Your Honor,



This writing is a Request for Information, Documents and Things pursuant to Colorado's application of the

Freedom of Information Act and the Colorado Open Sunshine Act. (collectively "FOIA).



As a matter of background and for your reference, according to a number of Denver Police Department ("DPD")

reports and Affidavits, several (upon information and belief seventeen) violent, reportedly "racially motivated"

crimes occurred in downtown Denver, specifically in the areas of the 16th Street Mall and "LoDo", reportedly in

the summer, and possibly fall and winter of 2009. (the "Crimes"). It is not known if these Crimes are ongoing

as of the date of this filing of this FOIA Request.



Based on DPD Affidavits, two suspects were reportedly interviewed about the Crimes, confessed to same, and

which confessions were corroborated by alleged co-conspirators of the Crimes. The two suspects were

released from custody without having been charged with any Crime.



In November, 2009 these same two suspected were implicated in a racially motivated murder, upon information

and belief, having followed the victim from downtown Denver to Centennial, CO where the victim was killed.



Because of the violent and horrific nature of the Crimes, with one victim being thrown through a glass door of a

LoDo building, another being "cold cocked" in the face, and the ensuing attacks on even more citizens, it is

respectfully submitted that the Public has an inherent right to know why the Public was not informed of these

terribly serious safety risks.



Upon information and belief, it was decided that the Denver area public was not to be informed or warned of the

Crimes during the time of their occurrence, and continuing after the commission of the Crimes, and as a result,

even more victims were seriously injured, and one victim was killed. (the "Decision"). This FOIA Request

relates only to Information Identifying those Individuals who participated in making the Decision, the Individual

who made the final Decision when the Decision was made, as well as the Production of Documents and Things

related solely to the Decision.



Specifically excluded from this FOIA Request is any Information, Document or Thing about the Crimes

themselves.



In the interest of Public Safety, I am, on behalf of myself and the citizens of Colorado Requesting the following

Information and Production of Documents and Things related to the Decision, pursuant to FOIA, as defined just

below:



"Document" means any written memorandum, summary, note, letter, correspondence, report, summary of a

report, reference to a report,whether by handwritten, typed, email or any other form of electronic means of

transmission, including, but not limited to, text messages, "instant messages", by computer, cell phone, radio,

or any other means of transmission, including the U.S. mail , as well as any and all copies of same referring in

any way to the Decision. If a privilege is being claimed against producing any Document, please state with

specificity and particularity the nature of the privilege being asserted, the reason the privilege is being asserted,

and Identify each Individual to whom the privilege being asserted apples.



"Thing" means any object, other than a Document capable of recording, holding storing, transmitting and/or

saving Information related to the Decision, including, but not limited to computers, cell phones, Ipods,

answering machines, answering machine tapes, and any other object of that ilk: These Things need not

necessarily leave the possession and/or control of the owner, as arrangements can be made.



"Identify each Individual" means to state the individual's name, office address, office telephone number,

whether or not an employee of the City of Denver, and if an employee of the City of Denver, Identify the

about November 20, 2009.

Dear Eric:



Per the Colorado Public Records Act, Colo. Rev. Stat. Sec. 24-72-20 I +, and per the Colorado Criminal Justice records laws,

am requesting access to cell phone records from your cell phone and Mayor John Hickenlooper's cell phone during the week

of Feb. 8 when the mayor was with you in Washington. Further I request cell phone records and landline records for the person

handling the mayor's scheduling during that time. Also in reference to my earlier CORA request I stated I was seeking e-mails

Dear Mayor John Hickenlooper,



I am writing about the Parks Department Director and his staff who have acted in the following

manner. Mr. Kevin Patterson has refused to call me back even though I have left him five

messages to do so. Mr. David Marquardt has transparently stacked the so-called External Dog

Park Master Plan Task Force with only pro dog park individuals. There presently is not one

representative on this 14 member committee that is even in our council District 6 containing

Veteran's Park which could be impacted - or even a Veteran who feels strongly about what this

park symbolizes regarding their military service to this country. The two veterans who asked to

be contacted are John Perich who founded and named Veteran's Park with the help of

Councilwoman Mary Degroot in 1988, and Tim Drago who is a Vietnam Veteran and founder of

the Colorado Veterans Monument at the state capitol. Mr. Drago wrote me " Veterans Park is

truly a unique entity in Denver. It is much more than a simple recreation area. It is a tribute to the

men and women who proudly serve and sacrifice in our nation's armed forces. To date 80

Colorado servicemen have died in Iraq and Afghanistan. Turning Veteran's Park into a Dog Park

would diminish their sacrifice." There is also the Veteran's Group Leaders who are comprised

of about 30,000 Veterans. Lastly, the nearby residents are not represented even though several of

my neighbors including myself have asked to be put on this task force.



