Insists the murder was committed by Timothy David Natividad. Tim Natividad always had guns, knives and drugs. Tim Natividad frequently came by the house saying that he knew her husband, Konrad Garcia. xxx TNL:Melody Rothschild Garcia Toward the Fall of 1988, Tim Natividad began acting strange. He spoke in cryptic language of "taking out" somebody. He began using methamphetamine in heavy doses. xxx TNL:Melody Rothschild Garcia He wore white suit and Melody noticed that it had blood on it. Tim Natividad told her that he had just killed somebody by beating the person to death. Joryville Park. Melody Garcia. xxx TNL:Melody Rothschild Garcia Tim Natividad had ridden his motorcycle to her house. He mentioned to Melody Garcia that he was going to "do" somebody. Tim started his motorcycle. Melody Garcia asked him who he was going to "do" and, between revving the motorcycle's throttle, she heard him say Frank just as he drove away. Melody Garcia believes that the reference to a "Frank" was actually Michael Francke. xxx TNL:Melody Rothschild Garcia Melody Garcia was interviewed by the Oregon State police in July 1989. The police were not interested in listening to her. xxx TNL:Melody Rothschild Garcia She is aware that Tim Natividad owned a stiletto knife that he strapped into his boots. He had a blue pin striped suit because she stored it for him in the basement of her house. xxx TNL:Melody Rothschild Garcia Tim Natividad vaguely resembles the well dressed man in the pin striped suit who was seen in the Dome Building moments before Michael Francke was murdered. xxx TNL:Betty Reynolds Interviewed Betty Reynolds on June 14, 1990 for information about Frank Thompson. Senator C.T. "Cub" Houck. xxx TNL:Betty Reynolds Shortly after that meeting with Frank Thompson, he was found floating in the Willamette River. She also recalls that she began to receive harassing telephone calls at work and at home. trying to break into her apartment. She recalls a stranger xxx TNL:Betty Reynolds Betty Reynolds is aware that Michael Francke had applied for a federal grant to assist him in uncovering corruption within the Corrections Department. Is aware that a briefcase was turned into the Ethics Commission, but she indicated that the contents were confidential, as they related to the ongoing Cub Houck investigation. xxx TNL:Harley Joe Interviewed Harley Joe June 14, 1990. He first met Jodie Swearingen in Summer of 1989. Kathleen Reeves. Saw Jodie at Russ' Day and Night on Broadway Street in Salem. Last time he saw Jodie was in October 1989. Harley agreed to meet her. When Jodie arrived she was frightened. Kept saying that "she knew the guy that did it." Harley did not know what Jodie was talking about. She never mentioned to him any names. xxx TNL:Harley Joe Told him that she was being sought by the police. She was frightened. Two plainclothes officers asked Harley if Jodie was at his house. Harley responded "no," but just as he said it, Jodie walked up the stairs and the police captured her. xxx TNL:Harley Joe Harley believes that Jodie is a person who desires attention. xxx TNL:Thomas Osbourne Interviewed Thomas Lee Osbourne June 14, 1990. Thomas Lee Osbourne first met Jodie Swearingen at a party in the Fall of 1988. He next met her again on 25th Street in 1989 when she was eluding the police. Jodie was extremely frightened for her life. xxx TNL:Thomas Osbourne Mr. Osbourne granted the request to search on the condition that the police not search the room in which Mr. Osbourne kept his pit bull terriers. Jodie was in that room. xxx TNL:Thomas Osbourne Mr. Osbourne decided to take Jodie to a safe house in Washington after this episode. Jodie related that the police began asking her questions about what she knew of the Francke homicide. Once she had made these statements to the police she became frightened because she was unable to tell them the truth. xxx TNL:Thomas Osbourne Jodie then explained that she had only met Frank Gable once. She was not with Frank Gable on the night of the murder and that Frank Gable was not her boyfriend. She was frightened of police. Believed the police were going to kill her. xxx TNL:Thomas Osbourne She went to Harley Joe's house on Division Street where she was eventually captured. Mr. Osbourne believes that Jodie was a person who desires attention. xxx TNL:Robert Wittmon Interviewed Mr. Wittmon on June 28, 1990, for information about his observations on January 17, 1989. Mr. Wittmon was at that time an employee of the US Postal Service. xxx TNL:Robert Wittmon He believes he observed the following events on either January 17 or January 18 at 7:15 p.m. xxx TNL:Robert Wittmon The headlights of the mail truck shone directly at a man walking slowly down the sidewalk on 24th Street. The man was walking at a normal pace, but he had an anxious look on his face. Described the appearance of the face as similar to that which a Mexican illegal alien has when the alien sees a mail truck for the first time. xxx TNL:Robert Wittmon Dressed in a light tan coat that extended to the mid-thigh. Hair was long, black and shoulder length, combed straight back and well-groomed. Could not determine whether the man wore a suit. xxx TNL:Robert Wittmon He has seen photographs of Frank Gable and the man who he observed did closely resemble Frank Gable, but the man was larger than Frank and the man's nose was more broad than Frank's nose. xxx TNL:Robert Wittmon Encountered a truck turning off Bittern northbound on to 25th Street. Rusty white Dodge or Chevrolet truck with homemade side runners. xxx TNL:Robert Wittmon Wittmon arrived at Building 35 at 7:15. At 7:20 p.m. he observed a man running out of a building across from Building 35 (perhaps the Dome Building). He ran toward a small red sports car that resembled a Fiat, and the man peeled out. The man was young with short dark hair, slight build, and tall. The man sped out of the parking lot. xxx TNL:Robert Wittmon Wittmon was approached in September 1989 by two people from Oregon State Police. The police had a photograph of a white pick-up with a camper attached. Mr Wittmon did not see this vehicle. The police were disinterested in his observations of the area around the Dome Building. xxx TNL:Frank Harmon (aka "Sam") Interviewed Frank Harmon on July 9, 1990 because he had some information about Cappie Harden with whom Frank Harmon had been acquainted for some time. xxx TNL:Frank Harmon (aka "Sam") Harmon lived in the house located at 3182 Hyacinth Street with John and Kelly Bender. Harmon bought a Gremlin from Cappie Hardin on January 17, 1989. Cappie Harden had brought the car to the Hyacinth Street house and Frank Harmon was repairing the car with Cappie Harden that day. xxx TNL:Frank Harmon (aka "Sam") Cappie received a telephone call around 10 p.m. and he went into the house to talk on the telephone to the person. Cappie told Frank Harmon that he had to go give Jodie Swearingen a ride somewhere. Cappie left in his Mustang shortly after 10 p.m. xxx TNL:Frank Harmon (aka "Sam") January 1990 Cappie telephoned him and asked Frank Harmon if he knew where Frank Gable parked his car on the night of the Francke murder. Frank Harmon asked Cappie why he was telling the police about the murder and Cappie responded, "I am just telling them (the police) what they wanted to hear." xxx TNL:Frank Harmon (aka "Sam") Frank Harmon disbelieves Cappie Harden's story of the murder. Frank Harmon also knows Jodie Swearingen. He disbelieves her story to the police because he knows her to be untruthful. xxx TNL:Frank Harmon (aka "Sam") Frank Harmon knows that Cappie Harden met Frank Gable only once and that was one time when Frank Gable gave Cappie a ride home from the Hyacinth Street house. xxx TNL:Marc Faulconer Interviewed Marc Faulconer on July 10, 1990. Valley Sports Management, Inc. Interviewed Mr. Faulconer for information about the 1988 Coed Softball Team sponsored by Magoo's Tavern. xxx TNL:Marc Faulconer Specifically interested in knowing whether Scott McAlister and Thomas Denney were teammates. Obtained the 1989 softball records and none showed Scott McAlister and Thomas Denney as teammates on the Magoo's squad. xxx TNL:Jim Eastridge Interviewed Jim Eastridge on July 10, 1990 for information about the 1988 Coed Softball team sponsored by Magoos. Mr. Eastridge did not know Thomas Denney. He did know of Scott McAlister. Mr. Eastridge had no recollection of the softball team or any of its players. xxx TNL:Phillip Johns Interviewed Phillip Johns on August 1, 1990. First, Mr. Johns had information on Frank Gable. Second, he had information on autopsy methods of Dr. Larry Lewman. xxx TNL:Phillip Johns Frank Gable was a "punk" who had joined the Christian group. xxx TNL:Phillip Johns Mr. Johns observed Frank Gable's behavior for six years inside the penitentiary. Frank's method of dealing with people was to confront them, but always have somebody else do the dirty work. Frank was not intelligent enough to have thought up the plan to rob "snitch papers" and to have carried out a murder. xxx TNL:Phillip Johns According to Mr. Johns, Frank was not a threat. He talked and acted "macho" but he was simply "hot air". Mr. Johns did observe Frank with Phil Kellotat from time to time, but Frank generally did not run in the same circle as Kellotat. xxx TNL:Phillip Johns Dr. Lewman performed the autopsy on Mr. Johns late wife, Edna. Dr. Lewman refused to analyze the gun shot indentation and the blood stains on the pillow, saying they were irrelevant and immaterial. Mr. Johns feels that he is a victim of a faulty autopsy. xxx TNL:Richard Welch I interviewed Mr. Welch on August 7, 1990 for information about Cynthia Hathaway and Johnny Lee Crouse. xxx TNL:Richard Welch Mr. Welch asked Cynthia Hathaway, "What do you know about the case?" Cynthia Hathaway responded, "I know that knife will never be found. That knife is in the Devil's Punchbowl." Mr. Welch asked her how she knew, and she responded, "I drove him there in my blue caprice. xxx TNL:Richard Welch Cynthia Hathaway told him that Johnny Lee Crouse told her that he and Tim Natividad had committed the murder. xxx TNL:Richard Welch Richard Dallas Welch firmly believes that Timothy David Natividad was a "punk" who was jealous of Frank Gable's success as a narcotics dealer. He said Natividad had to steal to get things. xxx TNL:Richard Welch Mr. Welch relates that John Crouse and Tim Natividad ran around together. He is frightened to go back to the penitentiary because he believes that the prison guards will kill him as he has helped Frank on his case. He spoke with Steve Jackson five times today. He wants to be a witness for Frank. xxx TNL:Richard Welch He believes that "Cappie Harden is full of shit." Michael Keerins told Mr. Welch that Cappie and he were "ratting" on Frank Gable because Frank is a rat. Cappie Harden told Mr. Welch that he was "ratting" on Frank Gable because, "it was either him or me." xxx TNL:Richard Welch Cappie Harden told Mr. Welch that he was the State's "million dollar baby". Mr. Welch is certain that some kind of a deal was made between the State and Cappie Harden. xxx TNL:Peter Baker Interviewed Pete Baker on August 7, 1990 for information on John Kevin Walker. He was responsible for smashing Walker's face at the Oregon State Penitentiary. "I hate rats! Kevin Walker was a rat. If I saw Shorty Harden, I would smash his face because I hate rats!" xxx TNL:Dewayne Christenson Interviewed Dewayne Christenson on August 7, 1990. Dewayne Christenson states he did not know Frank Gable until he met him recently in the Marion County jail. He also states that he did not know Cappie Harden either. Dewayne Christenson wanted to know the truth about Shorty (Cappie Harden). xxx TNL:Dewayne Christenson Christenson was transferred to a cell next to Shorty Harden on June 23 or June 24 of 1990. Mr. Christenson asked Shorty Harden why he was "ratting" on Frank Gable. Shorty Harden responded that he was ratting on Frank so Frank would not rat on him. xxx TNL:Dewayne Christenson According to Mr. Christenson, Shorty Harden continued, saying that Frank Gable does not know anything about the murder. Shorty Harden said, "I'm their (the State and the Oregon State Police) million dollar baby!" xxx TNL:Dewayne Christenson Mr. Christenson relates that it is obvious who really killed Michael Francke. He believes it was Tim Natividad. He furthermore believes that Elizabeth Godlove did not kill Natividad, even in self defense. He believes someone connected to the Francke murder killed Natividad to prevent him from talking about it later. xxx TNL:Dewayne Christenson Dewayne Christenson has a scheduled release date of August 16, 1990. He wants to participate in the trial as a witness for Frank Gable. xxx TNL:Bethel Hunsacker Interviewed Wayne Hunsacker on August 16, 1990 One of the State's principal witnesses. He probably would not report an unlawful activity to the police again as a result of their treatment of him in this case. xxx TNL:Bethel Hunsacker Hunsacker recalls punching out at 7 p.m. and walking from the time clock to the stairs leading out from the basement of the Dome Building. Mr. Hunsacker's vision of two people standing in the parking lot was obscured by ornamental bushes. Those bushes have now been trimmed, however. xxx TNL:Bethel Hunsacker Mr. Hunsacker turned to his right slightly and reached the sidewalk leading to the parking lot. Just as he reached the sidewalk, he heard a noise that sounded like someone getting the air knocked out of them. The noise got his attention, and he stopped and turned to his left. xxx TNL:Bethel Hunsacker He observed two men standing in the parking lot facing each other. Mr. Hunsacker was approximately fifty feet from the two men. He observed one man turn and walk in a normal fashion across the lawn toward the main entrance stairs of the Dome Building. That man was not wearing glasses. He was not running. He was not acting to be in any pain. xxx TNL:Bethel Hunsacker There was no unusual motion or gesture of this man. He looked like he was wearing a long coat. He was tall and thin. Mr. Hunsacker continues by saying that he did not believe this man was hurt. The man was not running, clutching himself, or acting in any unusual manner. xxx TNL:Bethel Hunsacker Mr. Hunsacker watched this man walk in a normal fashion toward the main stairs. From Mr. Hunsacker's position, the north portico stairs were not visible. As he watched the man walk toward the stairs, he turned to watch the other man. xxx TNL:Bethel Hunsacker The other man had turned quickly to the man's right and had run toward 23rd Street "just as fast as he could go." This man was short, had dark hair, had no glasses and was running without any visible trace of a limp. The man also was wearing a trench coat that was light colored and he also had dark pants. xxx TNL:Bethel Hunsacker The man reached 23rd Street and then ran through the construction site of the hospital. He did not see him anymore. He assumed that the man had gone into the Dome Building for some assistance. He thought at the time that the two men had just been clowning around. xxx TNL:Bethel Hunsacker He did not even tell his wife what he had seen because nothing seemed unusual or out of the ordinary that night. He told the police officer what he had observed the night before. xxx TNL:Alan Thompson Interviewed Alan Ray Thompson on August 16, 1990. Alan Ray Thompson was identified by Frank Gable as an individual with whom I should speak. Frank is talking to everybody who will listen to him. xxx TNL:Alan