					This is an agreement entered into between a photographer and a client for wedding
videography and photography services. This agreement can be customized to include
the date of the wedding, ceremony location, reception location, production time,
payment terms, payment method, and description of the services that will be rendered.
This agreement can be used by small businesses that offer photography and
videography services, or by engaged couples looking to hire a photographer for their
wedding.
WEDDING PHOTOGRAPHY/VIDEOGRAPHY AGREEMENT

This wedding photography/videographer agreement (the “Agreement”) is made and entered into
this ___________ day of __________________, 20____ [Instruction: Insert Date] (the
“Effective Date”), by and between __________________ [Instruction: Insert Name of Studio],
__________________ [Instruction: Insert Address] (the “Studio”) and __________________
[Instruction: Insert Name of Client], __________________ [Instruction: Insert Address] (the
“Client”).

WHEREAS, Client wishes to hire the services of the Studio to videotape and photograph the
wedding ceremony of the Client and to produce photographs, proofs, albums, negative films and
a video playback program on __________________ [Instruction: Insert Type medium of
video] (the “Production”); and

WHEREAS, Studio agrees to videotape and photograph the Wedding on the terms and
conditions as set forth hereunder;

NOW, THEREFORE, in consideration of the mutual benefits and covenants set forth below, the
sufficiency of which is acknowledged by the parties, and with the intent to be legally bound by
this Agreement, the parties expressly agree as follows:

1. THE WEDDING

The Client’s wedding (“the Wedding”):

    A. Shall be between:

    B. Shall be held on __________________ [Instruction: Insert Date] (the “Wedding Date”)

    C. The ceremony will be held at: __________________ [Instruction: Insert Location
Name],     __________________       [Instruction: Insert Address],   commencing     at
__________________ [Instruction: Insert Time] and concluding at __________________
[Instruction: Insert Time] (the “Wedding Ceremony”).

    D. The Reception will be held at: __________________ [Instruction: Insert Location
Name],     __________________       [Instruction:  Insert Address],   commencing     at
__________________ [Instruction: Insert Time] and concluding at __________________
[Instruction: Insert Time] (the “Wedding Reception”).

    E. The Rehearsal will be held at: __________________ [Instruction: Insert Location
Name],     __________________       [Instruction:   Insert Address],  commencing     at
__________________ [Instruction: Insert Time] and concluding at __________________
[Instruction: Insert Time] (the “Wedding Rehearsal”).

2. PACKAGE

Client has selected the following video and photo package:

(the “Package”).

3. FEE

    A. Deposit: Upon execution hereof, Client shall provide Studio with a deposit in the amount
of ___________________ Dollars ($_____) [Instruction: Insert Amount] (the “Deposit”). The
Deposit shall be consideration for Studio reserving its services for Client on the Wedding Date,
and shall be applied against the Fee as further indicated in this paragraph.

       i.   In the event that Client provides at least thirty (30) days written notice of cancellation
to the Studio, Studio shall return fifty percent (50%) of the Deposit to Client.

      ii. In the event that Client provides less thirty (30) days notice of cancellation, Studio
shall be entitled to retain the entire Deposit.

     iii. In the event that Studio cancels for any reason, the entire Deposit and any other fees
paid by Client will be returned to the Client.

     iv.   In the event that the Client postpones of the Wedding, the Deposit may be applied to
the rescheduled Wedding date, provided that (a) the rescheduled Wedding date is not less than
one year from the date the Effective Date and (b) the Studio has no conflicting obligations or
commitments.

   B. Fee: Client shall pay Studio a fee in the amount of ___________________ Dollars
($_____) [Instruction: Insert Amount] (the “Fee”). One-half (1/2) of the fee shall be paid to
Studio no less than ten (10) day prior to the Wedding Rehearsal. The remainder shall be paid to
Studio upon delivery of final copies of the photos and video.

   C. The Fee shall include the number of photograph prints, and videos indicated in paragraph
2 hereof. Extra video copies shall furnished at an additional cost of $___________________
Dollars ($_____) [Instruction: Insert Amount] per copy. Extra prints shall furnished at an

additional cost of $___________________ Cents ($0._____) [Instruction: Insert Amount] per
copy.

   D. The Fee shall include Studio’s photography and videography services for up to
______________ hours [Instruction: Insert Time]. If the total job time exceeds such time,
overtime charges will apply at the rate of ___________________ Dollars ($_____) [Instruction:
Insert Amount] per hour.

4. STUDIO’S SERVICES

   A. Studio shall arrive no less than one hour prior to the Wedding Rehearsal, Wedding
Ceremony and Wedding Reception to set up Studio’s equipment.

