Re: Statue of Limitations on Section 8 Special Claims and HAP
Date: March 15, 2000
This bulletin serves to rescind Management Bulletin #162 dated August 5, 1997. Effective
immediately, the statute of limitation for requesting Section 8 HAP adjustments and Special
Claims for Unpaid Rent/Damages and Vacancy is one (1) year from the date of occurrence as
denoted in the HUD Handbook 4350.3 Occupancy Requirements of Subsidized Multifamily
Housing Programs, Chapter 6, paragraphs 6-15(B)(5), 6-39(B), 6-39(B) and 6-41. The statue of
limitation for requesting Section 8 Debt Service is six (6) months.
Be aware that owners/agents are still required to retain all claims and supporting documentation
in the project’s file for three (3) years after the claim’s approval or denial.
