For starters, you can say that wrongful death is the death of a person due to negligence or even unintentional actions on the part of other person or persons. This is a degree below homicide or murder, where the actions are considered intentional or premeditated. In a wrongful death case, the defendants are usually people who did not intend to kill, but their actions have inadvertently resulted in death. Common Cases of Wrongful Death To help you understand more about wrongful death cases, here are some examples: Car and motor accidents are common examples of wrongful death lawsuits. In this situation, the person who was involved in the accident that resulted in the death simply did not intend to kill. However, he had been negligent in his driving; that is why he got into the accident in the first place. You could see now that the death of the victim was wrongful and undeserved. That way, it forms the basis for the victim’s estate to pursue a wrongful death case against the other party and make claims for compensations. What Makes Up a Wrongful Death Case? In order for one to be able to come up with a wrongful death claim in court, there are conditions to be satisfied: First, they must be able to prove that the death was a result in the negligence in part of the defendant. There could be several reasons for that. In the example accident above, the defendant might have been driving drunk; thus, he got into the accident. On the other hand, he may have disregarded driving rules like speed limits or beating the red light, to name a few. All these show that he had been neglecting the things that he should have been doing in order to avoid the accident. Second, they should also be able to prove that there had been monetary damages suffered as a result of the victim’s death. If the victim was the sole breadwinner of the family, then the victim’s estate can definitely make a claim for compensations under the wrongful death statute. The law recognizes that the family had suffered distress and financial problems as a result of the defendant’s negligent behavior. Thus, they are eligible to receive compensation for those damages suffered as a result of the accident.
