We no longer accept letters stating no change in the permit status. All valid permits must be filed on. Even if a permit is idle, a report must be completed and accompanied by a map showing the involved parcels, permit/subsidence control plan limit, etc. If you have any doubts as to what to send us map-wise, give us a call. If yours is a new operation that is being reported for the first time, West Virginia Property Tax Division will assign the NRAccount number when processing the report. The completed report should be filed with this office no later than September 1st as required by West Virginia Legislative Rule § 110-1K. All production reports received after September 1st will be considered as late and you may be penalized. See West Virginia Code § 11-1C-10 for further information concerning penalties and forfeiture of rights and remedies provided by law. REQUIRED FILING: (a) Report should be filed by all producers/original permit holders who had an active permit on file with the West Virginia Department of Energy/Office of Miners' Health, Safety and Training. This may involve both currently-producing and inactive operations. If you are a contractor with no lease rights please forward this report to the company for whom you are contracting and notify us by mail of your status. (b) If your mine/quarry has permanently shut down within the last year, the date should be noted on the report and a brief explanation as to why. (c) If you have received a permit but have not started mining , please note this on the report in Section II line item 3. 2. GENERAL INFORMATION HOW SHOULD THE MINING OPERATION(S) BE REPORTED? All produced tonnage that is reported to the Office of Miner's Health, Safety, and Training under your mine permit number must be accounted for by filing. If you have multiple permit numbers but only report to M.H.S.T. under one number, use that number for filing with us. If you report to M.H.S.T. under multiple numbers, file with us separately under each of those numbers. A separate report must be filed for each county if total property acreage is in more than one county. You should split your production tonnage between counties based on the percentage of active acres (see Section V) you assign to each. WHEN IS THIS REPORT DUE? PRODUCTION INFORMATION 1. Resource Reported : Identify the mineral resource being reported (limestone, sandstone, salt brine, etc.). 2. (A) Total Property Acreage associated with Mine Operation: Report and map contiguous parcels, regardless of ownership, that are under lease and/or involved in the permitted operation. For purposes of identifying active mining property(ies) the following guidelines will be observed. (i) If a producer owns 50% or more after attribution, of the voting stock of another company that either owns, leases, or has under contract parcel(s) that are contiguous to parcel(s) owned, leased or under contract by producer, these contiguous parcel(s) will be considered includable for purposes of determining the active mining property acreage. (ii) If a producer owns less than 50%, after attribution of the voting stock of another company that either owns, leases, or has under contract parcel(s) that are contiguous to parcel(s) owned, leased, or under contract these contiguous parcel(s), upon written evidence from the producer supporting same, will not be considered includable for purposes of determining the active mining property acreage. (B) Total Mineable Acreage as of 07/01/2010- List in acres and hundredths of an acre, the acreage of the natural resource that may be mined using generally accepted mining practices and suitable equipment. If you have PERMANENTLY ceased mining operations prior to 07/01/2010 please complete the explanation on page 2 Section IV of this report. 3. West Virginia Mining Permit Number - Provide the permit number under which production is reported to the Office of Miner's Health, Safety, and Training. Please note the flag for "in operation" as of 7/1/2010. 4. The topographic quad and section is necessary for all mines. If this information is unknown, a surface tax map number may be used. Recovery Rate - List the percentage (to the nearest whole percent) of the natural resource tonnage that is recovered through the mining and preparation processes. The recovery rate should reflect tonnage as reported to the through Office of Miner's Health, Safety, and Training divided by the calculated whole-bed tons-in-place. SECTION III. PRODUCTION OF THE NATURAL RESOURCE 8. (A,B&C) Production Period - Identify the annual production tonnage and the number of months in production as reported to the Office of Miner's Health Safety, and Training, for the calendar years indicated. 9. (A,B&C) Annualized Production - Indicate the annualized production if not in operation for the entire calendar year. This calculation can be performed by the following method: **(Tons produced)x(12 months/months in production)** 10. Calculate average annual acres mined according to formula on report. See WV Legislative Rule § 110-1I-4.1.3.a&b. OPERATION INFORMATION All permitted mining operations must file this report, but if the operation was PERMANETLY CLOSED, not temporarily, prior to July 1 you may skip Section V by completing the questions in Section IV of the report. If the mining operations are TEMPORARILY CLOSED, note the date the mine closed, the reason and continue completing the TOTAL report placing all of the mineable acreage in the reserve status. West Virginia Legislative Rule § 110-1K-4.1.2.c If the permitted operation has not begun production by the July 1st assessment date, the operator shall report the mineable natural resource(s) on an active property return and value them as reserves for the applicable tax year. Once a parcel or a portion of a parcel has been assigned to or designated as an active mining property, the parcel, or portion of the parcel, shall continue to be listed on the active return, filed annually, until such time as the permit has been retired. (B) Total Mineable Acreage - Enter the amount shown on line 2B, Section II. 12. Estimated Mine Life, in Years. Divide mineable acres by average annual acres mined. Note that for all natural resource minerals other than coal, the maximum life is 15 years, and for salt wells maximum life is 35 active acres per well . 13. Valuation Categories (per active natural resource, i.e. a natural resource you mined during the year) 14. (A) Active Acres - Average annual acres mined x mine life, or maximum life (whichever is lowest). (B) Reserve Acres - Subtract active acres from mineable acres. If you get a positive number, you have reserve acres. (C) Unmineable Acres - Acreage that does not meet the definition of mineable acreage. (D) Mined-Out Acres - Report acreage of properties where natural resource other than coal is owned, but has been depleted by prior mining operations. This includes areas that are restricted by permitting regulations. (E) Barren Acres - Report acreage of properties where natural resource right other than coal are owned, but the natural resource does not exist because of erosion, wash-out, non deposition, etc. SECTION VI. NATURAL RESOURCE OWNERSHIP PARCEL INFORMATION This section deals with each of the individual tracts of natural resource other than coal ownership that are involved within the mine boundary. Failure to complete &/or provide the land book identification for parcel(s) included in the operation may result in the appraisal(s) being placed on the producer as a chattel real (leasehold) estate and/or a property that the producer controls. The Parcel Information sheet has some time saving functions for undivided interest accounts and there are a total of 20 records for parcel information. You can add records by copying & pasting or delete records. You must list the county land book map and parcel or mineral account number and the ownership interest for each parcel.
