STATEMENT OF CHARGES FOR DISTRIBUTOR METERING AND DATA SERVICES OFFERED BY UNITED UTILITIES ELECTRICITY PLC APRIL 2004 (This statement is in a form awaiting approval by Ofgem) United Utilities Electricity plc Registered Office: Dawson House, Great Sankey, Warrington, WA5 3LW. Registered No. 2366949 (England) FORM AWAITING APPROVAL STATEMENT OF CHARGES FOR DISTRIBUTOR METERING AND DATA SERVICES OFFERED BY UNITED UTILITIES This is a statement of charges under which United Utilities offers Distributor Metering and Data Services in accordance with Condition 36B of its Electricity Distribution Licence issued under the Utilities Act 2000. Words and expressions used in this statement have the definitions given to them in the Act or Licence and shall be construed accordingly. The Licence requires that the terms and charges contained in this statement will be reviewed at least once each year. Charges shown are current at the time of publication and will not be changed except as provided for in the relevant agreement and subject to Condition 36B of the Licence, and are exclusive of VAT. FEE FOR STATEMENT Copies of this statement are available on request from United Utilities. Under Licence Condition 36(8) we reserve the right to make a charge for the statement “of an amount, which shall not exceed the amount specified in the directions issued by the Authority”. ENTITLEMENT In accordance with Licence Condition 36B we are required to offer to enter into agreements for the following services: § § § § Metering Asset Provision; Metering Operation, comprising of installation, commissioning, testing, repair, maintenance, removal and replacement of metering equipment; Metering Point Administration Services; and Data Transfer Services. Agreements for Metering Asset Provision Services and Metering Operation Services will be made with United Utilities and will set out the obligations of both parties. A User wishing to terminate his agreement or wishing to notify a change should give us no less than the notice required in the relevant agreement. We will normally respond within 28 days of a notification of change. In accordance with Licence Condition 37, Metering Point Administration Services are provided under the Master Registration Agreement. Users should contact MRASCo if they wish to become a party to this agreement. In accordance with Condition 38 of our Licence, Data Transfer Services are provided by ElectraLink Limited on our behalf. Users wishing to use this service should contact ElectraLink and make arrangements to become a party to the Data Transfer Services Agreement. United Utilities is a signatory to the Master Registration Agreement and Data Transfer Agreement, and will comply with the requirements therein. Where Metering and Data services are sought at a standard different from that referred to in the relevant agreement, we may consider special arrangements with respect to that service. 2 April 2004 FORM AWAITING APPROVAL AGREEMENTS THE APPLICANT WILL BE REQUIRED TO ENTER INTO TO OBTAIN EACH SET OF SERVICES (a) Metering Asset Provision Services The applicant will be required to: § enter into a Non Half Hourly Meter Operator agreement with United Utilities; or § appoint an agent and who is a signatory to such agreements who is entitled to act on his behalf; or § enter into a Non Half Hourly Meter Asset Provision agreement with United Utilities. (b) Meter Operation Services The applicant will be required to: § enter into a Non Half Hourly Meter Operator agreement with United Utilities; or § appoint an agent and who is a signatory to such agreements who is entitled to act on his behalf; or § enter into a Non Half Hourly Meter Asset Maintenance services agreement with United Utilities. (c) Meter Point Administration Services The applicant will be required to: § be a signatory to the Master Registration Agreement for the provision of registration services; or § appoint an agent and who is a signatory to such agreements who is entitled to act on his behalf. (d) Use of Data Transfer Services. Users of the Data Transfer Service will need to: § be a signatory to the Data Transfer Services Agreement made with ElectraLink Limited; or § appoint an agent who is a signatory to such agreements and who is entitled to act on his behalf. BASIS OF CHARGES FOR USE OF UNITED UTILITIES METERING AND DATA SERVICES Pursuant to the requirements of Condition 36B of the Electricity Distribution Licence, the following numbered paragraphs relate to the provision of Metering and Data services within United Utilities distribution services area to Users. 1. Where Distributor Metering and Data services are provided, a charge for those services will be levied on the User. 2. The charges for use of Distributor Metering and Data services reflect the current costs of providing, operating and maintaining Metering and Data services and the current volumes of requests for those services and include a reasonable return on the relevant assets and services. The revenues arising from the charges are subject to regulation in accordance with the terms of the Licence. 3 April 2004 FORM AWAITING APPROVAL 3. The costs may be recovered § as part of the fixed MPAN/day charge of the Distribution Use of System charges. The relevant charges are described in Schedule 1 of this statement and are payable in accordance with Line Loss Factors Class for the MPAN as described in our Condition 4 statement of Charges for Use of System. Where we are satisfied that Meter Asset Provision service is provided by a third party, the Line Loss Factor Class will be adjusted and Distribution Use of System rates will be reduced by the amounts shown in Schedule 1. Where meter provision service is provided to a User who has not entered into a Use of System agreement with United Utilities the relevant charge, in accordance with Schedule 1, will be separately applied. through charges billed separately from Distribution Use of System charges on an MPAN/day basis. The relevant charges are described in Schedule 1 of this statement, in accordance with the categories of Line Loss Factor Class for the MPAN as described in our Condition 4 statement of Charges for Use of System. through transactional charges for functions, as detailed in schedules 2 to 4, specifically requested by the User. § § 4. The Meter Asset Provision charges are for the capital cost of providing the metering equipment only, in our distribution services area, where we are the appointed Meter Asset Provider. These charges exclude initial installation, re-certification, and meter maintenance. The charges, as stated in Schedule 1, are made on an on-going rental basis through either the DUoS fixed charge for Users with Distribution Use of System agreements with United Utilities or billed separately for other Users. The charges in Schedule 2 are made on a transactional basis to recover the capital cost of the metering asset damage. 