       Sub: Appointment of Doctors on contract basis..

        In modification of the orders contained in Board‟s letter No.89/E(GR)II/7/54
dated 26.02.1990, it has been decided to raise the age limit of candidates for appointment
as contract doctors from “below 30 years” to 50 years. Rules governing relaxation for
scheduled caste/scheduled tribe and certain other categories as notified by the Govt. of
India from time to time, shall remain applicable. The crucial date of determining the age
limit shall be 1st January of the year of selection.

2.      It has also been decided to authorise DLW/Varanasi as also DCW/Patia and
RCF/Kapurthala jointly, to conduct selection for appointment of doctors on contract
basis, and send their recommendations to the Ministry for their approval. Instructions
regarding holding of selections are contained in Board‟s letter No.89/E(GR)II/7/54 dated
26.02.1990.


3.     All other terms and conditions shall remain unchanged.

Considering the acute shortage of doctors on Railways due to continued absence of
doctors, Board has reviewed the position and decided to permit the Railways to engage
medical practitioners on contract basis subject to a maximum of 80% of the posts lying
unmanned due to unauthorized absence of regular doctors. While making such contract
engagement, the procedure for contract engagement laid down in Board‟s letters no. 89-
E(GR)II/9/1 dated 26.02.1990, 05.06.1991, No. 94-E(GR)II/9/1 dated 15.12.1994, as
amended from time to time should be followed scrupulously.

As and when any of the regular doctor who has been absenting himself rejoins duty,
services of a corresponding number of contract medical practitioners

       Considering the acute shortage of doctors on railways due to continued absence of

2.      As and when any of the regular doctor who has been absenting himself rejoins
duty, services of a corresponding number of contract medical practitioners shall have to
be terminated by following the terms and conditions of contract.

3.      Railways should also take necessary steps to finalize action against unauthorized
absentee doctors within a period of 6 months from the date of issue of this letter. Details/
status of action taken in this regard should be reported to Board‟s office urgently.

       Considering the shortage of doctors on Indian Railways, the Ministry of Railways
have decided to delegate to the General Managers of the Zonal Railways powers to
engage both part time and full time contract doctors initially for a period of one year,
including extension of contract of those who are already under contract for second term
of one more year only.

2.     In case it is felt necessary to continue doctors on contract for a third year,
proposal for such cases should be submitted with full justification to Railway Board for
approval.

3.      Extension of the contract should be after a gap of about a week‟s time after expiry
of the contract and a fresh contract should be entered into for the extended period.

4.     While engaging doctors on the contract basis, representation of SC/ST and OBC
categories as per vacancies reserved for them, should be ensured strictly.

5.     The above delegation is for one year after which the scheme will be reviewed by
Board.

6.     Contract engagements should be made only in consultation with the FA&CAO of
the concerned zonal railway.

7.     Except for the above delegation of powers the terms and conditions of contract
and the method of selection as laid down by board earlier shall remain unchanged.

8.    This issues with the concurrence of finance directorate of the Ministry of

       Sub: Engagement of medical practitioners on contract basis.

In order to meet the shortage of regular doctors on Railways, the Board decided for
engagement of doctors on contract basis as a stop-gap measure. Instructions of the Board
were communicated to the Railways vide No.89/E(GR)II/7/54 dated 26.02.1990. The
position was reviewed several times since then and by Board‟s letter of even number
dated 25.07.97, it has been decided to delegate the powers for engagement of contract
medical practitioners to the General Managers, with the stipulation that the contract
doctors can be engaged for a maximum of two terms of one year or less each by entering
into fresh contracts each time. It has also been specified that there should be a break of at
least a week‟s time between the two terms of contract. In special cases. Wherever, full
justification is available, a third contract was also permitted with Board‟s approval in
exceptional cases.

Even with improvement in the materialization of regular doctors selected through the
UPSC, contract engagements are still continuing and it has become routine to seek
approval of Board for third term of contract of the same medical practitioner for the same
station. It would not be advisable to continue the same medical practitioner for such
prolonged periods without deploying the doctors who join through Combined Medical
Services Examinations conducted by the UPSC, to such locations since two years is a
long period for ensuring such deployments.

