TAOS COUNTY BOARD OF COMMISSIONERS SPECIAL MEETING TUESDAY, NOVEMBER 27, 2007 9:00 A.M. CONTINUATION OF NOVEMBER 6, 2007 PUBLIC HEARING MINUTES I. Call to Order The meeting was called to order by Vice-Chairman Charlie I. Gonzales at 9:10 a.m. II. Roll Call Roll Call was taken by Ms. Elaine Montaño, County Clerk Present were: Daniel Barrone, Commissioner District I Charlie I. Amendments/Withdrawn Items (See Attachment No 1) Commissioner Daniel Barrone made a motion to approve the agenda as presented. Commissioner Joe M. Duran seconded. A roll call vote was taken by the County Clerk indicating the following: Commissioner Daniel Barrone Vice-Chairman Charlie I. Yes Yes Yes Yes Absent Public Hearing (9:00 am)- Discussion, consideration, and decisions regarding the following: A. Sacred Vista II Subdivision Preliminary Plat Application (Continuation from October 30, 2007 Special Meeting) - Edward Vigil, Senior Planner and Stephen Natelson, Attorney at Law Commissioner Nicklos Jaramillo commented that his understanding was that from the prior meeting on October 30, 2007 that the Public Hearing had been closed and the meeting taking place today would be staff’s recommendations. Also, Vice-Chairman Gonzales had requested a packet of information that was missing from the applicant to be provided to the Commissioners and the Commissioners are yet to receive that packet. Commissioner Jaramillo informed the Commission that it is difficult to make a decision on the proposed subdivision when the Commission is receiving documents and packets just before or during the meeting. Commissioner Jaramillo also stated that there has been mention that this matter has become a political situation, Commissioner Jaramillo stated that personally this is not a political anything. As a Commissioner, Commissioner Jaramillo feels that he has been entrusted by the citizens of Taos County to make honest decisions based on what is best for Taos County. Vice- Chairman Charlie I. Gonzales also informed the Commission and the audience that he feels the same as Commissioner Jaramillo. The request for packets has not been received by any of the Commission members. Mr. Sammy L. Pacheco, County Attorney informed the Commission that in reference to the packets that were requested, a letter was received on November 9, 2007 from Mr. Stephen Natelson. Mr. Pacheco read the letter aloud for the record stating the following: “Dear Sammy, As you requested on the closing, an additional six copies of the applicants proposed findings. Since there is a notebook with all of the exhibits and since virtually all the exhibits are matters of public record, I am not copying those documents at this time. If you have any questions, please feel free to contact me. Taos County Board of Commissioners Special Meeting November 27, 2007 Page 3 of 13 Sincerely, Mr. Natelson”. Mr. Pacheco informed the Commission that his recollection was that Mr. Natelson did commit to provide the Commission with individual copies of the notebook at the meeting of October 30, 2007. Mr. Pacheco received another letter on November 9, 2007 and Mr. Pacheco made a note on the bottom of the letter and it was placed in the Commissioners file stating the following, “Commissioner and Julia, Renee is the custodian of the notebook with all the exhibits referenced in this letter please call her to inspect at your convenience”. Mr. Pacheco informed the Commission that at the last meeting that took place on November 20, 2007 Mr. Vice-Chair did make a comment that he was expecting Mr. Natelson to honor his commitment of furnishing the notebook. Mr. Pacheco informed the Commission that he conveyed the Vice-Chairs concern to Mr. Natelson on November 21, 2007 and again on November 26, 2007, Mr. Natelson responded that he was going to respond to that at today’s meeting. Mr. Pacheco stated for the record that the Commissioners have not received individually the binder which contains quite a few exhibits and is put together very well. The binder would have enabled the Commission to understand the project better. Vice-Chairman Charlie I. Gonzales asked Mr. Pacheco to introduce the gentlemen from NMDOT that wrote a letter pertaining to Rabbit Valley road. Mr. Sammy L. Pacheco, County Attorney introduced Mr. Rueben Chavez-Garcia to the Commission. Mr. Garcia is a District V Engineer for the New Mexico Department of Transportation. Mr. Garcia wrote a letter on September 6, 2006 in which he was asked to re-analyze his position regarding the West Mesa development in