The President opened the AGM and welcomed delegates and guests to the meeting.

His Excellency, Kevin Scarce AC CSO RANR, Patron of Local Government addressed
the meeting. The President thanked His Excellency for his attendance.

The President announced apologies from member Councils received prior to the
meeting and call for any further apologies.

The President also noted the various apologies from Members of Parliament including
the Premier of SA, the Hon Mike Rann MP, and Minister for State Local Government
Relations who was represented by the Hon Ian Hunter MLC.

achieved and acknowledged the achievements of the Immediate Past President, Cr

Strengthening Local Government Program

Moved Mt Gambier Seconded Gawler that the AGM:
1.   request that the LGA State Executive Committee be asked to treat as a priority for
    2007/08:
a)  improvements to Cabinet information on proposals by preparing a “Local
    Government Impact Statement”; and
b)  the establishment of a legislative framework for the State-Local Government
    Relations Agreement and the Minister’s State/Local Government Forum;
2.
a)  endorse the attached Implementation Framework for Shared Services in Local
    Government;

b)   support the approach that the LGA work with pilot Councils to progress the
     development of business cases;
c)    support the collaboration between LGCS and the LGA on procurement issues and
     shared services provision;
d)   endorse the securing of resources by the LGA from the Local Government
     Research & Development Scheme and LGFA grant for shared services to support
     the implementation of the Framework;
e)   support the enhancement of the Framework to include, overtime, current Local
     Government expenditures, targeted cost savings and key indicators of successful
     implementation;
f)   request that the LGA report on progress regarding implementation of the
     Framework at the 2008 AGM;
3.   note the progress by Councils in implementing the recommendations of the
     Financial Sustainability Inquiry as documented in the attached report on the 2007
     Financial Sustainability Survey;
4.   note the performance of the sector against selected financial indicators as set out
     in the attached SA Local Government Sector Financial Indicators Report 2007; and
5.   note that the LGA will prepare a submission to respond to the elections review
     report, including possible changes to LGA policy, in consultation with Councils.

Review of LGA Policy Manual

1. notes that the Draft Policy Manual has been subject to extensive consultation with
     member Councils, by two formal written invitations to comment, and informally by
     discussion at a President’s Forum; and
2. endorses and adopts the Draft LGA Policy Manual.

AMENDMENT Moved Pt Lincoln Seconded Lower Eyre Peninsula that the following
word changes occur in relation to point 7.5.2 on page 117 of the agenda papers: delete
“highest and best economic use” and substitute with “on a uniform cost basis”

Local Government House Building Fund and Municipal & District Purchasing Fund

Moved Wakefield Regional Seconded Yorke Peninsula that the AGM:
1.  endorse the recommendation of the CPA Board Pty Ltd that an amendment be
    made to the Indenture for the Municipal & District Purchasing Fund so that the
    Trustee is authorised to grant monies to any Local Government entities deemed
    appropriate by the Trustee (including the Local Government Association SA and
    the Local Government House Building Fund);
2.  endorses that any Member Councils not present at the LGA AGM are requested to
    pass a resolution to the same effect at their next available Council meeting.

Planning and Development Review

Moved Marion Seconded Pt Adelaide Enfield that the AGM receives a verbal update
    outlining:
1.  the progress of the Planning and Development Review and the options for further
    engagement of the Local Government sector in the Review process; and
2.  the LGA’s approach to consultation with Councils.

Federal Election Platform

Moved Whyalla Seconded Tea Tree Gully that the AGM endorses the actions taken by
the LGA State Executive Committee and by the Australian Local Government
Association with regard to the preparation and distribution of Federal Election Platforms.

State Government Regional Service Boundaries

Moved Mt Gambier Seconded Whyalla that the AGM:
1.  acknowledges that the implementation of uniform regional service boundaries for
    State Government Departments and Agencies will have benefits including
    improved efficiency and service delivery, and ease of dealing with State
    Government at the local level;
2.  notes assurances by the State Government that the new boundaries are not
    applicable to Local Government service delivery and will not be enforced by
    legislation; and
3.  acknowledges that some Councils are seeking to have the boundaries adjusted.

AMENDED Moved Holdfast Bay Seconded Grant that the Annual General meeting:

1.     acknowledges that the implementation of uniform regional service boundaries for

       servants seeking to use the regional service boundaries for spatial planning
       purposes, which Local Government understands is not their intent and which is
       likely to impact negatively on development planning issues; and
4.     acknowledges that some Councils are seeking to have the boundaries adjusted.

Moved Murray Bridge Seconded Wakefield Regional that the AGM:
1. receives a verbal update on the ‘Future Directions in Waste Management’ report; and
2. endorses the LGA’s Solid Waste Levy campaign and overall strategy.

Bus Stop Infrastructure

The President provided a verbal update.

Moved Marion Seconded Wattle Range that the AGM:
1.  receives a verbal update on the outcomes of the meeting between DTEI and LGA
    representatives held on 21 September 2007;
2.  endorses the development of a draft agreement on State and Local Government
    responsibilities for bus stop infrastructure; and
3.  notes that further updates will be provided to Councils through LGA Circulars as
    the matter progresses.