Thompson Had some information about Michael Keerins. He mentioned that he and Michael Keerins have been podmates since Michael Keerins returned from Idaho. xxx TNL:Alan Thompson Alan Thompson heard Michael Keerins talking about Frank Gable to another inmate. He told the other inmate, who he did not remember, that he was writing a book about Frank Gable. Alan Thompson overheard Michael Keerins say to the other inmate, "if it was not for the State and Michael Keerins, Frank Gable would be walking the streets today." xxx TNL:Alan Thompson Alan Ray Thompson is currently serving a sentence for possession of a controlled substance in case number 87C22118. xxx TNL:Sandra Harris Interviewed Sandra Harris on August 19, 1990 for background information on Prison Industries and Mr. James Leon Mickelson. Montana. Mr. Mickelson. xxx TNL:Sandra Harris The Warden of the Montana State Penitentiary, Henry Risley, expressed some concerns to her about Mr. Mickelson's reliability. Mr. Mickelson's personal behavior suggested abrasiveness, aggressiveness, and an ability for exaggeration. She added that he was a competent manager who did his job well. xxx TNL:Sandra Harris She is not aware of any unusual activities or any problems at Prison Industries during the relevant time period. Prison Industries was prohibited from selling its products to private entities. Mr. Mickelson departed the Prison Industries in 1983. xxx TNL:Curt Chisholm Interviewed Curt Chisholm on August 19, 1990. Mr. Chisholm has been in the corrections field in Montana for over twenty years. He was familiar with James Leon Mickelson. First, he noted that he knew of Mr. Mickelson but he did not know him socially. Second, he was aware of nothing unusual about Mr. Mickelson's tenure at Prison Industries. xxx TNL:Curt Chisholm My appointment with Mr. Chisholm was initially established by Representative Gerald Nisbet. During Mr. Chisholm's conversation with Rep. Nisbet, Mr. Chisholm relayed to Rep. Nisbet some personal observations about Mr. Mickelson's tenure at the Prison Industries. xxx TNL:Scott Seacat Interviewed Mr. Seacat on August 19, 1990. Mr. Seacat was not aware of Mr. James Mickelson, but he was aware of Prison Industries. Legislature audited Prison Industries just after it was started in 1979 and also during Mr. Mickelson's directorship in 1982. xxx TNL:Scott Seacat No financial irregularities sufficient to warrant an investigation. Mr. Seacat provided me with copies of the legislative audits on Prison Industries for 1980-1981 and 1982-1983. xxx TNL:Daniel Russell Interviewed Daniel Russell on August 21, 1990. His office is in the Corrections Building. Mr. Russell was a personal friend of Michael Francke. Mr. Russell was not amenable to an interview relating to James Leon Mickelson's tenure at the Prison Industries. xxx TNL:James Mickelson Traveled to Great Falls, MT on August 22, 1990. No record of property transfers to or from James Leon Mickelson during the 1979-1985 time period. It is unknown whether Mr. Mickelson did in fact own a furniture business in Great Falls, MT. xxx TNL:James Mickelson It remains undetermined whether or which antique furniture repair and refinishing operation Mr. Mickelson operated in Great Falls, MT. Ms. Harris is adamant that Mr. Mickelson did operate an antique furniture business in Great Falls. xxx TNL:Cheryl Slivek Interviewed Cheryl Slivek on August 22, 1990 about employment of James Leon Mickelson at the Easter Seals Society. Mr. Mickelson was the Marketing Manager of the workshop from February 14, 1979 through December 12, 1979. xxx TNL:Sonia Hoyt I interviewed Ms. Hoyt on September 7, 1990 for information about a vehicle she observed on January 17, 1989 shortly before noon. She had told the Oregon State Police that the car she observed had New Mexico license plates on it. xxx TNL:Sonia Hoyt The vehicle circled the parking lot in front of the Dome Building. It was a small car, like a Chevette or an import, with a rust color. She is certain that the vehicle had New Mexico license plates. xxx TNL:Deann Bradford Interviewed Deann Bradford on September 7, 1990. Ms. Bradford is the representative of the bank who directs inquiries about the Michael Francke Reward Fund to the Trustees. She directed me to speak with Fran Lushenko in the Governor's Office. xxx TNL:Fran Lushenko I interviewed Fran Lushenko on September 7, 1990 and served a Subpoena duces tecum at that time. Specifically interested in determining whether any claims had been made against the fund. xxx TNL:Fran Lushenko The principal trustee is Eric Hardgrove, who is responsible for the daily management of the fund from his place of employment at the Plaza Bank in Sunnyvale, CA. xxx TNL:Debora Ramey Interviewed Debbie Ramey on September 7, 1990 for information about the location of her sister, Frances Jones. They have not spoken to each other in a long time. Frances telephoned her parents from Billings, MT. She had no further information. xxx TNL:Alan Thompson Interviewed Alan Ray Thompson on September 7, 1990. Mr. Thompson had related to the investigator that Michael Keerins had confronted him just after my interview with Mr. Thompson on August 16, 1990. xxx TNL:Alan Thompson Michael Keerins went immediately to the E Pod telephone and placed a telephone call to someone in the District Attorney's Office. Michael Keerins told Mr. Thompson that he (Keerins) could make some arrangements with the District Attorney's Office to have Mr. Thompson's sentence reduced if Mr. Thompson would retract his statement to me of August 16, 1990. xxx TNL:Alan Thompson Mr. Thompson told me that he was standing by his story. On August 16, 1990 he overheard Michael Keerins boast, "if it was not for the State and Michael Keerins, Frank Gable would be walking the streets today!" xxx TNL:Alan Thompson The District Attorney is putting money on the inmate trust account of Michael Keerins. District Attorney purchased some running shoes for $139. Mr. Thompson has seen Michael Keerins waving the price tags and the receipts in the jail. Michael Keerins is very boastful about the association he has with the District Attorney. xxx TNL:Konrad Garcia Interviewed Konrad Garcia on September 11, 1990 for information on Timothy David Natividad. I had previously spoken to Melody Garcia. xxx TNL:Konrad Garcia Konrad Garcia related that Tim Natividad "popped into" his life in 1988. Konrad Garcia had no recollection of ever having known a Tim Natividad in the penitentiary. xxx TNL:Konrad Garcia At some point, Tim Natividad and Konrad Garcia began a telephone correspondence. Eventually Konrad Garcia placed Tim Natividad on his Visitor List at the penitentiary. Tim Natividad never came to visit him, they nevertheless continued to converse on the telephone. xxx TNL:Konrad Garcia Around October, 1988, Konrad Garcia noticed a change in the direction of the conversations. Tim Natividad began talking cryptically about how Konrad Garcia could "take out" people who had "fucked him over." xxx TNL:Konrad Garcia Tim Natividad eventually told Konrad Garcia that he (Tim Natividad) could get Konrad Garcia out of the penitentiary to "take out" somebody if Konrad Garcia did not mind who the target was. Tim Natividad told Konrad Garcia that he could be paid if he did not mind where the money came from, since it all came from the same place." xxx TNL:Konrad Garcia In retrospect, Konrad Garcia believes that Tim Natividad was recruiting him to commit a "hit" on Michael Francke. Tim Natividad had the power of somebody to bring a hitman out to do the "hit" on Michael Francke, to pay them, and to ensure immunity for them. The power, he believes strongly, comes directly from the Attorney General's office. xxx TNL:Konrad Garcia He believes that Michael Francke was killed for two reasons: first, to shut him up, and second, to get his dossier on corrupt activities. Konrad Garcia told the OSP that Scott McAlister set up Michael Francke and Tim Natividad was hired by Scott McAlister to either do the "hit" or find somebody else to do it. The OSP did not want to talk about this. xxx TNL:Richard Welch Interviewed Richard Welch on September 11, 1990 to determine whether he was consistent with the statement he gave me on August 7, 1990. He remains consistent with that statement. He remains available to testify on Frank Gable's behalf. xxx TNL:Arlen Smith Interviewed Arlen Smith on September 11, 1990. He related that his federal action will be held via teleconference. Mr. Smith advised a person to interview is Thomas Merriweather, who was in the Sexual Offender Program at the Oregon State Hospital on January 17, 1989. xxx TNL:Wayne Hunsacker I interviewed Mr. Hunsacker on September 27, 1990 to review the statement I took from him on August 16, 1990. He does not recall the types of shoes that the two men he observed were wearing. Has no recollection of a flashing red light from the car of Michael Francke. Does not recall observing any vehicle race away from the crime scene. Has no recollection of a young girl running toward a car. xxx TNL:Wayne Hunsacker Mr. Hunsacker remains faithful to his statement of August 16, 1990. A woman from the District Attorney's Office (Sara Moore?) and a police detective spoke with him the week following my interview (August 16, 1990.) xxx TNL:Wayne Hunsacker Hunsacker stresses that he is going to testify about what he saw and not what somebody else wants him to say that he saw. xxx TNL:Debbie Anderson I contacted Ms. Anderson on September 27, 1990 for information about statements that Wayne Hunsacker made to her shortly after January 17, 1989. Another co-worker, Mark (Phonix?) told her that Wayne Hunsacker had seen the murder. xxx TNL:Debbie Anderson Ms. Anderson spoke with Mr. Hunsacker shortly after the murder. He told her that as he was walking about of the building, he heard a person scream and he observed two men standing and facing each other. Then one man ran one direction and the other man walked to the Dome Building. xxx TNL:Mrs. Bob Dockins Interviewed Mrs. Dockins on September 28, 1990 to find out the address of Kevin Dockins. She told me that he no longer lived at that address and she did not know where he was. She had no further information. xxx TNL:Konrad Garcia I interviewed Konrad Garcia on October 4, 1990 to provide more details from our earlier conversation of September 11, 1990. xxx TNL:Konrad Garcia Mr. Garcia recalls that he first had contact with Timothy David Natividad in August 1988. Konrad Garcia had never heard of Tim Natividad before. xxx TNL:Konrad Garcia Tim Natividad was at Melody's house. Konrad Garcia asked Melody to talk to Tim Natividad. This was their first conversation. Mr. Garcia wanted to meet him in person because he was trying to figure out just who Tim Natividad was. Tim knew everything about Konrad Garcia, so he was curious to meet Tim in person. xxx TNL:Konrad Garcia Tim filled out his copy and returned it to the superintendent's office. Tim Natividad and Konrad Garcia never met in the penitentiary. xxx TNL:Konrad Garcia Tim's conversation became increasingly more "baited" with respect to the Corrections Department. Tim Natividad took great pains telling Konrad Garcia how he had been "fucked with" by the prison system, and how Tim Natividad could arrange for Konrad Garcia to "fuck" with the prison system to get even. xxx TNL:Konrad Garcia In late November, 1988, Konrad Garcia and Tim Natividad had their last telephone conversation. Tim Natividad told him that, "Top Man is getting too big and he needs his horns trimmed." He continued that "Top Man" had "fucked" Konrad Garcia and he (Tim Natividad) could arrange to bring Konrad out of the institution to "take out Top Man". xxx TNL:Konrad Garcia According to Konrad Garcia, Tim Natividad stressed that he could have him (Konrad) paid if "he (Konrad) was not particular about where the money came from since it's all covered. Moreover, Tim Natividad told Konrad Garcia that nobody would ever find out who "took out Top Man". xxx TNL:Konrad Garcia Konrad Garcia told Tim Natividad that he was not interested in the deal. In retrospect, Konrad Garcia believes that Tim Natividad was recruiting him to murder Michael Francke. xxx TNL:Konrad Garcia Garcia believes that Michael Francke was killed as a result of a conspiracy who discovered that Michael Francke knew about their activities involving drugs, racketeering and other things. xxx TNL:Konrad Garcia He believes that Nick Armenikis may have some involvement. Mr. Armenikis called Konrad Garcia into his office just after Konrad Garcia requested to have Tim Natividad placed on his visiting list. Following the Michael Francke murder, Mr. Armenikis again called Konrad Garcia into his office. He asked Konrad what he knew of Tim Natividad. xxx TNL:Konrad Garcia He also wanted to know if Konrad knew anything about Michael Francke. Konrad Garcia explained that he did not know anything about the murder and his conversations with Tim Natividad revolved around music and Konrad's family. xxx TNL:Konrad Garcia Mr. Armenikis called Konrad Garcia into his office just after Tim Natividad was killed. He again wanted to know if Konrad Garcia had spoken to Tim within the recent past and the content of their conversations. Konrad Garcia told Mr. Armenikis that he had not spoken with Tim Natividad since October. xxx TNL:Konrad Garcia Garcia notes that he told two detectives of the Oregon State Police about his observations with respect to Tim Natividad. Steve Fourhorn. During that conversation, Konrad Garcia told the police that Scott McAlister hired Tim Natividad to kill Michael Francke. Apparently the police were disinterested in listening to him. xxx TNL:Tyrone Williams I interviewed Tyrone Williams on October 12, 1990 for a factual development of his observations of January 17, 1989. He and a group of other patients left the ward at 7 p.m. to attend a Narcotics Anonymous meeting. xxx TNL:Tyrone Williams Stan Kuderoff was in the first group and Tyrone Williams was in the second group. The second group arrived in the parking lot for the Dome Building at 7:08 p.m. Tyrone recalls seeing a white car with its doors open. There was no flashing red light from the car. The only light was the dome light that was illuminating the car. Tyrone heard no siren. He looked into the car from a distance of about eight feet. He saw the telephone on its receiver. xxx TNL:Tyrone Williams He observed a man walking north along the sidewalk in front of the Administration Building. The man was about six feet tall with a heavy build. He had dark brown hair. The group returned through the parking lot at 9:45 p.m. The car door had been shut by this time. xxx TNL:Stan Kuderoff I interviewed Stan Kuderoff on October 12, 1990 for a factual development of his observations of January 17, 1989. He related that he and a group (Tyrone Williams, Rocky Montigue, Pat Boyd, and Steve Laknas) left the ward at 7 p.m. xxx TNL:Stan Kuderoff The group broke into two smaller groups along the way. Stan's group lead, while Tyrone's group followed shortly behind. Stan Kuderoff arrived in the parking lot of the Dome Building at 7:05 p.m. xxx TNL:Stan Kuderoff He observed the door to a car in an open position. The dome light of the car was illuminated. No flashing red light. Stan observed the telephone on its receiver. He did not see anybody running. He did not hear the sound of any cars rapidly leaving the parking area. xxx TNL:Stan Kuderoff He does not remember seeing any other cars in the lot. He does, however, recall observing a yellow van parked across