IRP International Registration Plan Applications and Instructions Registration Year 2005 JESSE WHITE Illinois Secretary of State IRP Registration Illinois has been a member of the International Registration Plan (IRP) since 1977. Since then, the Office of the Secretary of State has worked to ensure that the program operates effectively for those who base their registrations in this state. In Illinois, one plate and one cab card is issued to each vehicle registered. Registration fees are then apportioned among IRP member jurisdictions according to the percentage of total fleet miles generated in that jurisdiction. This booklet provides IRP applicants instructions on how to accurately apply for their registrations. Renewal applicants should also use the booklet as a guide to make sure current and new changes to the IRP are being observed. This booklet also lists other regulatory agencies that applicants may need to contact. Please refer to the appropriate instructions. IRP applications may be processed by mail, through a licensed remittance agency, or in person by appointment. Applications are processed in order of receipt. Please refer to the appropriate instructions. Please have your “Firm” number available. IRP plates are only sold at the Springfield facility. Some facilities can process 45-Day Temporary Apportionment Authorizations, but they cannot process applications for your IRP file. IRP renewals should be submitted for processing in early January or February. This will allow enough time for you to submit your payment in March. Payments are not required at the time the renewal is sent in for calculation. Apportionment is required for vehicles operating in two or more IRP member jurisdictions and having a combined gross weight exceeding 26,000 pounds, including the weight of the vehicle and the maximum load, or is a power unit having three or more axles, regardless of weight. Commercial vehicles weighing less than 26,000 pounds operating intrastate in two or more jurisdictions must apportion. First-year applicants or vehicles being added to an existing fleet will not be issued new-year registrations in March unless the carrier is willing to assume last quarter fees for the current registration year. Firstyear applicants and newly added vehicles will be issued new-year registrations beginning April 1. All units registered in the same IRP states are designated as a fleet. Illinois will accept apportionment applications for separate power fleets if they are registered in different IRP jurisdictions. If applications for more than one fleet are submitted, they will be designated as Fleet No. 001, Fleet No. 002, etc. Actual mileage generated by the apportioned fleet during the preceding fiscal year (July 1 - June 30) must be included on the renewal application. This consists of interstate and intrastate miles of each apportionable vehicle. This includes new applicants who were registered in another jurisdiction under their name. Estimated mileage for renewal IRP jurisdictions that are second-year estimates where no actual mileage was accrued in these jurisdictions during the reporting period, will pay fees based on percentages calculated over and above 100 percent of the fleet mileage total. If actual miles are indicated on an IRP jurisdiction that you are not apportioning, those miles are not to be included in any mileage totals, but must be reported. Estimated mileage in non-member IRP jurisdictions will not be accepted for the second registration year. If second-year estimates are listed on the application, the mileage will be deleted and not used in determining percentages. To determine the mileage percentages for a fleet: A. Total the miles for all jurisdictions that you answered “yes” to be apportioned along with reported actual miles (A) plus any non-member IRP jurisdictions with actual miles. Also include in this total any jurisdictions that are estimating mileage (1E) for the first time. This mileage total is used to determine the percentages for these jurisdictions. B. Divide each jurisdiction mileage by the total fleet mileage. This is the mileage percentage. C. To determine the percentage for the second-year estimated jurisdictions (2E), first add the second estimated mileage to the first fleet total. This new total is your “Adjusted Total.” Now, divide each second estimated jurisdictions mileage by the adjusted total fleet mileage. This is the ADJUSTED percentage. Carriers who apportion their vehicles may operate in interstate and intrastate commerce, provided they have the proper authority from the Commerce Commission, if required. For more information see page 40. IRP registration for owner-operators may be completed through either of the following procedures: a) The owner-operator (lessor) may register in his or her name. Fees will be calculated according to the mileage information supplied by the owner-operator. The plate and cab card will be the property of the owner-operator. Individual Vehicle Distance Record (IVDR) and supporting documents must be available for audit at the established place of business of the owner-operator. b) The owner-operator of the vehicle(s) may register in the carrier name, thus making the carrier the registrant. The owner-operator’s name must appear on the cab card as lessor. Fees will be calculated according to the mileage information supplied by the carrier. The plates and cab card become the property of the carrier. If you choose to register in your own name, the IVDRs and supporting documents must be available for audit at the business address used on the IRP application. If your records are maintained at a business address other than the address shown on your application, you must attach a letter indicating the agency’s name, address and phone number. 