PARKES SHIRE COUNCIL
Sealed and suitably endorsed tenders addressed to the General Manager will be received up to
closing time of tender at the Parkes Council Chambers, Cecile Street, Parkes, for supply and
delivery Parkes Shire Council’s Depot, Thornbury Street, Parkes and/or purchase of equipment
or vehicle, as applicable.
All tenders submitted to the Council shall be opened at the Council Chambers, Cecile Street, Parkes
and listed for public information. Any tenderer who lodges a tender accepts that public exposure of
the tenderer's name, contents of tender and terms of tendering will occur.
Tenders may be accepted by facsimile, prior to the closing time of the tender, provided
supporting documentation is subsequently received by Council prior to tenders being
considered by Council, provided evidence that those documents had been posted prior to the
closing time of tenders.
The acceptance of any tender shall be at the discretion of Council.
To avoid unnecessary complications, tenderers must tender the correct price on the correct and
latest model equipment/vehicle, giving due consideration to price variation applicable at time
of delivery, which is anticipated to be approximately four (4) weeks after closing date.
Council will not accept any price increase to that tendered.
As advertised, purchase or trade-in price can be offered for Council trade-in. Therefore a price
that is applicable without a trade-in is to be included on the tender form.
Careful completion of Council's Tender Form is essential; options, details and trade-in
descriptions are provided thereon. Build date of tendered vehicle is to be stated, all other
relevant information must be included by the tenderer.
The vehicles are to be registered prior to delivery to the Common Expiry Date of Parkes Shire
Council being 31 October 2007
Council's RTA Customer Number is as follows (This number is to be included on Registration
Papers) Parkes Shire Council – 05200123
Council's trade-in will be registered to 31 October 2007. The purchaser is responsible for Roads
and Traffic Authority registration transfer fees and other applicable costs.
Full technical details are to be included in the tender.
Tenderers may submit options on all or any of the following:
(a) Supply of new machine with trade-in: Nett changeover price
(b) Supply of new machine without trade-in
(c) Purchase of trade-in machine without supply of new machine
All prices are to include on-road costs except registration and insurance. All prices to include
Failure by a tenderer to submit offers in relation to any of the possible tender options will
preclude that tenderer from consideration in the event it is decided to award the contract on the
basis of that option.
Plant tendered must be capable of efficiently completing the tasks identified by the “intended
purpose statement” described below and conform to the following specifications: -

Plant is to be used by the Works Department for various municipal works including, street
maintenance, drainage construction, water and sewerage construction and park maintenance.
TENDER ASSESSMENT CRITERIA
The criteria to be used for assessing tenders will be based on the following, (tenderer’s to supply information to

MINI EXCAVATOR ERG CLASS HX2
1. Tenders must be submitted on the forms attached to these conditions.
2. All prices are to include on-road costs except registration and insurance.
3. Plant tendered must be capable of efficiently completing the tasks identified by the
“intended purpose statement” described below and conform to the following
Intended Purpose of the plant.
Plant is to be used by Works Department, predominantly for construction and
maintenance works at various localities within Parkes Shire.

OPTION (the following items should be included in the tender as an optional extra)
Side and rear curtains.
SWL from the rated lifting point is to be clearly marked on both loader arms and backhoe
stick to comply with Workcover requirements.
A detailed risk assessment of the unit offered shall be supplied with the tender. The risk
assessment should ensure that all aspects of safety have been assessed and modifications to
work processes (if necessary) are undertaken.
Under the OHS Regulations 2001, 'designers, manufacturers and hirers' must provide safety
information with all new plant and equipment.
The safety information will be incorporated into the operator training conducted by the
supplier of the new plant item.
Operator training records will need to be submitted to Council . These records are to include
who the training was delivered by, who received the training and the content of the training
delivered to Council's operator.
TENDERERS SHOULD STATE ANY OTHER INFORMATION OR SYSTEM THAT MAY BE
ADVANTAGEOUS TO COUNCIL AS AN OPTIONAL EXTRA. SERVICE, MAINTENANCE AND
WARRANTY PLANS SHOULD ALSO BE INDICATED.

5. All Tenders are to be made on the basis that Council may purchase the plant item with
or without trade-in. The following plant items should be classified as possible trade-ins,
and the trade-in allowance shown in the Tender.

6. Council reserves the right to accept or reject any tender, the lowest or any tender will not
necessarily be accepted.
7. Tenders close at 10.00 am on Thursday, 9 August 2007 and must be placed in the tender box
at the Administration Centre, Corner Cecile and Bogan Streets, Parkes, at which time Tenders
will be opened and the names only of those tendering will be announced.