    B. Throughout the duration of the Wedding Rehearsal, Wedding Ceremony and Wedding
Reception, Studio shall photograph and videotape the Wedding in a professional manner
consistent with the level of care, skill, practice and judgment exercised by other professionals in
performing services of a similar nature under similar circumstances with requisite skills,
qualifications and licenses needed to carry out such work.

    C. Studio will make best efforts to give the client the best photos and videos, but makes no
guarantee, in regards to the quality of the photographs or video tapes. The Studio also reserves
the right to edit and delete photos as it deems fit for the benefit of the Client. Studio does not
guarantee that everyone in the event will be photographed or included in the final edited
photographs, or that any particular shot, effect or interview will be included.

   D. The Studio shall not be responsible (and the Client assumes all such responsibility) for
securing permissions of any of the Wedding venues to allow photography and videography of the
Wedding. The Studio shall use its best efforts to abide by the rules of the venues.

    E. Studio shall provide Client with negatives and approval copies to Client no later than
_____________________ [Instruction: Insert Time] days following the Wedding. Following
receipt of approval copies, upon Client’s request, Studio will make one set of alterations. If such
alterations require more than one hour of editing time, such extra time shall be billed at
_____________________ Dollars ($_____)[Instruction: Insert Amount] per hour. Client shall
make such altertation requests in writing. Once requested alterations are completed, the final
photo and DVD copies will be produced. No additional alterations will be made.

   F. Studio makes no guarantee that photo or video DVD’s provided will function in all
computers or DVD players.

    G. Studio does not keep any photo or video files on its computer for a period longer than
_____________________ [Instruction: Insert Time] days from the delivery of the final copies,
so if any changes are requested after that time, Studio does not guarantee the availability of the
photo or video files.

5. RIGHTS

    A. The photographs and video produced by Studio are protected by the Copyright Act (17
U.S.C. 101 et seq.) and may not be reproduced in any manner without Studio’s written
permission. Upon Studio’s receipt of the entire Fee from Client, Studio shall transfer the
resulting images and Video to client provided that: (i) The Digital Files, Negatives and or
Transparencies are the property of Client for personal use and for only and (ii) the Client must
obtain written permission from Studio prior to publishing or selling the photographs and/or video
for profit.

    B. Studio shall have the irrevocable and unrestricted copyright to use and publish
photographs and videos of the Client for commercial, promotion, display, competition or other
purposes in any manner or medium, without any compensation to the Client. Client will be
responsible for advising all participants/ attendees that the wedding event will be videotaped and
photographed. All persons attending the event will be considered as consenting to be included in
the final photos/videos and/or commercial promotional materials.

    C. Client warrants that he/she has the legal rights over anything which the Studio will
videotape, including photos, music or other materials supplied by the client for use in this video,
and that client’s use will be limited to viewing by friends and family.

    D. Studio reserves the right to remove Studio’s employees and equipment from the Wedding
at any time if the Studio reasonably foresees any potential danger to the Studio’s employees or
equipment (including but not limited to belligerent or rowdy, intoxicated people; improper
fireworks; careless discharge of firearms). No refund of payments shall be given in such cases.
For outdoor Weddings, Studio shall utilize equipment to reduce wind noise and protect the
equipment in the event of rain. Notwithstanding the foregoing, Studio reserves the right to
immediately remove all equipment to an indoor location in the event of weather that may be
hazardous to Studio’s employees or equipment.

6. LIABILITY

    A. Studio takes utmost care with respect to the exposure, sound capture, editing, duplication
and delivery of the photo and video services offered. However, in the event if all of the photos
or video tapes are lost, stolen, damaged, or destroyed, for reasons beyond Studio’s best efforts,
Studio’s liability shall not exceed the total payments received by the Studio.

    B. The performance of this Agreement by Studio shall be contingent upon acts of God,
flood, fire, warfare, government laws or regulations, electrical failure, strikes by suppliers, and/or
conditions beyond its control.

    C. In the event if any of the Studio's photo or video equipment is stolen, damaged or
destroyed, either accidentally or intentionally, by the Client, its guests and attendants, or
employees of the Client, the Client will be fully responsible for the equipment's replacement.

7. MISCELLANEOUS

    A. This Agreement shall be construed in accordance with and governed for all purposes by
the laws of the State of __________ [Instruction: Insert State], applicable to contracts executed
and wholly performed therein. The parties agree to submit to the personal jurisdiction and venue
of Federal and State courts located in ________ County [Instruction: Insert County], State of
______________ [Instruction: Insert State].

   B. Any waiver of a breach or default hereunder shall not be deemed a waiver of a
subsequent breach or default of either the same provision or any other provision to this
Agreement.

   C. This agreement contains the entire understanding between the Studio and the Client. It
supersedes all prior and simultaneous agreements between the parties. Any modifications to this
Agreement must be in writing and signed by both parties.

IN WITNESS WHEREOF, the parties hereto have executed this Agreement as of the date first
set forth above.