8. 9. Rental/Leasing companies will apportion their vehicles as defined by Article XI of the International Registration Plan. Every applicant is required to maintain an IVDR. Decreasing weights resulting in discounting of fees will not be allowed. The lowest weights requested for jurisdictions registering by combined gross vehicle weight may not vary by more than 10 percent below the Illinois weight. If the combined gross weight varies more than 10 percent, the application will be rejected or denied. The exception to this rule is when the actual operating practice would justify a greater than 10 percent variance. This must be completely documented and approved by this office prior to registration each year. 11. Apportioned Tow Truck plates are available for vehicles fitting the statutory definition of a tow truck. (see Tow Truck Instructions on page 4 for details.) -3- Apportioned Tow Truck Instructions TOW TRUCK OPERATORS All persons engaged in the business of operating a Tow Truck or Wrecker are required to obtain a set of three distinctive Tow Truck plates issued by the Secretary of State. Fees for these plates are based upon the empty weight of the fully-equipped Tow Truck. Power Wrecker plates are available for apportioned vehicles fitting the statutory definition of a Tow Truck. Under Illinois law, a Tow Truck is defined as “Every truck designed or altered and equipped for and used to push, tow, carry upon, or draw vehicles by means of a crane, hoist, towbar, towline, or auxiliary axle, or carry upon to render assistance to disabled vehicles…” (625 ILCS 5/1-205.1). A Tower is described as “A person who owns or operates a Tow Truck or Wrecker” (625 ILCS 5/1-205.2). Each Tow Truck will display one plate on the front and one plate on the rear of the vehicle. The third plate will be displayed on the rear of the towed vehicle only when that vehicle does not have valid registration visible from the rear of the vehicle [625 ILCS 5/3-402A (9) and 5/15-111(d)]. Other jurisdictions may have different requirements, therefore, please refer to the attached chart for further information regarding other jurisdictions. TOW TRUCK INSURANCE REQUIREMENTS Tow Trucks are required to maintain insurance during the entire registration period on the vehicle. A properly executed Insurance Certificate must accompany your application for registration each year. Insurance requirements (minimum coverage) are as follows: On Hook Coverage for Towed Vehicle $ 25,000 Automobile Liability (Combined Single Limit) $500,000 Garage Liability (Combined Single Limit) $500,000 Garage Keepers Legal Liability $ 25,000 Workers Compensation Minimums under the Workmen’s Compensation Act. [625 ILCS 5/12-606(d)] Certificates of Insurance must also include the insured’s name as it is on file with the Secretary of State, the policy number, the company(s) name affording coverage, the Secretary of State as Certificate Holder, the name of the producer, the signature of the authorized representative of the company and the Vehicle Identification Number (VIN) of the covered vehicle(s). The Secretary of State’s office cannot accept Certificates of Insurance that do not meet the requirements set forth by law. Small Tow Operators with only one employee (themselves) may waive the Workers Compensation requirement. Tow 0perators that do not have storage facilities may waive the Garage Keepers Legal Liability requirement. Utility Companies towing only their own vehicles may waive the On Hook Coverage and Garage Keepers Legal Liability requirements. In each of these situations, an affirmation statement supporting such claims must accompany the Insurance Certificate showing the rest of the required coverage. The expiration date of coverage may not be before the expiration of the plates. All Certificates of Insurance must show an expiration date of March 31 of the respective registration year or be listed as “Continuous Until Cancelled.” A new Certificate of Insurance must be filed with your application each year. Unladen weight. -5- Household Goods Carriers Household goods carriers using equipment leased from service representatives may elect to base such equipment in the base jurisdiction of the service representative or that of the carrier. If the base jurisdiction of the service representative is selected, the equipment shall be registered in the service representative’s name and the household goods carrier shall be indicated as lessee. The apportionment of fees shall be according to the combined mileage records of the service representative and those of the carrier. Such records must be kept or made available in the service representative’s base jurisdiction. If the base jurisdiction of the household goods carrier is selected, the carrier shall register the equipment and the service representative shall be designated as lessor. Those vehicles shall be registered according to the mileage records of the carrier and the service representative that must include intrastate miles operated by those vehicles. The records must be kept or made available in the base jurisdiction of the carrier. Service representatives properly registered under this selection shall be fully registered for operations under their own authority as well as under the authority of the carrier. Permanent Trailer Requirements 1. Trailers must be titled in Illinois to qualify for a permanent non-transferable plate. 