Incident Diary

Many neighbour disputes can be sorted out by talking calmly with the other person. But Cross Keys Homes will take action quickly if this approach fails or if someone’s behaviour is very anti-social. We can only act against culprits if we have evidence. You can help by keeping a diary of everything that happens. Make sure you keep to the four steps below. Some Incident Diary sheets are in the back of this book for you to use.
How to keep the Incident Diary
Many disputes can be resolved without taking serious action. But if the situation is bad enough, we will use the law to force the culprits to stop, or even to evict them. To take legal action we need a carefully written down description of every incident. A court will only accept this incident diary if it’s written in a certain way. 1. The diary is your own personal record of what you see or hear. You must fill in the sheet called Incident Diary as soon as possible while the incident is still fresh in your mind. Do it on the same day if you can. If you leave it much longer a court might not accept it. 2. You can’t write down something that other people (including your wife, husband, partner or a friend) have witnessed. If they have witnessed something themselves, and they agree, put their name and address on your Incident Diary in the section called ‘any witnesses’. We will then contact them for a statement. 3. Fill in the Incident Diary sheet. If there are several incidents, list these down too. Put your signature and the date at the bottom of each form. Send the diary back to the area office within at least two weeks of the first incident happening or sooner if the matter is very serious. If your complaint involves hate crime (racial harassment, violence or threats of violence) you must let your area office know immediately, as these will be investigated within 24 hours. 4. We will aim to acknowledge all complaints within five working days (or within 24 hours if the matter involves hate crime, violence or threats of violence). The address of where to send your completed Incident Diary is at the back of this book. Please send in your Incident Diary sheets promptly. 5. Write down everything you see and hear in as much detail as possible. A general summary isn’t taken as seriously by the court as word-for-word evidence. So you’ll have to include swear words. You’ll see in the example sheet at the back of the book (which shows you how to fill in the diary) that we have written swear words down in full. This is much more effective than “he used abusive language”. We’re sorry if this is upsetting, but you’ll have to do the same if the case is to be successful in court.
Other evidence
It’s a good idea to collect other evidence to back up the diary. Photographs can help in some cases - car repairs, overgrown gardens and graffiti and so on. Put the time and the date the photo was taken on the back and sign it. Speak to a neighbourhood manager or police officer if you need help or advice about doing this. For very serious cases we can consider using professional witnesses to help us gather additional evidence.

Supporting witness
We take your reports about anti-social behaviour very seriously and realise that giving evidence as a witness can be very stressful. We will support you throughout this process to make sure that you feel safe and that you know who to contact if you are worried about any aspect of the action we are taking. A leaflet entitled ‘Supporting Witness’ will be sent to you which contains some useful information. This booklet is available in brail and other languages.