This task force is a sham if the purpose is as they represent, to "facilitate healthy relationships

between dog owners and non-dog owners." There are no non-dog owners on the committee it

appears. The very real stakeholders are the individuals who live in the immediate neighborhood,

who have to put up with the unsightly dog park (see attached photos of other Denver off leash dog

parks). We are also concerned about the traffic and barking dog noise from inside the park and

throughout the neighborhood as dog owners drive in and out of the park with their windows down

or with their dog in the back of an open truck. We see this and hear this on a smaller scale already

and when Veteran's Park is converted to a mud hole for dogs, the neighbors will be even more

impacted. The current Committee contains only people from the Great Dane Assistant League

along with others who only favor these dog parks and do not exhibit a balanced concern at the

meetings.



I was shocked as I observed one of their meetings recently. Mr. Marquardt started the meeting

stating that no one other than the Committee Members were allowed to speak even though there

was one affected Veteran and several individuals from the impacted Veteran's Park neighborhood

who all wanted to speak. One member of the Committee, Mr. Rust, started speaking about a

Denver Post Article from a doctor noting the potential health problem of dog excrement in the

same area where children play and areas containing picnic grounds. Mr. Rust also mentioned the

City's potential liability of allowing an off leash dog park in these areas. Another member of the

group then verbally attacked Mr. Rust by maliciously calling him a "dog hater" for even stating

these concerns. Mr. Marquardt did not admonish the individual for the attack or make any

statements to keep the tone of the meeting civilized. Mr. Rust then stated that a Realtor he had

spoken to lost a sale because the condo overlooked the large brown off leash area in Cheeseman

Park. The group appeared totally disinterested in his concern for the loss of value from people's

property near the Off Leash Dog Park. The entire group has no interest in examining the issue of

impacting our property values and other impacts to the immediate neighborhoods.



The Parks Department Director has sidestepped my previous Colorado Open Records request for

copies of the most recent Off Leash Dog Park survey response information by having staff send

emails feigning confusion at what information is requested.



Mr. Marquardt continues to double talk on this issue. While he emailed Councilman Charlie

Brown this: "I hope it clarifies for you my long standing and continued opposition to the

consideration of Veteran ' s Park for the Off Leash Dog Park Master Plan by removing Veteran ' s

Park from the list of parks being considered. . .. The Committee proposed and approved removal

of Veteran's Park from consideration as a part of the master plan deliberative process"; less than

24 hours later he told the External Dog Park Master Plan Task Force in the Wednesday, October

14th meeting that Veteran's Park is back on the table for a proposed off leash dog park. (See the

attachment above for this email). Mr. Marquardt has been persuaded by information comparing

the number of people living around the Veteran' s Park area to another park that could be

considered, Vanderbilt Park. The information demonstrated that there is more dense population

around Veteran's Park and he is making the assumption, more people means more people seeking

Off Leash dog space. I would counter this argument that most of the new growth in the area has

been for Denver University Students who for the most part do not own dogs. Also, the more

dense population means more children in the Washington-Veteran's Park neighborhoods and the

point is that we want to put kids first. If the Parks Department has the time, energy and money to

make changes in this area, we are asking for a playground for the neighborhood kids. In this time

of hard economics for most people, having a free place to take one's children to play is

paramount. Denver is not like New York or San Francisco where a high number of people have

little ot no yards and are over an hour's drive to open space to let their pets run free . I think your

concern and our city council's concern should be to establish playgrounds for children over Off

Leash Areas for dogs. These Off Leash areas are not cost free. I have read several articles on

what the cities have to do to try to reintroduce grass to any area that was devastated by a dog park.

Patrolling these parks is not free, and erecting and maintaining the waste bag dispensers is not

cost free. If you have money in the park's budget, please consider wisely spending that money to

invest in areas where our families can play on nice playground equipment, not our pets. In 2003 I

offered to create a fundraising effort to pay for playground equipment for Veteran's Park and

received no response from the parks department. I should note this dog park also conflicts with

the master parks plan last presented to our neighborhood about 2 years ago.



I have spoken with the board members of both the Washington Park East Neighborhood

Association, which has about 200 members, and the FANS of Washington Park, which has 127

members; I am a member of both. The FANS stated, "In addition, the location of a dog park in

Veteran's Park by this committee, when there was no one there to represent the neighbors or the

neighborhood around Veteran's Park or from the neighborhood association, seems very narrow

focused." (See attached letter) The President of the FANS group, Cindy Johnstone stated that she

emailed Kevin Patterson on March 22, 2009 asking to be on the External Dog Park Master Plan

Task Force but was totally ignored by Mr. Patterson. I can only draw one conclusion from this

behavior is that the Parks Department is so biased they believe they have the right to decide what

is best for us.