2. A $19 Illinois fee will be assessed at original issuance. 3. Trailer plates cannot be transferred. For units that are sold, plate(s) must be returned to the Illinois Secretary of State, Commercial & Farm Truck Division. See important notice concerning trailer licensing. Special Hauling Vehicle A. Eligible Vehicles/Benefits: 1) Any three-axle truck regardless of the type of load; or three-axle concrete mixer equipped with a road surface engaging trailing fourth axle having a distance greater than 72 inches but not more than 96 inches between any series of two axles may transmit to the road surface a maximum weight of 18,000 pounds on each of those axles. 2) Combinations of vehicles (tractor/semitrailer), regardless of what they are hauling, having five axles with a distance of 42 feet or less between extreme axles can be grandfathered into the old bridge formula and will not be subject to the federal bridge formula. This part of the law covers combinations of vehicles hauling any commodity. 3) A truck hauling concrete or asphalt in the plastic state that exceeds axle weight or gross weight limits by less than 4,000 pounds can accept the arrest ticket and proceed to its destination without shifting or reducing the load. Display: • The SHV decal must be displayed in the lower right (passenger side) corner of the vehicle’s windshield. • The SHV ID card must be attached to the corresponding vehicle ID card. F. The following is considered acceptable proof of payment for the heavy vehicle use tax: 1. A photocopy of your receipted Schedule 1, Form 2290. The VIN on the registration application must match the VIN on the Schedule 1, Form 2290. The registration application date must fall within the beginning and ending 2290 tax period dates, except when the application date is July, August or September, the 2290 from the prior tax period can be accepted. The Secretary of State cannot accept any 2290 forms when the tax period years have been changed or altered, even if the IRS employee changes the form. 2. A photocopy of the Form 2290 with Schedule 1 and evidence of payment of the tax, such as photocopies of both sides of your cancelled check. 3. Payment of the Form 2290 (Heavy Vehicle Use Tax) is due to the IRS by the last day of the month following the month of first use. However, no proof of payment is required for a vehicle that was purchased within the last 60 days prior to registration. A copy of the Bill of Sale must be presented at registration. Form 2290 should be filed with the IRS Center for the state in which your main place of business or legal residence is located. If neither of the above are located within the United States, file your return with the Internal Revenue Service Center, Philadelphia, PA 19255. Walk-in service is provided in Springfield, IL, at 320 W. Washington St., Monday - Friday, 8 a.m. - 11:15 a.m. and 12:30 p.m. - 4:15 p.m. (see map on page 1 for directions). Established Place of Business (First-Time Applicants or Change of Address) To verify your established place of business in Illinois, you must provide current copies (within 60 days) of three (3) of the following items, one of which must be a phone bill. The name and address on the original application and the application for changes must match. If there is a change see page 9. In the upper-left-hand corner of the application, complete the registration year, firm number and fleet number found on the original invoice or on a cab card of one of your vehicles. Each unit listed on the application must have the same fee months. The application must be signed to be processed. The following changes can be made on the application. 1. Additions For the vehicle being added to your fleet or first-time applicants, indicate an “X” in the “add/renew” column and complete the remaining columns. All units listed on the application must be for the same number of registration months. List weights in all jurisdictions by weight or list weight group number if known. NOTE: All renewable units are subject to 12 months registration fees. 2. Transfer a. Indicate an “X” under the transfer from column and list the description of the vehicle being taken out of service. The original cab card must be returned for the vehicle being taken out of service. If the cab card has been lost or stolen, an affirmation statement must be submitted. (See affirmation statement on page 20.) b. On the next line, list the vehicle the plate is being transferred to and put an “X” in that column. It is not necessary to list weights unless you are changing weights. (Refer to #6 in this section.) c. The current plate number must be listed. If plates are being transferred to a renewable vehicle not activated for the current year, the inactive plate and cab card must be returned. d. The new vehicle must have a different unit number than the original vehicle. NOTE: You cannot transfer plates from fleet to fleet. Additions or transfers to your fleet must be accompanied by proof of ownership and proof of payment of Form 2290 (HVUT). (See pages 9-10.) There are jurisdictions that do not recognize transfers, and you will be billed for these jurisdictions. 