Natural Resource Management

Moved Loxton Waikerie Seconded Tatiara that the AGM:
1.  notes that Councils currently have statutory responsibilities in the governance of
    NRM, a long history of involvement in service provision as well as significant
    interests in the on-ground delivery and funding of NRM services in communities in
    their roles as community leaders and land managers;
2.  endorses the LGA Executive Director to convene a forum with Regional NRM
    Board Chairs and General Managers, Departmental officers and Local Government
    representatives to make high level recommendations to the Minister for
    Environment and Conservation and the LGA President on significant issues of
    concern regarding the implementation of NRM arrangements across the State;
3.  requests the LGA Secretariat to liaise with SAROC, the Metropolitan Local
    Government Group and the Department of Water, Land and Biodiversity
    Conservation (DWLBC) to prepare a briefing paper for the forum outlining the key
    issues of concern and options for resolution, including the findings of the review
    report completed by Tony Lawson Consulting;

4.   requests the LGA Secretariat to incorporate the matters raised by the Northern
     Areas Council (and other Councils) in its Notice of Motion (listed separately on the
     AGM agenda) in the briefing paper for the Forum, including:
     * Local Government’s future role in NRM levy collection;
     * investigation of a single, state-wide NRM levy; and
     * the actual level of NRM service delivery and funding to communities prior to and
           following the establishment of Regional NRM Boards; and
5.   requests the LGA President and State Executive Committee to monitor the
     outcomes of the actions listed in recommendations 2–4 above, including proposals
     to the Minister for Environment and Conservation for changes to administration,
     legislation, funding, communication and working relationships as appropriate.

Port Adelaide Enfield - LGA to lobby State Government to set up a Permanent
Crime/Corruption/Conduct Commission to investigate such issues

Moved Port Adelaide Enfield Seconded Unley that the position of the Local Government
Association of South Australia is that South Australian State and Local Government and
the South Australian public generally require the protection of a permanent
crime/corruption/conduct commission similar to the types of bodies which exist in NSW,
QLD, and WA to investigate such issues at the State and local level and that the LGA
actively lobby the State Government for the purpose of achieving this objective.

Flinders Ranges Council - Alternative Fuel Sources

Moved Flinders Ranges Seconded Alexandrina that the Local Government Association
supports exploration for alternative energy fuels, the investigation of and introduction of
alternative energy sources provided any application for the development of such energy
sites fully comply with development guidelines and appropriate environmental impact
study and is in the best interest of ratepayers. Council(s) reserve the right to avail
themselves of the best available technical and environmental advice in deciding to
support or oppose of any application.

City of Salisbury – Unclassified Videos

Federal Government to review the continuing decline in Federal Government Financial
Assistance Grants    (these have diminished over the last 20 years from 1.01% in
1996/97 to 0.76% currently and still falling).

Council – Natural Resources Management

Moved Northern Areas Seconded Mt Remarkable that the Local Government
Association of SA:
1.     Lobby for amendment to the Natural Resources Management Act 2004 to
       remove the requirement for Local Council involvement in levy collection or
       administration;
2.     Promote the collection of the levy on a single, state-wide basis; and
3.     Investigate and report back on the actual level of NRM service delivery and
       funding into the community prior to and following the introduction of the Regional
       NRM Boards under the NRM Act.

Holdfast Bay – Annotated Development Act

Moved Holdfast Bay Seconded Streaky Bay that the Local Government Association
negotiates on behalf of all local councils with the State Government, a funding package
so that one of the law faculties at either Adelaide, Flinders or the University of South
Australia, can update and continue to update the South Australian Annotated
Development Act and the South Australian annotated Development Regulations, as
previously published by Adelaide University. This document needs to be updated
regularly as each decision is handed down.

City of Marion – Rate Concessions for Pensioners Self Funded Retirees

authorities could be held responsible for the failure of the impacted Council infrastructure
as a result of work undertaken by the authority for a period of 5 years or 10% of the
remaining estimated life of the asset, whichever is the greater and make a
corresponding financial contribution to maintenance of the asset.

City of Marion – Liquor Licensing

Moved Marion Seconded Coorong that the LGA lobby the State Government to secure
funding for Councils to fulfill their statutory obligations under the Liquor Licensing Act
1997 regarding the bi-annual review of Dry Zones.

City of Onkaparinga – Urban Boundary Changes

Moved Onkaparinga Seconded Barossa that the Local Government Association of South
Australia express its concern to the State Government regarding the latest round of
announcements of growth boundary changes and in particular the lack of prior
consultation with Local Government.

The President advised of three late notices of motion received after the closing date and
sought the meetings direction on dealing with them.

Moved Marion Seconded Berri Barmera that the three late notices of motion :
Campbelltown – NRM Levies; Naracoorte Lucindale – Ageing Infrastructure; and West
Torrens – Stormwater Discharge, be accepted and dealt with at this meeting.

Moved West Torrens Seconded Mid Murray that the LGA, on behalf of Councils,
undertake a review into the feasibility of a concept of individual Councils being able to
introduce a “charge and rebate system” for stormwater or wastewater discharge from
private and commercial properties to kerb and gutter, creeks and adjacent properties.
