In personally considering this matter, I have considerednay classified declaration dated October18, 2002, madsubmitted in snpport of mystate secrets privilege declaration in Edmonds DOJet v. al~, 02-CV-1448 (RBW). addition, I have reviewed and considered two classified declarations In by BruceJ. Gebhardt, the DeputyDirector of the Federal Bm’eau Investigation (FBI), one of dated October17, 2002and submitted in support of mystate secrets privilege declaration in Edmonds DOJet al., and the other dated May 2004 and submitted in support of mystate v. 12, secrets privilege assertion in Edmonds DOJ al., as well as in snpport of tbis state secrets v. et privilege assertion with respect to the proposeddeposition testimony of Sibel Edmonds in Bumett v. A1 Baraka Investment and Development Corp., MSC 04-203 (RBW) (Case Number CV9849 (RCC), Consolidated in 03 MD 1579 (RCC)(S.D.N.Y.)). (These classified declarations will be providedto the Court for ex ap_~, in camerareview, and set forth in more detail the privileged infomaationdescribed herein, as well as informationtoo sensitive to discuss on the public record.) My purposein submittingthis Declaration is to assert, at the request of the Director of the Federal Bureauof Investigation, and in nay capacity as Attorney Generaland head of the Department Justice, a formal claimof the state secrets privilege in order to protect the of foreign policy and national security interests of the UnitedStates. 3. As AttorneyGeneral, I possess original classification authority under § 1.4 of Executive Order 12958, dated April 17, 1995. 60 Fed. Reg. 19825. MyOctober 18, 2002 classified declaration submitted in Edmonds DOJet al., as well as the two classified Gebhardt v. Declarations, on whichI rely in this case, are properly classified under § 1.3 of ExecutiveOrder 12958because the public disclosure of the information contained in those declarations could reasonably be expectedto cause serious damage the foreign policy and national security of the to United States~ 4. I understandthat on April 13, 2004, Sibel Edmonds, former contract linguist a with the FBI, was subpoenaed give deposition testimony in Burnett v. A1Baraka. Ms. to Edmonds also the plaintiff in Edmonds DO et al., in whichI asserted the state secrets is v. J, privilege over certain informationat the heart of that case. 5. I have reviewed Ms. Edmonds’ subpoena in the Burnett case, and based on my personal consideration of the matter, I have concluded that any testimony by Ms. Edmonds with respect to the proposeddeposition topics as set fo~tb in Attachment to the subpoenawould A 2 necessitate disclosure of classified information, including identification and discussion of the nature of plaintiffs duties with the FBI, whichdisclosure reasonablycould be expectedto cause serious damage the national security interests of the UnitedStates. Anyfurther elaboration on to the public record concerningthis matter wouldreveal infom~ationthat could cause the very hm3ns assertion of the state secrets privilege is intended to prevent. Theclassified my declarations that I consideredin making this privilege assertion provide a moredetailed explanation of the infom~ationat issue and the harmsto national security that wouldresult from its disclosure. 6.