3. Replacement Plate If the plate has been lost or stolen, indicate an “X” in the replace plate column and list the vehicle information and the plate number being replaced. It is not necessary to list weights. 4. Replacement Card If the registration card has been lost, list the vehicle information and plate number of the vehicle. Put an “X” in the Replace Card column. It is not necessary to list weights. 5. Correction If information has been recorded incorrectly, list the correct vehicle information and plate number. Place an “X” in the Correction column. Circle, highlight or write a short statement directly on the application to aid our office in determining what corrections are requested. This correction could affect original fees paid on the unit. If the correction affects fees, the Secretary of State’s office will contact you. When correcting vehicle information you must submit Proof of Ownership (see page 10). -17- 6. Adding Jurisdictions If a carrier adds an IRP jurisdiction, the State of Illinois will calculate the mileage percentage for the added jurisdiction for ALL units within that fleet. Before an application for adding jurisdictions can be processed, all prior supplements must be paid in full. On the front of the IRP application you must list the desired registered weight in each jurisdiction being added. A page will need to be completed for each weight group. On the reverse side of the IRP application indicate a “Y” in the “App” column for each jurisdiction being added. 1. In the “ACT/EST” column indicate: a. “A” for actual mileage, if you reported miles on the renewal and did not apportion the jurisdiction. Enter the actual miles in the mileage column. b. “1E” if you did not apportion the jurisdiction in the previous registration year. c. Second St., Room 300 Springfield, Illinois 62756 CFT-24.2 -20- Multi-Year Supplement Processing As a result of the Illinois apportioned multi-year plate, there are circumstances when, after the renewal has been paid, it is necessary to continue to process supplements for the registration year that has not expired. (Registrations expire March 31 each year.) Some of these transactions affect both registration years. These transactions can be processed by the IRP department without the applicant submitting supplements for both years. This processing can only be done for supplements processed after the renewal is paid. Any supplements that were pending for payment in our hold file when the renewal was paid will not be billed for the new registration year. NOTE: This only affects the vehicles that have been renewed. The Two-Registration Year Processing works as follows: 1. The new-year renewal application is paid. (In some cases not all vehicles are renewed at this time. Some units may remain inactive until a later date.) 2. Supplements for additions, transfers, replacement plates or any multiple transactions involving transfers and replacement plates will be processed for the current registration year and an invoice sent to the applicant. Once payment for the current year invoice is validated, the IRP office will generate a newyear supplement to update your “active” unit(s) in the new registration year. An invoice and abstract for the new registration year will be mailed to your company. Please proofread the abstract before sending payment. 3. Once payment is received for the new-year invoice; cab cards will be issued. These cab cards will replace the original registration cards issued with the renewal. 4. The Secretary of State’s office will make every effort to process each application correctly. However, the abstract and cab card(s) should be checked for accuracy. Invoice and Payment Instructions All new registrants are required to pay with secured funds for the first three (3) years of registration. Acceptable secured funds are: cash, money order, certified check or irrevocable letter of credit from your financial institution. Credit card payments can only be accepted by telephone. DO NOT SEND FEES WITH YOUR APPLICATION After receipt of your application, the Secretary of State’s IRP office will calculate your fees and mail a billing invoice to you. This will ensure correct payment and speed the processing and mailing of credentials. Along with your invoice you will receive for your records, an IRP Abstract Listing that will indicate each vehicle being registered and any changes you requested for each vehicle. Please verify each vehicle’s information for accuracy. The vehicle information on the abstract will be the information on your registration cab card. If you find an error on the invoice or abstract, please call (217) 782-4815 or 782-4816 for further instructions. You will not receive an abstract when adding jurisdictions, a registrant’s name change or address change. One check for each invoice made payable to the Illinois Secretary of State must be submitted for payment. Please write your firm number on the check. Our office cannot accept underpayments or overpayments. A copy of the invoice should always be submitted with checks. Mail your payment and invoice to the Secretary of State at the address shown on your invoice. Walk-in applicants should bring more than one check for payment. Credit card payments can only be accepted by telephone. -21- Bad Checks: If a check is returned to the Secretary of State’s office from a financial institution for non-sufficient funds, the applicant will have to pay for his or her IRP registration with a certified check or money order for the next three (3) registration years. No two-party check will be accepted. All