I am asking you to instruct your Parks Department Director to replace some of the External Dog

Park Master Plan Task Force with people that are more inline with the general public. The 2003

survey done by the Parks Department showed that 76% of the general popUlation does not want

off leash dogs in city parks. Also please direct Mr. Marquardt not to force Off Leash Dog Parks

in residential neighborhoods that do not want them. He needs to respond to citizens' phone calls

as well. He is a public employee, not a private sector employee. The few dollars that the Pro Off

Leash Dog Park groups contributes to political campaigns or construction of certain Dog Parks

does not give them the right to ignore and adversely affect the nearby residences of the park. I am

riot against dog parks in areas that are away from and do not adversely affect the nearby

residential neighborhoods. I am also requesting that you instruct Mr. Marquardt to put me, Jim

Lawser immediately on the External Dog Park Master Plan Task Force to have a voice for our

neighborhood and also to monitor the fairness and the Director's purpose, to "facilitate healthy

relationships between dog owners and non-dog owners."



I am also asking you to direct Mr. Marquardt and Mr. Patterson to answer my Colorado Open

Records Request questions. To provide me with the total cost I will have to pay for each item

before I am charged for it. To provide the information I request and to contact me contact me

with a date and time we can meet to review the provided information. The questions I need

answered and the information I am requesting is as follows:



Who chose each of the members of the Dog Park External Stakeholder Committee? Their

name/names and title.

Why was each individual chosen? (Their name, their residential address, what they do for a living

and the reason they were selected, and a copy of how they each individually filled out the recent

Parks Survey)

Who chose the recent park survey method and questions? (Their name/names and title) Were all

of these individuals Denver City Employees? (If not, give the name of the company or

organization and what they provided) What was the city's total cost to do the survey?

What steps or assurances did you include in survey system/process to assure that only Denver

Residences responded? If only by zip code, could anyone who lives outside of Denver just enter a

Denver zip code to be included in the survey? (Provide a breakdown of all of the individual zip

codes received from the survey)

What steps or assurances have you taken to ensure you have a properly balanced External

committee that reflects the balance of the general public of which 76% does not want dogs off

leash in city parks?

What steps or assurances have you taken to ensure that you are following the directed purpose to

"facilitate healthy relationships between dog owners and non-dog owners"?

What money and financial agreements has each dog organization, company or individual provided

to the Parks Department for the off leash dog park effort? (List all names and amounts and

agreements $50 and over along with the total funds received for promised for 2009 and beyond)

Pursuant to the federal Freedom ofInformation Act, 5 U.S.C. s. 552, and eR.S. 24-72-

101, et seq. PubUc (Open) Records Act, CORA r request that you provide our office with: 1) Any

contract between Jefferson County or the City and County of Denver regarding the bands

"Slightly Stoopid," "Pepper," and "Sly & Robbie." Please include any applicable agreement

with the bands or their promoters, agents, etc. for the August 15,2008 Tailgate Tour Concert; 2)

Any agreement between the City and County of Denver, Jefferson County, and or the Jefferson

County Sheriffs Department, regarding security arrangements at Red Rocks Amphitheater,

including security alTangements both inside and outside the amphitheater, as well as for the

parking lot for 2008 concerts.



Please include the names of any security guards or other employees who may have been

involved in security or who were monitoring this event, both within the amphitheater, or on the

grounds outside the amphitheater, including the parking lots. Please provide a list of those who

were within the amphitheater and those who were in the parking lot.



Please contact my office as to where these records can be reviewed. I agree to pay

reasonable fees for the processing of this request up to $50.00. If the fees will exceed this

amount please contact me to allow inspection pursuant to Colorado Statute, C.R.S. 24-72- 101, et

11129/03 through 6/1105;



• Lists or other records containing the names, dates of employment, or salaries for any staff

members who worked or otherwise serve(d) in any capacity under Chief-of-Staff Michael

Bennet during the time period beginning 11129/03 through 6/1/05;



• Travel records reflecting any travel by Chief-of-Staff Michael Bennet, including but not

limited to travel expense reports, travel itineraries, budget reports, reservations,

communications with travel related staff or third parties, or lists of persons with whom

Chief-of-Staff Michael Bennet traveled, between the dates of 11129/03 through 6/1/05;



• Documents or records of charges and payments to any state credit cards issued to Chief-

of-Staff Michael Bennet or provided for his use;



• Telephone and cell phone records for Chief-of-Staff Michael Bennet's office telephone

and any state provided or paid cellular telephones;



• Information concerning the number and type of city vehicles available for Chief-of-Staff

Michael Bennet's exclusive use, and/or contracts concerning any vehicle used

exclusively by or identified or dedicated for Chief-of-Staff Michael Bennet and paid for

with city funds;
