SUPPLEMENT TO THE
CONOCOPHILLIPS RETIREE MEDICAL BENEFITS
SUMMARY PLAN DESCRIPTION
EFFECTIVE JANUARY 1, 2009
This is a legally required Summary of Material Modifications (SMM) to the
ConocoPhillips Retiree Medical Plan (Plan), component plan of the
ConocoPhillips Medical and Dental Assistance Plan, Plan Number 502.
This document supplements the ConocoPhillips Retiree Medical Benefits
Summary Plan Description (SPD) dated January 1, 2006 and is being
provided to those eligible for and impacted by these modifications. Please
retain for future reference.
The Plan was amended December 31, 2008, to change the retiree medical and
prescription drug coverage for eligible individuals (retirees and dependents) age 65 or
• The changes do not apply to the following retirees and dependents: those
residing outside the United States, heritage Burlington Resources Pre-1986
Louisiana Land & Exploration (LL&E), heritage Burlington Resources El
Paso and heritage Tosco El Dorado Union.
The amendments change the coverage for eligible retirees age 65 and over and their
dependents age 65 and over, effective January 1, 2009 as follows:
Medical coverage is provided exclusively under a group Medicare Supplement Insurance
contract between individual (retiree or dependent) and AARP and United Healthcare.
• The terms of coverage and claims and appeals procedures are described in
certificates of insurance issued by United Healthcare to covered individuals.
The certificate of insurance is incorporated by reference in this summary of
• ConocoPhillips will continue to pay a portion of the premium for this medical
insurance if the retiree or dependent was enrolled or eligible to be enrolled in
the Plan in 2008 and eligible for subsidized retiree medical insurance.
Premiums vary based on the retiree’s state of residence and also on age bands
(ages 65-67 versus ages 68-70 versus age 71+).
• Doctors services are covered only if the doctor is Medicare-approved and the
doctor accepts Medicare. However, some Medicare Supplement Insurance
Plan options have provisions to cover some amounts charged by doctors who
do not accept the Medicare rate.
• Medical services are covered only if Medicare covers them or the Medicare
Supplement Insurance Plan option specifically states the coverage provision.
Prescription drug coverage is available through one of the Medicare Part D Prescription
Drug Plans offered by United Healthcare. United Healthcare offers three AARP
Medicare Part D Prescription Drug Plans (AARP Medicare Rx Saver, Preferred,
Enhanced). Each of those plans is an insurance contract between the individual (retiree
or dependent) and AARP and United Healthcare. You can also choose a Medicare Part D
Prescription Drug Plan offered outside the Plan through other insurers.
• The terms of coverage and the claims and appeals procedures are described in
Evidence of Coverage (EOC) issued by United Healthcare to covered
individuals. The EOC is incorporated by reference in this SMM.
• ConocoPhillips will not pay any portion of the premiums for a Medicare Part
D Prescription Drug Plan.
• Medicare Part D Prescription Drug Plans have a ‘coverage gap’ period and the
coverage provisions during this period vary depending on the plan elected by
the retiree. Prescriptions are covered only if Medicare covers the medication.
If an eligible individual (retiree or dependent) turns 65 during the year, the individual
must affirmatively enroll in the United Healthcare Medicare Supplement Insurance Plan
described above in order to continue retiree medical coverage. Similarly, an eligible
individual (retiree or dependent) who turns 65 during the year must affirmatively enroll
in a Medicare Part D Prescription Drug Plan of their choice in order to continue retiree
prescription drug coverage. Deductibles and out of pocket expenses from the pre-65
retiree coverage through Aetna for medical and Medco for prescription drugs will not
transfer to the United Healthcare Medicare Supplement Insurance Plan options or to the
Medicare Part D Prescription Drug Plans.