the Center Street entrance to the hospital. xxx TNL:Stan Kuderoff Recalls returning through the area around 9:45 p.m. The car door was shut. He remembers that he did not see anybody running toward or away from the building. xxx TNL:Francis Martineau Interviewed Francis Martineau to investigate Frank Gable's tenancy at the apartments. xxx TNL:Francis Martineau Ms. Martineau was Frank and Janyne Gable's neighbor. Janyne moved into the apartments well before Frank did. Janyne had a small girl, Jessica. They believed that she really did not take adequate care of little Jessica. xxx TNL:Francis Martineau Frank Gable moved into the Apartment with Janyne in June or July of 1988. Believed that he was "the classic good looking, American man" because he was groomed, he appeared healthy and was in good shape. Worked out regularly at the Court House Athletic Club, which Francis Martineau also belonged as a member. xxx TNL:Francis Martineau He was far more sociable than Janyne. The tenants believed Janyne was arrogant and thought herself superior. Frank Gable and Jessica had a very good relationship. Jessica looked up to Frank and liked him immensely. xxx TNL:Francis Martineau He looked healthy, had a job and tenants could not understand why a nice man would want to be around Janyne. xxx TNL:Francis Martineau October 1988, Ms. Martineau noticed a change in Frank Gable. He started losing weight. There were many "scummy" looking people who started coming around the apartment at strange hours. xxx TNL:Francis Martineau Toward November and into December, Frank Gable became a different person. Ms. Martineau strongly believed that Frank Gable was using drugs and selling them to the people who came to his apartment. xxx TNL:Francis Martineau He lost weight rapidly. In December, Frank Gable backed his car into a brand new van, owned by a tenant Chris Laskowski. Frank Gable looked like a "walking dead person" in January 1989. He was a bag of bones. He was extremely skinny. His high cheek bones were extremely visible and well pronounced. His eyes were sunken. He looked unhealthy. xxx TNL:Francis Martineau She saw the composite drawing of the murderer, and she stresses that the drawing certainly does not adequately represent a fair image of Frank Gable in January, 1989. The composite may have looked like Frank Gable in August, but it in no respect resembled him in January 1989. xxx TNL:Francis Martineau Had a person seen Frank Gable in January, the person would have immediately noticed his emaciated, unhealthy appearance. Ms. Martineau firmly believes that Frank Gable was not the man in the pin striped suite because a suit would have been too bulky for him since he was so emaciated. xxx TNL:Francis Martineau She never saw him in a pin striped suit. She never saw him in a trenchcoat. He did not dress especially well in January 1989. He looked like an unkempt scrounge. Ms. Martineau does not believe that Frank Gable committed the murder. xxx TNL:Francis Martineau Gables rarely had money. They were constantly late paying their rent. Ms. Martineau believes that Frank Gable was not the "hit man" in the Michael Francke murder because he simply had no money. xxx TNL:Allan Johnson I interviewed Allan Johnson on October 19, 1990 to discover whether Frank Gable had many any threatening statements to Michael Keerins as had been reported in an Oregon State Police report. xxx TNL:Allan Johnson Frank Gable made no comments whatsoever to Michael Keerins. There were many comments made by Michael Keerins to Frank Gable and others in the pod about how he (Keerins) receives favorable treatment by the District Attorney's office in exchange for his testimony at Frank's trial. xxx TNL:Allan Johnson "Frank Gable did not fuck with Michael Keerins. Nobody was fucking with anybody." Allan Johnson related that the District Attorney takes Michael Keerins to dinner at the Black Angus restaurant each Friday afternoon. xxx TNL:Alan Thompson I interviewed Alan Ray Thompson on October 19, 1990 to discover whether Frank Gable had made any threatening statements to Michael Keerins as had been reported in an Oregon State Police report. He observed "nobody bothering anybody." He did not observe Frank Gable make any statements to Michael Keerins. xxx TNL:John Miethoff I interviewed John Miethoff on October 19, 1990 to discover whether Frank Gable had made any threatening statements to Michael Keerins as had been reported in an Oregon State police report. John Miethoff heard no statements by Frank Gable. xxx TNL:Curtis Coffin I have been monitoring the status of State of Oregon v Curtis Coffin. I attended the hearing today and discovered that the trial is now scheduled for June 17-19, 1991 for the conspiracy charge. Mark Geiger. xxx TNL:Tom Fuller I interviewed Mr. Fuller on November 2, 1990. Mr. Jerry Frazier accompanied us during the interview. Mr. Fuller was one of the individuals who attended the Director's Council meeting on January 17, 1989. xxx TNL:Tom Fuller He does not recall anything unusual during that meeting. He remembers commenting about the lack of security in the Dome Building and Michael Francke told him something to the effect of, "if someone is going to get you, there is ultimately nothing that you can do about it." The directors were preparing for the hearing before the Senate the next day. xxx TNL:Tom Fuller Fuller routinely used the north portico door for his entrance into and exit from the Dome Building. Many Dome Building employees used that door instead of the main doors because it was closer to the parking lot. The locking mechanism to the door was jammed and not operating properly on January 17, 1989. The north portico door was unlocked during the working hours of the Dome Building. xxx TNL:Tom Fuller He recalls a meeting earlier in the day with some people to discuss the Hauser property in Coos Bay. xxx TNL:Michael Shinall I interviewed Michael Shinall on November 7, 1990. Mr. Shinall related to me that he does not want to get involved with any attorneys or investigators in this case. xxx TNL:Michael Shinall He had just received some information that will "turn the case around." Mr. Shinall related to me that Elizabeth Godlove was the key to the case. The person who killed Michael Francke was the same person who killed Tim Natividad. xxx TNL:Ron Bissonnette Interviewed Ron Bissonnette on November 8, 1990 for information concerning his relationship with Frank Gable on January 18, 1989. Eric Johansen. xxx TNL:Ron Bissonnette Bissonnette first met Frank Gable around the first of January, 1989. They met at Larry Kessel's house. Jerry Baker and Debra Noyes were living with Larry Kessel at Kessel's house on 14th and Cross Street. xxx TNL:Ron Bissonnette Bissonnette maintains that he met Janyne Gable long before he met Frank Gable. He met janyne in November 1988 when she gave him a ride from his apartment on Franklin Street in West Salem to Jerry Baker's house. Scott and Anisa Dowd. xxx TNL:Ron Bissonnette Janyne Gable was the driver of anybody who needed a ride to pick up some crank. She also used crank. xxx TNL:Ron Bissonnette First encounter with Frank Gable was at the Kessel house. Ron Bissonnette did not appear at his court date. He moved in with Shelli Lynne Thomas for five days, through January 20, 1989. xxx TNL:Ron Bissonnette On January 17, 1989 Ron Bissonnette was spending the evening with Shelli Thomas at her house. At about 11 p.m. Shelli Thomas left the house to do something, so Ron Bissonnette went to Jerry Paul Baker's house at 14th and Cross. When he arrived there at 11:30 p.m. Frank Gable was in the house. xxx TNL:Ron Bissonnette Frank Gable did not appear "tweaked" to Ron Bissonnette, nor did he seem anxious or frightened. He just seemed "normal." Frank Gable left Baker's house at 11:45 p.m. and returned at 12:30 a.m. wearing other clothes than what he had when he left at 11:45 p.m. He wore a brown waist length coat. Frank Gable did not appear "tweaked". xxx TNL:Ron Bissonnette Frank Gable had arrived in the Toyota and was accompanied by a man who Ron Bissonnette had never seen before, or has never seen since. The man was about the same age as Frank Gable. He had shoulder length blonde hair. xxx TNL:Ron Bissonnette They arrived at the Baker house. The Toyota was idling in the alley (not in the driveway as the police report indicates). Frank Gable told Ron Bissonnette that they had been cruising around. They all remained at Baker's house for about 15 minutes. They all decided to go to Shelli's house. xxx TNL:Ron Bissonnette Ron telephoned her, but there was no answer. They decided to drive to Shelli's house. Ron Bissonnette, Frank Gable and the unknown man entered Frank's Toyota and drove to the Atkins Thriftway shopping center on Mission Street. Ron got out of the car and telephoned Shellie Thomas. There was no response. xxx TNL:Ron Bissonnette Ron left the telephone off the hook and the three of them drove back to Shellie's house. Ron got out of the car and stood next to the door. He could hear the telephone still ringing. Ron returned to the car and they went back to the Atkins Thriftway to put the telephone on the hook. xxx TNL:Ron Bissonnette They then went cruising around the area of "Felony Flats" the rest of the night. At some point, Ron bought a newspaper, some cola and some cigarettes at a convenience store on 25th and Mission Street. He did not look at the newspaper until after 9 a.m. on January 18. xxx TNL:Ron Bissonnette Ron Bissonnette related that Frank Gable's car had some clothes in it and some tools. He did not know what type of tools they were because it was dark and he could not really see them. The clothes were scattered in the back seat. It had the appearance to Ron that Frank had been kicked out of his house by Janyne and that is why his clothes were scattered about in the car. xxx TNL:Ron Bissonnette Also, during the cruising around town, Frank asked Ron Bissonnette if he wanted to buy a car alarm. He showed Ron the car alarm. The alarm was still in the box. The box was unopened. xxx TNL:Ron Bissonnette Around dawn on the morning of January 18, 1989 the trio arrived back at Shellie Thomas' house. Frank dropped Ron off at the house. Frank and the blonde man drove away. Ron entered the house and went to bed. He awoke around 9 a.m. He went into the kitchen and only then noticed the newspaper that reported Michael Francke had been killed. xxx TNL:Ron Bissonnette Ron Bissonnette believes that Frank Gable did not kill Michael Francke. He recalls that Frank Gable did not appear anxious or disturbed that night. They saw many police vehicles that night and Frank never acted nervous. xxx TNL:Ron Bissonnette Ron Bissonnette believes that the murder was committed by Tim Natividad. He has reached this conclusion on the basis of "deduction." He does recognize that Frank Gable and Tim Natividad do look similar in the night time, but he nevertheless believes that Frank Gable did not kill Michael Francke. xxx TNL:Ron Bissonnette Ron Bissonnette related some information about Jodie Swearingen. He has known Jodie since September 1988. They ran around together until she was sentenced to Hillcrest. xxx TNL:Ron Bissonnette He remembers that she telephoned Ron Bissonnette from the Bender house on January 17, 1989. At the time, Ron was staying with Shellie Lynne Thomas. Jodie wanted Ron to come to the Bender house and pick her up and go out with her. xxx TNL:Ron Bissonnette Ron went to the Bender house around 7 to 8 a.m. on January 29, 1989. He remembers seeing a lot of police around the house. He then recalls observing Jodie Swearingen being taken to a police car and driving away. xxx TNL:Ron Bissonnette Ron Bissonnette concluded that Jodie Swearingen is easily influenced and it would be possible for Jodie to go along with a story that someone "cooked up." xxx TNL:Ron Bissonnette He then added that Cappie Harden was making the story up. He believes that Cappie Harden was hanging out with Nick De Santos on January 17, 1989 or some guy named "Sam." Cappie and Nick or "Sam" made up the story in order to get reward money and their charges dropped. Ron knows that "Sam" is not Sam Harmon. Ron believes that Cappie Harden is lying. xxx TNL:Ron Bissonnette Finally, Ron Bissonnette related that the Oregon State Police questioned him every Monday for six weeks at the Oregon State Correctional Facility. The discovery provided to us by the District Attorney's office shows police reports for only three interviews. xxx TNL:Ron Bissonnette He also mentioned that the police attempted to get him to change his story. He knows that he moved in with Shelly Lynne Thomas the week of January 15-20, 1989. He also moved in with her in early March of 1989. He remembers that Shellie's child had been burned on March 4 by a cup of hot chocolate. He is certain that the time he spent with Frank Gable was January 17 through the 18, 1989 and not March, 1989. xxx TNL:Kenneth Farrell Interviewed Kenneth Morie Farrell on November 8, 1990 for information relating to his knowledge of Frank Gable. Considers himself Frank Gable's best friend. They have known each other at the Oregon State Penitentiary and the Cornerstone Program. Visited each other daily. xxx TNL:Kenneth Farrell There were two interviews with Mr. Farrell, but he told me that the Oregon State police spoke to him more than twice. xxx TNL:Kenneth Farrell Mr. Farrell related to me a description of his coat. Long black coat that Twyla, his wife, bought him. He did not loan the coat to anybody. He does not remember loaning the coat to Frank Gable in January. If he would have loaned it to him, Frank Gable would have worn it only one night. xxx TNL:Kenneth Farrell The second topic of the police report is the statement, "I think Frank could kill someone but he would have to be pretty low." Mr. Farrell asserts that he did not make this statement. xxx TNL:Kenneth Farrell The third topic was a red Dodge Colt. The police report makes it appear that Frank Gable and Ken Farrell purchased a red Dodge Colt. The car was used and owned by the Farrells. xxx TNL:Kenneth Farrell Police report mentions that Ken Farrell came to the Gable's apartment and saw Janyne Gable "freshly beaten up." This statement was false. She had no bruises and she had no red marks. Frank Gable had not beater her as the report implied. xxx TNL:Kenneth Farrell He did go into the bedroom and saw Frank Gable crying. Frank Gable told him that "he needed to get back into the program (Cornerstone Program) because he could not seem to make it on the outside." Mr. Farrell did not say "joint" as mentioned in the police report. xxx TNL:Kenneth Farrell He believes that Frank Gable had no involvement in the murder. "Frank is a pussycat," meaning that Frank Gable is not an overly aggressive person. Frank Gable is a sensitive person who is good with children. Does not believe that Frank Gable was capable of committing this murder. xxx TNL:Kenneth Farrell Mr. Farrell remarked that during the police interview of September 16, 1989, the police officers created in his mind through their discussions the picture of the event on January 17, 1989. xxx TNL:Kenneth Farrell The police officers told him that their suspect had been "jockey-boxing" Michael Francke's car when Michael Francke surprised the suspect. Michael Francke leaned into the car and started to pick up the suspect when the suspect reached into his boot and stabbed Michael Francke in an upward thrust. xxx TNL:Kenneth Farrell After giving this description, the police officers asked Ken Farrell if the scenario