Prolonged engagement of contract doctors seems to cause claims for continuity of service
on Railways. To avoid such unpleasant situations, it has been decided by Board that
utmost care should be exercised so that contract medical practitioners are utilized for
minimum periods at particular stations/Railways. It is also necessary to be cautious that
no individual medical practitioner is normally engaged for more than two years.
However, in exceptional cases extension of contract for third term can be recommended
to Board with full justification for such a proposal. If shortage of doctors is persistent and
regular doctors do not become available, proposal with sufficient justification may be
sent to Board for approval of contract for the fourth term, ensuring a minimum gap of one
year from the third term in the individual case. Thus, the extension of contract for the
fourth year may be recommended minimum one year after expiry of the third contract
and also after conducting a fresh screening of the individual. In no case an individual
medical practitioner should be considered for a fifth term. In case of specialists and super
specialists, a fifth year term may be considered with the approval of Board in very
exceptional circumstances and in exigencies of service.
While calling for applications for selection of medical practitioners zonal railways should
ask for information regarding past services of the candidates including on contract with
Indian railways, so as to ensure that no candidate who was on contract for a period of
four terms in the case of general duty practitioners and five terms in the case of
specialists/ super specialists is recommended for fresh engagement on the railways.

        The existing provisions regulating grant of monthly remuneration for medical
practitioners engaged on contract basis contained in Board‟s letter No.94/E(GR)II/9/1
dated 25.07.1995 have since been reviewed by the Board and it has been decided to grant
the following monthly remuneration to the medical practitioners engaged on the
Railways:

2.      In case fill-time contract doctors for whom railway accommodation is provided,
an amount equivalent to the sum of HRA and licence fee of the accommodation so
provided be deducted from the monthly remuneration of the concerned medical
practitioner. For working out the HRA element, the pay and NPA as admissible at the
minimum Junior Scale, Senior Scale and Junior Administrative Grade may be considered
as applicable to the General duty doctors, specialists and super specialists, respectively.

3.      Rate of deduction of remuneration for absence in excess of eligibility should be
worked out proportionately, taking the amount of monthly remuneration for the
respective category as payable for thirty days.

4.      The qualifications and experience prescribed in the Recruitment rules for direct
recruitment of doctors as Assistant Divisional Medical Officers and Super Specialists in
Junior Administrative Grade should be followed while making selections for general duty
and super specialist contract doctors. For specialists, the qualifications and the experience
prescribed in Board‟s letter No.89/E(GR)II/7/54 dated 05.06.1991 should be adhered to.

5.     These orders will take effect from 01.11.1997.

      Sub: Engagement of Contract Medical Practitioners (CMPs) (Full time and Part-
           time) in Railway – Revised terms and conditions.

   1. It is brought to your notice that the terms and conditions for engagement of
      Contract Medical Practitioners (CMPs) have been reviewed and the revised sets
      of terms and conditions are forwarded to you alongwith a draft agreement /
      declaration to be signed by the CMPs before entering into contract with them. All
      future engagement / extensions as fresh contracts on full or part-time basis should
      be made in accordance with these terms and conditions.
   2. Since these terms and conditions are not exhaustive in themselves, Railways are
      advised to follow the instructions / guidelines issued by the Railway Board
      regarding selection proceedings, conditions of private practice for full time CMPs,
      etc. conveyed to the Railways vide letter no. 89/E(GR)II/7/54 dated 26.02.1990.
      In addition, the administrative instructions / guidelines conveyed to the Railways
      vide Board‟s letter no. 93/E(GR)II/9/1 dated 15.02.1993 and 27.09.1995 and letter
      no. 96/E(GR)II/9/16 dated 10.07.1997 and 14.05.1999, regarding age limit for full
      time CMPs, slots permitted to be filled on contract, recovery of HRA/license fee
      element in case Railway accommodation is provided to full time CMP, the terms
      of contract for which an individual CMP can be considered for engagement etc.
      shall continue to be in force.
   3. With the introduction of the new terms and conditions, the restrictions stipulated
      in Board‟s letter no. 89/E(GR)II/7/4 dated 26.02.1990 that CMPs should be
      engaged at unpopular stations stands cancelled. Since, no administrative/ financial
      powers are to be exercised by the CMPs, the Railways should ensure that no CMP
      is made independent incharge of any of the dispensaries / health units
   4. It may be noted that with the introduction of these revised terms and conditions,
      part-time engagement of general duty medical practitioners will not be permitted.
      In addition, engagement of part-time medical practitioners in specialized
      disciplines for 6 hours duration per day has also been prohibited.