reference to Rabbit Valley road. Mr. Pacheco informed the Commission that Mr. Garcia’s initial comment when the application went forth to the various State Agencies was that he did not have an opinion or that he did not feel that there was any problem with that particular development. Mr. Pacheco read aloud the letter addressed to Satrupa Kagel stating the following: “Dear Ms. Kagel, Thank you for bringing the situation of the subdivisions in The Tortuga Mesa, West Mesa area to my attention. In accordance with the Tortuga Mesa Master Fire Plan and a letter of January 15, 2006 from David Mitchell to the Taos County Planning and Zoning they indicate that this area will have 13 subdivisions. This is something that I was not aware of and therefore, did not express concern. However with 250 homes planned within these 13 subdivisions you will experience 2,400 cars a day of additional traffic. I did visit the site today and that the current roadways system; Rabbit Valley Road and Lower Las Colonias Road are inadequate for this additional number of cars. In addition, the county will need to work with the developer(s) to find a solution to provide adequate access route(s) to the subdivisions. A copy of this letter is being forwarded to Ms. Agnes Cardenas to inform the Taos County Commissioners and for inclusion in a plat approval hearing for Sacred Vista II on Monday September 11, 2006”. Vice-Chairman Charlie I. Gonzales thanked Mr. Garcia for being present at the meeting. Vice-Chair Gonzales informed Mr. Garcia that it is important that he is at the meeting in order to answer any question pertaining to the letter that was just read by legal council. Taos County Board of Commissioners Special Meeting November 27, 2007 Page 4 of 13 Vice-Chairman Charlie I. Gonzales opened the public hearing at 9:24 a.m. for the record. Commissioner Nicklos Jaramillo informed the Commission that the public hearing has already been closed and it can not be re-opened again unless there is a vote by the Commission to re-open it because new evidence has come forth. Commissioner Jaramillo understood that Mr. Garcia is at this meeting at the request of the Commission on comments that the Commission wants to hear, not for a public hearing. Mr. Sammy L. Pacheco, County Attorney informed the Commission that he reviewed the approved minutes of the October 30, 2007 Public Hearing Meeting and on page 36 of 45 it states that the Chairman closed the public hearing “at this time”. The public hearing closed at 2:20 p.m. However, Commissioner Charlie I Gonzales made a motion to continue the Public Hearing for November 27, 2007 at 9:00 a.m. Mr. Pacheco informed the Commission that the Chairman did indicate that he closed the public hearing “at this time” the motion that was made and voted on by the entire Commission was that the Public Hearing be continued. Mr. Pacheco recommended allowing public comment if the Vice-Chair and this Commission feel that it is necessary. Commissioner Nicklos Jaramillo informed the Commission that comments were made after the break and the reason for the continuation was because Mr. Natelson was supposed to provide the Commission with the binder in order to allow the Commission to make a suitable decision. Commissioner Jaramillo informed the Commission that he doesn’t have a problem re-opening the public hearing however, Commissioner Jaramillo suggested that the Commission allow people who have an interest to speak out at the public hearing and not to pick and choose. Vice-Chairman Charlie I. Gonzales informed the Commission and the audience that he will allow Mr. Garcia to talk to the Commission, allow the Planning Department and Mr. Natelson to give closing comments to the Commission. Vice-Chairman Gonzales requested that the letter that was presented this morning addressed to Mr. Nathan Sanchez from some of the residents from Rabbit Valley road be made part of the record. Commissioner Nicklos Jaramillo requested that the letter be provided to Mr. Natelson and Ms. Mary Humphrey. Mr. Sammy L. Pacheco, County Attorney informed the Commission that the letter addressed to Mr. Sanchez will be Exhibit “Q”. Commissioner Nicklos Jaramillo also requested that the letter from Mr. Garcia dated September 9, 2006 be made part of the record. Mr. Sammy L. Pacheco, County Attorney informed the Commission that the letter from Mr. Garcia will be Exhibit “R”. Mr. Pacheco also requested that the Commission approve the Exhibit list that was provided to the Commission. Taos County Board of