THE GEORGIA STATE COSMETOLOGY BOARD Martha Harris, Chairperson Wednesday – August 4, 2004 Summary Martha Harris called the meeting to order at 9:15a.m. The minutes were reviewed and approved. The Executive Director presented a report. The School/Inspections Supervisor presented a report. An Executive Session was conducted. Old and New Business was discussed. The meeting adjourned at 4:05p.m.

A meeting of the Georgia State Cosmetology Board was held on Wednesday – August 4, 2004 at the Professional Licensing Boards Division office – 237 Coliseum Drive – Macon, Georgia. Those present were as follows: From The Board Martha Harris, Board Chairperson Pauline Cornelius Cynthia Stein Wanda Brooks Kay Kendrick John Siggers Betty Carlisle From The Staff Eleanor Surrency, Executive Director Janet Jackson, Assistant Attorney General Angela Price, Board Secretary Martha Harris established a quorum and called the meeting to order at 9:15 a.m. Kay Kendrick moved, Pauline Cornelius seconded, and the board voted unanimously to approve the minutes from the July 14, 2004 board meeting. Executive Director’ s Report Eleanor Surrency’s report included the following: 1. 1. Submitted a report of license suspensions/denials, suspension releases for ratifications.
Pursuant to requests from the Department of Human Resources (DHR) and the Georgia Higher Education Assistance Corporation (GHEAC) Kay Kendrick moved, Cynthia Stein seconded, and the board voted unanimously to ratify the

4. Requested board to establish a cognizant committee to receive reports from Legal Services and Enforcement, to review applications and make recommendations to the board. Pauline Cornelius moved, Kay Kendrick seconded, and the board voted unanimously to establish the cognizant committee to consist of Martha Harris, Pauline Cornelius, Wanda Brooks, and Kay Kendrick. 4. Informed the board that a representative from NIC Testing will attend the September 15, 2004 board meeting to present a proposal for testing applicants in Georgia. Pauline Cornelius moved, Kay Kendrick seconded, and the board voted unanimously to cancel the NIC Teacher recertification session scheduled for September 22, 2004. 5. Informed the board that a school inspection of Vogue Beauty School was conducted on June 30, 2004. Appeal Hearing An appeal hearing was conducted for Right Choice Beauty OSAH Docket No. OSAHPLDC-COSME0415966-60-RC. Kay Kendrick moved, Pauline Cornelius seconded, and the board voted unanimously enter Executive Session in accordance with O.C.G.A. χ43-1-2(k) and 43-1-9(h) to deliberate on applications and enforcement matters and to receive information on applications and investigative reports. Voting in favor of the motion were Cynthia Stein, Wanda Brooks, Pauline Cornelius, and John Siggers, Kay Kendrick, and Betty Carlisle. Eleanor Surrency submitted a list of unlicensed salons that were referred to Enforcement for Cease and Desist Orders for ratification. Eleanor Surrency requested the board’s decision on the correspondence from KM/appreticeEllijay. Ms. Surrency requested the board’s decision on the request from the owner of SSoC/Savannah to waive the 4-21-04 citation and the requirement that tables and chairs for nail and skin care are permanently set up in the classroom. Ms. Surrency Submitted completed examination applications from inmates at Pulaski State prison. Appearing Before The Board MS/reciprocityJamacia appeared before the board regarding her application. The owner of CIoNC/school appeared before the board regarding his request that June 3, 2004 citation be waived. Enforcement Report Representatives from Enforcement submitted case presentations.