was possible, and he responded, "Yes, it is possible." Mr. Farrell believes that the police officers manipulated his response to say that Frank Gable "could kill someone but he would have to be pretty low." xxx TNL:Kenneth Farrell Mr. Farrell related some information about Janyne Gable. He believes that Janyne Gable was fired from her job at the Oregon State Hospital because she was stealing drugs from the hospital infirmary. He recalls seeing several drugs with hospital markings at the Gable's apartment. xxx TNL:Kenneth Farrell He also remembers when Janyne Gable was arrested for possession of methamphetamine. Mr. Farrell was accompanying Janyne Gable to a house occupied by Richard and Pam Welch in South Salem. They were going to the house to buy some drugs. xxx TNL:Kenneth Farrell When they arrived there, the house was being raided. They turned around and were driving down 13th Street, being tailed by a police car. The police car pulled them over at the Jack Pot on 13th Street. The police searched Janyne Gable's purse and found a bag of methamphetamine. xxx TNL:Kenneth Farrell Although Janyne maintains that the bag was "planted" on her, Ken Farrell insists that Janyne had the bag all along. Ken Farrell had observed Janyne take "crank." She snorted it, whereas Frank Gable injected it. xxx TNL:Kenneth Farrell He related that if Frank Gable would have done the murder, Frank Gable would have confided in him as a means of reducing his guilt. Frank Gable never told him of any killing, and he believes that the other witnesses (Gesner, Childers, Walker, Harden) are making up the story to reduce their jail time or to cut some deal with the authorities. xxx TNL:Sam Harmon Interviewed Sam Harmon telephonically at his residence on November 19, 1990 to confirm a portion of the interview I had with Patrick Boggs of November 9. xxx TNL:Sam Harmon I asked him if he recalled being present at his former apartment on April 15, 1990 when Pat Boggs and Cappie Harden were arguing. Sam related that he recalled Cappie Harden arriving at his apartment and walking in without knocking. xxx TNL:Sam Harmon He remembers that Pat Boggs came to the apartment and Cappie Harden and Pat Boggs began arguing. Same Harmon does not remember what Cappie Harden and Pat Boggs were arguing about. xxx TNL:Patrick Boggs Interviewed Pat Boggs on November 9, 1990 for information on Shorty Harden. Mr boggs has known shorty Harden for six years. Shorty Harden was instrumental in having Mr. Boggs arrested on a drug charge in November 1989. xxx TNL:Patrick Boggs He was visiting Sam Harmon on April 15, 1990 when Shorty Harden arrived. They not only argued about Harden "setting up" Pat Boggs but they also argued about Shorty's role in the indictment of Frank Gable. xxx TNL:Patrick Boggs He asked Shorty Harden why he was lying to the Oregon State Police. Harden responded, "I'm just doing what they are telling me to do. My ass is on the line, too." xxx TNL:Patrick Boggs Pat Boggs believes that Shorty Harden is getting some money from somewhere. Pat Boggs believes that Harden received some money for his work in the Burroughs trial in Polk County. Pat Boggs knows that Cappie Harden gave Sweeney the target gun that was used in that murder. xxx TNL:Patrick Boggs Pat Boggs believes that Cappie Harden is lying about Frank Gable's involvement in the Michael Francke murder. xxx TNL:Ronald Bissonnette Interviewed Ron Bissonnette on November 12, 1990 for information about Cappie Hardin's friend named "Sam". Ron related that "Sam" is not Sam Harmon. "Sam" is not a Mexican. The only Mexican who Ron knows that Cappie Harden hangs out with is Adam Hernandez, who is also known as Manuel. xxx TNL:Rosella and Marvin Tooker Interviewed Mr. and Mrs. Tooker on November 13, 1990 for information about the men they observed running across Center Street on January 17, 1989. xxx TNL:Rosella and Marvin Tooker On January 17, 1989, the Tookers were shopping in the Food for Less. Mrs. Tooker drove the car out of the parking lot and on to Hawthorne Street. She then turned on to Center Street and headed in the westbound lane. xxx TNL:Rosella and Marvin Tooker Tooker recall driving west past Park Street and the State Hospital. Just as the passed the second crosswalk, the one which has a yellow flashing light suspended above it, three men darted across Center Street. It was 7 p.m. xxx TNL:Rosella and Marvin Tooker The lead male wore a tan, near knee length coat. He also more long blonde hair that came to his shoulders. This man was slender and tall. The other two men wore dark clothing and had dark hair. The men ran from the Oregon State Hospital across Center Street and continued in a northwesterly direction. Mr. Tooker remarked, "there go three men out making trouble." xxx TNL:Rosella and Marvin Tooker Mr. Tooker, being a retired police officer, telephoned the Oregon State Police on January 18, 1989 to report his observation. Just two days following this police interview, Mr. Tooker received a menacing telephone call where the caller told him, "Tooker, you better shut your mouth!" xxx TNL:Rosella and Marvin Tooker Mr. Tooker related to me that he did not say the man "possibly" wore a tan trench coat and that the man "possibly" wore blonde hair. Moreover, Detective Pederson's report makes it appear that the Tookers encountered the three men near 25th Street. He has two attorneys -- Steven Gorham and Irene Taylor. I broke contact. xxx TNL:Gerald Batty I interviewed Gerald Allen Batty on November 28, 1990. He indicated that his attorney is Dianne Allessi. All contact with Mr. Batty terminated. xxx TNL:Dennis Plante I telephoned Mr. Plante at his place of employment on December 3, 1990 at 9:35 a.m. for his recollection of any observations he made while working in the Dome Building on January 17, 1989. xxx TNL:Dennis Plante He was willing to talk to me and that he wanted to tell us (the Gable defense team) about the manner in which the Marion County District Attorney's office treated him. xxx TNL:Dennis Plante He wanted to obtain the permission of Kodak's attorneys in Rochester, NY and in Portland, OR because the company's attorneys were interested in Mr. Plante's treatment. The company's attorneys were concerned about the manner in which the prosecutors and state investigators handled Mr. Plante. xxx TNL:Ron Bissonnette I interviewed Ron Bissonnette on December 5, 1990 because he had information about Jodie Swearingen. He related that Jodie wrote him a letter advising him that she was not a witness to the murder and that she never saw anything. xxx TNL:Ron Bissonnette Ron Bissonnette showed me the letter, and told me that I could keep it. I took the letter into a chain of custody pending a later date for instructions. xxx TNL:Jerry Baker Interviewed Jerry Paul Baker on December 15, 1990 for information about Frank Gable. He met Frank Gable in December 1988 through Shelli Lynne Thomas. xxx TNL:Jerry Baker Frank Gable did not pull a gun on Jerry Baker as the police reports describe. Eventually, Jerry Paul Baker and Frank Gable became associates. xxx TNL:Jerry Baker On January 17, 1989 he and Frank Gable were together all day and into the night. They drove around in Frank's car and were stopping in on their friends. xxx TNL:Jerry Baker Jerry Paul Baker knows Cappie Harden. He dislikes Harden. He knows that Harden is lying to the police in order to get time off of his sentence, and also a piece of the reward money. xxx TNL:Jerry Baker He knows that Shorty Harden has worked as an informant for the police on previous occasions. Shorty Harden was paid $30,000 from the police in a case involving the murder of a little girl. He also indicates that Shorty Harden was paid $10,000 from the police in the Burroughs murder case. xxx TNL:Jerry Baker He recalls that one of Shorty's friends, "Cowboy" will say that Shorty Harden is lying to everybody about Frank Gable. xxx TNL:Francine Stewart Mr. Abel and I interviewed Francine Stewart in her residence on December 7, 1990 at 10 a.m. Francine Stewart is Frank Gable's sister. Frank Gable's childhood consisted of an environment of neglect, illness, sexual abuse, and maturation with alcoholic adults. His mother suffers from severe alcohol abuse. His father and his step-father suffered from alcohol abuse as well. xxx TNL:Francine Stewart Frank Edward Gable was born on August 28, 1959 in Fort Pierre, South Dakota to Delores Dashner and Frank Joseph Gable. Four children in the Gable family: Francine, Sydney, Frank and Jamie. xxx TNL:Francine Stewart Frank Joseph Gable was an alcoholic. He died of cancer and complications of alcohol abuse in November 1968 when Frank Edward Gable was eight years of age. xxx TNL:Francine Stewart Frank Gable's mother, Delores Dashner, is an alcoholic. She has entered many alcohol treatment programs. She is also drinking heavily again. Mrs. Dashner was the victim of several episodes of spousal abuse committed by her former husband, William Buchholtz. It is unknown whether she was the victim of spousal abuse committed by her deceased husband, Frank Joseph Gable. xxx TNL:Francine Stewart Her brother, Frank Edward Gable, was a bright, but mischievous child. Two disturbing character traits. The first was a capacity to "mouth off" to anyone in authority. Frank's second disturbing character trait was to take blame for something that he did not do in order to get attention. Traits evolved in Frank's early childhood since Frank was largely ignored by his father and his mother. Francine was Mr. Gable's favorite child whereas Sydney was Mrs. Dashner's favorite. xxx TNL:Francine Stewart Les Gederos began spending time with the boys and taking them on trips and taking them to various events. He also furnished alcohol to Mrs. Dashner. Francine Stewart believes that Les Gederos began sexually abusing the boys at this time. She also believes that he was furnishing alcohol to Frank's mother in order to exert control over her and the boys. xxx TNL:Francine Stewart During this period of early childhood, Frank Gable succumbed to childhood illnesses. Especially pronounced during this period from 1964 to 1969 were several severe attacks of rheumatic fever. The diseases required hospitalization. Frank developed a heart murmur as a result of rheumatic fever. xxx TNL:Francine Stewart He missed a great deal of his classes. Just as Frank was beginning to catch up to the other children, he would get sick again and fall behind. In 1970, Frank's mother was abusing alcohol so much that she granted temporary custody of the boys to Les Gederos. xxx TNL:Francine Stewart On the "tree claim" Frank Gable encountered his most shattering experience of his childhood -- a severe burn. During the fire, Frank's overalls became engulfed in flames. The fire severely burned his legs and lower extremities. xxx TNL:Francine Stewart He was taken to the Burn Institute at the Shriner's Hospital of Cincinnati, Ohio where he remained for nearly eight months. The fire was accidental and not self-inflicted as the Discovery suggests. Francine Stewart firmly believes that the burns and horrible scarring of his legs and extremities eroded his self-image and were a contributing factor to his juvenile delinquency. xxx TNL:Francine Stewart IN 1974 Frank Gable and his family moved to Glasgow Montana. Frank Gable's home environment in Montana was again filled with neglect, spousal abuse and alcoholic. There were six incidents of spousal abuse including one episode in which one spouse threatened the other with a knife. Two pets died of starvation in the home. xxx TNL:Francine Stewart During this period, Frank Gable developed juvenile delinquency. He was caught stealing candy from the base store. He was eventually placed in a juvenile home for stealing licorice from a store. She asserts that Frank's juvenile delinquency resulted from a combination of terrible home environment, sexual abuse by Les Gederos, and a low self-image caused by the scarring of his legs and the burn incident. xxx TNL:Francine Stewart When Frank Gable was 17 years of age, his mother granted temporary custody of him and Sydney to Les Gederos. Francine Stewart believes that Les Gederos took advantage of his mother's alcohol dependency in order to get custody of the boys. xxx TNL:Francine Stewart Francine Stewart visited Frank in Oregon. She observed that his behavior was becoming "wild". He was "mouthing off", fighting and staying out all night. She suspected that he began using drugs. After her visit to Oregon, Francine Stewart lost contact with Frank. xxx TNL:Francine Stewart In 1988, Frank was scheduled for release. Francine Stewart was pregnant. The two siblings telephoned and wrote each other about their good news. Frank was looking forward to being an uncle. xxx TNL:Francine Stewart In May 1988 Francine Stewart miscarried. Frank was extremely concerned about her well-being. In early 1988, she received a telephone call from Janyne, who seemed depressed. xxx TNL:Francine Stewart Francine Stewart does not believe that Frank Gable committed the crime of which he is charged. Although she would understand the crime if the victim were someone who hurt Janyne, she cannot comprehend how Frank could possibly hurt someone who he did not know. xxx TNL:Francine Stewart Francine Stewart recalls that an Oregon State Police detective interviewed her in late 1989. He took a taped statement from her. I showed her a copy of the statement that we possessed from the Discovery. She informed me that there were portions of the statement that had been edited. xxx TNL:Francine Stewart She also related that the police have been rude to her. The detective threatened her with imprisonment and a $50,000 fine if she refused to cooperate with him. He furthermore assured her that "the lady D.A. would make her life Hell" if she refused to cooperate with him. As a result, she has lost respect for the Oregon State Police. xxx TNL:Wesley Purkey Mr. Abel and I interviewed Wesley Ira Purkey on December 7, 1990. Purkey was formerly imprisoned at the Oregon State Penitentiary on charges of sodomy. xxx TNL:Wesley Purkey We contacted Mr. Purkey to verify the comments he made to the Oregon State Police about drug trafficking inside the Oregon State Penitentiary. Reluctant to talk about this subject because he explained that he had been stabbed by an inmate named Gubert just following the interview with the Oregon State Police. Purkey was stabbed on August 21, 1989 with an inmate manufactured knife by Steven Leroy Gober. xxx TNL:Wesley Purkey Purkey believes that Nick Armenikis controls the drug trafficking trade in the Oregon State Penitentiary. He indicates that Michael Francke was murdered because he discovered the drug trade and intended to expose it. xxx TNL:Wesley Purkey Purkey did not elaborate on his statements to the Oregon State Police. The Police interviewed him six times and administered three polygraph examinations on him. Discovery provided to us by the District Attorney's office contains only one interview and one polygraph. xxx TNL:Wesley Purkey The only example that Mr. Purkey provided to us relating to drug trafficking in the penitentiary was an episode in which two inmates went to visit Nick Armenikis in his office. The inmates did not have drugs with them when they entered Mr. Armenikis' office, but they had drugs when they departed his office. He did not name the two inmates. xxx TNL:Gerald Batty Interviewed Gerald Allan Batty on December 11, 1990, accompanied by Robert Abel. We contacted Mr. Batty for information about drug trafficking in the Oregon