This cause came before the Court on Plaintiff Federal Trade Commission's Motion for
Summary Judgment (D.E. filed on July 7,2005. This motion is before the undersigned on 137)
the consent of the parties pursuant to 28 U.S.C.$636 (c). Having carefully considered the motion
,the untimely responses and the reply thereto, the court file and all supporting evidence filed
therein, and the applicable law, it is hereby
ORDERED AND ADJUDGED that the FTCYs Motion for Summary Judgment is
GRANTED. As such, Final Judgment shall be entered against the named defendants, jointly and
severally,by separate Order. All other pending motions in this case are DENIED AS MOOT.
I IS FURTHER ORDERED that this Court shall retain jurisdiction of this matter for T
purposes of construction, modification and enforcement of this Order but the Clerk of Court is
hereby instructed that this file shall be CLOSED at this time.
