TOWN OF BROOKFIELD TOWN BOARD AUGUST 7, 2007 The regular meeting of the Town Board was held on Tuesday August 7, 2007 in the Erich Gnant Room of the Town Hall, 645 N Janacek Road, Brookfield, WI. Pro-Tem Chairperson Robert Flessas called the meeting to order at 7:05 p.m. with the following people present: Supervisors: John Schatzman, Patrick Stroebel and Dan Shea, Attorney James Hammes, Administrator Richard Czopp, Building Inspector Gary Lake and the Town Clerk Jane Carlson to record the minutes. Excused absence was Keith Henderson. APPROVAL OF AGENDA Supervisor Schatzman moved to approve the agenda as presented, seconded by Supervisor Shea, voted on, and carried unanimously. APPROVAL OF MINUTES Supervisor Shea moved to dispense with the reading of the minutes of the July 17, 2007 Town Board meeting and approve them as presented seconded by Supervisor Flessas voted on, carried unanimously. PUBLIC COMMENT OLD BUSINESS a. WAIVER TO DOG ORDINANCE AT 1375 S SPRINGDALE ROAD Mike Mattek spoke on behalf of Ms. Meggie Teasdale and explained that the board had requested that all five residence abutting or across from the property sign a letter that they are in support of the waiver being granted. He said that one resident has told them that he would not have a problem if the board would limit the waiver to allow only one additional dog which would limit them to three (3) dogs, and also limit the size of the dogs to no more than 40 pounds. Supervisor Schatzman explained that the last time a waiver was granted, the person had a hardship of already having three dogs not wanting to get a third one. In this case the person is in compliance but would like to acquire a third dog. He said that there is an ordinance on the books limiting the number of dogs a residence can have and thinks that it might be because of the close proximity of properties to each other. If a waiver is granted for the reason this one is requested, then the board should consider whether the ordinance should be changed to allow for more than two (2) dogs. Supervisor Schatzman moved to table any action on the waiver to the dog ordinance at 1375 S. Springdale Road until the petitioner submits the required information, seconded by Supervisor Shea, voted on, carried unanimously. b. DEVELOPMENT AGREEMENT WITH JAMES SHAFER FOR CONDOMINIUM DEVELOPMENT Supervisor Schatzman moved to approve the Development Agreement between the Town of Brookfield and James Shafer’s Trails Condominium Development located immediately west of the Town Hall site, seconded by Supervisor Stroebel voted on, carried unanimously. WAIVER OF ANNEXATION RIGHTS AGREEMENT WITH JACK SAFRO AND JAMES TESSMER Supervisor Shea moved to approve the Waiver of Annexation Rights Agreement with Jack Safro & James Tessmer as required for the Town granting a conservation easement to the Wis. DNR and Waukesha County Land Conservancy for Butler Garter snake mitigation, seconded by Supervisor Stroebel voted on, carried unanimously.
NEW BUSINESS a. SET TRICK OF TREAT Supervisor Shea moved to Trick or Treat for Wednesday, October 31, 2007 from 6:00 p.m. until 8:00 p.m., seconded by Supervisor Stroebel, voted on, and carried unanimously. PICNIC PERMIT Supervisor Shea moved to approve a Picnic Permit for Marx Park Sunday, August 19, 2007 for Bo Kui Teng from 12:00 noon until 6:30 p.m., seconded by Supervisor Stroebel, voted on, carried unanimously.

DEPARTMENT, BOARDS, COMMITTEE/COMMISSIONS RECOMMENDATIONS a. PLAN COMMISSION 1. REZONE TAX KEY BKFT 1123-997-008 Supervisor Schatzman moved to approve the rezoning of land identified as Parcel 2 on Certified Survey Map No. 10074 (Tax Key No. BKFT: 1123.977.008) from Rm-2 Multi-Family Residential district and C-1 Conservancy District with a Planned Unit Development (P.U.D.) Overlay District to B-2 Limited General Business District and C-1 Conservancy District, seconded by Supervisor Shea, voted on and carried unanimously.
VOUCHERS Supervisor Stroebel moved to approve the vouchers as presented in the amount of $137,032.67, seconded by Supervisor Schatzman, voted on, and carried unanimously. Included in the approved vouchers were: $25,682.01 to Veolia ES Solid Waste for refuse/recycling and yard waste services; $9,975.00 to Ray Galinski Contractors for rebuilding catch basins and $4,921.50 to Cramer, Multhauf & Hammes for legal fees. COMMUNICATIONS AND ANNOUNCEMENTS The attached list of correspondence was reviewed by members of the Board with no comment. There being no further business Supervisor Schatzman moved to adjourn, seconded by Supervisor Shea, voted on and carried unanimously.