State Penitentiary. His attorney, Dianne Allessi, gave me her consent to speak with Mr. Batty on December 10, 1990. xxx TNL:Gerald Batty Batty was immensely surprised that his name had arisen in the context of drug trafficking inside the penitentiary. His knowledge of drug trafficking comes directly from Wesley Purkey and other third hand sources. He has no direct knowledge or involvement in drug trafficking in the penitentiary, however, a guard named Corporal Garcia might be a source of information. xxx TNL:Ron Bissonnette I interviewed Ron Bissonnette on December 12, 1990 to discuss the letter that he received from Jodie Swearingen. He is willing to appear as a witness in the trial, saying that he received Jodie's letter through the regular mail, and that he recognizes the handwriting belonging to Jodie. xxx TNL:Richard Swain Interviewed Richard Swain on December 12, 1990. I had been given permission to interview Mr. Swain by his attorney, Noel Graffenson, on December 10, 1990. xxx TNL:Richard Swain I contacted Mr. Swain for information about Cappie Harden. Cappie Harden told him in June 1990 that he was making the story up about Frank Gable being involved in the murder. Cappie Harden and Richard Swain were incarcerated together in the Marion County jail during the time period in which Harden told Swain that he was making up the story. xxx TNL:Richard Swain Richard Swain provided me with a short history of Cappie Harden and the police. Cappie Harden has previously given the police information on some black guys who had committed a burglary. The black gang ran him out of Salem following the police apprehension of the ringleader named Barrett. xxx TNL:Richard Swain Cappie Harden then fled to Arizona, where he became involved in a drug ring. When the police closed it down, Cappie Harden "ratted" on his wife at that time, and the ringleader named Reynolds. Cappie Harden then returned to Salem. xxx TNL:Richard Swain He continued that Cappie Harden returned to Salem with some money. He believes that he was paid some money by the police for the information he gave them. Harden began dealing drugs in Salem. xxx TNL:Richard Swain Richard Swain continued that Harden suddenly came in to some money around March and April of 1989. This period roughly coincided with the Burroughs murder investigation. xxx TNL:Richard Swain Mr. Swain related that one of the defendants, Butch Hamel, was staying with Harden just before the police arrested him (Hamel). Richard Swain believes that Cappie Harden was paid some money by the police for the Burroughs case. He is unsure if Cappie Harden was paid out of Mr. Burroughs' $250,000 reward fund. TNL:Richard Swain Mr. Swain related that Cappie Harden is known as a liar and an opportunist. Mr. Swain observes that Harden's sentence, 18 months of probation, is suggestive of a "deal" with the police, especially in light of Harden's past criminal history. xxx TNL:Richard Swain I interviewed Richard Swain on December 14, 1990 to determine if he possessed any further information on Cappie Harden. He related to me that he had no further information at this time. xxx TNL:Robert Gray I interviewed Robert Gray on December 28, 1990 for information on Michael Keerins. Robert Gray has known Michael Keerins for several years. Michael Keerins has a history of "snitching". Gray believes that Michael Keerins has "snitched" on Robert Gray's brother, named Jimmy Weatherly. xxx TNL:Robert Gray Robert Gray furthermore notes that Michael Keerins told him that he invented the Frank Gable story to get out of the Idaho prison. An Oregon State Police detective, who has a big mustache, told Michael Keerins that he would be paid for information linking Frank Gable to the murder. xxx TNL:Robert Gray Michael Keerins then told Robert Gray that the Oregon State Police were offering to pay him $86,000 for "ratting" on Frank Gable. Robert Gray is wanting to testify for Frank Gable. xxx TNL:Dennis Hauserman I interviewed Dennis Lee Hauserman on January 2, 1991. I had previously obtained permission from his attorney, Olcott Thompson, to speak with him if Mr. Hauserman so desired. xxx TNL:Dennis Hauserman I contacted Dennis Lee Hauserman for information about Chuck Cochenour's statement to him that he (Cochenour) had killed Michael Francke. Mr. Hauserman related that he was at Chuck Cochenour's apartment around April 5, 1989. Present in the apartment were "Bobby T", Tina Louise Kerns, Dennis Hauserman and Chuck Cochenour. xxx TNL:Dennis Hauserman Chuck Cochenour had been shooting heroin and cocaine. Chuck Cochenour began talking about killing Michael Francke. Chuck Cochenour related that he walked up to Michael Francke and killed him by stabbing. xxx TNL:Dennis Hauserman Dennis Lee Hauserman indicated that Chuck Cochenour has left Oregon and is presently living with the Mexican Mafia somewhere in California. Hauserman asserted to me that Frank Gable did not kill Michael Francke. He continued that he does not like Frank Gable. xxx TNL:Dennis Hauserman He strongly urges that Chuck Cochenor and "the Law" have something to do with the murder. In response to my question of whether he has any theories of the identity of the murderer, he responded that "I don't want to die. I know who it was, but I don't want to die!". xxx TNL:Dennis Hauserman Dennis Lee Hauserman added that his brother-in-law is Michael Keerins. Hauserman is married to Tina Louis Kerns. She intentionally spells her name Kerns rather than Keerins because she has disassociated herself with the Keerins family. xxx TNL:Dennis Hauserman Hauserman personally knows Michael Keerins to be a liar. He is convinced that Michael Keerins is "ratting" on Frank Gable so that he (Keerins) will get publicity. Michael Keerins assert that he is responsible for keeping Frank Gable off of the streets. xxx TNL:Dennis Hauserman Hauserman communicated to me that he has hit Michael Keerins in the face twice since the two of them have been in the jail, and assures me that he will hit Keerins whenever he is able because Keerins is a "rat." xxx TNL:Julie Ringler Interviewed Julie Lee Ringler on January 2, 1991 for information on Frank Gable and her husband, Rick Ringler. xxx TNL:Julie Ringler Julie reviewed her Oregon State Police report and remarked that it seemed to be accurate. Police interviewed her only once and she did appear before the grand jury. xxx TNL:Julie Ringler Julie Ringler recalls that Frank Gable was at her house on Lee Street (2237 Lee Street, SE) sometime during the Winter of 1988. He showed her how she should defend herself if ever she was attacked while walking. Frank Gable grabbed her from behind and pulled her to the ground from behind. She related that she had the most terrifying feeling, even though Frank had warned her about what he was going to do. xxx TNL:Julie Ringler She went back to Frank and Janyne's apartment where she stayed until January 9, 1989. During this nine day period, Julie Ringler recalls that there were no other people living with the Gables. xxx TNL:Julie Ringler She also remembers seeing a keyring with something like a remote control button. She indicates that she does not know whether it was an alarm control button. She is now unsure whether the keyring was at Frank's apartment. xxx TNL:Julie Ringler Julie Ringler observed Frank's violent spousal abuse on one occasion. Julie observed Frank pick Janyne up by the neck and pin her against the wall. xxx TNL:Julie Ringler Julie Ringler does not recall attending a party around December 28, 1988 at Randy Studer's house. She does not remember Rick Ringler telling her about Frank Gable's actions at that party. She does not remember if Frank ever told her anything about killing somebody. xxx TNL:Julie Ringler Julie Ringler believes that Frank Gable did not commit the murder of Michael Francke. She does not like Frank Gable, but she believes that he did not do the murder. She indicates that Rick was in a great deal of pain and on medication (Vicadin) during the time period of the polygraph examinations and this may have skewed the results of the tests. xxx TNL:Earle Childers Interviewed Earle Francis Childers on January 2, 1991. I had previously been granted permission from his attorney, Paul Ferder, to speak with Mr. Childers. Earle Francis Childers informed me that he did not want to talk to me. xxx TNL:Richard Ringler Interviewed Richard Kirk Ringler on January 2, 1991 for information about Frank Gable and the party at Randy Studer's house on December 28, 1988. I had come at a bad time. He was unprepared to speak with me. xxx TNL:Richard Ringler He was somewhat apprehensive about talking to me because "the police really fucked me over." He had taken three polygraph examinations and had several interviews with the police. xxx TNL:Larry Kirkland Interviewed Larry Ellis Kirkland on January 9, 1991 to acquire some information about Earle Francis Childers. He and Earle Childers were incarcerated together in the Oregon State Penitentiary in late 1989. Earle Childers made several statements to Larry Kirkland regarding the investigation of Frank Gable. xxx TNL:Larry Kirkland Mr. Kirkland expressed his opinion of Earle Childers, "Earle Childers is the ultimate flake!" Apparently Childers engaged in acts of self-mutilation and was frequently in the penitentiary infirmary. xxx TNL:Larry Ogden Interviewed Larry Ogden on January 9, 1991 in order to obtain information relating to a "tip sheet." Mr Ogden related to me that on January 17, 1989 he was a patient in the Oregon State Hospital, Ward 41-B, sexual offender program. xxx TNL:Larry Ogden Ogden related that he was sitting in the gameroom window "thinking". Suddenly, he heard a loud pitched sound of somebody crying for help. From Mr. Ogden's vantage point, the Dome Building was clearly visible. Mr. Ogden continued that he again heard somebody cry for help. xxx TNL:Larry Ogden He heard two more cries for help, but these last two cries grew steadily softer. He saw nobody running and he saw or heard no cars peeling out. He did not see any other activity following the cries for help. Mr. Ogden related that he informed his counselor, Mr. Steven Barrett, that he had heard someone crying for help. xxx TNL:Larry Ogden Mr. Ogden relates that he initially told the police officer that he made his observations at 11 p.m. However, on further reflection, Larry Ogden knows that he made the observations much earlier. xxx TNL:Kennith Interviewed Harden. He Johnson. I permission. Hamel Kennith Hamel on January 9, 1991 in order to discuss Cappie instructed me that he was currently represented by Dustan terminated all contact until I could acquire Mr. Johnson's xxx TNL:John Larrimore I interviewed John Wesley Larrimore on January 9, 1991 to talk to him about Cappie Harden. He related that he did know Cappie Harden, but he was unaware if he had been the confidential reliable informant on whose information the Keizer police subsequently incorporated into their search warrant. xxx TNL:Dennis Hauserman I interviewed Dennis Hauser on January 11, 1991 because he had sent a message to see me. He informed me that He, Michael Keerins and Shorty Harden were making "crank" in Shorty Harden's apartment on Center Street on January 17, 1989. xxx TNL:Dennis Hauserman He also told me that Shorty Harden and Frank Gable met each other only once and that occurred when Frank Gable gave Shorty a ride from one end of town to the other. xxx TNL:Dennis Hauserman He knows that Frank Gable did not kill MIchael Francke. Mr. Hauserman adds that he knows who killed Michael Francke, but he will tell me later. He hinted that there were three guys who killed Michael Francke, and he knows them all. The men who set up the "hitmen" are high up within the State government. xxx TNL:Dennis Hauserman Informed me that the District Attorney Dingle had visited him. Told me that D.A. Dingle wanted to know everything about me, beginning with what I said and who I was. Hauserman told me that he was presently in "the hole" because he had beaten up Michael Keerins. Finally, he related that the whole murder involves a deli and a hotel. xxx TNL:Richard Kirk Ringler Witness was interviewed on March 13, 1991. He stated that he does not really know Frank Gable. He has only seen him maybe 10 times. He does not recall ever hearing Frank Gable mention anything about huring a government official. He furthermore asserted that he does recall being at a party at Tandy Studer's house, and Frank Gable came into the house extremely mad. Rick related that Frank was mad at Larry Kessell. I gave Rick Ringler a subpoena. xxx TNL:Dewayne Christensen Witness was interviewed at OSCI. He related that his counselor is Robert Galloway. I gave him a subpoena. xxx TNL:Ron Bissonnette Witness was interviewed on March 13, 1991 at OSCI. He related that Mr. Simpson is his counselor. Mr. Bissonnette is currently in Administrative Segregation. xxx TNL:Steven Scott Brobston Witness was interviewed on March 12, 1991. He was contacted because he was a former cellmate with Shorty Harden in the Marion County Correctional Facility during 1990. I wanted to know if Shorty Harden had made any comments to him regarding the role he was playing in the Gable case. Mr. Brobston related that he was Shorty's cellmate in the jail, but that he did not hear Shorty make any comments about the case. xxx TNL:Mark Davis Witness was interviewed on March 12, 1991. Mr. Davis informed me that he was being transported from the penetentiary to the Marion County court house in mid-1990 with John Kevin Walker. Mr. David recognized Mr. Walker because he had a pin stuck into his face from when he was injured on the penitentiary yard in April of 1990. Mr. Davis asked Mr. Walker why he was "ratting" on Frank Gable. Mr. Walker responded that he was going along with the D.A. and the police because they had promised him that they would reduce or drop charges against him in exchange for his testimony. Walker explained that nothing he told the police had ever happened and that Frank Gable did not confess to him that he killed Michael Francke. Davis related that this conversation carried over into the court house. Walker told him that when he was called to testify against Frank Gable during the trial that he would tell the court how he was coerced and intimidated by the state in order to make his statements against Frank Gable. Mr. Davis is willing to serve as a witness in this case. xxx TNL: Sidney Scott Interviewed March 20, 1991 at 2 p.m xxx TNL: Sidney Scott Related that he was a patient in the MED Program at OSH in January 1989. Just arrived in the program January 17, 1989. He recalls sitting in the window after supper at approximately 6:30 p.m. He heard a scream. He observed a man chasing another man. Lead man was on a bicycle. The tailing man had broken off the neck of a bottle and was chasing the man on the bicycle. xxx TNL: Sidney Scott Pair went across Center Street at the crosswalk and continued west on the south side of Center Street. The pair disappeared out of his sight in the grassy area just to the west of the old hospital. Other than this observation, Mr. Scott observed nothing else that night. He heard no more screams. xxx TNL: Michael Lawrence Simms Interviewed March 20, 1991 at 2:45 p.m. xxx TNL: Michael Lawrence Simms Contacted Mr. Simms for information relating to his association with Frank Gable. He was friend of Frank Gable and visited him frequently. They were in Cornerstone Program together. xxx TNL: Michael Lawrence Simms He did sell Frank Gable a dark pin striped suit jacket in