CONDITIONS OF TENDERING FOR PLANT
1. DATE OF ISSUE Monday, 28 May 2007
(a) These Conditions of Tendering for Plant are referred to herein as "Conditions".
(b) The form of Tender for Plant is referred to as the "Tender Form".
(a) The prices shown on the Tender Form shall be deemed to cover the delivery to Parkes
with all applicable charges and taxes of any kind whatsoever paid, including exchange,
customs or other duties.
(b) GST is to be itemised separately from the tendered price.
(c) No rise and fall shall apply from the date of closing of tenders until the delivery of
the plant irrespective of conditions specified by the tenderer in their tender.
4. SUBMISSION OF TENDER
(a) Tenders are to be presented on the attached Tender Forms only.
(b) The Tender shall be sealed, endorsed as set out on the title page of the Specification,
and addressed to the General Manager, Parkes Council, and shall be deposited in the
Tender Box at the Administration Centre, Corner Cecile and Bogan Streets, Parkes, not
later than 10.00 am on the date on the title page of the Specification; or where posted,
shall reach the General Manager no later than this time and date.
(a) Council is not bound to accept the lowest or any tender.
(b) Tenders shall remain open for acceptance until one week after the date of the Meeting
of Council indicated on the title page of the tender documents.
6. PLANT TO BE REGISTERED BY SUPPLIER
Plant shall be registered and delivered to Council’s Thornbury Street Depot. Reimbursement
for registration will be paid separately to the price tendered for the supply of the plant.
Compulsory third party insurance slip and group registration details will be supplied by
(a) Delivery of a new plant may be tendered on any working day, subject to the tenderer
giving Council at least 24 hours prior notice of intention to deliver.
(b) Council may refuse to accept delivery of a new plant item until it complies with this
specification, and until these Conditions of Tendering have been complied with.
(c) Council may by letter, addressed to the tenderer, terminate the contract when delivery in
compliance with this contract has not been made within fourteen (14) days after the
delivery period stated in the tender.
8. ROADS AND TRAFFIC AUTHORITY - REQUIREMENTS
All plant supplied shall be fitted with the necessary lights, indicators, alarms, seat belts,
and whatever is necessary to comply with the New South Wales Roads and Traffic
Authority requirements for travelling by night and by day.
9. ADDITIONAL WORK AT SUPPLIERS COST
The cost of any additional work and materials necessary to comply with the Roads and
Traffic Authority shall be deducted from the tendered price.
10. WORKCOVER AUTHORITY REQUIREMENTS
Where applicable all plant items shall be fitted or altered as required to comply with the
requirements of the New South Wales WorkCover Authority.
11. TENDER ASSESSMENT CRITERIA
The criteria to be used for assessing tenders will be based on the following, (tenderer’s to
supply information to ascertain same):
Suitability for purpose, as stated in specification
Suppliers backup service
Economical aspects and estimated value at 6,000, 8,000 and 10,000 hours
Compliance with specifications (minor variations accepted providing adequately disclosed).
Parts pricing - a list of consumables are supplied
Number of NSW Local Government sales
Minor variation from specifications or non provision of supporting data will not
necessarily constitute a non conforming tender, however if information is provided it
will be used in the determination of the most advantageous tender .
Council will accept the tender which, having complied with the requirements of
tendering and with regard to the specifications and assessment criteria, appears to be the
Council will post a cheque in payment of the sum tendered within eight working days after
acceptance of the plant item and receipt of an invoice.
13. TECHNICAL BROCHURES
Tenders for each plant item, or for each group of identical plant, shall include manufacturer's
brochures and supporting information covering the technical specification of the plant offered
and showing illustrations of the plant.
The successful tenderer shall supply with the plant, one workshop manual and one spare parts
manual applicable to the model, in addition to cd rom or disk type computerised manuals if
The supplier of all plant items shall train Council’s operators on Council’s worksite and
workshop staff on maintenance of the plant at Parkes Council’s Workshop. Persons taking
delivery must be briefed on any special precautions to be taken when operating the plant item.
16. PREPARATION OF TENDER
Alternatives for tendering are as follows:
(a) supply of new plant with trade in on present plant
(b) supply of new plant with no trade
(c & d) purchase only of present plant
(e) package deal discount ; if applicable
17. DEMONSTRATION MACHINE
If required, a machine, identical to that tendered will be supplied, free to Council, for
Council has analysed standard and extended warranty packages available throughout the
industry and noting the advantage of hours against years for Local Government usage, will
look favourably to those suppliers offering Council warranty for their product based on hours
not years of operation eg 6,000 hours versus 3 years.