Commissioners Special Meeting November 27, 2007 Page 5 of 13 Commissioner Nicklos Jaramillo made a motion to approve the Exhibit List that was provided by Mr. Pacheco with the amendments of Exhibit “Q and R”. Pacheco, County Attorney informed the Commission that there will be other exhibits that will need to be entered such as information from Mr. Natelson and Mr. Ken Cassutt. Ms. Elaine Montaño, County Clerk swore in Mr. Rueben Chavez-Garcia. Vice-Chairman Charlie I. Gonzales: My question to you Mr. Garcia, is do you still hold to this letter dated September 8, 2006 as far as the Rabbit Valley road is concerned. Mr. Rueben Chavez-Garcia: I would just like to add that I was notified by a concerned citizen to come and look at this particular subdivision and particularly the roadways that were going to be utilized by the subdivision. When the road was looked at the department did not feel that there was any impact to our roadway because of the size, it was small according to our standards. Then the concerned citizen showed me the fire plan that was proposed and by looking at your roadway system, it was obvious that the road is inadequate for 2-way traffic and I told this concerned citizen that I did not know your road standards but in other counties they have, depending on the amount of average daily traffic that utilize that road, there are different standards that are required Vice-Chairman Charlie I. Gonzales: Nathan, I would like you to address the standards of the different types of subdivisions when we get to it. Mr. Garcia, your opinion would you say that this road can not handle traffic of an ambulance, fire truck or big trucks of this nature. Mr. Rueben Chavez-Garcia: I did not go out and physically measure the road, but I think it might be 17 feet wide in some areas and that is pretty much in adequate. Vice-Chairman Charlie I. Gonzales: In part of the packet that we received there are aerial photos showing Rabbit Valley road. Mr. Rueben Chavez-Garcia: I did notice at that time that they were widening the road and there was a fence right next to the road and they were doing something to the road. Gonzales: I would like to have the pictures showing Rabbit Valley road included as part of the exhibits. Mr. Sammy L. Pacheco: That would be Exhibit “S” photographs taken by Ms. May Humphrey. Commissioner Nicklos Jaramillo: Mr. Garcia, a couple of questions on your letter that you submitted on September 8, 2006. Having worked with the highway department on other projects it is customary that you don’t get an opinion when in fact it does not directly impact state highways. In this case what you were looking at was Rabbit Valley road filtering back into a county road which is Lower Los Colonias. So therefore when the letter or the information from the Planning Department arrived at your department, the first thing you look at is the impact coming into a highway to see what kind of impact that it is going to have. So, am I not correct in that basically a no response from the highway department is because it did not directly affect the state highway but affected a county road and in your opinion the county roads were inadequate to provide for that service? Had it been and we have been talking about the possibility of developing a road that would filter off to 64 you at that would then have to come back and re-evaluate that decision based on the number of vehicles that would travel that road into a state highway is that correct? Mr. Rueben Chavez-Garcia: Yes, that is correct. I had first said that when I first looked at this subdivision, I did not have any concerns with the size and it did not affect any of our roads. However, these subdivision roads are bound to eventually come to a state highway. Commissioner Nicklos Jaramillo: Mr. Chairman, I just wanted to point that out that many of times we receive letters of no comment on a project, it does not mean that there is not an interest from that particular agency. It means that they are not impacted directly by it and therefore, they have no comment. The comment should come back from our Public Works Director from out Public Works Department as to what kind of impact it would have on county roads. Mr. Sammy L. Pacheco: Mr. Chairman I would just like to make sure that you allow Mr. Natelson to ask questions of Mr. Garcia. Ms. Elaine Montaño, County Clerk swore in Mr. Stephen Natelson. Stephen Natelson: Mr. Garcia, thank you for coming out today. What is your professional educational background for the position that