returned checks will be subject to penalties and interest. If correct payment is not received a revocation will be ordered on your IRP registration. The revocation order will be sent to the Secretary of State Police for the confiscation of all IRP plates. Your account will remain revoked until all fees are paid. Failure to comply could result in the revocation of your driver’s license. Acceptable forms of payment (except secured funds) are cash, personal check, company check, money order, credit card. Semiannual Installment Trucks, Tractors and Buses (only for Illinois fees) Illinois law (625 ILCS 5/3-816) provides for semiannual installment payments for the Illinois registration fees. Semiannual installments are based on 50 percent of the total Illinois registration fee for vehicles being registered between April 1 and June 30. The first installment payment is half of the registration fee plus the entire Commercial Distribution Fee due. Please attach a note to your application indicating that you would like to make installment payments. Your invoice will be mailed to you indicating the exact amount of your first installment payment. The balance of your base registration fee must be secured by a surety bond or certificate of deposit. The second installment payment is due by the following October 1 for trucks, tractors, buses and tow trucks. In the event operation has been discontinued after the first installment, the owner is still required to make payment of the second installment. Please see requirements below for surety bonds or certificates of deposit. Surety bonds and certificates of deposit must be surrendered to the Secretary of State’s office for the total amount of the second installment payment. IRP Credentials and Plate Display To every motor vehicle registered under the IRP, Illinois will issue a base license plate bearing the word “APPORTIONED” and an Illinois apportionment identification card (cab card). The multi-year license plates with blue characters on a white background are issued for vehicles that operate intrastate or interstate into jurisdictions that are members of the IRP. The prefix “P” denotes power unit, “T” denotes apportionable trailer or apportionable semitrailer, and “W” denotes apportionable tow truck. A cab card indicates the jurisdictions fees that have been paid for each vehicle. Power units will be issued a color-coded card with the registration year shaded on the left portion of the cab card. This cab card will indicate a March 31 expiration date. The weights in the cab card will be shown as pounds for all U.S. jurisdictions and as kilograms for all Canadian providences. A white cab card will be issued to all new apportionable trailers and semitrailers indicating “multi-year” in the expiration date. Identification credentials must be maintained or displayed as follows: 1. Apportioned license plates must be displayed on the front of straight trucks and tractors. 2. Apportioned bus and trailer license plates must be displayed on the back of the vehicle. 3. The original cab card must be carried on or in the vehicle for which it is issued. The letter should include the vehicle information and unit number. The Secretary of State’s office cannot issue refunds for unused portions of an IRP plate. However, the office may approve refunds if a billing error was made by this office or if there is a duplication of vehicles registered and fees paid. Refunds will not be issued if a temporary apportionment authorization was issued to a vehicle. If you are reclassing from a base plate to an apportionment plate and wish to inquire if any credit or refund is available, please call (217) 782-4815 or 782-4816. 45-Day Temporary Apportionment Authorization Once a carrier’s firm and fleet are established, fees have been paid, credentials issued and the immediate operation of a vehicle is necessary, the carrier may operate the vehicle using the Illinois 45-Day Temporary Apportionment Authorization. 45-Day Temporary Authorizations are not to be used on vehicles that need their registrations renewed. Once a 45-Day Temporary Authorization has been issued for a vehicle, registration fees are owed for that vehicle effective from the issuance date of the permit. If you obtain a 45-Day Temporary Authorization in March, you must register your vehicle for the current registration year. The authorization must be completed in full. One copy is to be carried in the vehicle, one copy is to be retained by the company for audit purposes, and a photocopy is to be forwarded to the Secretary of State’s office along with an accompanying IRP application. A photocopy should be kept for your records. The IRP application must be submitted to the Commercial & Farm Truck Division within five (5) working days after the 45-Day Temporary Authorization has been issued. When a 45-Day Temporary Authorization is issued to a vehicle, the specific reason for issuance must be indicated on the authorization. Below is a listing of valid reasons for temporary issuance: 1. The Hunter’s Permit enables a vehicle or combination of vehicles to use the highways for the purpose of locating a new job (IRP Article IX, Section 910). The Hunter’s Permit is valid for vehicles operating at unladen weight only and is non-transferable. Mileage Record-Keeping Requirements Individual Vehicle Distance Records As a condition precedent to the filing of an IRP application, every applicant is required to maintain Individual Vehicle Distance