Nondisclosure Statement
For Foreign Persons Involved in Export-Controlled Projects
Title of Research Project: Name of PI: School or Department: Location: The research project identified above involves the use of third-party Export-Controlled Information* that is subject to U.S. export control regulations, including the International Traffic in Arms Regulations and the Export Administration Regulations. It is unlawful under these regulations to send or take export-controlled information out of the U.S., disclose, orally or visually, or transfer export-controlled information to a foreign person inside or outside the U.S. unless authorized. A foreign person is a person who is not a U.S. citizen, U.S. permanent resident alien (a “green card” holder), a refugee, a protected political asylee or someone granted temporary residency under amnesty. Foreign person graduate and post-doctoral students are not exempt from U.S. export control regulations. The criminal penalty for individuals for unlawful export and disclosure of Export-Controlled information under the ITAR is up to ten (10) years imprisonment and/or a fine of one million dollars ($1,000,000) per violation. The criminal penalty for individuals for unlawful export and disclosure of information controlled under the EAR is imprisonment of up to twenty years and/or a fine of up to fifty thousand dollars ($50,000) per violation. I, (name of individual), acknowledge and understand that I may be personally liable for violations of the ITAR and the EAR. As a result, I will exercise care in using and sharing ExportControlled Information with others to which I have access or is disclosed to me in the course of my (check one: employment, assignment, or visit) at UML. I certify that I have read and understand this information and that I could be held personally liable if I unlawfully disclose, regardless of form or format, export-controlled information to unauthorized persons. *Export-Controlled Information or software means information required for the design, development, engineering, manufacture, production, assembly, testing, repair, maintenance, operation, modification, demilitarization, destruction, processing or use of export-controlled items identified on the Commerce Control List or US Munitions List. Exportcontrolled information does not include basic marketing information on function or purpose, general system descriptions, or information concerning general scientific, mathematical or engineering principles commonly taught in schools, colleges and universities or information in the public domain, including information generated from fundamental research.