Legal Service Reports Legal Service attorneys submitted requests from the Attorney General’s office regarding ciatations. Legal Service attorneys presented a report of applicants with convictions. The Board concluded Executive Session in order to vote on these matters and to continue with public session. The board voted unanimously to uphold the Initial Decision of M Patrick Woodard Jr. in the case of OSAH Docket No OSAH-PLDC-COSME-415966-60-RC. Kay Kendrick moved, Pauline Cornelius seconded, and the board voted unanimously to ratify the list of unlicensed salons referred to Enforcement for Cease and Desist Orders as follows: AYAHCUSA/Atlanta, SR/Decatur, TAHB&GS/Columbus, HoH/Smyrna, BOTGBA/Decatur, MBHS/Richland. Kay Kendrick moved, Wanda Brooks seconded, and the board voted unanimously to request the appearance of the supervising master of KM/appreticeEllijay for interview. Kay Kendrick moved, Pauline Cornelius seconded, and the board voted unanimously that the 4-21-04 citation of SSoC/Savannah stands and the requirement that the tables and chairs for nail and skin care must be permanently set up in the classrooms stands. Kay Kendrick moved, Pauline Cornelius seconded, and the board voted unanimously to request re- inspection of the SSoC/Savannah within ninety days. Kay Kendrick moved, Wanda Brooks seconded, and the board voted unanimously to deny the application of MS/reciprocityjamacia and require that she sit for the examination. Kay Kendrick moved, Pauline Cornelius seconded, and the board voted unanimously to deny the request of the owner of CIoNC/school to waive the June 3, 2003 citation. Kay Kendrick moved, Pauline Cornelius seconded, and the board voted unanimously to request that CIoNC/school is re- inspected within 90 days and that the student progress reports are researched. Kay Kendrick moved, Wanda Brooks seconded, and the board voted unanimously to accept the signed consent orders of Raymond Torregano and The Cut-N-Edge Salon.

Pauline Cornelius moved, Kay Kendrick seconded, and the board voted unanimously to request the salon in case COS040369 is re- inspected on evenings and weekends. Pauline Cornelius moved, Kay Kendrick seconded, and the board voted unanimously to refer case COS040721 to the Attorney General’s office. Wanda Brooks moved, Kay Kendrick seconded, and the board voted unanimously to dismiss and instruct inspectors to re- inspect the following cases: Hi Look Beauty Salon #COSA029800 11-13-03 - $550 Top Priority Beauty Salon COSA015139 – 10-24-03 - $500 Cynthia Stein moved, Pauline Cornelius seconded, and the board voted unanimously to amend the March 2, 2004 citation of Tracy’s Nail Care #NTSA00435 to $500. Wanda Brooks moved, Cynthia Stein seconded, and the board voted unanimously to accept $300 as settlement of the Nov. 4, 2003 citations against Kandolas Salon COSA028659. Kay Kendrick moved, Pauline Cornelius seconded, and the board voted unanimously to request the Division Director to Request a Compliance Specialist position be added to the staff to monitor sanctions that the board places on licensees. Wanda Brooks moved, Cynthia Stein seconded, and the board voted unanimously to approve the following applications for examination: AA, JB, RH, VJ, GL, YL, TW and that the licenses of inmates who pass the cosmetology examination will be placed on probation to run concurrent with criminal probation/parole and the consent order be subject to review upon release of inmate or change in probation/parole status. The board instructed the administrative staff to forward a statement to Sharon Wiber that the board does not render Legal advice to individuals, that only class I machines are permitted for use by estheticians and cosmetologists, and a recommendation that she contact the vendor to determine the class of the machine she has. The board requested that Ms. Surrency submit a report of Cosmetology Board licenses issued, expenses and revenues for Fiscal Year 2004. Old Business Dr. Femi Ajayi and members of the examination unit appeared to discuss board member’s concerns about examiners and training dates. Janet Jackson submitted advice as to the feasibility of issuing only a cosmetology salon license under O.C.G.A. χ43-10-01. Ms. Jackson concluded that “the board is not required to issue licenses that designate registered shops or salons as nail, esthetician, or cosmetology shops or salons. And there is no legal prohibition to licensing all shops and salons as “cosmetology” shops or salons. The statue and the rules do prohibit a person who is licensed as a cosmetologist, esthetician, or nail technician from performing services for compensation for which the person is neither licensed nor trained to perform”.