Records (IVDR) in the form and manner prescribed in these instructions. The IVDR is designed to show a pattern of continuous movement of the individual vehicle. Trips must be listed in chronological order. The applicant will be required to explain time lapses and unaccounted for movements in sufficient detail to permit the auditor to verify that all mileage is properly recorded. NOTE: The IVDR is not to be submitted to the Secretary of State. It is to be maintained by the carrier at the carrier’s principal place of business, as a record from which to complete the mileage schedule. This record must be available for audit upon notice. All records to support the IRP application must be retained by the applicant for a period of three years after the close (expiration) of each registration year. Please contact the address or telephone number below for proper procedures to implement on-board recording devices. An IVDR must be maintained by the applicant for each vehicle operated in interstate commerce in Illinois, either at the location from which the applicant is dispatched or at the central office of the applicant. When a vehicle is transferred from one dispatch point to another, a new IVDR should be prepared at the new dispatch point. At the end of the mileage period, all mileage records must be kept at the location listed on the IRP application. -28- The form of the IVDR must conform to the example in this book. All items of description must be completed on the IVDR. When more than one page is used for a vehicle, the subsequent pages must be numbered. The applicant should use a mileage chart to determine the number of miles operated by a vehicle on each trip. The mileage operated each day by the applicant’s vehicle is to be carried on the drivers daily log, or some other source document, such as a trip manifest, provided such other document forms an integral part of the revenue accounting system. The driver’s daily log or other source document must contain the following: • • • • • • Date of trip (starting and ending) Trip origin and destination Driver’s name or signature Total trip miles Mileage by jurisdiction Routes traveled or odometer reading (beginning and ending) • • • • Registrant’s name Fleet number Unit number or VIN Plate Number The applicant must include all deadhead miles from the termination of previous trip to the origin of the succeeding trip. All applicants are required to maintain IVDRs for the purpose of accumulating the required mileage statistics. Failure to maintain the prescribed records will result in credits being denied for inadequate or unavailable records at the time when your audit is processed with the member IRP jurisdictions. The Secretary of State will permit the use of alternate systems where permission has been received in writing from: Office of the Secretary of State, Field Services Division, 501 S. To obtain permission for use of a substitute mileage accounting system, the following conditions must be met: • The applicant must submit in writing to the Secretary of State a request for permission to use a substitute mileage accounting system setting forth the reason(s) a substitute is necessary. • As part of the request, samples of the forms proposed should be submitted. • A detailed step-by-step procedure for the use of this system must also be submitted. If such permission is granted, the applicant will not be required to maintain the IVDR. Once an alternate mileage accounting system is approved, a company need not request permission again unless their mileage account system changes. The total mileage on each page of the IVDR must be entered on the bottom line and carried forward to each continuation sheet. At the end of the annual period for determination of mileage, the total miles for each vehicle should equal the jurisdiction totals for each vehicle. The total mileage of the IVDR must match that reported on the IRP application. When a leasing company or any trucking service company prepares the IRP application for any carrier, the carrier must retain copies of the mileage information furnished, as well as all supporting documents. When a vehicle is registered in the name of the owner-operator, the IVDR and supporting documents must be available for audit at the established place of business of the owner-operator. -29- Appendix 1 Definitions/Requirements Apportionable vehicle: Any vehicle (except recreational vehicles, vehicles displaying restricted plates, city pick-up and delivery vehicles, buses used in transportation of chartered parties, and government-owned vehicles) used or intended for use in two or more member jurisdictions that allocate or proportionally register vehicles and is used for the transportation of persons for hire or designed, used or maintained primarily for the transportation of property and: 1. is a power unit having two axles and a gross weight or registered gross vehicle weight in excess of 26,000 pounds; or 2. is a power unit having three or more axles, regardless of weight; or 3. is used in combination when the weight of such combination exceeds 26,000 pounds gross vehicle weight; 4. is a commercial vehicle weighing less than 26,000 pounds operating intrastate in two or more jurisdictions. Vehicles, or combinations thereof, having a gross vehicle weight of 26,000 pounds or less and two-axle vehicles and buses used in transportation of chartered parties may be proportionally registered at the option of the registrant. Base jurisdiction: