Georgia Amendatory Endorsement
For use with Personal Liability Insurance
It is understood and agreed that the following amendments are made to the certificate to which this form is
attached.
Item 10 of the BODILY INJURY AND PROPERTY DAMAGE EXCLUSIONS section (“Bodily injury or property
damage which is intended or expected by any insured”) is amended to read as follows:
Bodily injury or property damage which is intended or expected by any insured, unless resulting from
actions reasonably committed to protect life or property.
Item 14 of the BODILY INJURY AND PROPERTY DAMAGE EXCLUSIONS section (“Bodily injury or property
damage arising out of the presence of…”) is amended to read as follows:
Bodily injury or property damage arising out of the presence of or the actual, alleged or threatened release,
discharge, escape, dispersal, seepage or migration of pollutants, unless the action leading to the bodily
injury or property damage is sudden and accidental. This exclusion does not apply to bodily injury or
property damage caused by heat, smoke or fumes from a hostile fire. As used in this exclusion a hostile fire
is one which is unintended, breaks out from where it was intended to be, or becomes uncontrollable.
Item 23 of the BODILY INJURY AND PROPERTY DAMAGE EXCLUSIONS section (“Any amount payable by any
insured to others as a result of punitive or exemplary damages judgement.”) is deleted.
Item 1.h. of the PERSONAL INJURY EXCLUSIONS section (“arising out of the presence of or the actual, alleged,
or threatened release…”) is amended to read as follows:
arising out of the presence of or the actual, alleged or threatened release, discharge, escape, dispersal,
seepage or migration of pollutants, unless the action leading to the bodily injury or property damage is
sudden and accidental.
Item 9. of the MEDICAL PAYMENTS TO OTHERS EXCLUSIONS section (“Whose injuries arise out of the
presence of or the actual, alleged, or threatened release…”) is amended to read as follows:
Whose injuries arise out of the presence of or the actual, alleged or threatened release, discharge, escape,
dispersal, seepage or migration of pollutants, unless the action leading to the bodily injury or property
damage is sudden and accidental.
Item 8 of the ALL SUBJECT TO THE FOLLOWING CONDITIONS section (“CONCEALMENT,
MISREPRESENTATION OR FRAUD”) is deleted and replaced with the following:
No claim under this policy will be sustained if any insured has intentionally concealed or misrepresented any
material fact or circumstance, made false statements, or engaged in fraudulent conduct relating to this
insurance or any claim hereunder.