   The above instruction may please be followed scrupulously.

                  Terms and Conditions for entering into contract
                  with Medical practitioners on full time basis:-
                                 -------

1. The contract shall be entered into for one year or less from the date of entering
   into the contract. Period of contract is not extendable on any grounds. However,
   the Railway administration shall reserve the right to enter into fresh contract with
   Practitioner for another term.

2. The full time contracted Medical Practitioner (hereinafter referred to as CMP)
   who enters into contract with the Railways will not have any claim or right for
   his/her continuity in service or automatic extension of the term of contract.

3. During the validity of the contract, the CMP will be at liberty to terminate the
   contract for betterment of his/her career or on any other grounds by giving 15
   days notice to the Railways. The contract can also be terminated by the Railways
   at any time during the contract by giving 15 days notice without assigning any
   reasons whatsoever. Contract shall also be terminated if the CMP is found to be
   mentally or physically incapacitated.

4. The CMP shall undergo a medical examination, before the contract is entered
   into, for his/her fitness to perform the work awarded to him /her.

5. At the time of entering into contract, the CMP shall produce certificates of his/her
   character and antecedents from two gazetted officers of the Central/State
   Government.

6. At the time of entering into contract, the CMP shall produce original certificates
   for proof of his/her date of birth and educational qualifications.

7. The CMP shall have to undergo a brief orientation for a period of two weeks.

8. Normally Sundays and National Holidays will be off and in addition, authorized
   absents without detriment to the terms shall be allowed at the rate of two days
   per month to be availed any time during the contract to the extent earned by the
   CMP till such time. Provided this facility shall be available to the CMP subject to
   fulfillment of conditions stipulated in clause 14 & 15 of the terms and conditions.
   Any CMP leaving his place of work on leave of absence/national holidays should
   get prior permission of the controlling authority.

9. Expenses on outstation journeys connected with the contracted works will be
   borne by the Railway. Duty passes will be issued by the Railways for the purpose
   of journey in the line jurisdiction of the Health Unit where the CMP renders
   service and to the Divisional HQ and the CMP will be paid Daily allowance at the
   following rates during such journeys subject to other provisions constrained in
   Board‟s letter No:F(E)1/98/AL-28/9 dt: 24.04.1998.

10. The monthly fee for CMPs engaged for full time and the daily proportionate
    reduction form the fee in the event the CMP absents himself for periods
    exceeding those stipulate in the contract, are at the following rates:-

11. Full time CMPs may be provided unfurnished accommodation subject to
    availability. In case railway accommodation is provided to the CMP, an amount
    equivalent to the sum of HRA and license fee of the accommodation so provided
    shall be deducted from the monthly fee admissible to the CMP.

12. The CMP may be given one set of First Class complimentary pass for self and
    family during each contract. The pass, however, shall be issued after he/she
    renders three months of contracted service regularly.

13. The CMP may avail of free medical treatment for self only except operations
    categorized as “Special” in Para 622(8) of Indian Railway Medical Manual 2000
    and treatment normally available at super speciality centre from his/her
    respective zonal railway hospitals during the currency of contract.

14. The CMP shall be governed in respect of matters not referred to in these terms
    and conditions by any orders/amendments to the terms contract issued by the
    Railways from time to time.

15. The CMP shall attend to all normal tasks which any medical practitioner is
    conventionally doing. He/She will also attend to emergencies and accidents.

16. The CMP shall issue sick/fitness certificates for a period up to 7 days, beyond
    which the certificate is issued by him/her should countersigned by regular
    Railway Medical Officer available at the nearest hospital/dispensary health unit.

17. The CMP should not perform administrative work like pre employment or
    periodical medical examinations, sanction of leave to Group „C‟ & „D‟ staff and
    certificate with respect to food items considered unfit for human consumption,
   etc. However the CMP shall be allowed to permit Group „C‟ & „D‟ staff casual
   leave if sought, for 3 days or less at a stretch.

18. The CMP shall not make medical recommendation of any kind referred to Para
    559 to 564 of Indian Railway Medical Mannual (IRMM),2000.

