PRISONER DISCHARGE TO COURT REQUESTS: PROCEDURE FOR PROVISION OF
PRISONER DATA TO ESCORT CONTRACTORS

Purpose

1.     This instruction informs Establishments of a revision to the procedure for providing prisoner
       information to contractors when discharging prisoners to court.

2.     Until now Contractors have been receiving discharge to court requests that are often poor
       quality and illegible. Critical information about the prisoner (escape risk, violence level, self
       harm risk, special needs) is regularly unclear or even omitted.

3.     The prisoner information form, which is easily completed using information from the LIDS
       system and the Courts Service lists, ensures an increased level of clarity and accuracy in
       the information provided. This has enabled both establishments and contractors to achieve
       effective transfers of prisoners to court.

4.     This form does not replace the PER form, which must still be completed and accompany
       every prisoner during transfer.

Mandatory Action

5.     All requests from prisons to contractors to transfer prisoners to court must be made on the
       prisoner information form (Annex A).

6.     Completed forms must be emailed or faxed to the relevant contractor. no later than 9.00pm
       on the day prior to the requirement to appear at Court. The notification will include details
       of each prisoner (including risk of violence, self-harm or escape) and the Court, with the
       listed / notified time of appearance, to which the Prisoner is to be produced.

Impact and Resource Assessment

7.     This instruction re-enforces and simplifies the current practice of notifying the appropriate
       contractor by fax - no later than 9.00pm on the day prior to the requirement to appear at
       Court, with details of each prisoner (including risk of violence, self-harm or escape) and the
       Court, with the listed / notified time of appearance, to which the Prisoner is to be produced.

8.     However, there is a requirement to select a Designated Location Number (DLN) from a list,
       to help prevent prisoners being taken to the wrong court.