early 1989. Was a one in ten chance that he sold the jacket to Frank Gable after the murder. Coat was a regular suit coat. Not a trench coat and was not a bulky coat. It was a suit coat and it fit Frank Gable. xxx TNL: Michael Lawrence Simms Mr. Simms had been questioned three times by the police who referred to themselves as "the two Polacks." He refused their request for a polygraph. xxx TNL: Michael Lawrence Simms Said he had no information that would help Frank Gable. xxx TNL: William Groener Interviewed March 25, 1991. xxx TNL: William Groener Groener was formerly employed by the State of Oregon Parole Board. Sometime in May 1990 he was contacted by Gene Miller who operates a used car lot off of 82nd Avenue in Portland. Mr. Miller informed Mr. Groener than an employee or acquaintance, named Robert Fuller, had information about Frank Gable. Robert Fuller had told Gene Miller that Frank Gable knew something about the Michael Francke murder. xxx TNL: William Groener Groener contacted the OSP with the information that Gene Miller had given him. He relates this is the only thing he has a connection with in the Francke investigation. xxx TNL: Rodney Dean Carey Address 1145 Karnet Court NE, Keizer. Interviewed on March 25, 1991. xxx TNL: Rodney Dean Carey Rodney Carey worked in Building 40 at the Oregon State Hospital on January 17, 1989. He took his break on the steps of the building that overlook the Dome Building. His break began at 7 p.m. He smoked some cigarettes and ate his meal. He returned to his job after his break ended at 7:30 p.m. He noted that on that night, he did not see or hear anything unusual. xxx TNL: Rodney Dean Carey Interviewed March 26, 1991. xxx TNL: Rodney Dean Carey Mr. Carey related that he worked in Ward 40 on January 17, 1989. He took his scheduled break from 7 p.m. until 7:30 p.m. He always took his break at that time. He was sitting on the steps of Building 40. xxx TNL: Rodney Dean Carey Carey informed me that he is trained to make observations around him, since he is a counselor at the Ward. On this night, January 17, 1989, he saw nothing unusual. He heard no cars peeling out; he saw nobody running away from the Dome Building and he did not hear anybody scream. xxx TNL: Rodney Dean Carey He indicated that from his position on the steps, he would have been able to observe the parking circles and the front lawn. He also would have been able to see 23rd Street and 25th Street. He reiterated that he saw and heard nothing. xxx TNL: Richard Fuller Interviewed on March 26, 1991 at 2 p.m. xxx TNL: Richard Fuller Fuller has known Gable for several years. Gable was member of the Lightyears Boxing club, organized by Fuller at the penitentiary. xxx TNL: Richard Fuller Fuller recalls he was transferred to the Washington State Penitentiary in late 1988. Frank Gable sent him a letter in late December of 1988 or early January 1989. The letter contained three photographs of Frank Gable. xxx TNL: Richard Fuller Just after Francke was murdered, Fuller received a telephone call from Gene Miller, who resided in Portland. Mr. Miller operated businesses in Portland that hired inmates. Miller told Fuller that Francke was murdered in Salem and that whoever killed Francke "really fucked up" because Michael Francke was trying to help the prisoners within the prison system. This telephone conversation occurred in the law library in the Washington State Penitentiary around January 20, 1989. xxx TNL: Richard Fuller Fuller explained he heard nothing more about the murder until March 1989 when he appeared before the Washington State Police and some prison officials from the Washington institution. The WSP asked him questions about Gable and showed Fuller a composite drawing of the suspect in the murder. Fuller stated the composite drawing resembled the photographs that Gable had sent him with his letter in December 1988 or early January 1989. xxx TNL: Richard Fuller In May 1989 Fuller was transferred from the WSP back to the OSP. He contacted Gene Miller and told him that Gable might know something about the murder. Early in June 1989, two detectives from the OSP took Fuller from the penitentiary to the patrol office (the green one next to the penitentiary) and questioned him extensively about Gable. Fuller gave the police the letter that he had received from Gable along with the three photographs. Fuller then returned to the penitentiary. He was housed in the Farm Annex. xxx TNL: Richard Fuller Just after the police interview Fuller related that he became frightened as a result of the information he gave to the police. He escaped from the Farm Annex on June 22, 1989. Fuller indicated he had previously been involved with the OSP when Det. Glover questioned him about a stabbing incident in which Fuller was the victim. No charges were brought against the alleged assailant, Hedin, who slashed Fuller's neck with a knife. For this reason, Fuller escaped from the Farm Annex. He was apprehended and placed in Administrative Segregation. xxx TNL: Karen Miles 4710 Linfield Court, NE. Interviewed March 27, 1991. xxx TNL: Karen Miles Contacted Miles for information about an incident in which a man told her of the murderer of Michael Francke. One day a man named Joe Logan came wandering through the apartment complex where she formerly lived. The man started a conversation with her. He told her that the man who killed Francke was Tim Natividad. xxx TNL: Karen Miles The man left her apartment. She telephoned the OSP and a detective arrived that very day. She told him of the incident, he gave her his card and asked her to telephone him if she ever saw Joe again. xxx TNL: Curtis Stephen Grecco 6135 Lauderback Street, NE, Keizer. Interviewed March 28, 1991. xxx TNL: Curtis Stephen Grecco Contacted Curtis Grecco for information about a telephone call that allegedly occurred from his home to the 911 operator on January 19, 1989. Grecco adamantly maintains that he did not make any telephone call in which the speaker told the 911 operator that the "man that killed Francke, his name is Curtis Grecco. He lives in Keizer. The murder weapon and the bloody clothes are in his garage." xxx TNL: Curtis Stephen Grecco Grecco explained that he received a telephone call from Wally Jorgensen on or about January 18, 1989 in which Jorgensen told Curtis Grecco that the police had interviewed him (Jorgensen) for information about the Francke homicide. The police were asking him about people in the boxing club who had previously been in trouble with the law. Jorgensen told the police that he knew a boxer, named Curtis Grecco, who used to box in the Capital Boxing Club. He had been in trouble with the law about 8 years ago. xxx TNL: Curtis Stephen Grecco Grecco recalls that shortly after the telephone call he received from Jorgensen, two police detectives arrived at his door, on January 22, 1989. The detectives introduced themselves and said they wanted to ask him some questions. When he discovered they believed he made a telephone call saying that he killed Francke, he thought they were joking. The police questioned him, searched the house and took several steak knives with them. xxx TNL: Curtis Stephen Grecco The two officers treated him well. No harassment or intimidation. Grecco told the police he didn't make the phone call. He indicated that he knew that police could trace 911 calls and that he was not stupid. xxx TNL: Curtis Stephen Grecco The police talked to Wendy Grecco, his wife, and she did tell the police that the voice "kind of sounded like him" when the police played a tape with Grecco's voice and a copy of the 911 tape. xxx TNL: Curtis Stephen Grecco Grecco adamantly maintains that he did not make the telephone call. He believed the call was fictitious. He doesn't want to be involved in this case because he doesn't want the publicity to damage his attempts to get a job with agencies dealing with troubled children. He has turned his life around and has not had trouble with the law for many years. xxx TNL: Curtis Stephen Grecco Grecco indicated he does not know anybody in this case except Michael Keerins. They knew each other while they were in MacLaren School. He claims that "Michael Keerins would rat on his mother in order to get twenty minutes taken off his sentence." Greeco has no contact with the Keerins family or any other person involved in this case. xxx TNL: Curtis Stephen Grecco Grecco reiterated that he did not make any telephone call to the police 911 number. He does not believe the state's experts (Lloyd Crisp and Alan Reich) who listened to the tapes of Grecco were correct. He maintains that the tapes were fictitiously made. xxx TNL: Lt. Gordon Ogden Interviewed April 1, 1991 at Coos County Jail. xxx TNL: Lt. Gordon Ogden Contacted Lt. Ogden to determine whether Gable had been placed in "the hole" in the days immediately preceding his arrest and transport to Salem on April 8, 1990. Lt. Ogden was unsure if Gable had been in the isolation unit, but if Gable were there for a disciplinary reason any reports about it would be confidential. Lt. Ogden indicated that the jail records could be obtained by a subpoena. xxx TNL: Correctional Officer Andrews Interviewed April 16, 1991. xxx TNL: Correctional Officer Andrews Contacted Officer Andrews for information regarding Randy Studer. Officer Andrews related to me that he would give his information when he testifies at the trial. xxx TNL: Robert Keith Hersha (aka "Doctor Bob") Interviewed April 17, 1991 after receiving permission of his attorney, James Evans. xxx TNL: Robert Keith Hersha (aka "Doctor Bob") Hersha is known as Doctor Bob in Salem. He told me the murder of Francke was planned in the Monterrey Apartments by Johnny Lee Crouse and Nancy Smith. Hersha was resident of the apartments at that time. Nancy Smith talked two other people into doing the murder: Timothy Marietta and Bobby Pachel. They recruited Pachel because he could get into any type of car. xxx TNL: Robert Keith Hersha (aka "Doctor Bob") On January 17, 1989 the following people departed the Monterrey Apartments to kill Francke: Crouse, Smith, Marietta and Pachel. Hersha did not know in whose car they went. Bobby Pachel opened the car door and Michael Francke saw them. Johnny Crouse stabbed Michael Francke and all of them ran off. They returned to the Monterrey Apartments. xxx TNL: Robert Keith Hersha (aka "Doctor Bob") Two days later Crouse and Smith drove to Portland to deliver the contents of what they obtained from the car. They were paid $3000 by whomever wanted the contents of the car. Apparently, Bobby Pachel had a falling out with the group and was killed. According to Robert Hersha, Pachel's body was placed into a 55 gallon drum and buried in a remote location. xxx TNL: Tracy Ocupe 4589 Agate Drive, SE, Salem. Interviewed April 17, 1991. xxx TNL: Tracy Ocupe Contacted Tracy Ocupe for information about Earle Francis Childers. She did not remember a lot about him. Even though they were close for a while, Ms. Ocupe had moved out of her mother's house during the time that Earle Childers was married to her mother. She recalls giving Earle a ride a few times to his substance abuse sessions at the Welcoma Club. She doesn't remember if she gave him a ride January 18, 1989. xxx TNL: Tracy Ocupe Her mother worked from 3 p.m. to 11 p.m. at the Salem Hospital. Her mother met Earle Childers when they were residents of an apartment complex. Ms. Ocupe indicated that her mother would prefer not to talk to me since her life had been made difficult through her marriage to Childers. The police had broken into their house several times in their searches for Earle Childers. The police had broken windows and doors in their house looking for Childers. xxx TNL: Tracy Ocupe Ocupe related that she does not remember ever meeting any of Childers' friends or associates, but added she wasn't around her mother's house much. Ocupe noted that she did not know if Childers would remember the exact articles of clothing he wore over a year ago; however, she added that Earle Childers was "pretty spacy". xxx TNL: Germano Cavota (aka "Eskimo Jerry") 3074 Lancaster Drive, NE, Salem. Interviewed April 18, 1991. xxx TNL: Germano Cavota (aka "Eskimo Jerry") I contacted Germano Cavota for information about Frank Gable. Cavota first met Gable in a Safeway parking lot in October 1988. Gable asked him if he wanted to purchase some marijuana. Cavota indicated he did have a business relationship with Gable, but he never considered himself an associate of Gable. They did not get along, especially after Cavota saw Janyne Gable exhibiting signs of having been the victim of beatings. xxx TNL: Germano Cavota (aka "Eskimo Jerry") Cavota used to visit Gable at his Hawthorne Avenue apartment to purchase drugs. He began going there less frequently after Gable got heavily into crank. Cavota did go to Gable's apartment on Highway Avenue (The Skyview Estates) a few times. xxx TNL: Germano Cavota (aka "Eskimo Jerry") Cavota has observed Gable wearing sunglasses during the daytime and at night. He remarked that Gable worse sunglasses about two-thirds of the time he knew him. xxx TNL: Germano Cavota (aka "Eskimo Jerry") Cavota described two coats that he observed Gable wearing. One was a black coat that went to the waist. The other was a dark leather coat that was long. Cavota could not remember any other description of the long leather coat, such as when he remembered seeing Frank Gable wear it. xxx TNL: Germano Cavota (aka "Eskimo Jerry") It should be noted that Cavota is a relative of Curtis Grecco. xxx TNL: Tracy Ocupe Interviewed April 19, 1991. xxx TNL: Tracy Ocupe Contacted Ocupe for information about her step-father, Earle Francis Childers. Her related that her mother had a surprise birthday party on January 15, 1989 at her mother's house on High Street. She recalls that Earle Childers was present at the party. xxx TNL: Twyla Boettcher 595 Bever Drive, NE, Keizer. Interviewed April 25, 1991. xxx TNL: Twyla Boettcher Contacted Boettcher for information about Frank Gable. She was formerly married to Kenneth Morie Farrell, who was a close associate of Frank Gable. She related that she and Kenneth Farrell are no longer married. xxx TNL: Twyla Boettcher Boettcher recalls taking Kenneth Farrell to a graduate group meeting in the Cornerstone Program. She attended the meeting with Farrell on that occasion. She doesn't remember the night of the meeting. xxx TNL: Twyla Boettcher Boettcher related that she purchased a large black trenchcoat for her former husband, Kenneth Farrell, as a Christmas present. The trenchcoat was dark, made of denim material and went to the mid-knee of Kenneth Farrell. She doesn't remember if she loaned the coat to Frank Gable in early 1989. She indicated the coat would have been very long on Frank Gable's body because Farrell was taller and larger than Frank Gable at that time. xxx TNL: Berta Aronson Interviewed April 25, 1991. xxx TNL: Berta Aronson Contacted Berta Aronson for information about a Graduate Group meeting at the Cornerstone Program on January 17, 1989. She related there was no record of Kenneth Morie Farrell attending a Graduate Group meeting on January 17, 1989. She informed me there were no log books kept of participants in the program signing into and out of the Graduate Group meetings. The hospital now maintains log books for the graduate group meeting, but this procedure did not exist in January of 1989. xxx TNL: Berta Aronson Although Berta Aronson does remember Kenneth Morie Farrell from the program, she does not know if