you currently hold at the state? Mr. Rueben Chavez-Garcia: I have a bachelor’s degree in civil engineer and I also have 29 years of experience both in construction, design, traffic and development. Stephen Natelson: When was the last time that you physically inspected the section of road called Rabbit Valley road that is depicted on the photograph? Taos County Board of Commissioners Special Meeting November 27, 2007 Page 7 of 13 Mr. Rueben Chavez-Garcia: It was the same date as the letter. Stephen Natelson: Do you have a sufficient present recollection of in order to answer some questions about that road? Mr. Rueben Chavez-Garcia: I can try. Stephen Natelson: Did you measure the driving surface of the road? Mr. Rueben Chavez-Garcia: No, I did not. Stephen Natelson: Did you measure the distance between the fence lines? Mr. Rueben Chavez-Garcia: No, I did not. Stephen Natelson: Did you take a look at Lower Los Colonias road the paved road? Mr. Rueben Chavez-Garcia: Yes, I did. Stephen Natelson: Did you measure the driving surface of that road? Mr. Rueben Chavez-Garcia: No, I did not. Stephen Natelson: If I were to tell you that I went out there the other today on both of those roads and determined that the driving surface on the paved surface of Lower Los Colonias road was approximately 22 feet does that comport with generally with what you might have recollected when you saw that? Mr. Rueben Chavez-Garcia: Yes. Stephen Natelson: In large measure the dirt surface of Rabbit Valley road except for where it pinches in as shown in the photograph is it approximately 22 feet? Mr. Rueben Chavez-Garcia: I don’t know I did not measure it. Stephen Natelson: Was Rabbit Valley road about the same size as Lowe Los Colonias road in width? Mr. Rueben Chavez-Garcia: The main area, the road goes wider because it’s got more clearance then Lower Los Colonias road. Stephen Natelson: Lower Los Colonias road appears to be wider than Rabbit Valley road by a couple feet on each side maybe. If you were lets assume for purposes of these questions that Rabbit Valley road is in fact a county road. What ability does the county have to improve the road for safety purposes? Taos County Board of Commissioners Special Meeting November 27, 2007 Page 8 of 13 Mr. Rueben Chavez-Garcia: Typically, in other counties they hire an engineer for develop estimates. Stephen Natelson: Based on your experience does the county have the ability to acquire by acquisition or condemnation additional right of way along the road generally Rabbit Valley road, specifically for the purposes of widening it? Mr. Rueben Chavez-Garcia: I don’t know. Stephen Natelson: Does the county have the ability and the power to pave that road? Mr. Rueben Chavez-Garcia: I don’t know how the county paves their roads. Stephen Natelson: The County has a right to install speed bumps in order to control speed on the road. Do you have any idea when 250 additional homes and the amount of traffic you projected will be generated? Mr. Rueben Chavez-Garcia: Whenever the subdivision is approved. Stephen Natelson: Do you know how many current lots are proposed or pending in that area? Mr. Rueben Chavez-Garcia: No, I do not. Stephen Natelson: Do you know how many lots are in this proposed subdivision? Mr. Rueben Chavez-Garcia: About 20 some. Stephen Natelson: There would be 14 lots. Now, would the addition of 14 lots at this time have any kind of negative impact on Rabbit Valley road? Mr. Rueben Chavez-Garcia: No. Stephen Natelson: Mr. Chairman, those are all the questions I have. Vice-Chairman Charlie I. Gonzales: Mr. Pacheco do you have any questions for Mr. Garcia? Mr. Sammy L. Pacheco: Mr. Chairman, I do not have any other questions. Commissioner Nicklos Jaramillo: Mr. Garcia, just for clarification you were sort of misled. Rabbit Valley road, what we are talking about consists of our inventory is 5/10 of a mile. The rest of it is private or public through there, so the question was when you were asked if you looked at it a lot of the bottlenecks are in the private sector and therefore the county has not jurisdiction to go in there unless they dedicate that road to the county. Taos County Board of Commissioners Special Meeting November 27, 2007 Page 9 of 13 Mr. Sammy L. Pacheco: Actually, I do have a question for Mr. Garcia. One of the items that were discussed in our last meeting was a traffic count. Is it possible to get assistance from the highway department to perform traffic count in that area? Mr. Rueben Chavez-Garcia: Yes, we can