19. The CMP will not have any financial powers, however he/she may operate the
    imprest account in accordance with the guidelines contained in the IRMM.
    However the cash vouchers in such cases shall be got countersigned by an
    authorized Railway Medical Officer. No cash imprest account shall be recouped
    unless the proposal is countersigned by an Indian Railway Medical Service
    Officer.

20. The CMP shall not initiate/review /accept the annual confidential reports of
    Group „C‟ Railway employees, however he/she shall, on request prepare and
    present the performance report of the staff.

21. The CMP shall not indent or condemn/recommend for condemnation any tools
    and plants.

       Sub: Engagement of Part-time Dental Surgeons.

        The system of engagement of Part-time dental surgeons has been reviewed by the
Board, and it has been decided to streamline the terms and conditions of engagement of
part-time dental surgeons. Considering the workload in the Divisional Hospitals, where
part-time dental surgeons are engaged, the Board has also decided to increase the
working hours of part-time dental surgeons engaged in the 41 Divisional Hospitals,
indicated in Annexure-B, with a proportional increase in the rates of remuneration of
those engaged for four hours duty daily.

       The detailed terms and conditions of engagement and the method of selection of
candidates for part-time engagement of Dental Surgeons are spelt out in Annexure-A&B.
A format of contract to be executed by the Part-time Dental Surgeon at the time of his
engagement is attached as Annexure-C.

        It should be ensured that while a maximum of 5 annual contracts can be entered
into with Part-time Dental Surgeons engaged for two hours work daily, only three annual
contracts are permissible in the case of Part-time Dental Surgeons engaged for four hours
work daily. In case further contracts become inescapable, proposals for such contract
engagements should be sent to Board with detailed justification, for their consideration
and approval. Every annual contract should be detailed in itself and there should be a
break of few days‟ time before the second contract is entered into with the same contract
part-time dental surgeon.

        A quarterly report detailing the engagement of Part-time Dental Surgeons should
be sent to Board‟s office for information and record.

      This issues with the concurrence of the Finance Directorate of the Ministry of
Railways.

1.     Dental Surgeons on part-time basis (referred to hereinafter as Pt. Time Dental
Surgeon) as are engaged on contract from time to time for a duration of four hours/two
hours daily.

2.      The contract shall be entered into for one year or less from the date of entering
into the contract. Period of contract is not extendable on any grounds. However, the
Railway administration shall reserve the right to enter into fresh contract, for one year or
less, with Practitioner or for further contracts. But no Dental Surgeon shall be ordinarily
engaged for more than 5 annual contracts. However, in cases where alternative
arrangements are not feasible and it becomes inescapable to engage a dental surgeon for
more than five annual contracts, a suitable proposal be sent to Railway Board with full
details and justification.

3.     Part-time Dental Surgeon who enters into contract with the Railways will not
have any claim or right for his/her continuity.

4.     During the validity of the contract, the Part-time Dental Surgeon or the Railway
Administration will be at liberty to terminate the contract by giving 15 days notice at any
time during the contract without assigning any reasons whatsoever. Contract shall also be
terminated forthwith if the Part-time Dental Surgeon is found to be mentally or physically
incapacitated.

5.      At the time of entering into contract, the Part-time Dental Surgeon shall produce
certificates of his/her character and antecedents from two gazetted officers of the
Central/State Government.

6.      At the time of entering into contract, the Part-time Dental Surgeon shall produce
original certificates for proof of his/her date of birth and educational qualifications. The
part-time Dental Surgeon must have three years working experience or be a postgraduate.

7.      The Part-time Dental Surgeon shall be of good general health. Any Dental
Practitioner engaged as Part-time Dental Surgeon shall cease to be on contract on his
attaining the age of 60 years.

8.         Normally Sundays and National Holidays will be off.

9.      The monthly fee for Part-time Dental Surgeon and the daily rate of proportionate
reduction from the fee in the event the Part-time Dental Surgeon absents himself/herself
for periods exceeding those stipulated in the contract, are at the following rates:

     (a)      Monthly Fee

              Part-time contract for:
              Four hours – Rs.6000
               Two hours – Rs.3000
      (b)      Proportionate reduction per day of absence

               Part-time contract for:
               Four hours – Rs.200
               Two hours – Rs.100

10.     The Part-time Dental Surgeon shall be governed in respect of matters not referred
to in these terms and conditions by any orders/amendments to the terms contract issued
by the Railway from time to time.