he attended the group meeting that night. xxx TNL: Roger Gorder 795 South Street, NE, Salem. Interviewed April 26, 1991. xxx TNL: Roger Gorder Gorder recalls two vehicles parked in the Dome Building parking lot as he drove past it on January 17, 1989. He recalls that one vehicle was a blue sports car with a license plate HQS975. He also recalls that he heard a metal striking noise as well as some movements in the parking lot. xxx TNL: Elaine Premo Interviewed April 26, 1991. xxx TNL: Elaine Premo Contacted Premo for information about the people she observed around the crime scene on the night of January 17, 1989. She recalls that her husband took their daughter to her ballet lesson at 5:40 p.m. that night. Elaine Premo picked up her daughter at around 7:40 p.m. They drove down Park and then turned west onto Center Street for their route. xxx TNL: Elaine Premo As they approached the intersection of Center Street with Park Street, Premo observed a walking on the side of the street. He had a beard and mustache, short brownish hair and was wearing jeans and a tan coat that was waist length. What caught her attention was a long chain attached to his belt and dipping beneath the coat. It resembled a "biker" chain. xxx TNL: Elaine Premo Premo then turned west onto Center Street. She observed a couple who appeared in their 20's crossing northbound in the crosswalk and head to the bus stop. This couple sat at the bus stop. What drew her attention to the couple was that each of them had a bandanna wrapped around their leg at about mid-thigh. Elaine Premo then continued west on Center street. xxx TNL: Kenneth Morie Farrell 130 24th Street, SE, Salem. Interviewed April 26, 1991. xxx TNL: Kenneth Morie Farrell Interviewed Farrell for information about hospital visits with Michael Weaver during January 1989. Farrell related that his friend, Weaver, was injured by a log truck during early January 1989. He was placed in the Salem Hospital for treatment. (Hospital records show that Weaver was a patient in the hospital from January 13 through January 17, 1989.) xxx TNL: Kenneth Morie Farrell During this time Farrell and Frank Gable went to visit Michael Weaver. They visited him every night. Kenneth Farrell was unable to visit Michael Weaver on his last day of hospitalization because he went to Graduate Group at the Cornerstone Program. xxx TNL: Scott Hedlund 3792 Rockwood Drive, SE, Salem. Interviewed April 26, 1991. xxx TNL: Scott Hedlund Contact Scott Hedlund for information about Frank Gable. He met Gable at Rigid Truss in Salem during the period of August through October or November 1988. He knew of him from work. He would occasionally go to Frank Gable's apartment on Hawthorne Avenue. After Gable quit Rigid Truss, Hedlund would still occasionally visit Frank. xxx TNL: Scott Hedlund Hedlund purchased a coat from Gable in March of 1989. It was a black trenchcoat with a nylon lining. The coat had white specks on it. Hedlund bought this coat for $20. It fit him well. xxx TNL: Scott Hedlund Hedlund observed Gable with a red handled pocket knife. It was about three inches long with the knife was folded up into his picket. He never saw Gable carry any other knives. He never saw Gable with a gun. xxx TNL: Scott Hedlund Gable gave a New Year's party at his apartment on Hawthorne Street New Years Eve of 1988. Present at the party were Rick Ringler, Scott Hedlund, his girlfriend Annmarie Hanson, Janyne Gable and Frank Gable. He can't remember of Julie Ringler was present. The party was a lot of fun. Gable was the designated driver of the party. He made sure everybody made it home safely. xxx TNL: Scott Hedlund Occasionally Gable would pick Hedlund up from work at Rigid Truss and drive to the Oregon State Hospital to pick up Janyne Gable. Hedlund recalls an incident about a month after the murder of Michael Francke in which Gable and he were talking about the death. Hedlund recalls that Gable did not "airy" about the murder. He recalls that Gable was not nervous or full of anxiety when talking about the murder. Based upon Gable's demeanor during this conversation, Hedlund believes that Gable did not kill Francke. TNL: Berta Aronson Interviewed April 29, 1991. xxx TNL: Berta Aronson Interviewed for information about sign-in logs for participants in the Cornerstone Program. She related there were no sign-in logs at the time of Michael Francke's murder. She indicated that even if there were those logs they would no longer be at the Cornerstone program because she has turned over so many things to the police relating to different people in the case that the logs are no longer at the program. xxx TNL: Scott Hedlund Interviewed April 29, 1991. xxx TNL: Scott Hedlund Contacted Scott Hedlund for information about Frank Gable. Hedlund was co-worker at Rigid Truss in Salem with Gable. He indicated Gable was a good worker at Rigid Truss. Gable did as he was told and performed his job duties well. Hedlund recalls that Gable was employed at Rigid Truss from about August to November of 1988. xxx TNL: Scott Hedlund Hedlund considers himself very close friend to Gable. They worked together at Rigid Truss and socialized together off the job. Gable would frequently give Hedlund a ride home from work even after Gable no longer was employed at Rigid Truss. They would drive from Rigid Truss to the OSH where Janyne Gable worked to pick her up after her shift. Gable would then take Hedlund to his apartment. xxx TNL: Scott Hedlund On one occasion within one month of the murder, Gable picked up Hedlund at Rigid Truss and drove him to the OSH. They parked in front of the building where Janyne worked and waited for her to come out. Gable started talking about the murder of Francke. Hedlund recalls that Gable appeared calm when discussing the murder. Gable did not appear nervous or "airy" when discussing the murder. Held notes that Gable was not discussing the murder with any form of first hand knowledge. Gable's comments were simply a manner of making conversation. Gable remarked that it was strange the police had no leads on the murder. xxx TNL: Scott Hedlund Hedlund repeated his earlier comment that he was a close personal friend of Gable. He remarked it was strange that Gable would confess the murder to people who were not close friends and yet never made any comment remotely sounding like a confession to Hedlund, to whom he (Gable) confided. Hedlund believes Gable did not confess to anybody. He believes the people who are saying that Gable confessed are making it up to escape criminal charges or to get some of the reward money. Hedlund does not believe that Gable killed Francke. xxx TNL: Scott Hedlund Hedlund does recall seeing Gable with a red knife that resembled a Swiss Army knife. It had a blade that came out along with other components, like a bottle opener. He saw Gable wear it in his pocket. It was not unusual for Gable to wear a knife because everybody at Rigid Truss carried knives as they were helpful to sharpen pencils for marking wood and chipping wood away during construction. Hedlund never saw Gable with long knives or with guns, nor did he ever hear Gable talk about knives or guns. xxx TNL: Scott Hedlund Hedlund bought a long trenchcoat from Gable in March 1989. It was a long black trenchcoat, composed of wool fabric that had white specks in the fabric. The coat fit Hedlund well. Gable told him this coat belonged to a friend who needed money badly. The coat came to Hedlund's mid-calf. This coat was too small for Gable, and indicated when he (Hedlund) stood up, he was four to five inches shorter than Frank Gable, and he is smaller in physical stature than Frank Gable. The coat was too small for Gable. It would have been impossible for this coat to have come from Francke because it would not have fit Francke since it was just right for his (Hedlund's) physical stature, and it was too small for Frank Gable, who is much smaller than Francke. xxx TNL: Scott Hedlund Hedlund recalls that he attended a New Year Party Gable's apartment on Hawthorne Avenue on New Years Eve of 1988. Rick and Julie Ringler, along with several other people, were there. Gable was the designated driver for the party members. He drove everyone home who needed a ride. Gable wanted to make sure his guests arrived home safely. xxx TNL: Gordon Elwood Martin Interviewed April 30, 1991. xxx TNL: Gordon Elwood Martin I asked Mr. Martin if he was currently represented by an attorney. He responded that he was and all contact was terminated until I had received his attorney's permission to interview him. xxx TNL: Angie Myhre Interviewed on April 30, 1991. xxx TNL: Angie Myhre Contact Angie Myhre for information about Samuel Rosillo Cornejo (aka "Diablo"). She indicated she has known Sam for one to one and one-half years. She first met him at either O'Callahan's or Cascade Park. She is aware that he had at least one other girlfriend in Salem, and that he formerly worked at an Oriental restaurant as well as at La Casa Real. xxx TNL: Angie Myhre Myhre related that she was sleeping at her cousin's house on 17th and Nebraska Street. Her cousin, Dorothy McDonald was living there with Moises Guerrero-Ochoa. She recalls around midnight she was awakened by pounding on the door. She opened the door and Sam Cornejo came into the house. xxx TNL: Angie Myhre She described him as wearing a long tan trench coat. He appeared nervous, "hyped", and "wired". He said that he had just killed someone at the hospital. She did not see any knives with him. She cannot remember if his clothes had blood on them. She knows that he was not wearing tennis shoes or sneakers, because she had never known him to wear those types of shoes. He had on slipper type shoes. She remembers that he did wear a tan colored trench coat. xxx TNL: Angie Myhre The next morning she and McDonald drove Sam back to his apartment, passing the Dome Building on the way. She does not remember seeing any police cars around it, but recalls that Sam told them he had killed Francke at the building. She recalls that he pointed to the Dome Building and said he killed Francke. TNL: Angie Myhre Myhre states that she believed Sam when he said that he had killed Francke because Sam told them before she heard about the murder on the news. She believes Sam was not joking when he told her he had killed Francke. xxx TNL: Angie Myhre Myhre recalls that she met with her friend Bobbi Shelton, telling Shelton that her friend Sam had killed Francke. Bobbi Shelton apparently contacted the police with that information because a few days later she was contacted by two police officers in a parking lot of a restaurant on Portland Road. They wanted information about her friend Sam. She related that she told the police that Sam had come to her cousin's house and told her he killed Francke. xxx TNL: Angie Myhre Myhre is aware the police interviewed her three times. She did not take a polygraph test. She does remember that she did go one time into the big green building that is the OSP building near the penitentiary. She remembers that she received a telephone call from the police one day, informing her that Sam was taking a polygraph. The police later telephoned her and informed her that Sam had been released from the polygraph session. xxx TNL: Angie Myhre A short time after Sam's polygraph two police officers interviewed her again. The interview occurred in the back seat of the police vehicle. One of the two police officers gave her $250. Myhre went to Seattle for ten days, but telephoned police officers to let them know where she was located. She does not know exactly when the police gave her $250, but related it to the time Dorothy McDonald had gotten into trouble with the welfare agency. xxx TNL: Angie Myhre Upon her return to Salem, Sam Cornejo found her and wanted to talk to her. He was very angry that she had spoken with police. She didn't see him again after that but she did hear from one of Sam's brothers that Sam was very mad at her. xxx TNL: Angie Myhre Myhre described Sam during this time period as around six feet tall with dark brown hair and a mustache. xxx TNL: Angie Myhre Myhre learned from the family of Sam Cornejo's death. She does not believe the death was suicide. She learned from the family that the knots were tied in such a fashion that it just did not suggest suicide. Also, she disputes that a cellmate would sleep right through Sam's death without hearing anything. The family told her that Sam was taken immediately to a cell and not placed into a holding tank when he was brought into the jail. xxx TNL: Angie Myhre Myhre believes that Sam Cornejo was killed at the jail for one of two reasons: he either killed Francke and somebody wanted Sam killed, or Sam saw the killing of Michael Francke and somebody did not want Sam to talk about it. xxx TNL: Gordon Elwood Martin Interviewed May 1, 1991 in the presence of Catherine Conrad, Martin's attorney. xxx TNL: Gordon Elwood Martin Martin related that his sister, Tracy Knepper, delivered a baby at Salem Hospital around January 16, 1989. He was in hospital frequently to see his sister, his friend Wayne Knepper (aka Horse Head) and his baby niece. xxx TNL: Gordon Elwood Martin Martin remembers observing Gable at the hospital during that time. Gable was accompanied by a man with dark hair. On one occasion Gable parked in the parking lot near the covered walkway that leads from the general parking lot to the hospital. xxx TNL: Gordon Elwood Martin Martin recalls that he had a conversation recently in the lunch room at the Marion County Correctional Facility with Rick Kienitz (aka "Shitty Rick"). During this conversation Kienitz told him that he had made up the story about Gable in order to get some time cut off his Idaho sentence. Kienitz indicated that he cut a deal with the State. Kienitz said to Martin that he (Kienitz) had heard that the way to get out of a sentence was to cut a deal with the state about Gable. xxx TNL: Rosemary Selmer Interviewed May 1, 1991. xxx TNL: Rosemary Selmer Contacted Selmer for information about a dark blue vehicle departing the Dome Building at the beginning of her shift. She observed a dark blue panel van stopped at a stop sign at the intersection of Bittern Street and 25th Street on January 17, 1989. This occurred when she arrived at the beginning of her shift at around 10:30 p.m. She did not recall how many people were in the van. The van turned to the east after the stop sign, and it continued between Building 35 and Building 40. xxx TNL: Yvonne Heinrichs 1473 Narcissus Court, NW, Salem. Interviewed May 1, 1991. xxx TNL: Yvonne Heinrichs Contacted Heinrichs for information about some vehicles she observed around the Dome Building on January 17, 1989. She related that she went to the Plaid Pantry on Center Street just near the Oregon State Hospital on the evening of January 17, 1989. She observed two people standing next to the telephones outside of the store. One was female wearing blue jeans and long hair tied at the back. The other was a man in blue jeans. Both appeared "scraggly." xxx TNL: Yvonne Heinrichs As she passed them to enter the store she heard the female say, "That's it. I'm not putting up with anymore!" She walked away from the man. The man then picked up the telephone and called someone. He acted very angry toward whomever he was speaking with on the other line. This occurred around 8 p.m. xxx TNL: Yvonne Heinrichs Heinrichs left the Plaid Pantry and walked in the direction toward the Dome Building. She observed a man cross the street at the crosswalk. She