request one through my office. Mr. Sammy L. Pacheco: Okay, however it is a dirt road and I was led to believe that the cable that the New Mexico Department of Transportation uses is only effective and accurate on paved roads, is that correct? Mr. Rueben Chavez-Garcia: That is correct, a dirt road traffic county would have to be done manually or use a device that is called a speed wagon that captures the speed of the vehicle and also does a count. Mr. Sammy L. Pacheco: I am going to ask permission from the commission to allow me to write you a letter to request your assistance to perform traffic counts on both Lower Los Colonias and Rabbit Valley road. Mr. Rueben Chavez-Garcia: I would recommend that you request a manual count at the intersection of Rabbit Valley road and Lower Los Colonias. The traffic count would be done on one day in the morning, noon and evening time. Vice-Chairman Charlie I. Gonzales: If there are no more questions or comments at this time, I will allow staff to speak at this time. Mr. Nathan Sanchez, Planning Director informed the Commission that all of reports done by staff have stated that there are numerous problems with Rabbit Valley road. Mr. Sanchez informed the Commission that there are currently 65 residents on Rabbit Valley road. Mr. Sanchez also informed the Commission that the Planning Department is considering for the future that once that number reaches 100, the application would be denied due to inadequate access. Mr. Sanchez referred to the Planning Regulations. Vice-Chairman Charlie I. Gonzales asked Mr. Sanchez about water studies for the area that will be affected in the future. Mr. Nathan Sanchez, Planning Director informed the Commission that the Planning Department submits a water study to the State Engineer for review and the State Engineer will then give his final decision for the application. Mr. Sanchez believes that in regards to this application the State Engineer was in favor of the subdivision. Mr. Sanchez informed the Commission that they have not requested an overall water study for the whole area. Vice-Chairman Charlie I. Gonzales asked Mr. Sanchez how many 30,0000 gallon tanks are required for this subdivision. Taos County Board of Commissioners Special Meeting November 27, 2007 Page 10 of 13 Commissioner Nicklos Jaramillo informed the Commission that the State Fire Marshals Office has repeatedly sent letters to the Planning Department addressing that each subdivision as to have a minimum of 30,000 gallons of water on site. They require it be within 1,000 feet of the dwellings. The Planning Department has approved subdivision with 10,000 gallon tanks, however 10,000 gallons of water will service approximately 7 minutes of fire fighting time. Commissioner Jaramillo stated that ISO states that 30,000 gallons of water are needed to combat one house fire at 250 gallons a minute for 2 hours that is the requirement. The requirement is for 30,000 gallons per subdivision. Vice- Chairman Charlie I. Gonzales asked Mr. David Mitchell to explain the water situation for the subdivision. Ms. Elaine Montaño, County Clerk swore in Mr. David Mitchell. David Mitchell: There is a 30,000 gallon water tank operational approved and inspected touching this property and then there is another 30,000 gallon water tank within a mile from the property. So, there are 60,000 gallons of water servicing this area. Mr. David Mitchell submitted a letter from Mark Yaravitz and the Fire Chief, Eric Montoya regarding Tortuga Subdivision fire protection as exhibit “T”. Commissioner Nicklos Jaramillo informed the Commission and the audience that the exhibits and information that is being provided again during the meeting will be impossible to review in order to make a decision today. The Commission will need the necessary time to review the information. Ms. Mary Humphrey informed the Commission and the audience that the subdivision application is obviously not complete and it is unfair to the residents and applicant to keep postponing the hearing in order to get a decision for this matter. Mr. Sammy L. Pacheco, County Attorney recommended to the Commission that a deadline be set for exhibits and information for this subdivision in order to avoid any further delays. Mr. Pacheco also informed the Commission that Executive Session for this meetings agendas will not be necessary since there will be no decision made today. Also, Mr. Pacheco recommended that an ample time be set for another hearing for questions and not for public comment. Mr. Stephen