11.         The Part-time Dental Surgeon shall nor exercise any financial powers.

12.    The Part-time Dental Surgeon shall not initiate/review/accept the annual
confidential reports of Group „C‟ Railway employees.

13.   The Part-time Dental Surgeon shall not indent or condemn/recommend foe
condemnation any tools and plants.

14.     The Part-time Dental Surgeon will be available in the Railway Unit during the
contract hours daily and will attend to Railway beneficiaries only. During the prescribed
hours of duty the Part-time Dental Surgeon shall not attend to any private patient or shall
leave the premises of the unit in which he is engaged, except with the permission of the
Head of the Hospital/Unit.

15.     Part-time Dental Surgeon will be required to perform minimal restorative
dentistry, periodontal treatment, extraction, endodontic treatment and any emergent
treatment.

16.     The Part-time Dental Surgeon will nor be entitled to any concession granted to
Railway employees and their families in case of exceptionally emergency cases, if any,
referred to Part-time Dental Surgeon at his private clinic or he is being called to attend
the cases at the Railway Dental Clinic, he does so free of charge. No extra payment will
be made to him for the services thus rendered.

17.     He will entitled to get one set of ordinary first class complementary pass available
for All Indian Railways per year for self and family after completion of one year term.

18.         The Part-time Dental Surgeon should work in the morning OPD hours preferably.
                                                                          ANNEXURE-B

Apart from existing arrangement regarding engagement of Part-time Dental Surgeons for
2 hrs. per day/alternate days, Board has decided to introduce 4 hours stage for engaging
Part-time Dental Surgeons, on 41 Divisional Hospitals where workload/employee
strength demands more working hours. For the Dental Surgeons to be appointed for 4
hours, slightly different terms & conditions have been evolved. Accordingly, for
appointing Dental Surgeons for 4 hours/day on 41 Divisional Hospitals, written contracts
have been entered into. Part-time Dental Surgeons to be appointed for 4 hours will be
offered written contract for only one year and the contract has to be terminated in writing
on expiry of one year. A fresh contract, if required, will have to be entered into with the
doctor.

As at present, no definite selection process is being followed, Railways are advised to
adopt following procedure, which is more stringent and will bring more transparency in
the selection process:

   i)      Selection process for contract engagements of Part-time Dental Surgeons have
           to be notified in local newspapers.
   ii)     Applicants‟ credibility/ability has to be gone into by evaluating their academic
           caliber followed by an interview by a committee, consisting of the CPO, CMD
           and one senior level Dental Surgeon.
   iii)    The report/panel thus prepared by the Selection Committee also requires
           personal approval of General Manager.
   iv)     Every contract should be distinct and not more than three such contracts
           should be entered into with a practitioner individual. In case where alternative
           arrangements are not feasible and it becomes inescapable to engage Part-time
           Dental Surgeons for more than three annual contracts, a suitable proposal is to
           be sent to the Railway Board with full details and justification.
   v)      A specimen for engaging Part-time Dental Surgeon is appended at Annexure-
           C.

   At present 41 Part-time Dental Surgeons are working in equal number of Divisional
   Hospitals, zone-wise, as under:

   CR-6, ER-3, NR-5, NER-4, NFR-3, SR-6, SC-3, SER-6, WR-5

   For 2 hours daily working, Part-time Dental Surgeons on these 41 Divisional
   Hospitals get an honorarium of Rs.3,000/- at present with complimentary pass facility
   (Para 239 of IRMM-2000). For 4 hours increased working at 41 Divisional Hospitals,
   remuneration of 41 Part-time Dental Surgeons has also been increased to Rs.6,000/-
   and one set of complimentary pass as per existing arrangemet.

reconsidered by Board. With a view to speed up the selection process, it has been decided
by the Board that the composition of the interview board (selection committee) for
selection of Dental Surgeon for engagement on part-time basis may be changed from
CPO, CMD and one Sr. level Dental Surgeon to “Sr. DPO, CMS/MS-Incharge and one
Sr. level Dental Surgeon”.

       Except the above variation in the composition of the selection committee, the
procedure laid down in Annexure-B of Board‟s letter cited above shall remain
unchanged.

Board and it has been decided to continue the delegation of powers to the General

13.01.2009.

2. In case of full time contract doctors for whom Railway accommodation is provided, an

working out the HRA element, the pay and NPA as admissible at the minimum of Jr.