then observed a large green car pull out of the Dome Building driveway that connects with Center Street. The car was a large green car that had red primer on the door. She noted that January 17, 1989 was a cold night and she observed very few vehicles parked in the parking lot as she walked past the Dome Building. xxx TNL: Yvonne Heinrichs When she reached Park Street she observed a unique blue colored sports car. The car had "soft edges." xxx TNL: Paul Bovelle Interviewed May 2, 1991. xxx TNL: Paul Bovelle Paul Bovelle is employed in Ward 50-H. He recalls that on January 17, 1989 he was driving south on 23rd Street. He had just turned off of D Street onto 23rd Street. He was heading toward Center Street in a southward direction. He indicated that he did not see anybody running away from the Dome Building across the street. He observed nothing unusual on that night. His observations occurred at 7 p.m. xxx TNL: Frank Bush 1320 SW Broadway Street. Interviewed May 2, 1991. xxx TNL: Frank Bush Contacted Bush for information about Mark Gesner. Bush is now retired but was employed at the Clark County jail in Vancouver, WA in the recent past. He observed Gesner while he was incarcerated in the jail. Gesner was visited quite frequently by the Oregon State Police, who questioned him about his knowledge of Gable. Gesner related to Bush that the police wanted him to say that Francke was killed as a result of finding a car burglar in the car. Gesner did not want to go along with that story. xxx TNL: Frank Bush The last time Gesner was in the Clark County jail he told Frank Bush that he was going to testify as the State wanted him since he had made a deal with the police. He related to Frank Bush, "It's a matter of 15 years or a few months. Everybody has to take care of themselves." xxx TNL: Frank Bush During Gesner's stay at the Clark County jail he indicated to Bush that his girlfriend, Rachel Shaver, was having some problems with the police. She had been threatened by someone. Gesner explained that just after the police questioned someone some big "goons" would show up at their door and threaten them by saying, "You better say no more!" This would occur just after a questioning session. xxx TNL: Frank Bush Gesner did not know if this "goon" was a police officer or somebody else. At any rate, Rachel Shaver was frightened of them, and she was frightened to change her story. xxx TNL: Frank Bush Bush recalls that Gesner asked Bush to place him (Gesner) in touch with the FBI to talk about the murder. Mark Gesner was extremely worried. He told Bush, "somebody is going to get set up. I want to talk to the FBI." Bush did contact an FBI agent, who did interview Gesner, but Bush does not know what ever became of that contact. xxx TNL: Frank Bush Interviewed May 2, 1991. xxx TNL: Frank Bush Bush again related that Mark Gesner made some statements to him while Gesner was in the Clark County jail. He told Bush, who was a guard at the facility at that time, that he had made a deal with the police for this testimony about Frank Gable. He told Frank Bush, "It's a matter of 15 years or just a few months. Everybody has to take care of themselves." xxx TNL: Frank Bush I served Frank Bush with his subpoena at this time. xxx TNL: Toni Jones 401 45th Court, NE, Salem. Interviewed on May 3, 1991. xxx TNL: Toni Jones Contacted Toni Jones for information relating to some individuals she observed in Steamer's Lounge on the evening of January 16, 1989. She and her step-mother, Susan Jones, had gone out for a drink at Steamer's, which is the lounge at the Chumaree in Salem. TNL: Toni Jones She observed Michael Francke sitting at a table. She recalls that she told her mother that the Director of Corrections was sitting in the lounge. This observation occurred just before 6 p.m. She remembers the time because she had a bowling engagement at 6:30 p.m. xxx TNL: Toni Jones Jones furthermore indicated she had observed Francke frequently in the lounge. On this particular evening he was sitting with a group of men who were wearing suits. xxx TNL: Toni Jones Jones recalls that there was a suspicious looking man sitting in the lounge. He was good looking and had brown hair. He also wore a tan colored trench coat. She remembers that he looked suspicious, however, she remarked that the man could have been waiting for someone. xxx TNL: Toni Jones I showed Toni Jones several photographs of individuals, including a series of two photographic throw-downs. She did not recognize any of the individuals in the photographs as being the suspicious looking man. She did note that she had gone to school with Timothy Natividad, and he was not the man she observed at Steamer's that night. xxx TNL: Gordon Elwood Martin Interviewed on May 3, 1991. I had previously received permission from his attorney, Catherine Conrad to speak with him. xxx TNL: Gordon Elwood Martin Martin informed me that he would provide me with some more information about Wayne Knepper when he received it. He furthermore related that he had an appointment with the Oregon State Police on Thursday of next week (this would be May 9, 1991). xxx TNL: Kerry Thornton Interviewed on May 6, 1991. xxx TNL: Kerry Thornton Contacted for information about his observation of the Dome Building grounds on January 17, 1989. He informed me that he did not remember anything about that night, however, he did state that he walked down Center Street that night. xxx TNL: Yvonne Heinrichs 1473 Narcissus Court NW, Salem. Interviewed May 5, 1991. xxx TNL: Yvonne Heinrichs Contacted Heinrichs for information relating to her observations of January 17, 1989. She provided me with some notes that she took about her observations. xxx TNL: Yvonne Heinrichs August 16, 1989. Letter to Patrick Francke regarding Michael Francke's murder. Concerned about the blacked out coroner's report offered to the Francke family and that perhaps not all available information had been given to Francke family about the murder. xxx TNL: Yvonne Heinrichs I'm not in a position to evaluate whether my experience that night is of any value or not. My dog's behavior that night resulted in my having more than an average interest in your brother's murder. xxx TNL: Yvonne Heinrichs Letter to Randy Martinak, Oregon Department of Justice regarding Psychic Lydecker's comments regarding Michael Francke's murder. xxx TNL: Yvonne Heinrichs Following is a description of Michael Francke's murdered given during a phone conversation between Beatrice Lydecker, a Psychic, and Yvonne Heinrichs on April 15, 1989. xxx TNL: Yvonne Heinrichs Consulted with pet psychic because of my dog Beau's very strange behavior as I drove past the Dome building the evening of Francke's murder. Later hearing of the murder I connected the dog's unique behavior with that event. xxx TNL: Yvonne Heinrichs Lydecker: At first Beau heard the man running and picked up on the smell of his murderous rage. Very thin face, slender, late 20's, running shoes, does a lot of running. Young, clean shaven, deep set eyes, small nose, wears baseball cap. Spent a long time sitting in car waiting for Francke to come out. Car was red or maroon. xxx TNL: Yvonne Heinrichs At this point I interjected that I had seen a car coming out of the curved driveway from the Dome Building, the side facing me was mostly red primer, that I saw green on the trunk lid and hood. Lydecker: That was the guy's car. He's the one who did it, you saw him. Beau saw him, that's why she was frantic to get out at that time. Maybe it was a Camero, I don't know car makes at all." xxx TNL: Yvonne Heinrichs Heinrichs: I don't know cars either, but I don't think it was a Camero." xxx TNL: Yvonne Heinrichs Lydecker: It doesn't matter, it's been painted since then." The guy was at the service for Francke, drove by, then was in the crowed, was really pleased with himself, really pleased with himself. Police have talked to him but he had an alibi, he lied. xxx TNL: Yvonne Heinrichs The reason he killed Francke was that Francke had something against him and refused to withdraw it. Lydecker said she thought Francke worked for the state, but wondered what position he held. I told her I thought it had something to do with paroles. xxx TNL: Yvonne Heinrichs Lydecker: Francke would not back down on something, wouldn't change his mind. The man who killed Francke may have been, or like a friend, someone he knew very well. I would recognize his face anyway. I will never forget it." xxx TNL: Yvonne Heinrichs Lydecker asked me if I thought anyone would listen to me if I tried to tell them what she had seen. I assured her that someone would listen, but didn't know if they could do anything about it. xxx TNL: Yvonne Heinrichs Lydecker said, "If they want to talk to me I can identify the murderer. xxx TNL: Yvonne Heinrichs Lydecker said the Los Angeles Police Department successfully used drawings based on her descriptions. Latourette Rd., Oregon City. 1-778-8067, 1-531-7389, 1-656-5342. xxx TNL: Yvonne Heinrichs Following is a description of the event which motivated me to consult Beatrice Lydecker, Pet Psychic. xxx TNL: Yvonne Heinrichs On the evening of January 17, 1989 between 8 - 8:30 p.m. give or take 1/2 hour, I drove past the Dome Building of the Oregon State Hospital in my van with my two dogs. xxx TNL: Yvonne Heinrichs We travelled west on D Street toward the intersection of D and Park. My dog Beau, who had been sleeping suddenly jumped up, looked out the windshield, and frantically started trying to get out the door on the driver's side. Over my lap, under my legs, despite my commands, "No! Get back, lay down," she just fought harder. my mind that maybe she had gone mad. The thought crossed xxx TNL: Yvonne Heinrichs A small blue car travelling east, lady driver and I reached the intersection at the same time. The blue car waited for me to go first. I turned south onto Park, struggling to keep Beau off my lap and out from under my legs. xxx TNL: Yvonne Heinrichs At Center and Park the traffic was extremely light. One car heading east on Center Street passed by, another car down by the Justice Center heading west. I turned west on Center street, seriously wondering just how far I was going to be able to continue to drive and fight off Beau at the same time. xxx TNL: Yvonne Heinrichs Thought if I could get down to the medical center by 24th Street I could pull into the parking lot and try and calm the dog. xxx TNL: Yvonne Heinrichs On Center Street just after we passed the first State Hospital crosswalk, I saw a young man with a light tan, hip length jacket on, walking east on the sidewalk. Maybe 5'9" - 5'10", 145 -160 lbs. xxx TNL: Yvonne Heinrichs At about the same time Beau got under my legs and in the struggle got her foot on the accelerator racing the engine. I had my other foot on brake. I got hold of the dog's skin and pulled her backwards up to the seat and shoved and pushed her to the passenger side. xxx TNL: Yvonne Heinrichs A car was coming down the driveway from the Dome Building, a thought crossed my mind that it might not stop. I braked slightly, the other car stopped. Beau momentarily clawed at the dashboard, looking at the other car, then tried to get over or under me again. xxx TNL: Yvonne Heinrichs The car that came down the driveway from the Dome Building was a large, squared off, American car, most but not all of the side toward me was covered with red primer. The trunk lid, and part of the hood was green. A man was driving. xxx TNL: Yvonne Heinrichs By the time we passed 24th Street Beau seemed to be calming down. We continued on to Plaid Pantry Store at 17th & Center where I stopped. xxx TNL: Yvonne Heinrichs As I headed into the store a man and woman came around the east side of the building and were arguing. The woman said she'd had it, wasn't going to put up with anymore. The man was over 6', 220-240 lbs, the woman 5'4"-6", thin, both shabbily dressed. Since they were standing close to my van I lingered in the store until the woman left, going back around the east side of the store. xxx TNL: Yvonne Heinrichs The man made a telephone call which resulted in a loud angry conversation. As I left the Plaid Pantry another young man, 5'8"-9", 145 lbs came walking east to west on Center Street past Plaid Pantry, turned around the building as if going to tavern, then back to Plaid Pantry. That concludes January 17, 1989 experience and observations on Center Street. xxx TNL: Yvonne Heinrichs Later, about 10:30 p.m. as I headed across the bridge to West Salem, my dog Beau again looked frightened. She tried to climb on my lap, very upset. The dog has done this everytime I cross the bridge from either direction, four to eight times a day, constantly reminding me of the night that behavior began. xxx TNL: Yvonne Heinrichs That was the impetus for me to finally contact the pet psychic. Beau has talked to her before, I figured she had something to say and would not let me forget it. If she ever exhibits such behavior again I will at least know I'm in close proximity to something violent or dangerous. xxx TNL: Yvonne Heinrichs Today, April 15, I suddenly became aware of what is causing the frightened reaction to the bridge. Today on TV News they showed a picture of the front Portico of the Dome Building. It has a railing on it that looks like a bridge railing. As soon as I can get someone to go with me I will take Beau to the Dome Building portico and let Beau explore the area to her satisfaction. Maybe that will help her get over the trauma of that night. xxx TNL: Yvonne Heinrichs Kind of a strange letter isn't it? So be it, that's the way it was. Yvonne L. CC: Oregon State Police Investigation Division, Salem. xxx TNL: Jerri Graham Interviewed May 8, 1991. xxx TNL: Jerri Graham Contacted Jerri Graham for information about Salvation Army clothing drop boxes that had been damaged during the early part of January 1989. SHe informed me that the drop boxes are damaged quite often by people who break into the boxes and strew the clothing around. She indicated that the Salvation Army maintains two drop boxes in Salem. One at 1085 Broadway St NE and the other at 1230 Winter Street. She looked through her incident report books, and noted there was no incident for the night of January 17, 1989. xxx TNL: Jerri Graham Graham did explain that incidents are placed in the incident report book when somebody observes a person damaging a drop box. The incident report book does not always contain all the incidents of damage to the drop boxes. xxx TNL: Kerry Thornton Interviewed May 8, 1991. xxx TNL: Kerry Thornton Contacted Kerry Thornton for information about his observations at the Dome Building on January 17, 1989. He related that he was looking for his dog on that night. He walked east on Center Street just past the Dome Building at around 7:15 p.m. He then cut across the southeast corner of the Dome Building grounds to reach 25th Street. He continued North on 25th street homeward. He observed nothing on his route. He indicated he was looking around since he was trying to find his dog. xxx TNL: Mary Vogelaar Interviewed May 8, 1991. xxx TNL: Mary Vogelaar Mary Vogelaar informed me that she was working at the hospital from the hours of 6:30 p.m. to 2:30 a.m. during January 1989. She indicated that Wayne Hunsacker had told her that he saw two guys fighting in the Dome Building parking lot. He told her that one guy ran away while the other guy walked to the building. Mary Vogelaar does not remember leaving her building on January 17, 1989, except to empty garbage. xxx
