Inc., the parties to these actions (wllectively, the "parties" and individually a "party"), have been negotiating an ESI plan as contemplated by the Rule 16(b) Scheduling Orders in t e aboveh captioned actions, which, by Stipulation and Order in the two actions, is scheduled to & M i z e d by October 5,2007;
IT IS HEREBY STIPULATED AND AGREED by and between the undersigned
attorneys for the respective parties that tbe parties will stipulate to that part of the ESI plan on
which agreement can be reached by October 5,2007; that the panies will then exchange letters,
by October 8,2007,5:00 p.m. EST, identifying any maiten regarding the ESI plan that remain to
be agreed upon; and that the parties will continue to meet a d confer on those remaining maners n
and that by October 12,2007,5:00 p.m. EST, the parfie8 will file an amended ESI plan to the extent that additional issues have hem agread upon, and will at the same time exchange letters sating out their respective positioos with nspeet to any issues that remain to be agreed upon. No othcr dates in the Rule 16@) Scheduling Orda shall be changed or affected by this Stipulation and Order.
