INFOCUS STATEMENT ON THE EUROPEAN UNION’S REACH REGULATION
InFocus Corporation is aware of the REACH Regulation (Registration, Evaluation,
Authorization and Restriction of Chemicals Regulation, EC 1907/2006), the European
Union (EU) regulation that is intended to regulate the use and importation of chemicals
and substances into the EU. InFocus supports the objective of REACH, which is to
improve the protection of human health and the environment and intends to comply with
all REACH legal requirements as they pertain to manufacturers and importers of
As a manufacturer of “articles” which do not intentionally release chemical substances,
InFocus is not subject to the REACH regulation’s registration and pre-registration
requirements. However, as a manufacturer of “articles” InFocus may be obligated to
provide information on Substances of Very High Concern (SVHC) if the SVHC is
present in excess of 0.1% concentration by total product weight due to Article 33
information disclosure requirements. InFocus may also be subject to the REACH
regulation’s Article 7 notification requirements that require notification to the European
Chemicals Agency if SVHCs are present in articles in quantities more than 1 ton per
producer or importer per year and if the substance is intended to be released under normal
or reasonably foreseeable conditions of use.
InFocus is in the process of incorporating REACH into its supply chain substance
declaration process so we can respond to REACH Article 33 requirements. We will also
be evaluating Article 7 notification requirements as its July 1, 2011 deadline nears.
