12'x12') - $150

The Festival will not collect a percentage fee or commission on any sales; all proceeds go to the vendors. All vendors shall
be responsible for collecting and reporting taxes and are required to possess their own State Board of Equalization Seller’s
Permit. Your original seller’s license must be displayed in your booth. (A copy of your seller’s license must be provided
along with your Booth Application. Do not send the original). Applications will not be accepted without a copy of your
seller’s license.

                                                 ADDITIONAL FEES
City Business License
All vendors will receive a copy of the Fillmore City Business License from us after your application has gone through the
jury process and has been accepted by the Event Committee. Complete the application and return it along with your check
payable to the City of Fillmore in the amount appropriate for your business. We will forward your application and check to
the City for you. If you are a Non-Profit Organization, mark the Booth Application where indicated. If you already have a
Fillmore City Business License, indicate your License No. on the Booth Application and mail a copy along with the Booth
Application. You will be required to display your City Business License in your booth during the event. If you have any
questions regarding a Fillmore City Business License or you need a blank application, you may contact the City of Fillmore,
Business License Division at (805) 524-1500.

Ventura County Environmental Health Department (VCEHD)
This fee is for Food Vendors only. All food vendors will receive a copy of Application for Permit to Operate a Food Facility
at a Community Event from us after your application has gone through the jury process and has been accepted by the
Event Committee. Complete the application and return it along with your check payable to Ventura County
Environmental Health Division in the amount appropriate for your booth. We will forward your application and check to
the county. A representative from the county will inspect each food vendor’s booth prior to the festival opening and a permit
will be given to you at that time. Additional information concerning requirements and fees are available by contacting,

                                                    JURY PROCESS
The Festival Committee will jury all arts, commercial, crafts, and food booth applications. Car-related items would
certainly be hot movers and will be first preference as selected vendor. We remind vendors that our community is very
family-oriented. We do not allow any drug-related items or items of a risqué nature into the park. All items to be sold at the
Festival MUST be listed in the vendor’s application. The event reserves the right to prohibit sale of any item obnoxious to
the Festival Committee and to reject or remove any exhibitor from the Festival. THE DECISION OF THE COMMITTEE
IS FINAL! Prior Festival participation does not guarantee acceptance in the 2010 Event. Once a vendor has been accepted,
no refunds will be issued.

                                                   SET-UP PROCESS
Vendors may drive to the closest area near their sites to drop off their booth items and then drive to a designated parking
area. Craft vendors may setup on Sunday, July 4th between 6:00 a.m. and 9:00 a.m. Any Craft vendor checking in after 7:30
a.m. will not be aloud to setup. Food vendors are required to setup on Saturday, July 3rd between 12:00 p.m. and 5:00 p.m.
Any Food vendor checking in after 5:00 p.m. will not be allowed to setup. No refund will be given to any vendor who did
not check-in before the allotted time. All vehicles must leave the concession area by 8:00 a.m. the day of the event and ready
to sell by 9:00 a.m. For safety reasons, no vendor vehicles will be allowed back into the area until 5:30 p.m. Oversized
vehicles will not be able to drive directly to an assigned space due to the configuration of the area and traffic congestion, but
the staff will guide the vendor to the nearest available parking. Security is provided Saturday night; BUT FILLMORE &
WESTERN RAILWAY SHALL NOT BE RESPONSIBLE FOR ANY LOSS OR DAMAGE.

                                              APPLICATION PROCESS
You must submit with your application, clear quality photo(s) (minimum 4" X 6") representing all of the products you are
bringing to the Event, and one photo of your booth. You may sell only items which have been juried and submitted with
your application. The photos will be used for the jurying process to insure the highest quality items possible.

All photos must have the vendor’s name included and will be returned after the Event if submitted with a self-addressed
stamped envelope. Reasonable precautions will be taken, but the Event Committee will not be responsible for loss or
damage to the photos.

All displays will be inspected during setup and at intervals throughout the Event to insure that displays and items are
consistent in quality to those represented by submitted photos. All vendor items must be contained within the allotted space.
Anything outside of the booth will be removed. The Event committee reserves the right to remove any work, which, in its
opinion, violates any of the Event’s agreement, rules, and conditions, or, in the sole and final judgment of the Event
Committee, is offensive or inappropriate for the Event. Violation may result in the vendor’s removal from the Event and no
refund will be given.

I, __________________________, in consideration of being permitted to participate as a vendor in the 2011 Sespe Creek
Car Show & Festival (“The Event”), and as an indispensable inducement to Santa Clara Valley Explorer Post #2958 (“The
Organization”) to allow my participation in the Event, declare, warrant, and agree as follows:

1.     I understand that my participation in the Event exposes me and my agents, employees, volunteers, and others
       claiming by, under or through me to risk of personal injury or death and to damage to property.

2.     Nevertheless, I hereby acknowledge that I am familiar with all such risks and assume them and all their
       consequences without exception.

3.     As against the Event, Organization, their members, volunteers, officers, directors, agents, and employees (“the
       Released and Indemnified Parties”), I hereby release, discharge, and agree not to sue at law or assert by any other
       means any claim for damages arising out of or in any way related to my participation and operations in the Event,
       from whatever cause, including the active or passive negligence of the Event or Organization and of any other
       participant in the Event.

4.     Should any agent or employee of mine, or any volunteer acting in behalf of any interest of mine, or any person
       claiming by, under, or through me assert against the Released and indemnified Parties, a claim for damages arising
       out of or in any way connected with the Event, or with the operations of the Released and Indemnified Parties or of
       any participant in the Event, I will defend and hold the Released and Indemnified Parties harmless from and against
       all loss threatened or incurred thereby, including expenses of investigating, the cost of reasonable settlement, the
       satisfaction of any judgment, and the reasonable fees of counsel and others, consequent on such claim.

I HAVE CAREFULLY READ THIS RELEASE AND AGREEMENT AND UNDERSTAND FULLY ITS
CONTENTS. I AM AWARE THAT I AM BOUND BY THE REPRESENTATIONS I HAVE MADE, THAT THIS
IS A FULL RELEASE OF ALL LIABILITY OF THE EVENT, RAILROAD AND INDEMNIFIED PARTIES TO
ME AND THAT I AGREE TO PAY FOR THE DEFENSE AND RELIEF OF THE RELEASED AND
INDEMNIFIED PARTIES UNDER THE CIRCUMSTANCES MENTIONED ABOVE.