Natelson, Attorney read aloud Exhibit “U” a letter to Mr. Edward Vigil from Mr. Mike Darr who is the Geo-hydrologists for the area. Commissioner Joe M. Duran made a motion to take a break. Commissioner Nicklos Jaramillo seconded. The Commission took a break at 11:00 a.m. and returned at 11:22 p.m. Absent Commissioner Joe M Duran made a motion to return to regular session. Commissioner Daniel Barrone seconded. A roll call vote was taken by the County Clerk indicating the following: Commissioner Daniel Barrone Vice-Chairman Charlie I. Mr. Stephen Natelson, Attorney informed the Commission and the audience that the area where the proposed subdivision is to be developed is a very attractive location. In early 2006 the Planning Department believed that this application was complete. The Planning department then sent off the paperwork to the required state agencies to solicit opinions. At that point the Planning Commission reviewed the state agencies opinions and recommended approval. The concern that was brought to the applicant’s attention at the time was that this project was a common promotional plan. Mr. Natelson informed the Commission that the notebook with the applicant’s findings and exhibits can be provided to each of the Commissioners. Mr. Natelson informed the Commission that he is willing to participate to provide all the necessary information needed in order to make a receptive decision. Ms. Mary Humphrey, Attorney requested that all the information and exhibits that have been provided to both Mr. Natelson and the Commission also be provided to her for her review. Ms. Elaine Montaño, County Clerk swore in Mr. Thomas “Chubie” Tafoya. Thomas Tafoya: I would just like to say a few words, I also own property in the area and the type of people that will benefit from this proposed subdivision will be the working class people for example, State Policemen, Ski Valley Workers and people who work at the District Attorney’s office to mention a few. It would be very difficult for the locals to own a home in Taos County if it weren’t for the subdivisions. Commissioner Nicklos Jaramillo informed the Commission and the audience that he is in favor of affordable housing for Taos County. Right now, affordable housing is not available in Taos County. Ms. Elaine Montaño, County Clerk swore in Mr. Robert Knight. Yes Yes Yes Yes Absent Taos County Board of Commissioners Special Meeting November 27, 2007 Page 12 of 13 Robert Knight: I just wanted to clarify that the residents don’t want close to off the road. The issue has been to put in an adequate road an alternative access so that the safety and the welfare of who ever the future residents are in that area is provided. Mr. Sammy L. Pacheco, County Attorney recommended that the Commission instruct the Legal or Planning department to determine if more information is needed from the Planning Department or Legal Department. Mr. Pacheco suggested December 31, 2007 as the deadline for submitting and exchanging information and possibly come back on January 29th or February 12th 2007 for a conclusion of this meeting. Mr. Pacheco suggested categorizing all the documents and exhibits for the Commissioners and give back to the Commissioners by January 1, 2007. Commissioner Nicklos Jaramillo informed the Commission that the procedure for any subdivision application goes to the Planning Department and gets reviewed for its completion. After it’s completion a meeting is scheduled with the Planning and Zoning Commission in order to review all documents and apply the rules and regulations and then give an approval or denial for the application. Commission Jaramillo is concerned that the Planning and Zoning Commission will no longer be part of the process. Commissioner Nicklos Jaramillo made a motion to send the application back to the Planning Department and Planning and Zoning Commission in order to review all new information that has been provided and come back to the Commission with a recommendation. Yes Yes Yes Yes Absent Executive Session - Discussion, consideration, and decisions regarding the following: A. For discussion in executive session regarding Sacred Vista II Subdivision. This Matter may be discussed in closed session under Open Meetings Act exemption 10-15-1(H)(3), which allows for administrative adjudicatory deliberations. Note: Executive Session was withdrawn since the matter of the Sacred Vista II Subdivision was continued for later date. VII. Adjournment Commissioner Daniel Barrone made a motion to adjourn.