For the purpose of fleet registration, the jurisdiction where the registrant has an established place of business, where mileage is accrued by the fleet, and where operational records of such fleets are maintained or can be made available in accordance with the provisions of Article XVI, 1602 of the International Registration Plan. Registrants based in any jurisdiction, not a member of the IRP, who have been licensing vehicles in any member jurisdiction under basing point, allocation or proration may declare the member jurisdiction where the most miles have been operated as their base jurisdiction for the purpose of IRP registration until such time as their actual base jurisdiction becomes a member of this agreement. Bus: A motor vehicle designed and used for transportation of persons for compensation. Combined gross weight: The total unladen weight of the bus, truck or truck-tractor and semitrailer unit and the maximum load carried thereon. Commercial vehicle: A bus, truck or truck-tractor and semitrailer combination used or maintained for transportation of persons or property for hire, compensation or profit or in furtherance of a commercial enterprise. Converter gear: An auxiliary undercarriage assembly with a fifth wheel and tow bar used to convert a semitrailer to a full trailer. Registration not required; may be titled at owners request. Corporation: An independent entity created to conduct a business, owned by shareholders and properly registered. Discounting: The lowest weights requested for jurisdictions registering by gross vehicle weight may not vary by 10 percent or more. Estimated Mileage: A reasonable amount of miles for each jurisdiction in which you anticipate operating based upon past usage, contracts or other acceptable reasons. Established place of business: A physical structure owned, leased or rented by the fleet registrant, the location of which is designated by street number or road location, which is open during normal business hours and in which are located: 1) a telephone or telephones publicly listed in the name of the fleet registrant; 2) a person or persons conducting the fleet registrant’s business; and 3) the operational records of the fleet (unless such records can be made available in accordance with the provisions of Article XVI, 1602 of the International Registration Plan). Use of a third-party service provider address is not allowed. -30- Fleet: One or more apportionable vehicles registered in the same jurisdictions. Flip axles: An axle that can be lowered from the upright position so as to convert a semi-trailer to a full trailer or as a means of equalizing the load on a truck or trailer. For-hire carrier: Any motor carrier that hires itself out to the general public to engage in the transportation of passengers or property for compensation. Full trailer: A vehicle without motive power, designed for carrying persons or property and being drawn by a motor vehicle, and so constructed that no part of its weight rests upon the towing vehicle. Individual Vehicle Distance Record (IVDR): The record required of all apportionment carriers (see page 27). Interstate movement: Vehicle movement between or through two to more jurisdictions. Intrastate movement: Vehicle movement from one point within a jurisdiction to another point within the same jurisdiction. Lessee: A person, firm or corporation that has legal possession and control of a vehicle owned by another under terms of a lease agreement. Lessor: A person, firm or corporation that, under the term of a lease, grants the legal right of possession, control of and responsibility for the operation of the vehicle to another person, firm or corporation. Operational records: Documents supporting miles traveled in each jurisdiction and total miles traveled, such as fuel reports, trip sheets and logs. Preceding Year: The period of 12 consecutive months immediately prior to July 1 of the year immediately preceding the commencement of the registration or license year for which apportioned registration is sought. Private carrier: A person, firm or corporation that transports its own freight. Registrant: A person, firm or corporation in whose name a vehicle is properly registered. Registration year: A period of time for which registration issued by the base jurisdiction is valid according to the laws of the base jurisdiction. Rental fleet: Vehicles rented or offered for rental without drivers and designated by a rental company as a rental fleet. Semitrailer: A vehicle without motive power, designed for carrying property and being drawn by a motor vehicle, and so constructed that some part of its weight and that of its load rests upon or is carried by the towing vehicle. Tow truck: A truck designed or altered and equipped for and used to push, tow or draw vehicles by means of a crane, hoist, tow bar or auxiliary axles or to render assistance to disabled vehicles. Trip lease: The lease of a vehicle to a lessee for a one-trip operation only. Tractor: A motor vehicle designed and used primarily for drawing other vehicles not so constructed so as to carry a load other than a part of the weight of the vehicle and load so drawn. Truck-tractor: Every motor vehicle designed and used primarily for drawing other vehicles but constructed so as to carry a load (i.e., dromedary) other than a part of the weight of the vehicle and load so drawn. Unladen weight: The weight of the vehicle fully equipped for service, excluding the weight of any load.