5. The Meter Operation charges are for field services work, on metering equipment in our distribution services area, where we are the appointed Meter Operator. We undertake this work at the specific request of the User. The charges are made on a transactional basis, in accordance with the details provided in Schedule 3 of this statement. 6. We provide the Meter Point Administration Services for metering points within our distribution services area, unless other Distribution Businesses are operating in the area and provide or procure their own MPAS Service. MPAS maintains a register of technical and other data that is necessary to facilitate the supply of electricity, by any Supplier, to a premise connected to our electricity distribution system. The type of data held by the MPAS includes inter alia the identity of the Supplier, the type of metering installed at the premise, and a unique and accurate address for each premise. In addition, MPAS amends the register to reflect any changes of Supplier registration at each premise. MPAS provides this data to Suppliers and/or their agents, any person identified in the Balancing and Settlements Code and any person identified by the Master Registration Agreement as being entitled to receive such data. 4 April 2004 FORM AWAITING APPROVAL MPAS also provides an enquiry service, known as the MPAS Helpdesk, for any customer or electricity Supplier and/or their agents. This service, which is free of charge, provides data to the customer and relevant data to the Supplier, in relation to the supply of electricity to the premises Meter Point Administration costs are recovered through the fixed charges in DUoS. The additional Meter Point Administration Services stated in schedule 4, are charged on a transactional basis. 5 April 2004 FORM AWAITING APPROVAL PAYMENT OF FEES 1. Charges for Meter Asset Provision recovered through DUoS will be payable in accordance with the billing period and payment terms agreed with the User. The billing of Users with Distribution Use of System agreements will either be through: i) site specific DUoS; or ii) through Supercustomer DUoS methodology as described in the Distribution Use of System agreement in accordance with the LLF of the MPAN. The billing of other Users will be done separately as per paragraph 2 below. 2. Within 14 days of the date of a DUoS account or an account for other users of Meter Asset Provision services being submitted in accordance with paragraph 1 above, the User shall pay us all sums due. Payment shall be made to such bank account (located in the United Kingdom) as is specified in the account, quoting the account number against which payment is made and/or such other details as we may reasonably require. If any amount remains unpaid after the due date thereof, we shall, (in addition to any other remedies), be entitled to charge interest on the amount unpaid. This shall include interest and any Value Added Tax unpaid, at the rate of 3% per annum above the base lending rate during such period of Barclays Bank Plc, compounded annually. Terms for transactional charges are standard for all services and are included within the relevant agreements. We shall normally submit to the User within 21 days after the end of each calendar month, an account specifying the payment due from the User in respect of transactional services referred to in Schedules 2 to 4, performed during that month and any Value Added Tax payable thereon. 3. 4. Within 30 days of the date of a transactional charges account submitted in accordance with paragraph 3 above, the User shall pay us all sums due. Payment shall be made to such bank account (located in the United Kingdom) as is specified in the account, quoting the account number against which payment is made and/or such other details as we may reasonably require. If any amount remains unpaid after the due date thereof, we shall, (in addition to any other remedies), be entitled to charge interest on the amount unpaid. This shall include interest and any Value Added Tax unpaid, at the rate of 3% per annum above the base lending rate during such period of Barclays Bank Plc, compounded annually. 6 April 2004 FORM AWAITING APPROVAL DE-APPOINTMENT 1. Users can appoint their preferred service provider, subject to the requirement to be appropriately accredited for the purpose by Elexon. If de-appointed, we will cease to raise charges. Equally, if transactional activities are not required of us, then we will not levy such charges. Users can appoint and de-appoint United Utilities as agent for Metering and Data Services via the appropriate data flows across the Data Transfer Network. There are no specific charges for appointment or de-appointment. However, de-appointment may trigger transactional charges for additional work at the request of the User. In accordance with the relevant service agreement, de-appointment will be carried out within the appropriate timescales. United Utilities shall, if applicable, serve a notice to the User, setting out the likely duration of any constraints on its ability to perform the relevant de-appointment. Such notice will be given in accordance with the appropriate agreement. 2. RIGHTS OF DETERMINATION If the applicant and United Utilities fail to agree contractual terms, or any variation of contractual terms proposed by United Utilities, for the provision of distribution metering and data services, either party may request settlement by the Office of Gas and Electricity Markets, 9 Millbank, London, SW1P 3GE.
