Mr. Mayberry handles commercial disput es, including antitrust cases, shareholder's disputes,
franchise disputes, software development disputes, financial services litigation, construction
litigation and intellectual property litigation. He has appeared in federal, state trial and appellate
courts locally and on a pro hac vice basis in numerous other jurisdictions. He has also
represented clients in arbitration proceedings. He routinely handles cases involving business torts
and unfair business practices. In addition, he has rep resented creditors in collection actions,
work outs and bankruptcies and has represented lenders, including subprime lenders, in litigation
regarding dis putes over mortgages and other loan transactions.

In the antitrust area, Mr. Mayberry advises clients on compliance wit h the Robinson-P atman Act,
Sherman Act, Clayton Act and state unfair trade practice laws. He advises clients on sales,
marketing, and distribution programs that raise antitrust issues. He also has experienc e litigating
antitrust matters, including large class action cases concerning both horizontal and vertical

He counsels clients regarding e-discovery plans and implementation of those plans and related
issues; and he handles cases with extensive e-discovery issues, including recently leading a
review project in which more than 3 million files were reviewed for responsiveness and privilege.
